Mayor Hester called the meeting to order at 6:00 P. M. The
Invocation was given by Deacon Ed Harris from the St. John's
Missionary Baptist Church, followed by the Pledge of
Allegiance to the Flag led by Mayor Ezell Hester, Jr.
AGENDA APPROVAL
Mayor Hester suggested that if some of the epeople had *Change people
questions regarding items which could be answered by City to read
Manager Cheney that they not bring them up at this meeting, "Con~nissioners" -
but discuss them later, due to the length of the Agenda. See minutes of
8/2/88meeting.
City Manager Cheney wished to add two bills under CONSENT
AGENDA, Item K.: $121,327.80 to the Solid Waste Authority
for tipping fee for the landfill for a one-month period and
$1,230.00 for Emergency Services for annual license renewal.
He also wished to delete Item D.9 (Solomon Industrial
Building) from the CONSENT AGENDA and place it under Item
VI. DEVELOPMENT PLANS as Item D.
Commissioner Marchese moved to approve the Agenda as
corrected. Motion was seconded by Commissioner Mann and
carried 3-0.
ANNOUNCEMENTS
Commission Workshop on Proposed 1988-89 Budget -
Thursday, July 21st and Friday, July 22nd at 7:30
P.M. Pineland Plaza Commission Chambers
Mayor Hester announced that the Commission would have a
workshop meeting on Thursday and Friday, July 21 and 22 at
7:30 P.M. at Pineland Plaza to discuss the Proposed 1988-89
Budget.
2. Crime Night Out Activities - August 7, 8, and 9, 1988
Mayor Hester stated that Crime Night Out Activities will be
held August 7, 8 and 9, 1988.

3. Proclamation
a) National Night Out - August 9, 1988
Mayor Hester read the proclamation which proclaimed August
9th National Night Out and urged the citizens of Boynton
Beach to support and participate in the National Night Out
on August 9th and Crime Prevention Awareness '88 on August
7, 8, and 9, 1988.
The Proclamation was presented to Michelle Costantino,
President of the Eagle Eye Crime Watch of Boynton Beach and
"Sam" DeLong, Vice President of the Canvas Business Watch
and coordinator for the Sunday events.
Ms. Costantino thanked the City Commission for allowing them
to participate in the program. The goal of the Eagel Eye
Crime Watch is to unite every member in the City in the
spirit of crime watch and work with the Police Department.
She stated that the City is too big for the Police
Department to do everything. All citizens must do their
part.
Ms. DeLong mentioned some of the support given by various
organizations. Their theme is "Arm Yourself with Knowledge
and Live Smarter." Her goal was to gather an expo of infor-
mation and products geared to crime prevention to arm the
residents with knowledge. They are working with the Palm
Beach Post, Boynton Beach Police Department, Boynton Beach
Fire Department, and the Palm Beach County Sheriff's
Department. Channel 29, Channel 5, Channel 12, the Fraternal
Order of Police Auxiliary, the Sexual Assault Assistance
Program, six different departments from the Palm Beach
County Criminal Justice Department, the Police Support Group
(PAPA), Florida Power and Light Company, Bell South
Mobility, Protect Security, CK Locksmith, William Base and
Company, Audio Advisors and the Eagle Eye Crime Watch group
will be participating. She thanked the Commission for
having faith in them to undertake the task and extended an
invitation for everyone to attend.
4. Recognition of the Paramedic Team
City Manager Cheney stated that last week at an
International competition the City's Paramedic Team came
back from Orlando with first place. Last year they came
back in second place.
Jim Ness, coordinator of the team, introduced Ken Overby and
Tom MacRae and congratulated them on their spirit of
cooperation. Mr. Ness showed a video of their trip to
Orlando which included their actual competition. He

explained the actions of the group for the Commissioners and
explained the point system. He pointed out that they always
work as a team and he felt this was the most important thing
on the job as well as in competition. Mr. Overby held up
the trophy they brought back and Mr. MacRae passed around
the plaques for the Commissioners to see.
City Manager Cheney noted that if the group wins the trophy
three years in a row, they can keep it. There was applause
from the audience and the team was thanked for a job well
done.
5. Presentation of Service Awards to Employees
Mayor Hester presented the awards to the City employees
thanking them for their years of dedication and service to
the City as follows:

PRESENTATION
1. Reynolds Aluminum Donation to City's Tree Memorial
Fund
John E. Greer, Area Marketing Representative, Reynolds
Aluminum Recycling Company, presented the check in the
amount of $677.22 to Mr. Bob Spence of the Tree Memorial
Fund, noting the check represents a total of 33.87 tons of
newsprint collected from April 15th through June 30th. He

also pointed out that this was only a portion of the savings
to the City as the tipping fees saved amount to approxi-
mately $1,185.45 giving a grand total savings of $1,862.67.
Mr. Spence stated that it was a pleasure to receive the
donation from Reynolds Aluminum and noted that the Tree
Memorial Fund has been supported by individuals, clubs and
organizations as well as corporations. He noted that they
will continue to plant specimen trees throughout the City.
Mayor Hester thanked Mr. Greer for the donation noting that
he felt sure it would be used to beautify the City.
CITY ~NAGER'S REPORT
A. Woolbright Road between Military Trail and Congress
Avenue
City Manager Cheney stated that this project is approved for
construction in 1990/91. As part of that approval, the
Property Owners Association of Quail Ridge have agreed they
will not protest the construction in the future.
Precautions have been taken to ensure the road does not take
away from the atmosphere of that development. With the
completion of the road, there should be some improvement in
traffic going east/west as one more road will be opened.
B. Brochures produced by the Public Information Office
City Manager Cheney held up a brochure produced by the
Public Information Officer entitled "OMBUDSMAN." He stated
that this is only the first of such information which will
be produced by the Public Information Office. They plan to
produce brochures on topics such as water rates, rental
housing, etc. The brochures will be of the same design as
this one and will be available to the public to provide
information.
C. Police Department/Citizen Seminars
City Manager Cheney stated that a second series of meetings
had just been completed. He had to miss the last two days
but understood that it was a successful endeavor. The next
session will be held in mid August. After that session, the
program will be evaluated to determine if more sessions are
necessary.

Consider request submitted by Mr. Robert Lloyd,
Superintendent of J.M. Beeson Company, for approval to
place a temporary construction and office trailer on
site in conjunction with the construction of Herman's
Plaza, Congress Avenue, east of the Boynton Beach Mall.
Edgar Howell, Building Official stated in his memorandum to
City Manager Cheney that the Building Department recommended
approval for a period of one year. The trailer will be used
by construction and office personnel only.
J. Approve request for disinterment from Lot ll0B, Block R,
Boynton Beach Memorial Park
Mrs. Marcia E. Petty of 801 S.W. 18th Court, Boynton Beach,
in her letter dated July 14, 1988, requested permission to
disinter the remains of her husband (William B. Petty) from
Boynton Beach Memorial Park for reinterrment at Graceland
Cemetery, Decatur, Illinois.
K. Approval of Bills
Bill in the amount of $121,327.80 for the Solid Waste
Authority for tipping fee for the landfill for a one month

Commissioner Marchese moved to approve CONSENT AGENDA, Items
A.1 and 2; B. 1 and 2; C.1 (Resolution No. 88-SS), C.2
(Resolution No. 88-TT), C.3 (Resolution No. 88-UU); D.1, 3,
4, 5, 6, 7, 8; E; F; G; H; I; J; and K (with the addition of
$121,327.80 from the Solid Waste Authority and $1,230.00 for
Emergency Services). Motion was seconded by Commissioner
Mann and carried 3-0.
Discussion on Item D. 2. from CONSENT AGENDA
Donald Klein, 2665 Bayshore Drive, stated that he was
appearing before the City Commission due to some conditions
placed upon the approval of Tara Oaks which were not accept-
able to the developer. He noted that some of the conditions
had been given to them at the Planning & Zoning Board
meeting and they did not have time to evaluate them to
determine if they were feasible. Mr. Klein stated that
after evaluating the conditions, they found that the costs
calculated to comply with the conditions have made the

project unfeasible. The cost per lot would increase from
$20,000 to $31,000 if these conditions were all met. He
felt that some of these requirements would benefit all the
citizens of Boynton Beach and not just the home owners in
Tara Oaks.
City Manager Cheney asked if these conditions had been
required of the developer prior to the P&Z Meeting or if
they were brought up at the meeting. Mr. Annunziato stated
that some of them were brought up at the meeting and the
developer approved them with the conditions. Mr. Klein
stated that three of the requirements were brought up at the
P&Z Board meeting and had never previously been made known
to them.
Bob Bentz, Land Design South, stated that he had attended
the P&Z Board meeting and that he did agree with the con-
ditions, but that he had made it known that they had several
concerns. They had not had enough time to analyze the
requirements before agreeing to the conditions.
The Engineer for Land Design South stated that they were
being required to do the following:
Build Congress Boulevard from the exising location
up to where proposed Knuth Road was going to be at
cost of approximately $90,000.00.

2. Build Knuth Road north of Congress to the L-25 at a
cost of $156,000.00.
3. Build Knuth Road south of Congress to L-26 at a
cost of $92,000.00.
4. Build Knuth from L-26 to Woolbright Road at a cost
of $71,000.00.
5. Design Knuth all the way north of L-25 to the
exising Knuth at a cost of $16,000.00.
6. Build a water main along Congress at a cost of
$7,200.00.
Build a 16" water main from Woolbright down to the
existing water main on the other side of L-25 at a
cost of $64,000.

$36,000.00.
Supply a diesel generator on a vehicle to serve Tara
Oaks lift station and other lift stations which can
be moved around at a cost of $15,800.00.
3. Provide street lighting on both Congress and Knuth
at a cost of $40,000.00.
He noted that the other costs are what would be considered
as normal costs for a development:
1. Water and sewer capital facilities charge of
$140,000.00.
2. Road Impact Fees of $62,700.00.
3. Normal inspection and processing fees of $17,500.00.
4. Recreation Fees of $51,000.00 (estimated on the
appraised value).
This comes out to $11,000.00 per unit or a total of
$860,000.00. The developer would like to build the improve-
ments if he could, but the problem is this would make the
project unfeasible.
Mr. Klein felt that the costs would have to be cut in half
or less than half to make the project feasible. The deve-
loper is prepared to go along with the extension of Congress
Boulevard, construction of Knuth Road north of Congress to
L-25 canal, the construction of 10" and 6" water mains pro-
vided there are credits back for the water and sewer impact
fees, inspection processing fees, recreation fee, capital
facilities charge, road impact fees if credited against the
construction of Congress Boulevard and Knuth Road north to
the L-25. These would cut the expenses in half without
jeopardizing services to the citizens of Boynton Beach or
Palm Beach County.
There was further discussion in which Mr. Klein stated that
these requirements would make it economically unfeasible to
build the project.
Mayor Hester wished to table the action on this request
until he has time to evaluate the information. City Manager
Cheney was also in favor of tabling action on this item to
allow time for him and his staff to sit down and discuss the

situation with the developer. Mr. Klein was agreeable to
meeting with the City.
Commissioner Marchese moved to table the request for appro-
val of the construction plans and preliminary plak which

units plus landscaping in connection with a previously
approved planned unit development until the August 2nd City
Commission Meeting pending a possible resolution to the

Mayor Hester felt that the building looked much better and
was more in keeping with the surrounding area. City Manager
Cheney stated that the Commission had former Mayor Cassandra
to thank for the elimination of the red color on the
building. He had insisted upon the removal of the red color
and the developer had gone to the national chain and
acquired permission to use another color at the City's
request.

Mr. Golden from the Planning Department stated that the P&Z
Board voted 5-1 to approve this request. Chairman Walshak
did not vote in favor as he did not wish to see the antennae
mounted on the roof. In answer to a question from
Commissioner Marchese, Mr. Golden stated that the ordinance
will provide for roof mounted antennas and all engineering
reports necessary will be provided regarding the safety of
the antennae to be located on the roof.
Ellen Duffer, representing Service Merchandise, stated that
the visibility of the antennae seemed to be the problem at
the P&Z Board Meeting last week. She went back to their
contractor, Hughs Networks, and they propose to drop the
antennae mount down by one foot. She stated that the dish
will not be visible at all from the street. The parapet
wall is 3' high and the antennae will only be 6' high.
Commissioner Marchese stated that three sides of the anten-
nae must be screened according to code.
Mr. Annunziato did not feel this would be a problem, but if
additional screening is needed, the owner has agreed to pro-
vide screening.
Commissioner Marchese moved to approve the request for an
amended site plan to allow for the addition of a roof-

Mr. Golden stated that this request would allow a rear set-
back from 15' to 8' to allow the addition of a solid roof
over an existing screened enclosure. The TRB made a finding
of no substantial change and forwarded the request to the
Planning & Zoning Board. The P&Z Board approved the request
only for those lots which back up on a lake.
Commissioner Mann moved to find no substantial change and to
approve the request including the Planning Department com-

Eichorst, Acting Pubic Works Director, forwarded a memoran-
dum stating that the location of the dumpster inside a fence
would create a serious problem for garbage trucks attempting
to make a pick up. The TRB recommended approval subject to
staff comments stating that the dumpster must be relocated
according to the approved plans. Mr. Eichorst feels this is
not acceptable either and with the approved plan the truck
would be backing into an alley and this could be dangerous.
Darlene O'Donnel stated that she has a business on this prop-
erty which is owned by Mr. Bill Roman. Mr. Roman was not
present at the meeting. She did not understand the problem
with the dumpster. She asked what should be done. She
stated that she is at work at 6:00 A.M. when the garbage
truck comes and would have the gate open for him.
City Manager Cheney suggested this item be tabled so that a
solution could be worked out. Mrs. O'Donnel did not want to
have to wait any longer as she is concerned for the safety
of her business in that area.

Mayor Hester asked if anyone wished to speak in favor of the

Someone in the audience stated that she did not understand
the Proposed Ordinance and Bud Howell, Building Official,
stated that the ordinance would require sprinklers on all
buildings (new construction) two stories or more in height.
Mayor Hester asked if anyone wished to speak in opposition
to the request.
Tom Lira, agent for Quail Run, stated that the majority of
fires are caused by occupants of units and not because of
poor construction. He questioned where the builder's

responsibility ended. He had read the city's Comprehensive
Plan and noted that the City wished to do everything
possible to keep housing construction at an affordable
price. This ordinance would increase the cost per unit by
about $2,000.00. He felt this amount would have to be
passed along to the buyers or renters of the units.
Mayor Hester felt that the Commission's job was to enforce
the City's codes. This ordinance was one which was an
attempt to protect life.
Commissioner MarcheSe felt this was a step in the right
direction in protecting the lives of the citizens of Boynton
Beach. He asked Chief Allen if this ordinance would be a
step backward and Chief Allen responded that it would be a
step forward. Tom Clark, city Engineer, also felt that it
would be a step forward.
Andy Carolino, Post Buckley Schuh & Jernigan, stated that
there was no argument with the intent of the ordinance. He
felt there were some technical considerations that relate to
the types of systems required for various types of
buildings. He suggested this proposed Ordinance not be
approved at this time but that it be looked at to clear up
the problem areas and then be brought back to the Commission
for approval.
City Attorney Rea felt that the proposed Ordinance did have
very broad applications. Commissioner Mann had received
calls from people regarding the proposed ordinance. He had
requested that they make some suggestions regarding the
ordinance. City Attorney Rea suggested that the Public
Hearing be continued.
Commissioner Mann moved to continue the public hearing on
proposed Ordinance No. 88-32 until the August 2, 1988 City

City Manager Cheney requested this item be left on the

Consider Water Service Agreement for Thomas F.
Gustafson (Approximately 300' south of N.W. 22nd
Avenue east of Lawrence Road)
Mr. Golden explained that this request would allow for a
2400 square foot convenience store and fuel island on
Lawrence Road similar to the one at Club Meadows. He noted
that this request must come before the Commission and they
must review the site plan to see if it is generally accept-
able and consistent with the Comprehensive Plan.
Brenda Arnold, Kilday and Associates, stated that the road
is presently a two-lane road, but plans show that it will be
a five-lane road when traffic warrants. She stated that
they agree with all the staff comments.
City Attorney Rea stated that legally everything was fine.
Commissioner Marchese moved to approve the Water Service
Agreement for Thomas F. Gustafson subject to all staff com-

3. City of Boynton Beach vs Melear, et al. Eminent

City Manager Cheney stated that this was for settlement of
legal fees and he felt that $750.00 was more than reasonable
and he recommended approval.

ween Boynton Beach and Melear relative to eminent domain

No Loitering Signs
Wilda Searcy, 402 N.E. 13th, wished to place "No Loitering"
signs in her neighborhood. She had a photograph of the type
sign she was referring to and passed it around for the
Commissioners to see.
Mayor Hester did not want to see signs on every home and
stated that the City could not put up signs on private
property. He understood what she was talking about but felt
that if people were loitering, the Police Department should
be called. Mrs. Searcy did not feel that they would come
out and the property owners wanted to put up signs. Her
friend has a beer garden and installed such a sign, and the
loitering stopped. Mayor Hester noted that was a business
and not a residence. Mrs. Searcy stated that she has a sign
on her home at the present time and she does not mind having
a sign there.
Mayor Hester explained that he felt that at times the citi-
zens must do something to help themselves. Cleanup begins
with each individual. If someone were loitering on his
property, he would ask them to leave and if they did not, he
would report it to the Police Department.
Commissioner Marchese stated that he wants to reduce crime
in this area. He suggested that Mrs. Searcy work with the
Ombudsman and City Manager Cheney as well as the Legal
Department to see what can be done regarding signs. There
was no action that could be taken at this time, but every
consideration would be given the request.
Mrs. Searcy thanked the Commission and noted that she did
not expect action at this time.
Loitering and Drug Related Problems
Lottie Pierce, 203 N.E. llth Avenue, stated that she knew
the problems could not be solved in one day, two days or
even ten years. She suggested that the Police Department
and the City Manager could work together and do something
about the problems. They should study the suggestions made
by the people and see what solutions they can come up with.
She noted that the drug problem is terrible and she wanted
to see something done. She next asked City Manager Cheney
if he had an answer to her previous question, and he stated
that he would have an answer for her in a couple of weeks.

rents. Mayor Hester explained that was due to the new ren-
tal law which was recently passed by the City Commission.
Ms. Pierce felt that it was not right to go back and tax a
house from 30 years ago. You should start and tax the new
ones coming up. Mayor Hester explained that under the new
rules, people who own rental property must now take out an
occupational license. This is an attempt to improve the
quality of life for citizens in Boynton Beach.
Commissioner Marchese stated that the citizens want a better
quality of life in Boynton Beach and this is an attempt to
provide that. This will allow the City to find out about
the rental units and determine the condition they are in.
City Manager Cheney stated that the license costs $2.00 per
room per year. A letter was sent to people who are believed
to have rental units. There will be an attempt to ensure
that the residences comply with the code.
Ms. Pierce felt that all property should be examined and not
just the rental property.
Rental Ordinance
Sarah Williams, 1331 S.W. 22nd Avenue, stated that she was a
landlord and had received one of the letters from the City
which required that she get an occupational license. She
was very hurt by this request. She did not feel that one
sector should be singled out and felt that the City should
be trying to create harmony instead of putting one side
against the other. She had noticed that some property which
is not rental property is in need of repairs. Ms. Williams
stated that she owns 20 units on one street and each unit
has five rooms. She is licensed by the State and her units
are inspected twice a year. She tries to stop drug dealing
in her units, but has not been very successful. She did not
feel she should be taxed because she had been unsuccessful
in her attempts to rid the units of drugs and drug dealers.
She asked if anything was going to be done about the vacant
lots. She had noticed that they were used for drug deals as
well as homes.
Mayor Hester wanted to make it clear that the rental law was
not just to rid the area of drugs. The attempt is to pro-
vide a better place to live for the people. The City must
begin somewhere and has selected the rental property.
City Manager Cheney asked if Ms. Williams could provide him
with some addresses that the City might have missed when
sending out the letters. She stated that she knew of many

names the City missed. Ms. Williams again stressed that all
homes need to be cleaned up and not just rental property.
Loitering
Veoletta Wright, 301 N.E. 26th Avenue, was in favor of doing
something about loitering. She had observed that in
Hollwood and Dania even the blight area seemed to be better
than areas here in Boynton Beach. She felt that many
problems need to be addressed. Eliminating the loitering
would be a good first step in cleaning up the City according
to Ms. Wright.
Mayor Hester felt that Boynton Beach could be better if
people would take more pride in their own area.
Commissioner Marchese felt that drugs are in all areas. If
the people don't buy them, the dealers will leave. People
must take pride in their own area. He hoped that people
like Ms. Wright would take the initiative to help create
more pride in the area.

Mr. Annunziato stated that several months ago the Planning
Staff requested that action on Items A, C, and E (B, D and F
are related to these three) be postponed until the applica-
tions for plan amendment submitted at the April 1st sub-
mission date could be addressed. A tentative approval by
the Commission on these projects would allow them to be for-
warded to the Department of Community Affairs (DCA) for
review by DCA and the Treasure Coast Regional Planning
Council.
Mr. Annunziato explained that the three projects are all
located on Lawrence Road. Citrus Glen is annexed, zoned
and under construction. He pointed out the locations of the
remaining properties. Elementary School "P" should be under
construction by the end of the year. The City has had an
indication from an adjoining property owner that he might
like to move toward annexation as well. This will be
addressed in the October plan submission.
City Attorney Rea stated that approval of these projects
could be done at the same time as long as the actions are
spelled out specifically.
Jim Sturrock, Boynton Nurseries, was available for any
questions regarding Citrus Glen - Phase II. Augustin A.
Hernandez, Palm Beach County School Board, was present to
answer any questions regarding Elementary School "P." Allen
Miller, applicant for Lawrence Lake, was also present.

Mr. Annunziato explained that when the proposal to rezone the
east side of Federal Highway came before the City
Commission, the Commission requested that Staff take a look .
at the feasibility of rezoning the west side of Federal
Highway as well. It was felt that one reason for rezoning
the east side was due to the fact this was a major entrance
to the City. This being the case, the west side was also at
the entrance to the City.
The Staff felt that the situation on the west side was very
different from the east side. The businesses on the west
side back up to the railroad and behind that some property
is zoned industrial. To rezone the west side would cause
many more businesses to become conditional uses. The lots
are very small and of strange configuration on the west
side. Mr. Annunziato also stated that the west side was a
very difficult area to develop and most of the businesses
presently located there seem to be doing well. He suggested
that the landscaping could be improved and the area cleaned
up. Strict code enforcement should help eliminate some of
the existing problems.
The P&Z Board held a public hearing and they unanimously
recommended denial of the rezoning request.
Mayor Hester asked if anyone wished to speak in favor of the
request.

ings and recommendation for denial of this request. He felt
that the same recommendation should be taken for the east
side of Federal Highway. He used the same argument for the
east side as was given for the west side as many properties
would become nonconforming uses.
In answer to Mayor Hester's question, Mr. Annunziato stated
that no final action has been taken regarding rezoning of
the east side of Federal Highway. Consideration will have

to be given to readvertising, etc. the east side. The
Planning Department recommended that the east side be

two locations was approximately $200.00.
City Manager Cheney suggested that the City do the capping.

stated that, due to the fact they could not get clear title
to the property, they had recently lost a good sale. She
requested that the City cap the lines as she did not feel
she should be responsible since she was only one year old

Mr. Golden explained that the elaborate formula for calcu-
lating required parking had caused problems for everyone.
This amendment would simply require a 10 percent buffer for
everyone when calculating parking requirements.

C. Report on Employee Pension Plan Amendments
City Manager Cheney stated that this was a clarification for
the Commission and for the City records. The change in the
Pension program was recently approved by the City Commission
to allow full benefit at age 55 instead of age 62 with 25
years of service. Pensions get complicated and not all the
questions were placed on the table. Regarding the issue of
people who retire before age 62 with less than 25 years of
service or at 55 with less than 25 years of service, the
assumption was that this applied to those people. The anal-
ysis of the cost to change the system did not assume those
changes (retiring at 25 years under age 55). This would
give a person a longer period of time to collect benefits.
It did not assume retiring at 62 with less than 25 years of
service. If those two things were included for existing
employees (about 30 of them), the increase in cost would be
approximately $170,000.00 a year. He further explained that
now that the employees understand that the actuary assumed
that those things did not apply, they have talked with those
employees affected. Many of those employees were not
planning to retire before age 62 anyhow, and would not be
affected. These employees have been met with and understand
the situation. He wished the record to show that the only
change is at age 55 with a full 25 years of service this
change applies. If both these conditions are not met, the

cost would be much greater and the opportunity for employee
input into the system would be much less. This has been
clarified to those employees concerned and letters written
back and forth with the actuarial firm. The Pension Board
reviewed this clarification last week and accepted it. It
was the desire of City Manager Cheney and the Board to get
this to the Commission as a clarification.
Commissioner Mann moved to accept the clarification
regarding the Employee Pension Plan Amendments. Motion was
seconded by Commissioner Marchese and carried 3-0.
