Approval of Minutes of February 19, 2003 Motion Mr. Foot moved to approve the minutes of February 19, 2003 with the amendment that on page 34, the case number be changed from 02-2685 to 02- 2682. Ms. Zibelli seconded the motion that carried unanimously. :[]]. Approval of Agenda Inspector Mike Melillo gave the status of the following Agenda items: Page l, Page 3, Page 7, Page 9, Page 13, Page 21, Case #02-2474, removed Case #03-128, removed Case #03-232, closed Case #03-310, removed Case #02-2590, removed Case #02-3210, removed Motion Ms. Zibelli moved to approve the Agenda as amended. seconded the motion that carried unanimously. Vice Chair Hammer Meeting Minutes Code Compliance Board Boynton Beach, Florida March 19, 2003 Following the motion, new information came to light and Inspector Melillo advised of two more changes to the Agenda: Page 11, Page 45, Case #03-0451, removed Case #02-2925, complied Motion Mr. Foot moved to accept the additional changes to the Agenda as noted. Chair Hammer seconded the motion that carried unanimously. Vice TV. Swearing in of Witnesses and Tntroduction. Tnspector Melillo called the roll. Chair DeLiso explained the plea system. Assistant City Attorney Tolces distributed a revised version of the motions to the Board members. The Recording Secretary administered the oath of truthfulness to all persons who planned to testify at the meeting. V. New Business A. Cases to be Heard Case # 02-3221 Property Address: Violation(s): Guy Estella 212 S.W. 10m Avenue SBC '97 Ed. 105,6 Red Tag from Building Division Inspector Cain reported that the property had originally been cited on December 18, 2002 for an inspection requirement for electrical and drywall and not having a permit for a re-roof. Service was accomplished by hand carry. Guy Estella, ].26 West South Atlantic Drive, Boynton Beach, explained that he was unable to get into the property due to a Restraining Order prohibiting him from doing so. He expected a hearing on the case in 3uly. He asked for six months. Inspector Cain indicated that Mr. Guy did not have to go on the property in order to pull a permit for the re-roof. Mr. Guy stated that he had gotten the permit but Inspector Cain believed that it was still open. The Board determined that there were no safety issues pertaining to the electrical work. 2 Meeting Minutes Code Compliance Board Boynton Beach, Florida March 19, 2003 Motion Vice Chair Hammer moved to table Case No. 02-3221 until 3une 17, 2003. Ms. Costantino seconded the motion that passed 5-2, Mr. Rossi and Ms. Zibelli dissenting. Case #03-130 Property Address: Violation(s): Wilner Paul 205 S.W. 10t~ Avenue Ch15-Art. ZX-15-120 (D) 1.D Install sod in bare spots. Inspector Cain reported that this property had originally been cited on 3anuary 23, 2003. The violation was discovered through a routine inspection. Service was accomplished by certified mail. Wilner Paul, 205 S.W. 10m Avenue, Boynton Beach, pled No Contest and requested a,0 days. ]Inspector Cain suggested sixty days because it was a corner lot and he needed to put in a sprinkler system and sod. Motion Based on the testimony and evidence presented in Case No. 03-130, Vice Chair Hammer moved that this Board find that Wilner Paul is in violation of Boynton Beach Code Section Chapter 15, Article TX-15-120 (D) 1.D, and moved to order that the Respondent correct the violations on or before May 18, 2003. The Board has considered the gravity of the violation, the actions taken by the Respondent, and any previous violations by Respondent, and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $25.00 per day plus administrative costs shall be imposed for each day the violation continues past May 18, 2003. Mr. Miriana seconded the motion that passed unanimously. Case #03-229 Property Address: Violation(s): Peter Stodolak 415 S.W. 9th Avenue FBC 2001 Ed., 104.1.1 Installing a new a/c without a permit. Red Tag. Inspector Cain reported that this property had originally been cited on .lanuary 29, 2003. Service was accomplished by certified mail. The violation was a referral from the Building Division. 3 Meeting Minutes Code Compliance Board Boynton Beach, Florida March 19, 2003 Peter Stodolak, 12867 Cocoa Pine Drive, Boynton Beach, pled No Contest and requested 45 days. He had applied for the permits and paid the penalties the day before the meeting. Motion Based on the testimony and evidence presented in Case No. 03-229, Mr. Miriana moved that this Board find that Peter Stodolak is in violation of the Florida Building Code 2001 Edition, 104.1.1, and moved to order that the Respondent correct the violations on or before April 18, 2003. The Board has considered the gravity of the violation, the actions taken by the Respondent, and any previous violations by Respondent, and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $25.00 per day plus administrative costs shall be imposed for each day the violation continues past April 18, 2003. Case #03-234 Property Address: Violation(s): Peter & Julie Stodolak 208 S.W. 7th Avenue FBC 2001 Ed. 104.1.1 and 104.7.5 Permit required; work before issuance of permit. Inspector Cain reported that this property had originally been cited on January 29, 2003 through a Red Tag from the Building Division. Peter Stodolak, 12867 Cocoa Pine Drive, Boynton Beach, pled No Contest and requested a,5 days. The contractor did not complete the job according to the current Code and needs to do additional ductwork. Motion Based on the testimony and evidence presented in Case No. 03-23~,, Vice Chair Hammer moved that this Board find that Peter and ]ulie Stodolak are in violation of the Florida Building Code 2001 Edition, 10~,.1.! and moved to order that the Respondents correct the violations on or before May 3, 2003. The Board has considered the gravity of the violation, the actions taken by the Respondents, and any previous violations by Respondents, and hereby orders that if the Respondents do not comply with this Order, a fine in the amount of $25.00 per day plus administrative costs shall be imposed for each day the violation continues past May 3, 2003. Ms. Zibelli seconded the motion that passed unanimously. Mr. Tolces mentioned that the violation of Section 104.7.5 had been left out of the motion. Vice Chair Hammer and Ms. Zibelli agreed to the inclusion of Section 104.7.5 in the previous motion. The revised motion passed unanimously. Case #03-370 Property Address: Violation(s): 3ean & Vena Meant 417 N.E. 2nd Street Chapter 15, Article ZX-15-120 (O) 1. Znc., Pt3-LDR, Ch 2.S.8A.S.B (13) Remove outside storage from yard and carport area. Get weeds out of rock driveway. Remove appliances. Water and fertilize yard. Inspector Laverdure reported that this property had originally been cited on February 7, 2003. The violation was discovered by a routine inspection of the neighborhood. Service was accomplished by certified mail. Vena Meant, 417 N.E. 2nd Street, Boynton Beach, pled No Contest and requested 30 days. She indicated that the garbage had been removed. Inspector Laverdure agreed that the garbage had been removed but noted that the Respondent still had to remove the weeds from the driveway and improve the yard by watering and fertilizing it. He also stated that a refrigerator was on the property. Ms. Meant stated that they planned to put the refrigerator out for the garbage pick-up on the day following the meeting. The Board determined that the refrigerator had the door on it and advised the Respondent that the door had to be removed immediately for reasons of safety. Mr. Foot asked Inspector Laverdure to verify that the door had been removed from the refrigerator. Add more shell rock or install a new driveway (permit required). ]inspector Pierre reported that this property had originally been cited on February 6, 2003. The violation was discovered through a routine inspection. Service was accomplished by certified mail. Mr. Patterson, 1020 N.W. 3r~ Street, Boynton Beach, explained that he had ordered sod and shellrock for the property but the deliveryman had to go to the hospital for a few days. He offered to show the Board the receipts and stated that there was another case on 532 N.W. 11th Avenue. Mr. Patterson asked for 30 days. Motion Based on the testimony and evidence presented in Case No. 03-365, Vice Chair Hammer moved that this Board find that T. & .lessie M. Patterson are in violation of the City of Boynton Beach Code Sections Chapter 15, Article :[X-15-120 (D). Patterson 532 N.W. 11m Avenue Chapter 15, Article IX-15-120 (D). Inc. Sod yard and remove all debris from property. Inspector Pierre reported that this property had originally been cited on February 6, 2003. The violation was discovered through a routine inspection. Mr. Patterson, 1020 N.W. 3rd Street, Boynton Beach, stated that his uncle was doing the work at this property but had to go to the hospital. He offered to show the Board the receipts for the 30 tons of sod and shellrock for both of the properties before the Board, including this one. Mr. Patterson asked for 30 days. Motion Based on the testimony and evidence presented in Case No. 03-366, Mr. Foot moved that this Board find that Thelmar and 3essie M. Patterson are in violation of the City of Boynton Beach Code Sections Chapter 15, Article TX-15-120 (D) [nc., and moved to order that the Respondents correct the violations on or before April 18, 2003. Sod bare spots and remove all debris from property including all tires. Car repairs are not allowed in a residential area. Inspector Pierre reported that this property had originally been cited on February 5, 2003. The violation was discovered through a routine inspection. Service was accomplished by certified mail. 7 Meeting Minutes Code Compliance Board Boynton Beach, Florida March 19, 2003 Leo Poole, :t970 N.W. :I~ Street, Boynton Beach, pled No Contest and requested 30 days. He stated that the notices had been sent to the wrong address. Motion Based on the testimony and evidence presented in Case No. 03-367, Vice Chair Hammer moved that this Board find that Leo V. Poole is in violation of the City of Boynton Beach Code Sections Chapter :15, Article IX-:15-:120 (D) Inc. and Part 3 of the Land Development Regulations, Chapter 2, Section 5.D.:1. and moved to order that the Respondent correct the violations on or before April :18, 2003. Remove all auto parts from property. ]Inspector Pierre reported that this case had originally been cited on February 6, 2003. The violation was discovered through a routine inspection. Gilbert Sanchez, 5:~4-5:t6 N.W. ~1~ Avenue, Boynton Beach, pled No Contest and asked for 30 days on the sod. He stated that the vehicles had been removed. Mr. Patterson, 1020 NW. 3rd Street, Boynton Beach, pled No Contest and requested 30 days. Mr. Patterson spoke on behalf of his mother, Thelmar Patterson. Remove all trash and debris in back yard. 9 Meeting Minutes Code Compliance Board Boynton Beach, Florida March 19, 2003 :Inspector Pierre reported that Mr. Hack was originally cited on February 10, 2003 as a result of a citizen complaint. Service was accomplished by certified mail. Solomon Mack, 222 N.W. 12th Avenue, Boynton Beach, stated that he had moved the lawn mowers and all trash from the property. He requested 30 days to completely finish the job. Motion Based on the testimony and evidence presented in Case No. 03-411, Vice Chair Hammer moved that this Board find that Solomon Mack is in violation of the City of Boynton Beach Code Sections Chapter 15, Article IX-15-120 (D) Inc. and moved to order that the Respondent correct the violations on or before April 18, 2003. Ch23-Art ii.O, SBC '97 Ed 104.1.1, and 3401-6. Inspector Webb reported that this case had complied and should be dismissed. Motion Ms. Costantino moved to dismiss Case No. 00-3284 at the request of the City staff. Vice Chair Hammer seconded the motion that passed unanimously. Case #02-1742 Property Address: Violation(s): Scott & 3oan Kessler 1114 N. Federal Highway SBC '97 Ed. 104.1.1 and 3401.6 See Don 3ohnson 11/13/00 memo for violations. 10 Meeting Minutes Code Compliance Board Boynton Beach, Florida March 19, 2003 Inspector Webb stated that the City's Certification Team cited this property on 3uly 11, 2002 as a result of an unannounced inspection. Service was obtained by certified mail. The building has one business tenant. The City will not license any further businesses until the violations discovered in the inspection have been resolved. Inspector Webb stated that there had been 20 violations originally and 19 of them were corrected. They had made progress on the outside of the building. .loan Kessler, 6:L74 Balmy Court, Boynton Beach, owner of the commercial property introduced her tenant. Ms. Kessler pled No Contest and requested 90 days to complete the work. Bill Ruggero, 3760 Learwood Drive, Loxahatchee, introduced himself and offered to answer questions. Mr. Ruggero stated that Don Johnson and Scott Blasie had done a reinspection of the building. At that time, occupational licenses were reissued. The only outstanding violation is the firewalls between each unit. They had gotten estimates from contractors to extend the partition walls up to the ceiling and make them into one-hour firewalls. There is also one wooden door that needs to be replaced with a one-hour fire door. He believed that 90 days would be sufficient to complete the work. Mr. Blasie stated that the partition walls needed to come down or be permitted. On the 20-item punch list, items 1 and 10 had not been satisfied. He had been advised that the partitions would be taken down. To his knowledge, the other 18 violations had been satisfied. These items need to be rectified through the Building Department. Motion Based on the testimony and evidence presented in Case No. 02-1742, Mr. Foot moved that this Board find that Scott and .loan Kessler are in violation of the City of the Standard Building Code 1997 Edition, 104.1.1 and 3401.6, and moved to order that the Respondents correct the violations on or before .lune 17, 2003. The Board has considered the gravity of the violation, the actions taken by the Respondents, and any previous violations by Respondents, and hereby orders that if the Respondents do not comply with this Order, a fine in the amount of $25.00 per day plus administrative costs shall be imposed for each day the violation continues past .lune 17, 2003. The Respondents are further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for reinspection of the property to verify compliance with this Order. Ms. Costantino seconded the motion that passed unanimously. 11 Meeting Minutes Code Compliance Board Boynton Beach, Florida March 19, 2003 Mr. Tolces requested that Inspector Webb ensure that a copy of Mr. Johnson's memorandum pertaining to this case was included in the permanent record. (A copy is attached to the minutes. Case #02-2724 Property Address: Violation(s): Delorise B. Lester 199 N.W. 21~ Avenue Ch15-ArtiTX-15-120 (D) 1. :Inc. and 15-16 of the B.B.C. of Ord. Remove all trash and debris. Sod bare spots. Remove abandoned vehicle. House number required on building. Inspector Webb reported that this property was originally cited October 18, 2002. The violations were discovered through a routine neighborhood inspection. Service was accomplished by posting. Cynthia Cooper spoke for her mother, Delorise Lester, who was unable to come to the meeting. She stated that there was a number on the door but the screen door blocked it. They were trying to get rid of the vehicle. There is shellrock on the swale already. They sodded other areas. She requested 30 days to complete the work. A discussion ensued about asphalt and shellrock swales. It was determined that swales with these coverings were allowed if it could be established that they had been in existence prior to the City's Ordinance prohibiting them. It appears that this property fell into the acceptable category. Chair DeLiso stated that the shellrock rock swale area needed to be weeded out and freshened up. Motion Based on the testimony and evidence presented in Case No. 02-272a,, Vice Chair Hammer moved that this Board find that Delorise B. Lester is in violation of the City of 8oynton Beach Code Sections Chapter 15, Article IX-15-120 (D) Inc. and Section 15-16, and moved to order that the Respondent correct the violations on or before April 18, 2003. The 8oard has considered the gravity of the violation, the actions taken by the Respondent, and any previous violations by Respondent, and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $25.00 per day plus administrative costs shall be imposed for each day the violation continues past April 18, 2003. Ms. Costantino seconded the motion that passed unanimously. Case #03-093 Property Address: Violation(s): Coy & Michelle Adams 1940 N. Seacrest Boulevard SBC '97 Ed. 104.1.1 Red Tag from Building Department Inspector Webb reported that this property had originally been cited on .lanuary 21, 2003 as a result of a Red Tag from the Building Department. Service was accomplished by certified mail. Coy Adams, 1940 N. Seacrest Boulevard, Boynton Beach, asked for a clarification on the nature of the problem. :Inspector Webb stated that it pertained to an inspection that was required for an air conditioning system that Mr. Adams had installed two years ago. Mr. Adams stated that the air conditioning system was part of a contract with an agency called Stellar Home Improvement that did all the work. He assumed they took care of it. Mr. Blasie stated that Sam Dillingham from the Building Department had gone to the house twice and tried to make the inspection but no one was at home. Mr. Blasie asked Mr. Adams to contact Mr. Dillingham at the City to make an appointment for the inspection. Mr. Blasie recommended tabling the case for 30 days. Motion Vice Chair Hammer moved to table Case No. 03-093 until the Code Compliance Board meeting on April 16, 2003. Ms. Costantino seconded the motion that carried unanimously. Lien PenalL'v Certification (Tabled) Case #01-2554 Mafia R. Pejouhy 152 S.E. 28m Avenue Inspector Roy stated that this case had been tabled seven times to date. The original date of the violation was September 25, 2001 for an unsafe building/structure on the rear of Ms. Pejouhy's house. A Code Compliance Board hearing was held on November 21, 2001 and no one appeared. The Board set a date for compliance of December 21, 2001 and proposed a fine of $25.00 per day plus administrative costs. 13 Meeting Minutes Code Compliance Board Boynton Beach, Florida March 19, 2003 t4arta R. Pejouhy, 152 S.E. 28m Avenue, Boynton Beach, came to the podium to answer questions. She introduced her attorney, Bert Shapiro. Bert Shapiro, 120 S. Olive Avenue, Suite 301, West Palm Beach, stated that he had received a letter from the Faith-Based Community Development Corporation indicating that they would remove anything that was not permitted in the room in question and would do so on April 12. Inspection at 1114 N. Federal Hwy.. - Vacant Building 10. On November 9, 2000, I conducted an inspection for the Code Enforcement Response Team at the above location. My inspection revealed the following: I. The previous tenant was a BeauLy School. This tenant constructed numerous walls and installed electrical and plumbing without benefit of permits and inspections. Section 104.1.1 of the Boynton Beach Amendments to the 1997 Standard Building Code. The siding and soffit have either deter/orated or are loose on the perimeter of the building and need to either be replaced or properly fastened. Section 3401.6 of the 1997 Standard Building Code. Patch all holes in inter/or of building where insects and rodents can enter, nest and breed. Wall A/C tm/ts have been removed from the air conditioning can and the can now allows insects and rodents to enter the building. Section 3401.6 of the 1997 Standard Building Code. Electrical raceways have been removed and are lying on the floor. Electrical wires are sticking out &the wall. Wires need to be placed in raceways sealed. Section 3401.6 of the 1997 Standard Building Code. and raceways need to be Romex wiring is feeding A/C outlet. Romex is not allowed in a commercial establishment and needs to be removed. Raceway to supply A/C outlet needs to be legally permitted. Section 3401.6 &the 1997 Standard Building Code. Sinks, toilets and laundry equipment have been removed with open drain pipes allowing sewer gas to enter the structure. Permits and inspections required for removal of these fixtures. Ceiling in numerous areas shows signs of water damage. Roof leaks need to be patched and sealed. If value of roof repair exceeds $500, permit and inspections are required. This building, through unpermitted walls, has been broken up into vahous occupancies. Depending on the future use of each occupancy, minimum of 1-hour tenant separation walls will be required and additional restrooms may be required. In some of the restrooms where toilets have been removed, the toilet waste line has now been made into a floor drain without benefit of permits and inspections. There has been a 220 amp electhcal receptacle placed in the existing shower area, which must have been converted to house a washer and dryer. Receptacle must be removed fi.om shower area or shower area must be completely eliminated and permits will be required t© close offshower drain and shower faucet and for the installation of the 220 amp dryer receptacle. Section 104.1.1 of the Boynton Beach Amendments to the 1997 Standard Building Code. Open waste line on northeast comer of building at the exterior needs to be capped and sealed. Hot water heater has been installed using Romex, which is not allowed in a commercial building. Electrical supply shall be hard piped. Permits and inspections are required. Section 3401.6 of the 1997 Standard Building Code. Romex wiring running out of building at soffit on south side of building. This Romex shall be removed and whatever electrical circuit the Romex was supplying shall be hard piped. Permits and inspections are required. At the time of my inspection, it could not be ascertained what circuit this Romex wire supplied. Section 104.1.1 of the Bovnton Beach Amendments to the 1997 Standard Building Code. South side of building has an open junction box with wires visible. Junction box needs to be capped and sealed. Section 3401.6 of the 1997 Standard Building Code. Romex wiring is feeding into electr/c panel on the south side of the building. In a c.ommercial building, Romex cannot be used. Romex shall be removed and electrical · circuit hard piped. In conclusion, licensed contractors shall file applications, secure permits and receive applicable inspections for all unpermitted ~vork.
