65-GGRESOLUTION NO. 65-GG
WHEREAS, the owners of land abutting a certain thirty
foot dedicated right-of-way lying within the municipal limits of the City of
Boynton Beach, Florida, more particularly described hereinafter, have
petitioned the City Council of the CITY OF BOYNTON BEACH, FLORIDA,
for a resolution vacating and abandoning subject right-of-way; and
WHEREAS it appears that subject right-of-way has never
been laid out, improved or used by the general public; and
WHEREAS, after thorough investigation there appears to be
no valid reason why subject right-of-way should not be vacated and abandone¢
and
WHEREAS, in consideration of subject abandonment the owners
of the abutting property have agreed to dedicate certain needed right-of-way
for the installation and construction of Congress Avenue, which project is
to be deemed essential for the public good and beneficial to the inhabitants
and citizens of the CITY OF BOYNTON BEACH;
NOW, THEREFOR.tE, be it resolved by the City Council of the
CITY OF BOYNTON BEACH, FLORIDA'
That the dedicated road right-of-way, 30 feet in width,
located in Section 20, Township 45 South, Range 43 East,
and bounded on the South by Boynton Canal, and on the
North by Lot 94, according to the Plat of the Subdivision
of Se ction 29 and 20, Township 45 South, Range 43 East,
as recorded in Plat Book 7, at Page 20, Palm Beach County
Records~ is hereby vacated, nullified, closed and abandoned
and subject area is hereby returned to acreage for purposes
of taxation.
