Minutes 11-18-96 MINUTES OF THE SPECIAL CITY COMMISSION MEETING
HELD IN THE LIBRARY PROGRAM ROOM, BOYNTON BEACH, FLORIDA,
ON MONDAY, NOVEMBER 18, 1996, AT 6:30 P.M.

CALL TO ORDER
Mayor Taylor called the meeting to order at 6:40 p.m. He announced the purpose of this
meeting to be the consideration of additional applicants for the position of City Manager.
Mr. Donaldson was instructed to review the resumes again in an effort to bring back
additional candidates. He did phone interviews with seven individuals and forwarded
copies of the resumes of three additional candidates. In addition, he provided the resume
of Kerry Willis, the former manager from Lake Worth.
Dennis Kelly
Mr. Kelly was originally in the group of ten candidates that were identified. Mr. Donaldson
feels the reason Mr. Kelly was in the second tier of candidates was related to the fact that
North Palm Beach is a smaller city of approximately 12,000 people, with approximately 100
employees. However, Mr. Kelly showed a great deal of ability. Mr. Kelly is one of the
finalists for the manager's position in Lake Worth.
James Shapard
Mr. Shapard is currently a Deputy City Manager in Joliet, Illinois. The organization there
is similar in size to Boynton Beach with 680 employees and six different unions. Mr.
Shapard was a manager for five years in another Chicago suburb. Mr. Donaldson
interviewed Mr. Shapard over the telephone. He seems outgoing, and ready for a
manager's job. Mr. Shapard is currently earning $72,400.
Thomas Melena
Mr. Melena is currently working as a consultant in the Minneapolis area. He had been the
Manager for seven years in Apple Valley which is a suburb of Minneapolis of approximately
40,000. He left that position due to a parting of the ways. He has been doing consulting
work and decided to work on his Ph.D. He was sent to Haiti as a UN advisor as part of his
U. S. Army Reserves duty. Mr. Donaldson spoke with him over the telephone, and spoke
to others who know him well. Those people speak highly of him.

desires, arrangements can easily be made for them to be interviewed.
· The four candidates can be brought in for interviews.
· The position can be readvertised and Mr. Donaldson can come back in January.
Vice Mayor Jaskiewicz supports Mr. Donaldson's suggestion to interview the candidates
who are located in the Florida area. This process would be less costly. In addition, she
feels Florida experience is a bit of a priority and should count for something.
Mayor Taylor asked for the Commissioner's opinions on whether or not they would be
interested in interviewing any or all of the four candidates recommended by Mr. Donaldson.
Commissioner Tillman said he is not willing to entertain any of them since this group was
already eliminated. Interviewing these candidates will be a violation of the process. He
feels going back into this group is fruitless. In his opinion, if the job is to be readvertised,
this City needs a new consultant.
Vice Mayor Jaskiewicz explained that she just returned from the Legislative convention in
Tampa. There were many city managers and elected officials there from ail over the State.
She discussed with them the selection of a city manager for Boynton Beach, and she
learned that this is not a unique situation Boynton Beach is experiencing. In many cases,
interviews were conducted up to five times before a final selection was made. In addition,
it is not unusual to have differences of opinion among the Commissioners because each
Commissioner has different priorities. However, all Commissioners have the best interest
of the City at heart.
Commissioner Bradley did not feel any of the four candidates presented this evening will
· be an excellent candidate. Although we had a good process, we could not capitalize on
it. Therefore, he recommends redoing the process.
Vice Mayor Jaskiewicz recommends eliminating the first five candidates that were already
interviewed. However, she suggests giving these candidates an opportunity to be heard.
During the selection, the Commissioners did not have an opportunity to discuss all of these
candidates. Some of the candidates that were interviewed were not the first choices of
some of the Commissioners.
Commissioner Bradley feels it is Mr. Donaldson's opinion that Mr. Kelly is the best of the
remaining candidates. However, in Commissioner Bradley's opinion, because Mr. Kelly
comes from such a different community, he is not a strong candidate.
Vice Mayor Jaskiewicz pointed out that none of the candidates matched exactly what each
Commissioner wanted.

Commissioner Tillman feels the major problem involves the fact that the Commissioners
did not have specific standards and objectives that clearly defined what all of the
Commissioners agreed on. He wants to be certain that when the Commission goes
through this process again, there are clear objective standards to base the selections on.
If those guidelines are followed and each candidate is judged by those guidelines, personal
preferences will not come into the process. If that is not done in the future, the
Commissioners will find themselves in the same situation.
Vice Mayor Jaskiewicz explained that the Commissioners established two pages of criteria
with regard to education, experience and what was necessary in management style and
personal traits. Mr. Donaldson used that criteria. Perhaps the Commission was not
specific enough.
Commissioner Titcomb realizes that all of the Commissioners will have preferences. The
discomfort seems to be that the engagement of the procedure was flexible and changed
in process. The public is hoping that the Commission will have unity and consensus in
what is being done, and it is important for all of the Commission to agree on the rules of
the process so that the final choice is not made on a split decision. The final decision
should be a unanimous decision. Commissioner Titcomb is uncomfortable selecting one
of the four candidates recommended this evening. In addition, he does not feel anyone
will come to work for this City unless support of the entire Commission is fodhcoming. He
reminded the Commissioners that two weeks ago, the top candidates were voted down.
It is Commissioner Titcomb's opinion that we should look for new candidates since the
Commissioners were not able to reach a consensus.
Vice Mayor Jaskiewicz stated that she would have liked the Commissioners to have been
able to sit around a table and hash this out. That is not possible because of the Sunshine
Laws. She would have liked to hear what the other Commissioners felt were the strengths
and weaknesses of the candidates. Vice Mayor Jaskiewicz does not feel enough went into
the selection of a candidate for a position as important as city manager. Not one candidate
is ideal; however, the shortcomings must be weighed.
Mayor Taylor pointed out that he sees things in the resumes tonight that he did not even
see in the first five candidates. Some of these candidates have been successful in other
areas. He would be interested in talking to some of them. It is obvious, however, that
there will not be a consensus. Therefore, it would be necessary to look elsewhere. Mr.
Donaldson did his job by bringing 60 names to the Commission. He identified the people
he thought we were looking for. It is now the Commission's responsibility to hire a city
manager. He does not feet the Commission should get hung up on the process. It is
possible to set up criteria, but he is not sure he wants to be that structured. He feels that
sometimes it is necessary to go with a "gut feeling". Mayor Taylor reiterated that he has
gone through this many times. This is not new to him.

The comments from the audience were as follows:
· Why is Mr. Turner not qualified to run the City of Boynton?
You brought in four more candidates tonight, but I did not hear you include the
remaining two top candidates from the last meeting. What that means is that there
really are six candidates tonight. In addition, the professional was paid $20,000 of
our tax dollars, and he tried to do the best job he could do. Will additional tax
dollars be spent to get more people? Also, if the procedure or process is changed
again, what assurance will we have that once you make a selection, down
midstream you will not change the rules again?
There were three top candidates. The first one did not get the job and the other two
were not offered the job and are not being considered. Have they lost their
qualifications and skills? Will you change the process every time you do not get the
candidate you want? Why are you choosing a new process? What you are doing
is constantly contaminating the process.
I have a question about the selection of Carrie Parker when she was chosen. When
Scott Miller left, did you go through this process?
Commissioner Bradley explained that the Commission offered the job to her based on her
experience and knowledge of the job. She had been the Assistant City Manager here for
many years.
Someone from the audience pointed out that the Number 2 candidate was eliminated
because he had not been a city manager; however, Ms. Parker was never a city manager.
Vice Mayor Jaskiewicz explained that the most important reason why she eliminated Mr.
Turner from the selection process was the fact that while he was serving as an assistant
city manager, the city manager position became available. Mr. Turner applied for that
position and was one of the five finalists. His interviewers did not feel he was ready for the
position of city manager.
· Why is Dale Sugerman not being selected as city manager?
Mayor Taylor advised that Mr. Sugerman did not apply for the position.
· Why did we go through a nationwide search when you want to consider only people

who have had experience in Florida?
Mayor Taylor said that is not the truth. The Commissioners would like the fact that a
candidate has Florida experience, but the total package is reviewed. The Commissioners
went through one-on-one interviews, group interviews, and social settings to select the
candidate. The Commission did not focus on one category only.
The reason Mr. Turner was not chosen in his town was not stated. Is it possible that
the selection process was contaminated? Therefore, there could be a lot of reasons
why someone is in the city and not selected as city manager. That is not reason
enough not to consider a candidate for Boynton Beach.
Why is the Commission now saying something was wrong with the process when
the position was already offered to one candidate?
Vice Mayor Jaskiewicz advised that none of the five candidates other than Mr. White
received the four votes necessary to place that person in the position of city manager.
Mayor Taylor said the Commission agreed to offer the job to one person. The Commission
never agreed to offer the position to the second, third or fourth candidate. The
Commission agreed to come back to consider the remaining candidates if the first choice
withdrew.
Before you made your announcement for city manager, did you have KSAs that you
were going to consider? You gave criteria to the consultant that you would use to
base the selection on. Once that was done, the consultant looked at all of the
candidates and chose the top ten. You felt these were viable candidates and they
were ranked. You offered the top-ranking person the position. The others are
equally qualified based on your KSAs. I have a problem with the fact that you had
ten and selected three. If the first did not work out, you offer the position to the next
person who met your criteria. What I am hearing is that you wanted the first person,
but there were some prejudices surrounding your second candidate. You refused
to even offer the position to those people. This is a democratic process. We are
looking for infinite wisdom. If all three candidates rejected the position, then the
process should begin again.
I have problems with statements that were made about unions. Who runs the City?
Do the people have a voice? He questioned whether the City could fire a union
member if that person was practicing racial slurs. This City Commission said they
were unified. A great deal of money was spent at Hutchinson Island, but not much
has changed. It seems like the same old process. He asked why the Commission
is not considering the third candidate.

Mayor Taylor explained that neither of the two remaining candidates had four votes. He
further explained that the fact that the Commissioners cannot agree on these candidates
does not mean the Commission is not unified. The Commission has not yet reached a
consensus on this issue. There are five Commissioners that have to work with the city
manager. No manager would want to work with a divided Commission. Mr. White
withdrew because he did not feel he had total support of the Commission. Mr. Turner was
not the Mayor's first, second, or third choice for the position. The Commission needs to
select the right person for the City, and the Mayor does not care about a process.
The Commission should be speaking for the City of Boynton Beach. This is not a
personal thing. The Commission is an institution designed to serve the population.
We do not like what you are presenting to us. We want you to reconsider your own
personal opinion, and come up with something decent and in order that is not
subjective to your own personal opinion. You need to have criteria for selection.
Everyday I receive calls from people in the community who are saying you are a
racist. Are you a racist?
Mayor Taylor advised that if people really knew him and his family, there would be no
reason to ask that question.
Last month, the Commission selected three people they wanted to consider. If you
knew then that you were not going to consider Numbers 2 and 3, and you were
going to change the rules in the middle of the game, why did you put their names
up on the board?
Mayor Taylor explained that the Commission would not have arrived at Mr. White's name
if they had not used that process.
In making the choice, you need to see who the people are who are interested in that
choice. The Commission needs to do what the people want them to do. You had
criteria to choose the top three. You either need to look at the two remaining names
or begin the process again. Coming up with other choices tonight is a poor
decision. These people were looked at once before. The citizens want a good city
manager. This is the first real test of the Commission to see if there is unity. The
Commissioners were urged to talk about this decision even if it takes hours. The
people will be here to hear those discussions.
· Did the majority of the Commission vote for the Number 2 candidate?
Mayor Taylor responded affirmatively, but explained that he did not receive the four votes
necessary to place him in the position of city manager.

We want you to do something with the other remaining selections. Because of a
personal thing that you do not like, you are going back to the drawing boards to get
more candidates. There are people who have already been ranked and
interviewed, and you are bound by the process you used to look at those two
remaining candidates.
I personally have a problem when it was first stated that we are going on this wide
search for candidates. When the person is not familiar with a city, it is a process in
itself for that person to become acclimated to the city. He questioned how many of
the candidates were employees or ex-Commissioners of the City of Boynton Beach.
Mayor Taylor advised that none of these people applied for the position.
I am seeing the inability of the City of Boynton Beach to select a Black city manager.
This is an example of racism. In the history of this City, there has never been a
Black city manager.
By creating a new pool, this new pool is contaminated. What makes the other two
candidates less qualified because Number 1 did not accept the position?
I wonder when we are going to stop what we are doing and move this city forward.
It is time to stop the bickering and come to a consensus to move on. If we do not,
I see a lot of tension in our City because of racial discrimination. We are getting on
edge due to the Fire Depadment, Police Department, Information Officer, Mr.
Newbold, and due to any department in City Hall. African-Americans in the
community of Boynton are on edge. You have heard and read about St.
Petersburg. We are just looking for something to blow. We see these things
happening in the hiring process of the city manager. We are not pleased about
what transpired. We are here as a group to work together to move the City forward.
What is a good plan so that the next time we do this, we will give everybody an
equal opportunity? Friday is Ms. Parker Hill's last day and we have not selected an
interim city manager. People are looking at us and wondering what we are doing
here. Every department in the City is having insurmountable problems. There are
rumors Mr. Turner accepted another job. I wonder if he would accept the job if you
were to reconsider him.
Mr. Donaldson advised that he spoke with Mr. Turner today. The City Manager in
Longview, Texas had a stroke last week and will not be able to return to duty for six
months. Mr. Turner will be appointed as the acting city manager with a raise his salary for
at least six months.
When the President of the United States dies~ the Vice President steps up and
takes over. I have known two or three city managers to leave Boynton Beach. You

have an assistant city manager. I do not understand why he cannot step up. Will
he always be an assistant city manager?
More than $20,000 of taxpayers' money has been spent to hire an overseer to go
forth and do what is necessary to come up with 60 or more names which were
published in the newspapers. Out of that number, you narrowed the list down to 10
names. Out of the 10 names, the Commissioners came up with five. The five
names were held in private until a vote was taken. You voted your choice. The
numbers went from five to four. Out of the four, one was picked and then
scratched. Another was picked and it fell through because there were not enough
votes. Now there are two names left. Your ratings were 8, 11, and 12. You went
from the bottom to the top with an 8 rating being your better choice. Now you are
stuck with an 11 and a 12. It seems like the last thing I understood is that you want
to give more tax dollars to find more names to add to the list. Why? These two are
the most qualified that were accepted. Now you are going to put the least qualified
ones back. You said you had the best. One man is Black and one is White. What
is the problem, or should I ask two of you if there is a problem in the selection of the
two men. I realize it is election time, and you need all of the help you can get. The
City of Boynton Beach needs help also. We do not need self-righteous leadership
to run the City of Boynton Beach. The Pledge of Allegiance says, "...one nation,
under God, indivisible, with liberty, and justice for all." We say the Pledge at every
meeting. Where does it fit in? God made us all. He didn't separate us. We
separated ourselves. Ask for God's help. Unless there is a change in City
government, there will be a lot of hurt people. You need to look beyond your
feelings for a cure for the City because there is a bad sore that hurts now, but will
really hurt later. There is a change coming. I will continue to pray for the City and
its leadership because somewhere somebody is left out and I am afraid it is God.
Without God, man is up the creek without a paddle because there is nothing we can
do without the power of God.
Vice Mayor Jaskiewicz feels the inference that God is not the most important thing in her
life or Mayor Taylor's life because they differ in opinion on who should be city manager is
a terrible statement. When she was elected with 73% of the vote of the City, she said she
would always vote in the best interest of the City. She asked God's help to do that, and
she asks Him everyday to help her live her life in a way that is pleasing to Him. To infer
that either she or Mayor Taylor is racist is hurtful. She worked over 10 years in the north
end to make it better. The direction that she, Mayor Taylor, Sid Rosen, Commissioner
Bradley, and Commissioner Matson moved in was done so to make a difference in the
City. That is the reason why goals were established. The biggest emphasis was directed
at the north end community. They insisted on community policing. They were insulted that
the Police force had only two or three minority officers. Twenty-four officers have been
hired in the Police Department since May of 1995. With regard to City hiring practices,
Vice Mayor Jaskiewicz asked Mr. Sugerman to provide a list which covers the period from

April of 1995 indicating how many minorities were hired in this City. In that length of time
only, 91 minorities were hired for this City. Countless hours have been spent marching in
the community, and organizing a Nuisance Abatement Board to rid this community of drug
dealers. Many of the people present at this meeting were not present at those marches.
She is insulted by the suggestion that she is a racist, and reminded everyone that racism
is a double-edged sword. She pointed out that one of the top leaders in this City's
administration is Wilfred Hawkins, who she has worked with for 12 years. He did not apply
for the position, nor did Dale Sugerman. As individuals, the Commission must find the best
candidates for the position.
Commissioner Tillman said a number of things happened this evening. He is hopeful that
at the end of this meeting, everyone will be able to leave here knowing that the
Commission will move in a direction which is better for the City. The City of Boynton Beach
is a diverse community. Commissioner Tillman has lived here since his birth 37 years ago.
He knows the back side of this City. He understands what the majority of the people are
speaking about. This City must realize it is diverse. Mention was made earlier about not
putting together a standard set of objectives for selection. The problem exists now
because there was no set of standards and objectives. He is afraid that when the decision
gets down to making the choices, we infer other areas and decide certain things are
missing. He does not want that to happen again. Rules can be manipulated, but feelings
cannot be changed. There is an undercurrent here. A subjective approach must be set.
Commissioner Tillman is not interested in going back into a pool that was already
eliminated. There is no sense in doing that. He feels it is time to move on and be willing
to come to the conclusion that mistakes were made. Those mistakes may have been
technical or judgmental, but that does not matter at this point. We must put aside personal
preferences and personal attacks. The Commissioners are chosen to represent the
governed, not themselves. Commissioner Tillman said he has never represented himself.
His interest is purely for the betterment of Boynton Beach. He wants to raise the standards
of everybody in the City.
Commissioner Bradley feels the pool of candidates is not good because this is a move
backwards. In addition, Mr. Turner's spirit will continue to emerge. He feels the City needs
to move forward and find another mechanism to get a pool of candidates. He pointed out
that when the vote for Mr. White came forward, Commissioner Tillman voted for Mr. White.
It would have been easy for him to vote for Mr. Turner. He voted in favor of a consensus.
Vice Mayor Jaskiewicz said Mr. White was not her first choice either, but she also voted
in order to reach a consensus. She pointed out that you do not eliminate someone on the
basis of just one thing. There were several factors involved in her elimination of Mr. Turner
as a viable candidate. Although Mr. White was not her first choice, all of his
recommendations were strong. She liked Mr. Turner personally and feels he is a man of
integrity, but she rated Mr. Smith higher than Mr. Turner. She would like to move forward
and would like to speak with Dennis Kelly.

Commissioner Titcomb pointed out that Mr. Turner was his first choice, and Mr. White
became his first choice based on the criteria and his powerful presence. Mr. Turner then
became his second choice. He has voted consistently to protect the process. He believes
in following the rules and finds it difficult to change the rules midstream. He knows that the
Mayor and Vice Mayor did not have Mr. Turner as their first choice. Mr. Wagner worked
his way into the top five. because Mr. Smith withdrew from the process. He believes the
right thing to do when the Number #1 withdrew was to offer the position to Number 2, and ·
se on down the line. Commissioner Titcomb realized that a super-majority vote would not
be achieved for anyone in this pool. He recommends looking to an interim situation to
allow the Commission to regroup and revisit the issue. He realizes that his duty is to work
with the Commission to find a candidate we can agree on.
Mayor Taylor said he does not have a problem with Commissioner Titcomb's suggestion
if the Commission cannot agree on any of the recommendations made by Mr. Donaldson.
He asked for direction on where the next group of candidates will come from.
Commissioner Titcomb felt that Mr. Donaldson has reached a level of frustration with the
process based on the criteria that was presented to him. Perhaps even Mr. Donaldson
would benefit from some breathing time to go back and look at the criteria and determine
where the loophole was in this process.
Mr. Donaldson stated that he is concerned about the ability of the Commission to find
someone they can agree on. He began this process believing that the five Commissioners
were uniform in wanting to move the community forward. In addition, there will be an
election in March for three Commission seats. This will be a concern to some of the
applicants. Mr. Donaldson does not believe that any of the existing candidates can be
agreed on. He recommends having additional recruitment. That recruitment should be
broad based and include candidates of all diversities. The job should be readvertised and
he can come back in January or February to see what kind of response is received from
the new recruitment. His biggest concern at that time will be that the candidates
interviewed may be concerned about the fact that the elections in March may result in
changes on the Commission. Mr. Donaldson also advised that he is committed to helping
the City find a City Manager. There is no additional charge for any additional work.
Vice Mayor Jaskiewicz questioned whether any of the Commissioners would be interested
in considering the two local candidates since there would be very little expense involved.
Commissioner Bradley felt it is necessary to have a cooling off period. The Commission
has been hard at work and failed, and the pool that was gathered did not work out. The
Commission needs to let it go and come back to it renewed and refreshed.
Vice Mayor Jaskiewicz reminded everyone that this is not a unique situation. Very few
cities select a city manager from the first group of candidates.

Mayor Taylor questioned whether the Commission will consider any of the sixty candidates
that have already applied. Commissioner Bradley feels anyone can reapply for the job, but
the Commission needs a new start. Mayor Taylor feels the five candidates already
interviewed should be eliminated so that the Commission does not get hung up again.
Vice Mayor Jaskiewicz also suggested that the Commissioners review the criteria again
so that if something is missing, it can be added now.
Commissioner Tillman suggested that Mr. Donaldson draft something that is more specific
in terms of what the Commission will be looking for so that people will not be waffling the
next time. He questioned whether the contaminated group will be eliminated in terms of
the readvertisement.
Mr. Donaldson said he will try to bring in a new group of people through advertising and
direct contacts. He will recruit people to apply for the job.
Commissioner Titcomb would not have a problem with anyone in the original group
reapplying under the new criteria. If they make the cut, they will be considered again.
Mayor Taylor has a problem with this because the Commission was not able to agree on
anyone the first time. Commissioner Titcomb feels that if they make the cut under the new
criteria, they should have the opportunity to work their way up through the pack again. He
disagreed with the statement that because someone was number 2 or 3 they are not viable
candidates. People wound up where they were because of a consensus.
In terms of criteria, Mr. Donaldson will write some things down on paper such as skills the
manager needs to have. The Commissioners can then rank the areas by importance. If
the job is to be readvertised, the ads wilt not appear until the first or second week of
December. Interviews can begin in January.
Commissioner Bradley did not have a problem with the process beginning in January with
interviews in late January or February.
City Manager Parker Hill recommended that the advertising dates be checked because she
believes all of the December dates have already been missed. Mr. Donaldson said the ad
for the ICM Newsletter must be in by November 20 for the December 9 issue. This
publication comes out every two weeks. The Datagram comes out every two weeks. Mr.
Donaldson will focus on the two-week publications.
Mayor Taylor does not personally feel a cooling off period is necessary. He realizes this
is a business issue. A comment was made that we are trying to do the best of our ability.

is too much being made about the Commission be divisive. The Commission is trying to

make a decision. This is an issue that needs to be hammered out.
Commissioner Bradley said there was a majority in a couple of instances, but because of
the 4-1 vote, a manager could not be selected. On one hand, we each operate individually
and independently. However, the people expect the Commission to operate as a group.
As a group, the Commission named the top three candidates. This is the area where there
is a great deal of passion. Members of the Commission feel it, as do the residents. This
is the reason why he recommends a cooling off period. In speaking with one of the
Commissioners from Miami, he learned that they recently went through a workshop where
people talk about how they are feeling about one another. He feels this is something this
Commission needs. He feels upset, and senses that others feel the same. He will
investigate further if the Commission would like more information on this issue.
