PRESENT Edward Harmening, Mayor Lynne Matson, Vice Mayor Matthew Bradley, Mayor Pro Tem Jose Aguila, Commissioner David Katz, Commissioner Carrie Parker, City Manager James Cherof, City Attorney Sue Kruse, City Clerk I, OPENINGS A, Call to Order Mayor Harmening called the meeting to order at 6:15 P. M. for the purpose of canvassing the petitions for election. Mayor Harmening stated that the agenda is incorrect and that this meeting should be adjourned prior to reviewing the Boynton Beach Code of Ordinances. II, HARCH 14, 1995 GENERAL ELECTION A, Recetpt of Candidates Nomlnatln9 Petitions Mayor Harmenin9 announced that David Katz, Jerry Taylor, and James R. Warnke are the candidates for the Office of Mayor. Sidney W. Rosen was the only candidate for Commissioner of District I. Therefore, Mayor Harmening declared him elected. Shirley Jaskiewicz and Michael Lyons are the candidates for Commissioner of District III. Vice Mayor Matson stated that according to the Code, the City Commission judges the qualifications of the Commission. She questioned if they also have the right to question the qualifications of candidates. She was in receipt of three Talent Bank Forms from Michael Lyons. The one dated September, 1992 indicates that he resides on Lawrence Road in the County. The one dated April, 1993 indi- cates that he resides on Southern Cross Circle. Mr. Lyons voted in Precinct 141A in 1990, 1992, 1993 and 1994, which means that he lived in the County but voted in the City. In addition, while living in one precinct on Congress Avenue, he voted in another precinct on the other side of town. City Attorney Cherof stated that the Code refers to the Commission .judging the qualifications of City Commissioners, and does not apply to candidates. The Commission has no jurisdiction over candidates. The role of the City Clerk is ministerial in nature. She accepts the applica- tion, reviews it on its face and checks it for the signature. Then the City Clerk sends it to the Supervisor of Elections to be placed on the ballot. Any challenge after that is a challenge that resides in the right of private individuals, opposing candidates, and citizens of the City. B, General Election Proclamation Mayor Harmening read the General Election Proclamation in full. I I I. AD~IOURNMIENT There being no further business to come before the City Commission, Vice Mayor Matson moved to adjourn the meeting at 6:26 P. M.
