AN ORDINANCE OF THE CITY COM~ISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA, PROVIDING FOR
AMENDMENT TO CHAPTER 18 OF THE CODE OF
ORDINANCES TO ADD A NEW SECTION PROVIDING FOR
CREATION OF AN INTERNAL REVENUE SERVICE CODE
SECTION 125-FLEXIBLE BENEFIT PLAN; PROVIDING
FOR AMENDMENT TO SECTION 18-55 TO REDEFINE
ANNUAL EARNINGS; PROVIDING A CONFLICTS
CLAUSE; PROVIDING A SEVERABILITY CLAUSE;
PROVIDING AUTHORITY TO CODIFY; PROVIDING AN
EFFECTIVE DATE; AND FOR OTHER PURPOSES.
WHEREAS, the City Commission of the City of Boynton Beach
desires to provide employees of the City that currently
p rtlclpate in the group insurance program to have those premium
-
dollars paid to their insurance carrier prior to being taxed, and
accordingly desire the adoption of an Internal Revenue Service
Code Section 125-Flexible Benefit Plan for insurance premiums
only;
NOW,
CITY OF BOYNTON BEACH, FLORIDA:
Section 1. Chapter 18
amended to add a new Article VI
Article VI. Flexible Benefit Plan.

Section 2. Article II, Section 18-55 of the Code of
Ordinances is amended as follows:
Annual Earnings. Gross earnings received by the employee as
compensation for services to the City, including overtime pay.
Bonuses shall be excluded. Flexible benefits shall be excluded.
Section 3. That all ordinances or parts of ordinances in
conflict herewith be and the same are hereby repealed.
Section 4. Should any section or provision of this
ordinance or portion hereof, any paragraph, sentence, or word be
declared by a court of competent jurisdiction to be invalid, such
decision shall not affect the remainder of this ordinance.
Section 5. Authority is hereby granted to codify said
ordinance.
Section 6. This
