63-RRESOLUTION No. 63-R WHEREAS, pursuant to the charter of the CITY OF BOYNTON BEACH, FLORIDA, the City Council of said municipality has heretofore, by-resolution, adopted certain Civil Service Rules and Regulations govern- ing the merit system of said municipality, effective July 16, 1962, as here- tofore amended; and WHEREAS, pursuant to the procedure set forth in said charter, the Personnel Officer of said City has heretofore prepared certain amend- ments to said Rules and Regulations, which proposed amendments have been approved by the City Manager and submitted to the City Council for their consideration; and WHEREAS, the City Council has examined said proposed amend- ments, and after due consideration deems the enactment of said amendments to the best interest of the City and essential for the effective operation of the municipal merit system; NOW, THEREFORE, BE IT RESOLVED by the City Council of the CITY OF BOYNTON BEACH, FLORIDA: 1. That the proposed amendments to the existing CITY OF BOYNTON BEACH Civil Service Rules and Regulations, adopted July 16, 1962 as amended, heretofore proposed and submitted by the Personnel Officer and approved by the City Manager, and more particularly set forth hereinafter are hereby adopted, ratified and approved, subject amendments being as follows: (a). The first sentence of sub-paragraph (a), Section 4, Article X of the CITY OF BOYNTON BEACH Civil Service Rules and Regula- tions is hereby amended to read: (a). DEATH IN THE FAMILY - In case of death of the employee's mother, father, foster parents, brother, sister, wife, husband, son, daughter, mother-in-law, father-in-law, grandparents, or grandchildren, the employee shall be allowed reasonable and necessary time to attend the funeral. (b). Section 5, of Article III, of the CITY OF BOYNTON BEACH Civil Service Rules and Regulations is hereby amended by adding after the first paragraph thereof the following paragraph: The position of Department Head shall be filled according to Merit and fitness of all candidates to be judged on the basis of: age, experience and background, education, special or specific training, physical and mental fitness, aptitude for the position, and by meeting all requirements as outlined in the job description. In addition to oral interviev~s conducted by t he City Manager, candidates may be required to pass oral or written examination prepared and administered by the Personnel Officer and super- vised by the Civil Service Appeals Board, demonstrating their knowledge of the position they are seeking. Qualified employees in the classified service may be considered for promotion to the position of Department Head; provided they shall have served at least two (2) years with the City of Boynton Beach in a supervisory or semi-supervisory capacity and their knowledge of the job, age, experience and background, education, special or specific training, physical and mental fitness and aptitude for the position meet all requirements as outlined in the job description. Such candidates shall present proof of the above mentioned qualifications and shall submit such proof along with a written request to be considered for the position to the City Manager. The final selection of all Department Heads shall be made by the City Council, upon the recommendation of the City Manager. (c). Section 1, Article VIII, of the CITY OF BOYNTON BEACH Civil Service Rules and Regulations is hereby amended by adding after the second paragraph thereof the following paragraph: Whenever a permanent employee in the classified service is promoted to a position in a higher classification, either through the re- allocation of his position, or by passing a promotional examination, said employee shall be required to serve a six (6) months probationary period in the higher classification before being confirmed in the position. However, said employee, because of his permanent status in the classified service, shall retain his Civil Service rights during this period. If, during this six (6) month probationary or testing period in the higher classification, employe performance does not meet required standards as determined by job specifica tions; or his monthly performance rating as filed by his Department Head are not indicative of his ability to perform the duties of the higher position, the employee shall, with the approval of the City Manager, upon the written request of the Department Head, be returned to his former permanent classi- fication and the position thus vacated filled by the next eligible candidate. All positions filled as the result of the above mentioned classification pro- motion shall be filled, subject to the permanent employee's ability to perform the duties of the higher position and to attain permanent status in the higher classification and all new personnel so employed shall be advised that their period of initial probation will not be considered complete until the permanent employee they are replacing is confirmed in the higher classi- fication. (d). The second paragraph of Section 4 (b) of Article II, of the CITY OF BOYNTON BEACH Civil Service Rules and Regulations is hereby amended to read: -2- Retirement ageforall employees in the classified service in all departments, except ~lice and Fire, shall be mandatory at age 65 years. The mandatory retirement age for all classified employees in the Police and Fire Departments of the City shall be at age 60 years. In all depart- ments, except Police and Fire, employees past the mandatory retirement a may be continued in their positions upon the recommendation of the City Manager, with the approval of the City Council. Employees past the man- datory retirement age retained in their municipal employment, in accordan~ with the above procedure, shall be considered non-classified and shall not be entitled to civil service benefits. For the purposes of this Section, the respective mandatory retirement ages of 60 years and 65 years shall be considered attained upon the individual employee's reaching his 60th or 65th birthday, as the case may be. ame nde d, 2.
