WHEREAS, the CITY OF BOYNTON BEACH, FLORIDA, has
heretofore caused a segment of a certain public road known as SEACREST
BOULEVARD to be constructed between N. E. 10th Avenue and the South
right-of-way line of the Boynton Canal, within the municipal limits of the
said CITY OF BOYNTON BEACH, FLORIDA; and
WHEREAS, said segment of subject public road has been construc-
ted, maintained, kept in repair and worked continuously and uninterruptedly
by the city for a period in excess of four years prior to the date of this
Resolution; and
WHEREAS, the city has heretofore caused the above described
roadway to be surveyed by the engineering firm of K. C. Mock and Associate
and a map depicting same to be prepared, a copy of which said map is
attached hereto and hereby made a part hereof; and
WHEREAS, pursuant to the provisions of Section 337.31 Florida
Statutes 1955, that portion of the above described public road, not previously
dedicated to public use, is deemed to be dedicated to such public use,
NOW, THEREFORE, be it resolved by the City Council of the
CITY OF BOYNTON BEACH, FLORIDA:
1. That the Mayor and the City Clerk of the City are hereby
authorized lo recite upon the attached map thai the portions of the public
roadway he re inabove described, not previously dedicated to public use,
have vested in the City pursuant to the provisions of Section 337.31 Florida
Statutes 1955, and to thereafter record a certified copy of this Resolution an~
map attached thereto with the Clerk of the Circuit Court in and for Palm
Beach County, Florida.
2. That the lands encompassed by the roadway hereinabove
referred to, not previously dedicated to public use, are more particularly
described as follows:
PARCEL A: The East 9.17 feet of Lot 1 and the East 9.17
feet of Lot 32, Block 5, HAPPY HOME HEIGHTS, according
to the plat thereof on file in the office of the Clerk of the
Circuit Court in and for Palm Beach County, Florida,
recorded in Plat Book 11, Page 30.
PARCEL B: The East 6.47 feet of Lot l, Block 6~,
HAPPY HOME HEIGHTS, according to the plat thereof
on file in the office of the Clerk of the Circuit Court in
and for Palm Beach County, Florida, recorded in Plat
Book 11, Page 30.
PARCEL C: The West 8.9 feet of Lot 9, 1VtEEK$ AND
ANDREWS ADDITION, according to the plat thereof on
file in the office of the Clerk of the Circuit Court ih
and for Palm Beach County, Florida, recorded in Plat
Book ~, Page 84.
PARCEL D: The West 13. 9 feet of Lot 9 MEEKS'. ADDITION,
according to the Plat thereof on file in the office of the Clerk
of the Circuit Court in and for Palm Beach County, Florida,
recorded in Plat Book 9, Page 54.
PARCEL E: The West 26.63 feet of Lot 13, THE FRANK
WEBBER ADDITION, according to the plat thereof on file
in the office of the Clerk of the Circuit Court in and for
Palm Beach County, Florida, recorded in Plate Book 9, Page 3.
