A RESOLUTION OF THE CITY OF BOYNTON BEACH, FLORIDA, AUTHOR-
IZING AND ORDERING THE CONSTRUCTION OR RECONSTRUCTION OF
CERTAIN ADDITIONS, EXTENSIONS AND IMPROVEMENTS TO THE CON-
SOLIDATED AND COMBINED MUNICIPAL WATER AND SEWER SYSTEM OF
SAID CITY UPON A SPECIAL ASSESSMENT BASIS IN THE DISTRICTS,
LOCATIONS AND ROUTES SET FORTH, AND FOR THE FINANCING AND
APPORTIONMENT OF COSTS: FURTHER PROVIDING FOR THE PREPARATIO
OF PLANS AND SPECIFICATIONS FOR SAID PROJECT AND PROCEEDINGS
RELATIVE THERETO, ALL WITHIN THE CORPORATE LIMITS OF SAID CITY
OR AS OTHERWISE PROVIDED BY LAW.
WHEREAS, the City Council of the City of Boynton Beach,
Florida, now owns and operates a consolidated and combined municipal water
and sewer system; and
WHEREAS, the City Council of said City deems it necessary
and essential to the best interests of the City, and in furtherance of the pro-
tection of the health, safety and welfare of the inhabitants thereof, to construc
improve, extend, enlarge, reconstruct, maintain, equip, repai~rand operate
sewerage disposal system or systems within and/or partly without the corpor
limits of said City, and to construct or reconstruct sewers within the corpora'
limits of said municipality; and
WHEREAS, the City does not have sufficient funds available
for the payment of the cost of such improvements in cash, as the work is done
and
WHEREAS, it is the purpose of the City to proceed under
and in accordance with the requirements, provisions and authority of the laws
of the State of Florida, including and in particular, Chapter 184, Florida
Statutes Annotated, and to issue water and sewer revenue bonds and to levy an
impose special assessments for ber~¢its under and by virtue of the provisions
of said Chapter 184, Florida Statutes Annotated, and in accordance with
resolutions and proceedings hereafter adopted in compliance therewith;
NOW, THEREFORE, be it resolved by the City Council of
the City of Boynton Beach, Florida:
SECTION l: That the City C~ouncil does hereby order the construction
or reconstruction of additions, extensions and improvements to the con-
solidated and combined municipal water and sewer system of said City
upon a special assessment basis, under and subject to the provisions of
Section 184. 05, Florida Statutes Annotated, within the corporate limits
of the City of Boynton Beach, Florida, or as otherwise authorized by law,
as more particularly set forth in the areas described hereinafter and in
accordance with plans and specifications to be prepared by City Engineers,
RUSSELL & AXON. The description of the improvements, locations,
routes, terminal points, material, nature, character and size of the
project herein contemplated is as follows, to wit: (The following schedule

SANITARY SEWER IMPROVEMENTS
MATERIALS:
Materials for sanitary sewers shall conform to the following requirements:
Sanitary Sewer Lines: Sizes 8", 10", 12", 18" and 24" inside diameter, to
be constructed of vitrified clay pipe with factory made joints using materials
having resilient properties.
2. Sanitary Sewer Lines: Sizes 27", 30", 36" inside diameter, to be constructed
of reinforced concrete pipe with rubber gasket joints.
3. Lateral Sewers: 6" diameter to be constructed of vitrified '-Clay pipe with
factory made joints, or of cement-asbestos pipe with applicable joints·
4. Sewer Manholes: Shall be constructed of brick or of reinforced concrete
and shall have cast iron frames and covers.

SEWAGE TREATMENT PLANT AND LIFT STATIONS
The Sewage Works Improvements for the City of Boynton Beach, Florida
include the sanitary sewers described in the preceding section and the
sewage treatment plant and lift station improvements as follows:
1. LIFT STATION NO. 1 - Lift Station No. 1 will be located at the northern
end of N. W. Fourth Street. The station will be new and will be complete
with three sewage pumps, electrical controls, piping, valves and other
necessary appurtenances. A 20-inch cast iron pipe force main will be pro-
vided to pump sewage from Lift Station No. 1 to the sewage treatment plant.
2. LIFT STATION NO. 2 - Lift Station No. 2 will be located near the eastern
terminus of N. E. Second Avenue. The station will be new and will be com-
plete with three sewage pumps, electrical controls, piping, valves, and other
necessary appurtenances. An 18-inch cast iron pipe force main will be pro-
vided to pump sewage from Lift Station No. 2 to Sewer System No. 1.
3. LIFT STATION NO. 3 - Lift Station No. 3 will be located near the inter-
section of N. E. Fourth Street and N. E. Sixteenth Avenue. The station will
be new and will be complete with two sewage pumps, stand-by engine, elec-
trical controls, piping, valves and other necessary appurtenances. A 10-inch
cast iron pipe force main will be provided to pump sewage from Lift Station
No. 3 to Sewer System No. 3-A.
4. LIFT STATION NO. 4-A - Lift Station No. 4-A will be located near the
intersection of Seacrest Blvd. and N. E. Twenty--:sixth Avenue. The station
will be new and will be complete with two sewage pumps, stand-by engine,
electrical controls, piping, valves and other necessary appurtenances. A
6-inch cast iron pipe force main will be provided to pump sewage from Lift
Station No. 4-A to Sewer System No. 4.
5. LIFT STATION NO. 5 - Lift Station No. 5 will be located near the eastern
terminus of Oak Street. The station will be new and will be complete with two
sewage pumps, electrical controls, piping, valves and other necessary appur-
tenances. An 8-inch cast iron pipe force main will be provided to pump sewage
from Lift Station No. $ to Sewer System No. 3.
6. LIFT STATION NO. 11 - Lift Station No. 11 will be located near the inter-
section of S. W. Eighth Street and S. 'W. Twenty-seventh Terrace. The station
will be new and will be complete with two sewage pumps, stand-by engine,
electrical controls, piping, valves and other necessary appurtenances. A 10-inch
cast iron pipe force main will be provided to pump sewage from Lift Station No. 11
to Sewer System No. 2.
SEWAGE TREATMENT PLANT - Additions will be made to the existing sewage
treatment plant, increasing the capacity to 1.6 MGD. The improvement~ will
include two additional primary tanks, conversion of existing filter to a high
rate filter, two additional final tanks, one additional digester, five additional

sludge drying beds; additions to the control house and additions to the
electrical piping, valves and appurtenances, as necessary. The sewage
treatment plant is located on the north bank of the Boynton Canal adjacent
to proposed State Road No. 9 right-of-way.
SECTION 2: Thai the property against which assessments are to be
made for the cost of such improvements shall be and the same is hereby
designated as Districts as hereinbefore set forth, and the apportionment as
between the City and the property of the cost of each improvement, including
incidental expenses a provided by law, shall be computed, assessed and
apportioned as follows:
1. To each lot or parcel of land, to the property or curb line of
which a sanitary sewer lateral shall have been laid, shall be
apportioned lhe cost of that lateral;
2. To abutting property shall be apportioned according to frontage,
as a special assessment for benefits, not less than two-thirds
(2/3) of either (a) the cost of the sewer improvement or (b)
the cost of an eight inch sanitary sewer as estimated by the
City Engineers (whichever be the lesser), not including therein
the cost of laterals, pumping stations or outlets; and
3. To the manicip~lity shall be apportioned the remaining cost of the
sewer improvement; provided, however, that in the case of lois or
parcels which abut on more than one street, or which have irregu-
lar shapes or unusual depths, or which are served or are to be
sewer
served by such/improvement although not abutting upon either side
of the street in which such sewer improvement is constructed,
shall be made under such rules and regulations as the Council
shall deem to be fair and equitable.
SECTION 3: That the City Engineers, RUSSELL & AXON, be and
they are hereby authorized, ordered and directed to prepare in duplicate,
plans and specifications of each improvement ordered hereby and an estimate
of the costs thereof, which costs shall include, in addition to the items of cost
set forth in sub-section (5) of Section 184.02, Florida Statutes Annotated, the
cost of re-laying streets and sidewalks necessarily torn up or damaged as well
as the following items of incidental expenses: (a) printing and publishing of
notices and proceedings, costs of abstracts or title, and (b) any other expense

necessary or proper in conducting the proceedings and work provided for by
law and this resolution, as well as any other resolutions incident or necessar,
to conducting the proceedings and work hereby authorized.
SECTION 4: That said City Engineers shall also prepare in duplicate
a tentative apportionment of the estimated cost as belween the municipality
and each lot or parcel of land subject to special assessment hereunder; such
apportionment to be made in accordance with the provisions of this resolution
and the provisions of sub-section (7) of Section 184.05, Florida Statutes
Annotaled, in relation to apportionment of costs in the preliminary assessrne~
roll, one of the duplicates of such plans, specifications and estirnaie, and suc
tenlative apporlionment of costs shall be filed with lhe City Clerk of the
municipality and the other duplicate shall be retained by the engineers in thei]
file, all thereof to remain open to public inspection at all resonable times.
SECTION 5: Thai it is further determined and deemed necessary and
advisable to issue Water and Sewer Revenue Bonds in accordance with the
)ns of said Chapter 184, Florida Statutes, to finance the cost of t he
improvements hereby ordered and provided for, and thai the City Council of
said City does hereby signify and declare its intention so to do and io here-
after provide therefor and to authorize the issuance thereof through the
enactment of a proper and sufficient resolution as may be deemed necessary
and proper.
SECTION 6: Thai GENE MOORE, as City Atlorney of the City of
Boynton Beach, Florida, be and he is hereby authorized and directed lo draft
and prepare the necessary and requisite resolutions, docurnents, notices and
other legal proceedings for the valid levying of special assessments for
benefits, and to coordinate the preparation of lhe requisite and permanent
assessment rolls and apportion ment of costs by the City Engineers, RUSSEL
& AXON, all in accordance with the Statutes and laws of lhe State of Florida
in such cases made and provided.

SECTION 7: That TEREESA PADGETT, City Clerk of said City be and
is hereby authorized and directed to fully Comply with all the provisions of sate
Chapter 184, Laws of Florida, applicable to the matters and proceedings
therein and in this Resolution specifically authorized and provided for.
SECTION 8: This Resolution shall take effect irrnrnnediately upon its
passage and approval as provided by law.
