I. CALL TO ORDER
Mayor Taylor called the meeting to order at 6:30 p.m.

II1. PUBLIC HEARING - PROPOSED BUDGET FOR FISCAL YEAR 1995/1996
Mayor Taylor opened the Public Hearing.
Harry Stein, 760 East Ocean Avenue, distributed the following documents to the
Commission:

Two newspaper articles from the Palm Beach Post, dated April 30,
1992 and October 4, 1994, pertaining to the location of the bridge;
Resolution No. R90-191;
Resolution No. 83-AA;
Resolution No. 83-;
Resolution N°. 77M;
Resolution No. 75-SS; and
Letter dated December 20, 1994 from Michael J. Busha, AICP, Acting
Executive Director of the Treasure Coast Planning Council, to Beatriz
Caicedo, supporting the Ocean Avenue alignment for the new Boynton
Beach Bridge.
He said he was authorized by the Board of Directors of Coastal Towers to appear
before the City Commission this evening. His remarks concerned the resolution
adopted by the Commission on October 3, 1994, recommending Ocean Avenue as the

place for the relocation of the bridge. He was concerned with how and why this
resolution was adopted.
Mr. Stein said the Treasure Coast Regional Planning Council consists of ten members
from Palm Beach County, three members from municipalities, four members who are
appointed by the Governor, and three alternate members. He stated that the City,
through its Redevelopment Coordinator, relies a great deal upon the recommendations
of the Council. He stated that Jose Aguila represented the City on this Council, but
resigned in August, 1993, and was never replaced. Therefore, when the Council
recommended that the bridge be located on Ocean Avenue, no one from Boynton
Beach was there to participate in that recommendation. That recommendation was
made verbally on September 16, 1994. The full report, with recommendations in
writing, was not made by the Council until December 15, 1994, about one and a half
months after the City Commission had adopted the resolution.
Mr. Stein said the City Commission meeting that was held on October 3, 1994
regarding the resolution which concerned the bridge was highly irregular. He said he
called most of the Commissioners prior to that meeting and knew from his
conversations that the decision was "in the bag". He stated that the agenda item
appeared to be faulty because it was listed on the agenda for discussion, but turned
into the adoption of a resolution.
Mr. Stein stated that Ann Ford never submitted a resume, which is normally the custom,
for the important position of Redevelopment Coordinator. Shortly after September 16,
1994, she made an extremely crucial recommendation which the Commission followed
and which affects us in a drastic way.
He urged the Commission not to allocate any funds in the budget for a Redevelopment
Coordinator and that this position not be filled at this time; that no expenditures be
made in connection with the proposed bridge on Ocean Avenue; and that the bridge
location be reviewed and a resolution adopted to revoke the October 3, 1994 resolution.
NO one else wishing to speak, Mayor Taylo.r declared the Public Hearing closed.

IV. COMMMISSION COMMENTS
Mayor Pro Tem Matson reiterated what a wonderful job the City Manager, the Finance
Department, and staff has done. She said she has never seen a budget go so
smoothly. She was very proud of them and grateful.
PROPOSED RESOLUTION NO. R95-115 RE: ADOPTING A PROPOSED
MILLAGE RATE (FISCAL YEAR 1995/1996) AND SETTING FORTH THE
DATE, TIME AND PLACE OF THE FIRST PUBLIC HEARING TO CONSIDER
THE PROPOSED MILLAGE RATE AND THE TENTATIVE BUDGET
Attorney Trehy read Proposed Resolution No. R95-115 by title only.
Motion
Mayor Pro Tem Matson moved to approve Proposed Resolution No. R95-115.
Commissioner Jaskiewicz seconded the motion.
City Manager Parker advised that the first public hearing to consider the proposed
millage rate and the tentative budget has been scheduled for Tuesday, September 5,
1995, at 7:00 p.m., as part of the regular City Commission meeting.
Commissioner Rosen stated that the millage rate has been the same for the past four
years, which is testimony to the wonderful job done by the City Manager and staff. He
was certain the public will appreciate this very much, especially in these times.
The motion carried 5-0.
City Manager Parker clarified that according to the TRIM bill we have to advertise the
rollback millage prior to Tuesday, September 5, 1995. We will also advertise the
budget hearing at the same time. She advised that the Property Appraiser made an
error by putting the 1994 and 1995 annexation and new construction together.
Therefore, we do not have $31 million-in new construction. The millage is slightly
different and the rollback rate is now 7.8763.
