MI. Sugerman advised that these drives are scheduled for replacement one year from now at a
co~st of $45,000 per drive. The Utilities Department will be retrofitting the drives at $25,000 per
driVe and hopes to get the same amount of life from the retrofits.

Attorney Cherof reported that this Letter of Credit would need a correction before approval

D. Ratification of Planning & Development Board Action:
Nancy Byrne reported that the Public Hearing item for Lowe's must be the first item to be
addressed because if it is not approved, nothing else can move forward.
Attorney Cherof advised the Commission that they would need a motion to pull ~[tems D.1, D.2,
D.3, D.4, D.7 and D.8 from the Consent Agenda. They would be addressed after the Public
Hearing.
Lowe's Home Center (Number of Signs) - Southwest corner of T-95 and
Woolbright Road - Request for relief from Chapter 21 Signs, Article TV,
Section 2(B) which limits a single use to one (:L) site sign to allow the
erection of two (2) site signs
Lowe's Home Center (Pole Sign Height) - Southwest corner of 1-95 and
Woolbright Road - Request relief from Chapter 21, Signs, Article IV,
Section 2(B) which limits maximum sign height to 20 feet to allow for
erection of a 49 foot high pole sign
A~orney Cherof advised that there was an issue regarding this request. Mayor Broening
advised that the applicant is supposed to present this item to the Commission at the meeting.
A~orney Cherof advised that there isn't much room for deviation because of the way the notice
w~s pUblished. That notice was published as a variance for height.
Lowe's Home Center - Southwest corner of 1-95 and Woolbright Road -
Request for relief from the City of Boynton Beach Land Development
Regulations, Chapter 23, Article 11.(A)(7) which limits the maximum
number of driveways along a single street to two (2), to allow a total of
three (3) driveways

Request for a height exception in accordance with the City of Boynton
Beach Land Development Regulations, Chapter 2, Zoning, Section 4.F.1
to allow a five (5) foot increase from the maximum forty-five (45) foot
height limit, or a 50 foot high roof feature at project entrance

relief from Chapter 2, Zoning, Section 5(D)(2)(a) requiring a minimum
side (corner lot) setback of 25 feet, to allow a 10 foot side setback

this request was denied because there wasn't significant hardship and granting the variance
would have impact on the adjacent properties.

Attorney Cherof advised that he did not see where either of these two requests supports a
h~rdship, and knowing that, they both should be denied. What was presented to the Planning
&Development Board did not establish a hardship. The applicant must establish a hardship
arid the hardship must be that the property cannot be developed.

Mr. Sugerman reported that this summer, leakage was found in the deep injection well. This
goes down 3,600' into the ground. There are two ways to fix the problem. We could attempt
t~ patch the leak at a cost of $12,000. We have a permit to do this work. Tf this doesn't work,
v~ will have to pull the casing out until we get to the hole. We could then repair it and put it
ack in place. That could cost $750,000. Although staff is hoping the "quick" fix will work, they
wbuld like authorization for both types of repairs in the event the "quick" fix does not work.
Attorney Cherof inquired whether there might be a product deficiency from the original installer
o, could pressure have caused the hole? Mr. Sugerman advised that they are not sure, but
thiey are alluding to the hole being caused by thunderstorms. Hr. Sugerman said he would
investigate this further.
Mw. Sugerman wanted the Commission to be aware of the fact that the "quick" fix would be
a~empted at a cost of $12,000. However, if that does not work, the more expensive repair
wguld be required. Tf the more expensive project were required, we would award a contract.
Therefore, it would go back to Commission for award of that contract.

are recipients of the grant funds and if Bikini Beach vacates the space, they would not re-lease

With respect to these two items, Attorney Cherof reported that the City was joined into the
m~rtgage foreclosure proceedings that led up to Mr. McShane acquiring the property. The
City's liens were wiped out at that point. Staff and the Code Compliance Board should have
pi~ked up that fact. Attorney Cherof will provide the documentation from the Courthouse by
the time of the meeting. Attorney Cherof advised lVlr. IvlcShane to talk with the Title Company
that did not pick up on the fact that the liens had been wiped clean.
Attorney Cherof advised that the Commission's motion should be to reduce the fine to zero.
Vi~e Mayor Tillman suggested moving this item up on the agenda at the beginning of the
m~eting and el minating it by releasing the lien.
M~yor Broening said this item would be moved up under Item TI-Administrative.
XII. UNFINISHED BUSINESS:

mmissioner Weiland said he was not polled regarding the fluoridation workshop. Mr.
wkins advised that Joyce will be handling that item and he believes it is planned for after
