Minutes 05-13-96 JOINT CITY COMMISSION/PLANNING & DEVELOPMENT BOARD PUBLIC WORKSHOP FOR EVALUATION & APPRAISAL REPORT OF THE 1989 COMPREHENSIVE PLAN HELD IN THE PROGRAM ROOM OF THE CITY LIBRARY, BOYNTON BEACH, FLORIDA, ON MONDAY, MAY 13, 1996, AT 6:30 P.M. CALL TO ORDER - Mayor Jerry Taylor Mayor Taylor called the meeting to order at 6:40 p.m. At his request, all participants introduced themselves, n addition to those listed above, Stella Rossi, citizen, was also present. 2. CONSERVATION ELEMENT A. Overview of Consultant Findings (Executive Summary) Ms. Papandreas'said the Conservation Element includes both land-based and policy- based objectives. One of the principal objectives was the preservation of 75% of sites rated as "A". It appears that 75% of the "A" rated land is currently undeveloped. However, not all "A" rated lands are in preservation categories. Approximately 160 acres are in a permanent preservation status. Another portion of that is eligible for development. One hundred (100) acres of the land is owned by other governmental entities, but not managed for preservation. One of the recommendations of the E.A.R. is that the City seek additional cooperation with the Department of Transportation to get better management of the surplus DOT lands that are currently "A" list preservation sites. There are a number of them on 1-95. No special recognition is given to these sites. Since the Conservation Element was last prepared, an important new inventory of natural resources became available in the Lake Worth Living Estuary Study, and some information was included for consideration of new objectives. The objectiVes for retrofitting drainage outfalls and reduction of water consumption have not been met. These objectives should be reconsidered in light of the current situation. However, all seven objectives have been met or partially met. Mrs. Rossi questioned whether or not the City of Boynton Beach has its own ratings. Ms. Heyden responded negatively and advised that the ratings are the same as Palm Beach County's ratings. Mrs. Rossi said the ratings were set up for the $100 million bond issue and not for the cities. Throughout Palm Beach County, they only derived at 14 of the best sites. It is possible that the City has other sites. Mrs. Rossi advised her that Boca Raton has its own ratings because not all of the sites in Boca Raton were in the County inventory. Ms. Papandreas explained that the inventory appeared to be done in a methodical fashion. It appears it is still valid. As far as community value is concerned, it will be introduced in this process and continue as the Plan is amended. Over the next year, it is up to the City to'determine whether or not it is comfortable with the ratings. Direction regarding the following objectives from the "Objectives Achievement Matrix" [pages 4-7 and 4-8 of EAR and pages 1-4 of staff comments) - obj 4.2, poi 4.2.2, poi 4.2.3, poi 4.2.4, poi 4.2.7, obi 4.3, poi 4.3.3, poi 4.3.10, obj 4.4, poi 4.4.2, poi 4.4.3, poi 4.4.4, poi 4.4.5, poi 4.4.6, obj 4.6, poi 4.6.4 and poi 4.6.5 Obiective 4.2 "Through the long-term planning horizon, the City shall maintain local surface and ground water quality equal to or better than existing levels for recognized pollutants and conserve, appropriately use and protect the quality and quantity of waters that flow into the Intracoastal Waterway." The recommendation, in terms of maintenance, is that this be divided into two objectives - one for ground water and one for surface water, n addition, consider adding a policy to require planting on existing lakes, ponds and wet retention areas. Commissioner Bradley asked for an explanation of the difference between ground water and surface water. Ms. Papandreas said most of the policies relate to surface water. OF THE 1989 COMPREHENSIVE PLAN BOYNTON BEACH, FLORIDA MAY 13, 1996 is not a drainage ~ssue. and this is not addressing run-off. With regard to the recommendation to add a policy to add planting areas on the existing lakes, ponds, and wet retention areas, Mr. Reed explained that at Silvedake Estates, they are planting aquatic vegetation to stabilize the banks. He explained that the plants help filter out the nitrogen and pesticides. However, in Silverlake Estates, they still must spray the lakes for algae and to keep the growth from getting out of control. Commissioner Bradley feels this is a big burden to place on private homeowners or homeowners' associations. Ms. Papandreas suggested considering a policy to set up a pilot program for one or two lakes. Mr. Dubb offered the lakes at Siliverlake Estates for the pilot program since they are already in the process. Commission Bradley was of the opinion that there are more critical drainage and run-off ~ssues than this one. He likes the idea, but he is not certain it can be implemented. Consensus There was a consensus to delete this recommendation. Policy 4.2.3 "Subsequent to Plan adoption, the City shall enforce and, where appropriate, improve subdivision regulations to require all new development or substantial redevelopment to provide on-site retention or detention of at least the first inch of rainfall." MS. Heyden advised that new development is required to meet this policy. With respect to redevelopment, our Parking Lot Regulations are triggered when there is an addition of square footage, addition of parking spaces, or reconfiguring more than 25 percent of the parking area. The entire site must then be brought up to Code, and this includes retention. There have been many remarks about this policy, and in particular, the pretreatment policy. Ms. Heyden asked for direction. In'response to Commissioner Bradley's question, Ms. Heyden advised that an appeal to these regulations is available through a parking lot variance. Ci'~y Manager Parker advised that this is an expensive policy. The applicants have an ability to seek a variance, but economics is not a basis for a variance. Most of the complaints received by the City in this regard are based on the fact that it costs too much money to effectuate the drainage. Consensus There was a consensus of the participants to leave this policy in the Comprehensive Plan. Policy 4.2.4 "The City shall lobby the Florida Department of Transportation to replace existing direct discharge drainage outfalls with drainage retention ponds." City Manager Parker advised that some of this will be driven by the change in the Clean Water Act through the federal government. We are going through the permitting process for our storm water drainage, and FDOT must permit their storm water through the Water Management District the same as we do. Consensus There was a consensus of the participants to retain this policy. Policy 4.2.7 "The City shall investigate the financial feasibility and potential funding sources for implementing a canal maintenance dredging program to eliminate polluted sediments, to reduce resuspension of sediments through prop dredging and to improve tidal flushing." Ms. Heyden said the City does some canal maintenance dredging at this point, but it is done more for maintenance than in terms of environmental improvements. This refers to all canals. Commissioner Bradley suggests that with regard to improving tidal flushing, widening the inlet would reduce the amount of sediment. City Manager Parker recommended that a study be performed on the feasibility of this suggestion since there is a counter claim that if the inlet is widened, the volume of water will increase and flood the yards of homes. Commissioner Bradley feels it is necessary to continue dredging maintenance, and he would like to see this issue studied. He questioned what canal maintenance we would do other than at the boat ramp canal. Ms. Papandreas explained that in 1988 when the studies were done, they indicated there were water quality problems in the Intracoastal. That is the reason why many of the policies indicate improving the water quality. City Manager Parker advised that throughout the Intracoastal, there are small gas spills. OF THE 1989 COMPREHENSIVE PLAN BOYNTON BEACH, FLORIDA MAY 13, 1996 water in that area because these spills have impacted the Intracoastal. Ms. Heyden advised that this policy recommends investigation. Consensus There was a consensus of the participants to retain this policy. Obiective 4.3 "To provide for the continued existence of at least 75% of the acreage occupied by "A" rated ecosystems sites through the long term plan horizon." Recommendation: This objective has been achieved with the public acquisition of the Seacrest and Rosemary parcels. The objective will be retained and the policy wording will be revised to reflect ongoing procedures. Increase cooperation with FDOT for maintenance of unused R-O-W. Consider setting minimum size of 5 or more acres for preservation. With regard to the 75% of "A" rated sites, there were 296.6 acres left at the time of the COmprehensive Plan. The recommendation was that on those sites where development will not take place, that the City enter into an intedocal agreement to establish a preservation easement and maintain those areas for the long term. Staff is planning to reword the objective to indicate that it has not been achieved in terms of preservation, but between undeveloped and preservation, it has been achieved. With regard to the minimum size acres to preserve, a policy exists that requires a minimum off10 acres. We have adopted, on first reading, an Ordinance to modify the policy to five (5) acres to preserve ecosystems. City Manager Parker did not feel this made sense. If the minimum size is 10 acres, we cannot have five (5) acres set aside for preservation. Ms. Heyden believes that the City FOrester was recognizing the need for a minimum number of acres. City Manager Parker e~plained that if Quantum Park is the only location of concern, this would not make sense because they are not going to change what they already have. They will not group everything together to make 5 acre parcels. If Quantum Park is the only site of concern, this should be eliminated. MS. Papandreas said the recommendation can be revised to say, where possible, there be sites of 5 acres of more. However, Ms. Heyden feels a minimum should not be set, and we should keep the 25%. OF THE 1989 COMPREHENSIVE PLAN BOYNTON BEACH, FLORIDA MAY 13, 1996 Consensus There was a consensus of the participants to eliminate the last sentence of the recommendation. Policy 4.3.3 "The City shall establish a Density Bonus program or other incentives in the City Plan and/or appropriate support regulations to preserve natural areas; this provision to be explored with regard to the densities and intensities of use in the City and adjacent jurisdictions." Ms. Heyden advised that this policy was drafted into Ordinance form and was part of a workshop meeting. However, it is now stalled. A determination needs to be made regarding whether this is a policy the City wishes to encourage, or whether to remove the policy from the Comprehensive Plan. If the decision is made to encourage the policy, an Ordinance will be brought back to the Commission. Ms. Heyden confirmed for Commissioner Titcomb that the Ordinance is written so that tighter density would be allowed for larger environmental tracts. City Manager Parker explained, however, that the densities in the PUD are tight. All of the developers attempt to get the maximum of the range. The Commission has expressed concern about these densities. If there is a preserve, they will put more units in the PUD. Commissioner Bradley asked if there is another way to provide incentives because environmentally-sensitve land and higher densities do not fit together. Mayor Taylor and Vice Mayor Jaskiewicz were not in favor of tying the densities to the preservation, and Mr. Dubb recommended eliminating the policy and adding a policy to establish an incentive. Consensus There was a consensus of the participants to investigate deleting the density and establishing an incentive, Policy 4.3.10 "Within one year of Plan adoption, the City shall have prepared a program for the preservation of "A" rated sites. This program shall be coordinated with property owners and developers of "A" rated sites." Ms. Heyden explained that this issue is tied to the issue raised by Mrs. Rossi. Mrs. Rossi 6 MEETING MINUTES JOINT CITY COMMISSION/PLANNING & DEVELOPMENT BOARD E. A.R. OF THE 1989 COMPREHENSIVE PLAN BOYNTON BEACH, FLORIDA MAY 13, 1996 said the sites Should not be "A" rated. They should be a Florida native habitat because there is very little left. If it is Florida native habitat, there is no need to rate it "A", "B", or City Manager Parker advised that when we calculate the 25%, it is of the area that is still natural. At some point, all of the areas will erode down to zero. Mrs. Rossi pointed out that even the "A" rated sites have exotics. If they are not removed, the area will degrade to zero. Mrs. Rossi would like all of the sites treated as Florida native habitats. Once the exotics are removed, native plants should replace them. Ms. Heyden suggested that a study be made to reevaluate the ratings. Ms. Papandreas recommends in the Plan amendments, that we take the "A" rated sites and on those that have not been developed and are not public ownership, that we seek interlocal agreements toget preservation status on the property. Consensus There was a consensus of the participants to follow Ms. Heyden's suggestion. Obiective 4.4 "The City shall, to the maximum extent feasible, protect all remaining areas of substantial native upland and wetland vegetation and eliminate undesirable exotic tree species." Recommendation: The comment in the recommendation column is that the "objective was achieved through the adopted LDRs. Retain objective, revise policies to reflect ongoing procedures. Consider deletion of policies to develop program for removal of exotic species, Consider setting minimum size of five acres for preservation parcels," Ms. Hoyden advisec~ that the last sentence of the recommendation will be removed. She requested feedback relative to the policy on the removal of exotic species. The intent was that all exotics on all properties be removed. City Manager Parker advised that $10,000 is included in the budget every year for the removal of M61aleuca trees. However, the $10,000 gets cut every year to balance the budget. The City receives many requests for the removal of Melaleuca trees; however, our policy has been that if the property owner has the tree cut down, the City will haul away the tree stumps and branches. The City Forester then goes out and paints the stump with a non-growth chemical so that the tree will die. In 1990, a certain radius from City Hall was done. Nothing has been done since then. The City has cleaned up all of its park sites and d[ainage sites. MEETING MINUTES JOINT CITY COMMISSION/PLANNING & DEVELOPMENT BOARD E. A.R. OF THE 1989 COMPREHENSIVE PLAN BOYNTON BEACH, FLORIDA MAY 13, 1996 Mr. Rosenstock feels it is absurd for the City to implement a program of removing rVlelaleuca trees and Australian Pines which offer shade, and not implement a program to replace them. Doing one thing without the other is useless. Mayor Taylor feels that if the overall goal is to get rid of exotic species, this policy should remain in the Plan. He felt this would be a great program if the City was going to replace the trees. However, we can continue with the program that we now have in place. Mrs. Rossi explained that consideration has to be given to the fact that Melaleuca is very evasive, as is Australian Pine. Consensus There was a consensus of the participants to retain the current policy. Policy4.4.2 "Subsequent to Plan adoption, modify the land development regulations such that outright preservation of existing, non-exotic trees on any existing vegetated site shall be preferred over 'cut and replace' preservation techniques." Ms. Heyden said this policy ~s in the LDRs, and is very weak. Mr. Hallahan has been able to "twist people's arms" to get them to replace every existing tree that is removed. HOwever, this has g~ven them an "out" to take down existing mature trees and replace them with small trees. Consensus There was a consensus of the participants to modify the LDRs to recognize that some trees are better for the environment than others, and set up different replacement requirements. Replacement trees of a reasonable equalivent number and size will replace those removed. Policy 4.4.3 "Subsequent to Plan adoption, the City shall continue to enforce and, where appropriate, improve upon existing subdivision or other development regulations which require shoreline vegetation buffer strips, restrict the amount or location of site clearing, maintain natural drainage flows and require the removal of on-site exotic tree species." At this point, City Manager Parker questioned why each policy was being addressed for detail. Ms. Heyden advised that the objective has not been met, and in order to implement the objectives, the policies must be reviewed. OF THE 1989 COMPREHENSIVE PLAN BOYNTON BEACH, FLORIDA MAY 13, 1996 revisions could not be made as we go through the Comprehensive Plan process over the next year. Ms. Papandreas offered to work with staff to get refinement on this objective. City Manager Parker pointed out that Ms. Heyden said it must be addressed at the policy level. Ms. Heyden said that reviewing the policy gauges how well we have or have not met the objective. The policies must be evaluated because the objective is very vague. City Manager Parker recommended not reviewing each subpolicy this evening. We can have a workshop just on conservation, and Kevin Hallahan can be invited to attend that workshop. Mr. Wische remarked that he thought this review was going to be something where the consultant would say most of what was in the Comprehensive Plan would go through, but there are a number of specific items to be addressed. The way this review is being handled, it could take months to accomplish something. Mr. Rosenstock agreed that it was his opinion that the consultant and staff were the experts. He thought they would be providing the advice; instead, they are seeking advice from the participants. Ms. Papandreas agreed that they were getting more detailed than necessary at this point. City Manager Parker feels the detail must come out of a workshop on each item. Those workshops could be advertised so that the Sierra Club and Audubon Society can attend. When the Housing Element is reviewed for detail, housing people will be invited. At this point, we should be deciding on whether to include or delete objectives we have not achieved. It is staff's responsibility to tell the participants which policies need to be amended. We can delete policies during the Comprehensive Plan amendment. Policy 4.4.4 "Subsequent to Plan adoption, establish criteria for requiring a buffer zone of native upland vegetation around wetland and deepwater habitats which are preserved, restored or recreated on-site. The buffer ~one may consist of preserved or planted vegetation but should include canopy, understory and ground cover of native species only." Ms. Heyden explained that this policy talks about buffer zones around wetlands and deepwater habitats which we do not require at this time. She asked whether or not the participants wish to revise this policy to reflect no enforcement of it. The City does not require Policy 4.4.3 or 4.4.4. Consensus There was a consensus of the participants to eliminate this policy. MEETING MINUTES JOINT CITY COMMISSION/PLANNING & DEVELOPMENT BOARD E. A.R. OF THE 1989 COMPREHENSIVE PLAN BOYNTON BEACH, FLORIDA MAY 13, 1996 Policy 4.4.6 "Subsequent to Plan adoption, the City shall modify the land development regulations to require native vegetation species to satisfy at least 50% of all site landscaping requirements as a conditon of development or permit approval." City Manager Parker advised that the City Forester follows this policy. Ms. Heyden said it is being enforced by what was ~n the E.A.R. Ms. Papandreas advised that the wording of this policy must be revised to reflect the ongoing procedures. Consensus There was a consensus of the participants to retain this policy. Policy 4.6.4 "The City shall join the "National Xeriscape Council" and shall fund, either individually or cooperatively, at least one demonstration project within the short term planning horizon." Consensus There was a consensus of the participants to retain this policy. Policv 4.6,5, "The City shall locally promote the Xeriscape concept through the distribution of desired vegetation species listings and the requirement for these vegetation species to satisfy at least 50% of all required site vegetation as a condition of development or permit approval." Consensus There was a consensus of the participants to retain this policy. Direction regarding certain "Recommended Plan Amendments" managing other agency sites for preservation via preservation agreements and improving environmental resources (page 4-10 of EAR). One of the 'ssues that came up in the Lake Worth Lagoon Estuary Study was the water quality concerns relative to the discharge of pollutants. Under Recommended Plan Amendments, there is a recommendation to develop and improve coordination with the TOwn of Ocean Ridge to help eliminate the discharge. l0 MEETING MINUTES JOINT CITY COMMISSION/PLANNING & DEVELOPMENT BOARD E. A.R. OF THE 1989 COMPREHENSIVE PLAN BOYNTON BEACH, FLORIDA MAY 13, 1996 Consensus There was a consensus of the participants to coordinate with the County and the Town of Ocean Ridge. 3. RECREATION & OPEN SPACE ELEMENT A. Overview of consultant findings (executive summary) No overview was required by the participants. Direction regarding the following objectives from the "Objectives Achievement Matrix" (pages 5-13 through 5-15 of EAR and pages 4-7 of staff comments) - obj 5.1, poi 5.1.2, obj 5.5, poi 5.5.2, poi 5.5.9, poi 5.7.1 Obiective 5.1 "The City shall improve and increase access to parks and recreational facilities, where available space exists, by providing adequate automobile parking, bike rack facilities, and handicap access to all existing and planned neighborhood and district parks operated by the City by the Year 2000." Recommendation: Objective achieved. Retain objective; reevaluate policy on shuttle, based on recent experience; retain policy for ICW access with extended date. In response to Ms. Heyden's question, City Manager Parker advised that a workshop meeting ~s scheduled for Thursday, May 30, 1996, relative to bus service. The meeting will be held with the City Commission, Palm Tran and the Senior Advisory Board. Ms. Heyden was advised that Palm Tran's route will go to the beach. Policy 5.1.2 "By the Year 2000, the City shall provide parking and bike rack facilities within all existing neighborhood and district parks." Ms. Heyden advised that we have not yet installed the bike racks. The Parks Department has no objection to it, but the general feeling is that the children will not use them. Commissioner Titcomb questioned whether or not a program exists to solicit support for underwriting the cost of bike racks from private sponsors. Ms. Heyden responded negatively, but pointed out that it could be done. l! MEETING MINUTES JOINT CITY COMMISSION/PLANNING & DEVELOPMENT BOARD E. A.R. Obiective 5.5 '"l'he City shall increase the provision of recreation facilities and open space by public agencies and private enterprise, and specifically require that future private, as well as dedicated areas, are developed and equipped to be at minimum (e.g., size, facilities, access) equivalent of a public neighborhood park." Recommendation: Objective achieved. Consider recommending preparation of a strategic park and recreation plan to guide park provision for infill neighborhoods. Ms. Papandreas said there were a few isolated areas where there were deficiencies in recreation and open space. Overall, the City set goals and met them. The City set a much more extensive set of goals than any other community. The few strategic areas can be looked at with a microscope. City staff is doing a good job. Policy 5.5.2 "Subsequent to Plan adoption, the City shall provide specific criteria within the Subdivision and Platting Regulations that guide the development and facilitation of private park areas and/or private recreation facilities that are used to satisfy the requirements for receiving 50% credit toward the public park dedication requirement. The criteria shall require that the needs of residents are met in accordance with standards contained in this element." Ms. Heyden said this policy ~s geared toward establishing criteria for private recreation amenities. At the present time, the City has no minimum square footages for clubhouses. The recommendation is to set a standard and implement a policy. Consensus There was a consensus of the participants to set minimum square footages for clubhouses. Policy 5.7.1 "By 1992, the City shall negotiate with St. Joseph School in an attempt to formulate, at a minimum, a policy regarding the temporary use of the School's recreation facilities by adjacent residents." Ms. Heyden advised that in discussing this with the Recreation and Park Department, they advised that they have been "skiddish" about getting into using the school on the theory MEETING MINUTES JOINT CITY COMMISSION/PLANNING & DEVELOPMENT BOARD E. A.R. OF THE 1989 COMPREHENSIVE PLAN BOYNTON BEACH, FLORIDA MAY 13, 1996 that the residents are using the school anyway. Therefore, the City has not been actively engaging in discussions with St. Joseph's School. Ms. Heyden believes the issue involves the fact that if this issue is raised, St. Joseph's School may want a contribution or maintenance of their facilities. City Manager Parker advised that it is easier with the public schools because we do reciprocal things with the School Board. Fees are paid by those who attend the private schools. Some of these fees go toward maintenance of the facilities. If we begin negotiating with private schools, they may want a certain amount of money for the residents to be able to use the facilities. Consensus There was a consensus of the participants to eliminate this policy. Direction regarding certain "Recommended Plan Amendments" - reduce standard for recreation and open space/park linkages (page 5- 16 of EAR). There are two recommended Plan amendments. The first recommendation is to reduce the standard for recreation facilities. We not only have levels of service for minimum park sizes and walking distance to the parks, we also set levels of service for each type of recreation and the amount per person. The recommendation is to delete this standard. When parks are developed, they are master planned based on the needs of the residents in the area. Ms. Papandreas explained that the recommendation is to delete them as mandatory, but that they be preserved as guidelines. The Recreation and Park Director feels the neighborhood needs take precedence over "cookie cutter" guidelines for park facilities. The acreage standards would remain the same. However, taking the different levels of service out of mandatory, but retaining them as advisory, puts them in the appropriate context to be used by staff. In addition, after a detailed accounting of public and private recreation, and a tabulation of how many people have access to each facility, it appears ali needs are being met. The second recommendation refers to urban open space and it suggests adding policies fo~ linear parks and pathways both publicly funded and as part of the private developments. Recommendation: This objective has not been achieved. Consider revising objective and policies to address delete numeric target and instead designate adequate sites at sufficient density/intensity ranges for housing. Ms. Papandreas advised that the policy requires us to look at homes for moderate income, Iow income, Very Iow income, and homeless. The City is specifically remiss, according to the 1990 census, in the area of 1,500 rental units. Mr. Rosenstock feels that until he can be shown hard numbers as to how many people in the City of Boynton Beach in each category need the housing, and how many units are built and in the planning stage, no decision can be made. He does not want to provide housing for people outside the City of Boynton Beach. Ms. Papandreas pointed out that the State realizes that all of the cities in Florida are having difficulty compiling the data. The State has pending the delivery of an affordable housing assessment to every community. Mayor Taylor feels the City should decrease the numbers we anticipated building because our population has not expanded as was projected. Consensus There was a consensus of the participants to follow Mayor Taylor's recommendation to decrease the numbers. Policy 6.1,3 "Subsequent to Plan adoption, review the zoning regulations for the purpose of allowing increased density to encourage in provision of affordable housing." This policy refers to increasing density to encourage affordable housing. She explained that the City had a density bonus to address affordable housing. Consensus There was a consensus of the participants to eliminate this policy. Policy 6.2.6 "Subsequent to Plan adoption, establish procedures to permit, on a demonstration basis, mixed-use (i.e., commercial and residential) and other innovative reuses of dilapidated housing and vacant, substandard lots, which wi! result in the removal of substandard housing units in the NSA area." Obiective 6.3 "By the Year 2000, the City shall continue to implement a series of housing programs aimed at providing adequate housing and housing sites for Iow and moderate income persons available to meet their housing needs." This objective has not been achieved. Ms. Papandreas explained that the assisted housing issue will be more problematic for Plan amendment. It needs analysis. Policy 6.3.8 "Subsequent to Plan adoption, establish procedures to avoid locating public-assisted housing where it would over impact the area with subsidized households." Ms. Heyden advised that this policy was not codified. Ms. Papandreas said there are a number of ways to approach this. One of the ways is joimng with larger areas to form a consortium Another way is small siting. There are a number of ways to show a good faith effort and make a good faith effort but not jeopardize the security of the community. Policy 6.3.12 "Subsequent to Plan adoption, amend the zoning ordinance to a~[ow construction on nonconforming lots if the result will be the provision of well designed and affordable housing." Ms. Heyden said this policy is codified, but she has had several complaints about the City building infill housing on lots that were substandard. Mayor Taylor agreed that he received complaints relative to the fact that $60:000 homes have been allowed to be built next to $200,000 homes. Mr. Rosenstock recommended changing the Code to prevent this from happening. This policy should be eliminated. Ms. Papandreas recommended adding a dimension of neighborhood compatibility instead of deleting the policy. MEETING MINUTES JOINT CITY COMMISSION/PLANNING & DEVELOPMENT BOARD E. A.R. Policy 6.4.1 "Subsequent to Plan adoption, amend the zoning ordinance to allow mobile homes m all areas of the City where single-family detached dwellings are permitted, subject to the zoning regulations and other code requirements that apply to other types of single-family detached dwellings." Ms. Heyden advised that this policy has not been codified. The City allows mobile homes in all single-family zoning districts, but they must comply with the minimum lot area of the zoning district. Ms. Papandreas said there is a requirement to allow mobile homes in the community. This allows them. However, if the loopholes are kept tight, most mobile homes will not fit through any of them. She recommends that no change be made. Consensus There was a consensus of the participants to accept Ms. Papandreas' recommendation for no change to this policy. Objective 6.5 "Subsequent to Plan adoption, sites for group homes and foster care facilities should be allowed in residential zoning districts in accordance with applicable provisions of Florida Statute 89.372, FAC, to ensure that the needs of persons requiring such housing are met. ' This is similar to mobile homes. The City cannot prohibit them. We drafted a group home Ordinance with distance requirements in 1991. The Ordinance is now on hold. t? Obiective 6.6 "By 1995, uniform and equitable treatment for persons and businesses displaced by state and local government programs will be provided consistent with Sec. 421.55 Florida Statutues." Ms. Papandreas recommends revising this objective to state that displacement will be avoided if feasible. However, if unavoidable, benefits will be provided consistent with the applicable law. Consensus There was a consensus of the participants to accept Ms. Papandreas' recommendation. Policy 6.8.6 "Subsequent to Plan adoption, establish criteria and procedures to avoid concentrations of assisted housing." This policy has not been codified. The recommendation is to retain this policy. Direction regarding "Recommended Plan Amendments" - housing for very Iow incomes and affordable housing siting (Page 6-10), preservation of existing affordable housing, new job to housing link policy and interlocal agreements for adjacent communities to meet affordable housing (page 6-11), and new affordable rental housing policy (page 6-12). The federal government is pulling funds away from public housing projects because they now recognize that this type of housing does not work. Boynton Beach has two existing public housing projects. Consideration has to be given to what will happen to the residents of these housing projects, and what can the City do to ease the transition of the property so that it does not become a burden for the community. At this point, a pro-active position should be taken to ease the transition for the people in the neighborhood. Mi'. Dubb requested that the Ordinance mentioned in Object 6.5 be brought to the Planning ano Development Board for review prior to taking it to the City Commission. Consensus There was a consensus of the participants to include Lantana, Lake Worth, and Delray Beach. All cities in the Lake Worth Lagoon should be included. Policy 7.2.9 "Subsequent to Plan adoption, the City Commission will adopt resolutions that request seek support and funding from County, State, and Federal Agencies relative to e~ establishing a long-term water quality ~mprovement program for Lake Worth and the Intracoastal Waterway." This policy should be retained. Policy 7.3.2 "Subsequent to Plan adoption, investigate the feasibility of requiring all beach access locations to be converted to dune cross-over structures and for existing walk paths to be restored and vegetated." This policy should be retained. Policy7.4.3 "Subsequent to Plan adoption, modify the land development regulations to require that future hook-ups to the City water system be restricted to users that are either on or will hook-up within a time specific period to a sanitary sewer system." The recommendation is to bridge that gap and take an active stance. The City would work toward an intedocal agreement with Palm Beach County toward an emergency preparedness program. The City will work toward incorporating more local input and participation in the emergency planning and procedures. Consensus There was a consensus of the participants to reword this policy to recommend strengthening our local participation and get more local input. Policy 7.6.5 "Within three years of Plan adoption, the City shall develop a survey or local informational program to identify the location and magnitude of the coastal area population requiring assistance in evacuation." This policy will remain. Obiective 7.8 "Subsequent to Plan adoption, or when mandated by State Statute, protect, conserve and, where possible, improve local wildlife, coastal wetlands, estuaries, coastal barriers and marine habitats." This objective has been partially achieved; however, not all of the LDRs have been modified. Consensus There was a consensus of the participants to retain this objective. Policy 7.9.1 "The City shall develop by June 1991, a master plan that includes additional shoreline access and boat ramps at the Intracoastal Waterway site recently approved for acquisition." Consensus There was a consensus of the participants to delete this policy. Policy 7.9.2 "The City shall prepare a master plan of Jaycee Park that increases by 1996 public use and access to the Intracoastal Waterway, subject to lease restrictions." .Consensus There was a consensus of the participants to reword this policy to indicate that this area belongs to F.I.N.D. Policy 7.9.3 "Subsequent to Plan adoption, the City shall establish procedures to investigate the feasibility of joint utilization of Palm Beach County Parks at South Lake Worth Inlet and Gulf Stream." Mayor Taylor pointed out that we already utilize these parks. Ms. Heyden will investigate this situation with the Recreation and Park Department. Policy 7.9.7 "Cognizant of impacts to established uses, the City shall subsequent to Plan adoption, establish criteria for marina siting and to give priority to development plans which increase public interaction with the waterfront. The City shall consider developing performance standards which guide the review of proposals in this respect." Ms. Heyden advised that a study was done by the Treasure Coast Regional Planning Council, which went to the County, but has not yet been adopted. With regard to marina development, the number of slips would be restricted to 50. Ms. Heyden recommended retaining this policy, and addressing it at a later date. Mayor TaylOr advised that he wants to come back to this issue of marina siting. Policy 7.11.1 "Within five (5) years, the City shall develop a post-disaster redevelopment plan for establishing construction criteria and siting requirements for use in redevelopment of existing developed properties. This effort would include a review of the coastal construction building code, the current flood protection Ordinance, and include criteria to distinguish between immediate repair and long-term redevelopment." Consensus There was a consensus of the participants to retain this policy. Direction regarding certain "Recommended Plan Amendments" emergency shelters and local emergency management capacity (page 7-12) and marina siting criteria (page 713) With regard to Pages 7-12 and 7-13, Regional Goal 4.3 of the Strategic Regional Policy Plan relative to safe shelter should be eliminated. Policy 8.4.1 "The City shall continue to make public school recreation areas accessible to the public by including future schools within the Community School Program, and negotiate with the appropriate officials to gain public use of those public facilities currently closed to public (after-hour) use." Consensus There was a consensus of the participants to retain this policy. Policy8.7.2 "The City shall, by 1991, renegotiate the expired utility service agreement with the Town of Ocean Ridge. Renegotiations should be contingent upon reaching a consensus concerning the use of the City's public sewer system." Mr. Rumpf advised that a utility service agreement with the Town of Ocean Ridge has been renegotiated, and the agreement is good for 23 years. Objective 8.23 "Through establishment of coordination mechanisms with the Bethesda Healthcare CorPoration, the City will inform them of the growth plans of the City, and if necessary, the major factors influencing growth. From the coordination, the City will become aware of the Corporation's needs and concerns." Ms. Papandreas said this objective has been achieved, but there should be increased cooperation for a growth center on the east side of 1-95. A.R, OF THE 1989 COMPREHENSIVE PLAN BOYNTON BEACH, FLORIDA MAY 13, 1996 Direction regarding certain "Recommended Plan Amendments" - extension of annexation boundary (page 8-5) Ms. Papandreas advised that the Plan currently contains a reference to Lawrence Road as an interim annexation limit. It is suggested that the annexation boundary be extended so that there is recognition that the City has exceeded that goal. Commissioner Titcomb reported that during the Vision 20/20 Conference, the feelings were that anneXation should be taken to the levy. They wanted this done to prevent a City like Boca Raton from coming up north and annexing to our boundary. Ms. Papandreas does net believe that DCA would approve annexation past the service area. She recommends annexing to the maximum utility service area. Mr. Dub6 recommends extending the boundary to the Turnpike. Consensus There was a consensus of the participants to extend the boundary to the maximum service area. 7. CAPITAL IMPROVEMENTS ELEMENT A. Overview of consultant findings (executive summary) Ms. Papandreas explained that in the Capital Improvements Element, the Plan reproduced approximately 35 objectives that were contained in other elements. By putting these objectives at the front of the Element, it takes away from the policies and objectives that are specific to Capital Improvements. Ms. Papandreas' initial recommendation was to delete the duplicated objectives. However, if the City wishes to maintain them in this Element for reference, they should be moved to the back of the Element and include them as an appendix. The eight or ten recommendations which are specific to Capital Improvements should be at the front of the Element. Obiective 9.C.7 "The City shall, by 1992, attempt to utilize private recreation facilities within the Neighborhood Planning Areas that are projected to have unmet future park and recreation facility needs (Areas #11, #15, and #17)." Ms. Heyden advised that this objective is achieved on an ongoing basis. The recommendation is to delete it at this point because it is duplicated in 5~7. Policy 9.D.1.3 "On an annual basis, the City shall monitor and evaluate the Capital Improvements Element and reaffirm the City's Capital mprovement Program in conjunction with annual budget deliberations and adoption." Ms. Papandreas said the City will readopt the Capital Improvement budget each year. The Capital Improvement Element is intended to be reviewed and renewed every year. This has not happened in Boynton Beach. As time goes by, the names of projects mutate. The project years slide and the dollar amounts change. The difficulty is coming in years later and trying to track the expenditures from what was originally planned. Ms. Papandreas recommends that the City keep closer coordination from year to year. Consensus There was a consensus of the participants to retain this policy. Policy 9. D.5.1 "Subsequent to Plan adoption, the City shall annually update the Five-Year Capital Improvements Program and accompanying Capital Budget and submit to Commission a finalized Capital Improvements Program Budget prior to January 1st of each calendar year."
