65-P RESOLUTION NO. 65-P
WHEREAS, the owners of lands abutting a certain thirty foot
dedicated right-of-way lying within the City limits of the CITY OF
BOYNTON BEACH, FLORIDA, more particularly described hereinafter, hat
heretofore petitioned the City Council of the CITY OF BOYNTON BEACH,
FLORIDA, for t he adoption of a resolution vacating and abandoning subject
right- of- way; and
WHEREAS, it appears that subject roadway has never been laid
out, improved or used by the general public; and
WHEREAS, after thorough investigation, there appears to be no
valid reason why subject roadway should not be vacated and abandoned; and
WHEREAS, in consideration of subject abandonment, the owners
the abutting property have agreed to dedicate certain needed Fight-of-way
for the installation and construction of Congress Avenue,
NOW, THEREFORE, be it resolved by the City Council of the
CITY OF BOYNTON BEACH, FLORIDA:

That the thirty (3 0) foot/roadway running northward from
Old Boynton Road West to the Boynton Canal, lying between
Lot 79 and Lots 82 through 93 inclusive on the West, and Parcel
"C" and Lots 68 through 78 inclusive on the East, all in the
Subdivision of Sections 29 and 20, Township 45 South, Range
43 East, according to the Plat thereof on file in the office of
the Clerk of the Circuit Court in and for Palm Beach County
Florida, recorded in Plat Book 7, Page 20, be and the same
is hereby vacated, nullified, closed and abandoned and subject
area is hereby returned to acreage for purposes of taxation.
