62-ERESOLUTION NO. 62-~
WHEREAS, the owner of all of the lands abutting the certain
three (3) foot publicly dedicated utility easement over the westerly three (3)
feet of lots 17, 18, 19, 20, 21 and the North eighteen (18) feet of lot 22, all
in Block 4, BOYNTON HEIGHTS, Boynton Beach, Florida, has petitioned the
City Council of the City of Boynton Beach, Florida, for the adoption of a
resolution vacating and abandoning said publicly dedicated utility easement;
and
WHEREAS, it appears that subject easement has never been used
by the general public or any franchised public utility; and
WHEREAS, after thorough investigation it appears that no hardship
will be occasioned by the abandonment of said easement and that no present
or future use of same is contemplated, and that said abandonment will be for
the best interest of the general public, and no valid reason exists why same
should not be vacated;
NOW, THEREFORE, be it resolved by the City Council of the City
of Boynton Beach, Florida;
That the publicly dedicated three (3) foot public utility easement
lying across and over the westerly three (3) feet of lots 17, 18,
19, 20, 21 and the North eighteen (18) feet of lot 22, all in Block
4, BOYNTON HEIGHTS, a subdivision of the City of Boynton
Beach, Florida, according to the plat thereof on file in the
office of the Clerk of the Circuit Court in and for Palm Beach
County, Florida, recorded in Plat Book 10, page 64, is hereby
vacated and abandoned and all rights of the public in and to same
are hereby relinguished.
