Tnformational Items by Members of the City Commission Commissioner Weiland requested that the Commission direct staff to compile a report showing all parcels of property under 10 acres that could be annexed into the City. He knows of two properties that are contiguous and could be added to the tax base for the City. Mayor Broening asked Commissioner Weiland request to look at all properties that might Commissioner Weiland agreed. if he would consider expanding his have a future purpose for the City. Commissioner Weiland also referred to an item on kickboxing under Future Agenda Items. He said that there would be something coming to the Commission to show how this could be done legally and then the Commission could decide whether they wanted it or not. This would probably be the first meeting in May. He would like this matter to proceed in a timely manner so that the Commission could make a decision. Commissioner McCray invited everyone to the St. John's Missionary Baptist Church on Sunday at 5:00 p.m. for a production that was written by the pastor, Rev. Lance Chaney. Mayor Broening recommended that everyone read the new edition of City Visions that shows how the City works. There are articles on 9-1-1, how the water system works, etc. City Manager Bressner reported that the City has 30 boxes of donations to mail to our adopted military unit, D Company of the 101st Airborne. The cost to mail each box is $8.50 and he said that donations to help defray the cost of shipping would be appreciated. Vermeer Southeast Sales (LAAP 03-001), 1060 Wi ~[ndustrial Avenue - Request for relief from the City of Boynton Beach Land Development Regulations, Chapter 7.5, Article 11, Section 5.E, buffer requirements, to avoid the requirement to install trees and a continuous hedge along the east (rear) perimeter (Heard out of order) Commissioner Weiland explained that this property is located on West Tndustrial Avenue. At the property line and west of the railroad tracks, the CSX Railroad has a buffer of scrub oak and saw palmetto running along the property line as a buffer. Just east of the Vermeer property line, the City has two large utility lines. Tf this business would be required to install this buffer, they would have to move the buffer in 30 feet. The CSX is putting a double track in and the second set of tracks is not going to hinder the existing buffer. Motion Commissioner Weiland moved to approve this item without the contingency of having to replace the buffer in case the CSX removes their buffer. Vice Mayor Ferguson seconded the motion. City Manager Bressner explained that the CRA reviewed this matter and added the condition (should existing stand of landscaping within the railroad right-of-way be removed, the applicant shall be required to install a landscape buffer along the eastern property line as required by today's code), which staff does not believe is enforceable. TRG-Boynton Beach, Ltd. 743 N.E. 1st Avenue Request to amend the Land Development Regulations Chapter 2. Zoning, Section 6.F. MIXED USE ZONING DISTRICTS, TABLE 6F-1, Schedule of permitted principal, accessory and conditional uses TO INCLUDE residential, Single-Family, attached use as a permitted use in the Mixed Use-High Intensity (MU-H) zoning district (1sT reading of proposed Ordinance No, 03-015) Assistant City Attorney Tolces announced that this was a quasi-judicial matter and administered the oath to everyone who would be testifying. It was the consensus of the Commission to hear testimony tonight on this matter. Assistant City Attorney Tolces read proposed Ordinance No. 03-015 by title only. Dick Hudson, Senior Planner for the City, presented the request. The specific location where this would first be applied is the area that encompasses the site of the proposed Marina Village at Boynton Beach. The Land Development Regulations were amended on .lune 18, 2002 to adopt zoning regulations for the Nixed Use zoning districts. The major purpose for the amendments was to enable redevelopment efforts in the urban core of the Federal Highway Corridor redevelopment area. The central core extends from Woolbright Road on the south to the C-16 Canal on the north. The Nixed Use-Low district on the ends of this area allow both single-family detached and attached units as well as multi-family development. The Nixed Use-High allows only multi-family residential development. The site plan for the proposed Marina Village shows 12 townhouses along the south side of the north marina. Since the Marina Village is zoned Mixed Use-High Intensity, this code amendment would be necessary for the site plan approval. The Mixed-Use High Intensity zoning district encourages the most intense development allowed in the City, with residential density at a maximum of 80 dwelling units per acre, 85% lot coverage, and a maximum height of 150 feet. This district is a very small area, approximately 75 acres. The district was put in place to establish compactness and a critical mass of development and a population that supports the downtown as a destination area. [t was also to encourage building at greater heights than is allowed in other Townhouses are permitted throughout the remainder of the redevelopment Staff feels that if single-family attached dwellings or townhouses become a permitted use in the High :Intensity area, it would no longer serve to establish the critical mass that is necessary to ensure the success of the downtown. The change may also combine a residential use that is less compatible than the multi-family use in an activity center. Staff feels that there are sufficient areas elsewhere in the corridor where townhouse development is both permitted and encouraged and that the requested amendment is not necessary to provide a variety of housing types and price ranges. Staff also believes that placing townhouses between the Marina facilities, which typically attract people, would further lower the potential of the proposed Marina project as a pedestrian-friendly destination. Staff recommends denial. If the City Commission wishes to approve the request, staff recommends that it be a conditional use and that the number of units be limited to no more than five percent of the total residential units in any single development. Commissioner Weiland questioned how staff arrived at the five percent. Mr. Hudson said that staff recommends none; however, they feel that five percent is the maximum that could be put in place without weakening the overall density of a project. Bonnie Miskel, represented the developers of the project, The Related Group. She is a land use and zoning attorney and has done a great deal of land development applications within other communities' mixed-use projects. She is doing projects in West Palm Beach, Delray Beach, Boca Raton, and Ft. Lauderdale. In the central core areas of those cities, there are no limitations on the application of townhomes. They try to afford developers and owners the best opportunities so that the best and most creative projects come to them. Tn downtown Ft. Lauderdale, in a regional activity center, townhomes are a permitted use, without any limitations. The development community believes that the market will dictate what project works for a community. People moving to Florida today have different views of urban lifestyle than people who have lived here a long time. This request for a text amendment would allow diverse products in a Mixed Use-High classification. As far as placing population in this area to support existing and future retail services, she reminded the Commission that this project was previously approved for 282 units. Now, with the townhomes, there would be 350 units so this development would create critical mass and will encourage redevelopment in the downtown area. Meeting Minutes Regular City Commission Boynton Beach, Florida April 15, 2003 Brian Edwards, 629 NE 9th Avenue, supports this amendment. However, he wants it to go back to the CRA for much needed work. There should be a public parking partnership and general access to the area. Beverly Agee supports townhouses in the district. She believes that we need to encourage flexibility but we have a duty when we get to the site plan to look at the specifics and ensure that the public has a place to walk. Henderson Tillman, 54 Bentwater Circle and a CRA member, spoke as a citizen of Boynton Beach. Staff has not developed and defined a footprint of what these townhomes would look like. He felt that it behooves us to follow staff's direction and look out for the betterment of the entire City. Barkley Garnsey, 326 SW Ist Avenue, thought that there should be more time for staff to look at this proposal. ]~f the Commission allows townhomes in this district, it should be at least a conditional use. Public access and public parking should be provided. The City has made it attractive for developers by changing our zoning and height limitations. The developers should also make concessions. Ms. Miskel said that this is not about money, but about creativity and diversity. If the developers were concerned only with making money, they would not be proposing 12 townhomes. The question is should townhomes be permitted. Her client is only proposing 3.4% of their units as townhomes. They are not depleting the critical mass. They are increasing the number of residences that would be located downtown. .lorge Peres, Chairman of The Related Group, made a commitment to the Commission regarding public access. He explained that there would be no living space in the rear of the townhouses. There will be an 11-foot totally public access in the back of the townhouses and the public will be able to walk in the front where the parking will be located. City Manager Bressner said that by adding townhomes as a conditional use, it would allow the Commission to see how a townhouse development would interact with the land on a case-by-case basis. [t would give the CRA and the Commission an opportunity to review what works and what does not. If the Commission supports including townhomes in this district, staff requested that it be as a conditional use with a five percent cap. Meeting Minutes Regular City Commission Boynton Beach, Florida April 15, 2003 Vice Mayor Ferguson felt that we need to get started. There is mixed use with townhomes in all the other CRA areas and he saw no reason not to include them here. He thought they should be included as a conditional use but did not believe they should be limited to five percent. Commissioner Weiland agreed with the Vice Mayor. Although he was not sure about the cap, he felt that it might not really matter if we approve on a case-by-case basis. Commissioner McCray agreed. He did not feel that a five percent cap would make a difference. He also felt that the Commission should move forward as we have been waiting 20 years for this project. Commissioner McKoy was inclined to approve this as a conditional use but he was not sure about the cap. Mayor Broening was disappointed that there was no firm recommendation from the CRA. He knows that there are a lot of precedents for townhomes in the state and the country. They are acceptable in many places. He believes that a conditional use is good but he did not support a cap. Motion Vice Mayor Ferguson moved to amend the Land Development Regulations, Chapter 2 Zoning, Section 6.F. Mixed Use Zoning Districts to include townhouses as a conditional use. Commissioner Weiland seconded the motion that carried unanimously. Assistant City Attorney Tolces clarified that the Commission had just approved proposed Ordinance No. 03-015 on first reading with the change to conditional use. A break was called at 7:45 p.m. and the meeting reconvened at 7:55 p.m. IX. CITY MANAGER'S REPORT: A. Update on Heart of Boynton Project (Tabled to AprillS, 2003) Authorization for staff to apply for a HUD Section 108 Loan for the purpose of initiating Phase ! property acquisition in the Heart of Boynton Community Redevelopment Area (Proposed Resolution No, R03-058) ([ten? tabled to April ~, 2003) ('Items heard out of order) 10 Meeting Minutes Regular City Commission Bovnton Beach, Florida April 15, 2003 Motion Commissioner McCray made a motion to remove items A and B from the table. Mayor Ferguson seconded the motion that carried unanimously. Vice Commissioner McCray explained that the reason he had asked for the tabling was because he was receiving many telephone calls from District II citizens who were getting incorrect information. He wanted everyone to leave with a clear understanding of the matter. City Manager Bressner explained that about 18 months ago, the City received funding from the State Department of Community Affairs to prepare the Heart of Boynton Plan. The Plan was approved by the City Commission. It is an outline and a basic overview of some things that the City would like to explore. It is a plan but is not written in stone. We need input and ideas and are developing a mechanism to talk with citizens to get the best project for the community. This will be accomplished through neighborhood associations and churches. This Commission decided it was time to look at this area and provide incentives for redevelopment. Wilfred Hawkins, Assistant City Manager, said that we are at a milestone with the Heart of Boynton Plan. This presentation tonight is a significant point in the planning process. It is an on-going process and we want to hear from the citizens. The Heart of Boynton is the core area for the Community Redevelopment Area of the City and was the original CRA adopted in 1983. This area is the foundation for the existence of a CRA in the City of Boynton Beach. There must be some benefit for this area. The Plan was adopted by ordinance in December 2001 and went through two public hearings. The Plan can be revised. The purpose of the Plan was to benefit this area, to spur economic development, and improve housing and living in the area. Contrary to rumors, it is not to take people out of the area but to bring them back to the area. We must have people living there to support redevelopment. The City received a grant for $50,000 from the State and they are looking for us to bring this plan to fruition. The Plan has a residential component. To clarify rumors, there is no intent to slash and burn the community. We have a successful infill program that will continue. There are three geographic areas that we are looking at for redevelopment. They are: 1. The Cherry Hills housing complex - No one in the Housing Authority complex will be displaced. They must be placed in proper housing either in this City or in Palm Beach County. 2. The current Public Works facility on 9th Avenue - We have outgrown this facility and it is no longer compatible with this community. 3. The housing area to be placed next to Poinciana Elementary School. Meeting Minutes Regular City Commission Bovnton Beach, Florida April 15, 2003 The total redevelopment is geared to these three areas. The remainder of this community will receive infrastructure upgrades, utilities, lighting, sidewalks, and other amenities. The Plan is to be implemented in phases and will not be done in a short period of time. :In summary, Assistant City Manager Hawkins said that what we will be doing now is finalizing some ideas of what we want things to look like and acquiring some land in the target area of Martin Luther King, 3r. and Seacrest Boulevards. There will be criteria that must be met for developers to work in this area. We want to revitalize this area and have better social services. Part of the Plan is looking at rebuilding Wilson Center. Dan DeCarlo, Neighborhood Project Specialist, explained that when this Plan was adopted, they wanted to give the people in the neighborhood a voice. They did that with neighborhood organizations. Most of these neighborhoods that have organized have been meeting since last September or October and have been working closely with the Police Department, Code Compliance, and Public Works. The redevelopment must include the people who live there and we are working very hard to do that. Quintus Greene, Development Director, explained that his focus is on the implementation of the Plan. He requested that the City Commission authorize staff to apply for grant money to get the project done. He talked about the intersection of Martin Luther King, Jr. Boulevard and Seacrest Boulevard where there is a real opportunity to set the tone for everything else they plan to do. Staff looked at one block in each direction and found that there are assets there (e.g., Sara Sims Park, St. John's Missionary Baptist Church, and a magnet school) that could be enhanced. We have a community where young professionals come to church on Sundays but they do not live there. He questioned why they should not live in the neighborhood where they grew up. The City wants to create an environment where young professionals with children would want to live. The proposal is to acquire the properties, relocate the residents, clear the area, and redevelop it. On the east side of Seacrest to NE 1st Street, they are proposing a mixed use development of approximately 40-60,000 square feet of commercial, office, and retail space; 60-80 dwelling units; and parking for 150-200 cars. On the west side of Seacrest Boulevard in the southwest quadrant, they propose to redevelop Sara Sims Park as a passive neighborhood park. Tn the northwest quadrant, they propose to build a new single-family subdivision of approximately 25 homes in various price ranges. This mixed use is very consistent with the Plan. This area (Martin Luther King, 3r. Boulevard and Seacrest Boulevard) is the first phase for implementation of the Plan. 12 Meeting Minutes Regular City Commission B0ynton Beach, Florida April 15, 2003 Mr. Greene explained that staff was requesting authorization from the Commission to apply for funds from a federal loan program entitled Section 108 that would allow for property acquisition and relocation necessary to implement this aspect of the plan. We would be asking for up to a $3 million loan to do this. There would be no money coming out of the General Fund and the City would still be eligible to receive Community Development Block Grant funds. This loan program allows cities to borrow up to five times their Block Grant allocation and in our case that is up to $3 million. It allows for repayment over a period of 20 years. The security for the $3 million government guaranteed loan is the CDBG allocation. We can still receive the CDBG allocation every year. The payments on the loan can be made out of the Block Grant allocations or from the profits of the project. The interest rate is relatively Iow. This first phase of the project is expected to take approximately five years. The CRA will use its 'I'~F money to acquire non-residential properties and the City will use the Section 108 loan money to acquire residential properties. By using federal dollars, the residents get the benefit of the Federal Uniform Relocation Act. This means that if a homeowner's mortgage is paid off, the City will find them a new home without a mortgage. The City will buy their house and give them the difference between what they get for their house and what it costs them for a comparable house. Renters also receive benefits and they can go as high as $5,000. People with mortgages should be able to purchase other housing with no higher mortgage. Assistant City Manager Hawkins submitted letters of interest from local banks and developers. These are marked "Exhibit A" and are on file in the office of the City Clerk. He also explained that it is the intent for legitimate businesses to stay in the area. Whenever a developer comes in for a mixed use, they will be required to talk to the local business people. Rev. Sylvester Wright, Boynton Hill Church of God in Christ, 722 NW 2nd Street, was happy that something positive was about to happen; however, he had a concern regarding the illegal activities moving to the west. He felt that the area needs to be patrolled. Jewel Wright, 508 NW 11th Avenue, was glad something was going to get done. She requested that the City Commission authorize the funds for Section 108. The City made a commitment to the Plan and if the process does not move forward, there would be the continuation of the decline of the community. He supports moving forward. The next step would be to have a strong group to hold the City accountable. Mrs. 3. M. Lee, 407 NW gth Avenue, wants to see action and change. She said that her concern regarding long-time residents getting comparable housing was answered. Ms. Lee asked whether there was enough land to build 25 homes comparable to homes out west. Mr. Greene answered that there was. Erica Hammond, 418 NW 4th Avenue, said that she was a professional who currently lives in the neighborhood. She requested that the Commission vote yes to get this project underway. Rev. Anthony Reed, Pastor of St. Paul AME and resident of 239 NE 9m Avenue, wanted the Commission to approve the HUD section loan and keep the residents involved. He felt that it was fair to let the people and institutions that have taken an active role in the development of this community also be involved in its future growth and development. Annetta 3enkins, Sr. Program Director with Local Znitiative Support Corporation, said that they consider themselves good partners with the City, the CRA, and with non-profits in the area. She offered their support, commitment, and resources and urged approval. Elizabeth 3enkins, 711 NW 1st Street, stated that she is president of her neighborhood association that has been in existence about five years. She requested help. She asked that the Commissioner from District [! come to their association meeting. Mayor Broening told IVls..lenkins that she could count on all the Commissioners attending. Sarah Williams, 1331 SW 27th Avenue, is the Director of the Boynton Community Forum Families and Friends Network. She applauded the efforts to make Boynton Beach better and to address the redevelopment issues. At the strategic planning sessions in 1997, two major problems were asked to be considered crime and unemployment. She felt that this was a great project; however, some things in the Plan need to be amended. Dr. Martha Meeks Light, 225 NW 6th Avenue, spoke for 12 people that could not be present tonight. There is a lot of tension because of misunderstanding or misinformation about this Plan. They need something in writing because at different meetings, different things have been said. There are people in that area who do not want to relocate, not because of financial reasons but for emotional reasons. They would be leaving all of their surroundings. The majority are 55 years or older and are now within walking distance of their churches. She has seen the Plan and it looks good. She looks forward to a new Wilson Recreation Center but she would like to be living in the area and not be relocated. Before proceeding with Phase 1, she asked that the Commission remember the people it will affect and proceed with caution. Leonard Albury, 120 NE 8th Avenue and President of Boynton Terrace Neighborhood Association, said that they approve of this plan to get the funding; however, they want to see the right things being done and want to be involved with the program. He urged people to attend homeowners association meetings. David Fellows, 638 NE 9th Avenue, is the Vice President of ]:NCA and said that they look at the success of the Plan as being critical to downtown development. He offered :INCA's assistance. Commissioner McCray said that he has directed staff to obtain a list of all the presidents and vice presidents of homeowners associations in District [I and they are going to meet as a group. He thanked all the citizens for their input. Commissioner Weiland felt that we need to renovate the library. opposed to the fact that the Commission was only given one choice. However, he is Herb Suss is a member of the Library Board and he requested approval because they are on a tight time frame. Tt is a very vital service. Maryann Tara, 2637 SW Cranbrook Court and President of the Friends of the Boynton Beach Library, spoke in support of the expansion and renovation of the Library. Libraries are forever and this would be a proud legacy for all the citizens. Sean Fenton felt that this project should not be held up because of the money. He felt that the City could afford this project. Valerie Pleasanton, 235 SW 13th Avenue and Chair of the Library Board, said that we need to provide the Library expansion to go along with all the other changes in the City. Once the architect gets on board, the design could be altered. ]:n order to make the deadline, we need to get started. The money is already identified in the budget and she urged approval. Their condominium association received approximately $7,000 that they matched over two years. Before this program, the condominium was slowly decaying and now it is awakened. The homeowners recently voted for over $70,000 of improvements. He thanked the City for the program. Debby Coles-Dobay, Vice President of Old Boynton Estates Homeowners Association, thanked the Commission for continuing the program, l~t is very good for the community. Old Boynton Estates did some plantings and curbing, which not only beautified Old Boynton Estates but also surrounding communities. C,8, Proposed Resolution No. R03-068 Re: Accepting the City's Local Housing Assistance Plan (LHAP) for State Fiscal Years 03/04 - 05/06. These funds are for the continuation of the State Housing Initiatives Partnership (SHIP) Program Commissioner McCray said that some of the Commission went to Tallahassee to lobby for SHTP dollars. If we do not get the $600,000, we need to find money to fund this program. Commissioner Weiland related to what Commissioner McCray said. His concern was where we were going to get the money. We would have to either raise taxes or cut some programs. Motion Commissioner McKoy moved to approve proposed Resolution No. R03-068. Ferguson seconded the motion that carried unanimously. Vice Mayor C.10. Proposed Resolution No. R03-070 Re: Authorizing eminent domain proceedings for the acquisition of one parcel of land in order to construct a fire station City Manager Bressner explained that City staff is requesting authorization to proceed with a resolution of public necessity for purchase of property in the southeast quadrant of the City. City staff and the Urban Group have been working for months to locate a 1.5-acre site east of the Florida East Coast Railroad right-of-way and south of Woolbright Road and north of Golf Road. An initial analysis showed a deficiency in the 21 Meeting Minutes Regular City Commission Boynton Beach, Florida April 15, 2003 response time for this area. Currently, there is no fire station east of the railroad tracks. This station would serve the entire Federal Highway corridor if necessary. City Manager Bressner explained that property values have continued to escalate. Regarding the 3aycee Park property that was considered as a fire station site, the surrounding property owners want that site preserved as open space. Staff also looked at property in the vicinity of Golf Road and Federal Highway but were unable to get a satisfactory size property. City Manager Bressner further explained that the proposed property that the City is considering is located in the vicinity of 18th Avenue and Federal Highway. There is access from both streets. The only detriment is there is a building on the property. What the resolution of necessity does is set the stage for structured negotiations. The goal is to get a negotiated price for the property. Vice Mayor Ferguson asked how long this would take and Assistant City Attorney Tolces responded that the minimum time would be six months. There was discussion regarding other property (e.g., lots west of Baker's Furniture or property at Golf Road and Federal Highway). City Manager Bressner said there have been conversations with owners of other properties in the past, but he was willing to revisit them. Motion Vice Mayor Ferguson moved to approve proposed Resolution No. 03-070. Commissioner Weiland seconded the motion and reiterated his desire to pursue other properties as well. There was consensus of the Commission regarding this. The Commission felt that the City should proceed as quickly as possible. City Manager Bressner will keep the Commission abreast of discussions and action taken regarding land acquisition. Herb Suss was in favor of this resolution. Commissioner Weiland commented that, in his opinion, there is no desperate need for a fire station but for a paramedic station. Vote The motion to approve passed unanimously. C,11. Proposed Resolution No. R03-071 Re: Authorizing approval of the Scope of Services for the 2003-04 Fire Assessment Work Plan with Government Services Group, Thc. at a cost not to exceed $20,000 22 Meeting Minutes Regular City Commission Bovnton Beach, Florida April 15, 2003 City Manager Bressner explained that the delay in the property acquisition would not extend the fire assessment. The issue before the Commission now is to proceed with the analysis work that is required in order to establish the proposed rates for next fiscal year. This analysis still needs to go forward even if the rate is changed. Part of the math that determines what the rate is going to be is the number of dwelling units, either single-family or multi-family, the square footages of businesses, and the areas that are allocated for non-profit. If we do not plan to spend very much, the assessment does not have to be very much. Vice Mayor Ferguson asked what happens if we have a zero assessment, which he plans to vote for. City Manager Bressner answered that the agreement with the County requires that we do an analysis and send out bills even if there is a zero assessment. E. ist Avenue - Request for Major Site Plan Modification to increase multifamily units to 338 and add 12 townhouse units, decrease commercial/retail space to 24,591 square feet, increase garage parking spaces to 740 spaces, increase total project height to 168 feet and other related site modifications City Manager Bressner announced that this would be the last Commission meeting for Lusia Galav, Principal Planner for the City. She and her husband are moving to Arizona and, on behalf of the Commission and staff, he said she would be missed. Lusia Galav, Principal Planner, explained that she would concentrate on the changes between this major site plan modification and the one approved in September 2002 before the project changed ownership. The project basically remains the same except for a few changes. One of the major changes is the addition of the 12 townhouses adjacent to the north Marina area. The second change is the height. The Mixed-Use- High district allows a height of 150 feet. This project, in general, has a height slightly under 150 feet; however, mechanical equipment would extend the height to 168 feet. The third change is that the applicant does not meet the parking requirements and has requested to use fee-in-lieu of parking for approximately 70 parking spaces. The last item is a landscaping issue. The site plan does not meet the requirement of 50% native vegetation. They would have to either amend their plan or request some type of relief from that landscaping requirement. 23 Meeting Minutes Regular City Commission Bovnton Beach, Florida April 15, 2003 The configuration of the buildings is slightly different. There is only one recreation amenity and that is the pool area located between the towers. The last plan had 282 rental units. This plan has 338 condominium units and 12 townhouse units. Bonnie Miskel, representing the owner, The Related Group of Florida, stated that her client's projects include CityPlace of West Palm Beach, the Moorings of Lantana, Boca Grande in Boca Raton, Miramar Town Center in Miramar, all of which are mixed-use projects. Roger Frye, architect for the project, felt that this project is a way to connect the downtown to the waterfront. They felt that two :L5-story towers would be visually significant. They will be at the terminus of Boynton Beach Boulevard and will be seen from other parts of the City. The large buildings will be on the northern portion of the site. The seven-story buildings are located so that they hide the garage and provide a transition from the larger buildings to the public streets. The driveway and streets remain public. Boynton Beach Boulevard is connected from Ocean Drive along the water. They felt that this was a critical part of the design. The base of the seven-story building along Ocean Avenue will be entirely retail and the south tower, will also be all retail at the base. There is another retail section and restaurant on the overlook. The parking garage is on the western portion of the site and has a 20-foot minimum setback so they can provide adequate landscaping. The garage is hidden by the seven-story buildings. The parking garage goes from five levels to three. Mr. Frye clarified that this is a height exception and not a variance. There are provisions in the code to allow for steeples, etc. The height to the roof deck is 144 feet. Everything above that is actually parapet, roof mansards, or mechanical equipment rooms. They wanted the parapets and mansards to hide the air conditioning equipment. The elevator machine room is in the center of the building and that is where the 18-foot height exception occurs. Mr. Frye wanted to point out that the project was designed so that the public had access to everything except the pool area for the condominiums. Of the 786 parking spaces, including the townhouse spaces, 255 are parking spaces for commercial and retail use for the project. Ms. Miskel said there were no problems with the conditions of approval. She suggested that the Commission may want to change comment #21 to include conditional use. The only real dispute with staff is the height exception. The Boynton Beach Code allows for a height exception. It is not a variance where you must demonstrate hardship. The spirit of the height exception is to allow for mechanical equipment, elevator towers, and other minor roof-top appurtenances. The top of the elevator is the highest point and they added the mansard, which increased the height. The previous owner was 11 feet above the 100 foot maximum allowed at that time. Her client's height is very comparable. Commissioner Weiland felt that mature landscaping is needed with these tall buildings. Ms. Miskel said that her client is committed to giving the City a premier project and they will work with staff to provide something that is exceptional. Commissioner McCray questioned the 70 parking spaces that were lacking. Hs. Galav responded that the Land Development Regulations give the City Commission authority to grant or not grant a fee-in-lieu of parking. When questioned by Mayor Broening whether staff foresees a parking problem at the Marina, Ms. Galav said there is a problem now but as far as if it will continue, that depends. Host of the projects in urban areas allow for a reduction in parking. :It is a policy decision. Ms. Miskel explained that her client has done so many mixed-use projects and believes they will have a surplus in parking. A lot of people who live there will be walking to retail places. .lorge Peres, Chairman of The Related Group, said that when they have a project like this, they sell a unit that comes with one parking space. They leave an additional one-half space for anyone who wants to buy it and they end up selling approximately half of those. The reason that there is a deficit here is that the code asks for more than 1.5 spaces per unit. Brian Edwards, 629 NE gth Avenue, was concerned regarding the parking. There is the least parking with this project. Greg Kleinrichert, Skylake Subdivision, saw an opportunity for the City with this project. Burr Garnsey, 316 SW Ist Avenue, represented Sea Mist III. He felt that development is necessary; however, current businesses have struggled over the years and they need to be remembered. He requested that the Commission consider the needs of the small businesses. To eliminate street parking and isolate parking away from current businesses is a death sentence to businesses that have been there for 30 years. 25 Meeting Minutes Regular City Commission Bovnton Beach, Florida April 15, 2003 Kathleen Ambridge felt that the City finally has a first-class company. She worked with The Related Group in CityPlace. She requested that the Commission be flexible and allow the project to go forward. Warren Timm, 130 NE 26th Avenue, thought that the project looked a lot better affcer hearing the presentation tonight. However, the CRA still had a 3-3 vote on it and he felt there should be a consensus. Barkley Garnsey, 326 SW Ist Avenue, looked forward to progress in the downtown. However, he trusts the Commission to help the developer make a grander project. This project needs to be bigger than an island of condominiums and townhouses. They need to ensure public access to the waterfront and public parking. When they bought this project, it included over 200 shared public parking spaces for all uses downtown. Herb Suss thought that on-street parking is important for the project but they should meet parking requirements. He did not believe the 12 townhouses belonged in this project. He requested that the Commission approve this site plan but remove the townhouses and add the 70 parking spaces. Lee Wische, 1302 SW 18th Street, thought that this was a fantastic project. The developers have shown that there is access for the public. This is the group that is going to make something happen. Tt is a great project and should be approved. Alice Otis, 203 SW 13th Street, did not think upscale retail would draw many people. There is not much waterfront remaining and walking behind buildings is not much public access. Bob Foot, Coastal Towers, thought that the residents of the townhouses would want security and quiet. He has not heard the word "easement" or "dedication." The Commission should require public access 24 hours a day. Allen Marcovitch, 11SS SW 25th Avenue, was very excited about the downtown. He felt that the towers would be very dynamic and he was glad to see a quality developer come in. His only comment is that the structures are too plain and he would like a more futuristic look. Bruce Black, 6S6 Manor Drive, was happy to finally see something coming to this area. He thought that the Related Group was a fine company. However, parking is a big issue. He felt that with most families having at least two cars, one space per unit was not adequate. He did not think that the buildings were attractive and were not what the City's vision was many years ago. He felt that they were cramming too many people in there and they were not willing to compromise on the height. 26 Meeting Minutes Regular City Commission Bovnton Beachf Florida April 15, 2003 Chris Francois, who owns a restaurant at 115 S. Federal Highway, said that you cannot please everyone 100%. This is a very good project and we have been waiting for a very long time for it. She urged approval of the project. 3ennifer Spitznagel said that she owns property in the City and is a real estate professional. Concerning the height, she felt that 8'8' and 9' ceilings were a plus for marketability. Regarding the parking, the highest and best use of waterfront property is residential with very little commercial mixed in and tied to commercial off the water. This is what is happening there. David Fellows, 638 NE gth Avenue, said his biggest concern is the parking. Sometimes there are events downtown and he wondered where people would park. We have a wonderful lagoon and he hoped the City would schedule activities there but he had a concern about where people would park. Mr. Peres felt that the current site plan has much more water access than any previous ones. Regarding public access, he stated that they have no problem with granting permanent easements to the City and they will put that in their condominium documents and that will prevent anyone from putting gates where the City does not want them. Regarding public parking, he clarified that they give one parking space with each condominium unit. They leave .5 space per unit for additional parking if the condominium owner wants to buy it. It has been their experience that not many people buy them. They changed the use from rentals to condominiums. He felt that this was important because rentals are typically 95-97% occupied. In a condominium in an area like this, you may have 50% of the people living there at one time. Mr. Peres said they have over a $100 million investment so they must make sure that this project works. Regarding the architecture, it is Florida Vernacular. The last project that Roger Frye did for Related Group was CityPlace and we won the award for the best mixed-use job in the country. The code allows 80 units per acre, which is almost 600 units. Mr. Peres said that they could easily have that many units and have the project under 120 feet; however, they wanted to have various heights and make the site attractive. If they raised the seven- story buildings two to three stories and lowered the 15-story buildings to 13 stories, there would be an almost continuous height. Commissioner Weiland commented that there is a church nearby that perhaps could share parking if there was a problem. He thought that retail should not be all within this project but expanded out into other areas of the downtown. 27 Meeting Minutes Regular City Commission Bo nton Beach Florida Vice Mayor Ferguson did not see a problem with the height exception and he, was satisfied from this presentation that there would be public access. The parking seems to be a continuous problem. He wondered whether there could be an agreement where the owner would get his 507 spaces to do what he wants with them. Included in those spaces would have to be some access for valet parking for the restaurants and the commercial areas. The 255 public parking spaces should be reserved to be open to the public at all times. Also, if possible, he would like a dedication made for the roof of that building for a communication tower. Commissioner McCray commented that the CRA is only an advisory board to the Commission and the Commission has taken everything that they said under consideration. He felt that the project was nice and we should move forward. Commissioner McKoy added that we need progress and he thought that the developer showed that he had a concern regarding the character and the visual effect of the towers. He felt that the parking concern would linger for some time and he did not believe there was a quick fix. He commended the developers on their vision. City Manager Bressner explained that the site plan includes townhouses. Any approval of the site plan would require that they be removed until the ordinance passes on second reading. He had concerns over the 70 parking spaces. He requested that the Commission consider leaving the parking issue open. Ms. Miskel said that her client needs approval tonight. If parking is still an issue, they would not know how many condominiums to sell or how much retail space. They are confident that they have enough parking. She urged approval. She agreed with City Manager Bressner regarding removing the townhouses. Mayor Broening thought that the best deal is when both parties walk away feeling a little bit cheated and he felt that is what they have here. Parking is a continuous worrisome thing but he believes that there is a long range plan for a parking structure. Motion Vice Mayor Ferguson moved to approve the major site plan modification to increase the multi-family units to 338, decrease the commercial/retail space to 24,591 square feet, increase garage parking spaces to 740 spaces, increase total project height to 168 feet, and other related site modifications. Commissioner Weiland seconded the motion but wanted to ensure that the comments were included as far as full access, working with staff on the landscaping, and additional comments recorded in the minutes. PUBLIC AUDIENCE: INDIVIDUAL SPEAKERS PRESENTATIONS WILL BE LIMITED TO 3-MINUTE Trent Ward, 3102 Palm Drive, spoke regarding Barcelona Precast. This property was conditionally annexed by the City in July 1998 and the owner has not attempted to meet any of the conditions. There is work going on there seven days a week. There is chemical residue on Mr. Ward's cars, pool, and patio furniture. The City initiated a lawsuit last year and not much has happened since. He requested that the City close this business immediately. Assistant City Attorney Tolces explained that since this was in litigation, there should be no discussion on it except to say that the City Attorney's office is taking all steps necessary to ensure that this business does operate in conformance with City codes. As a piece of personal history on how long this process takes, Assistant City Attorney Tolces said that he was involved in a case for the City of Delray Beach with a property that was annexed in 1996. There was a lawsuit filed in 1997 and the trial will be held this summer. Bob Holechek, 3103 Palm Drive, said he had new information regarding Barcelona Precast. They never had a life safety inspection. He stated that the Fire Department said they were requested not to inspect the property. However, he felt that there was plenty of setback for that project. Commissioner Weiland said he is not against development. He just wants the right things to happen the right way. He felt that we need to have redevelopment in the downtown but need to reconsider the height on Federal Highway. He requested that the Commission think about this. City Manager Bressner explained that there is another project coming to the CRA. They prepared their plans based on setbacks and heights approved previously by the Commission. Two of our proposed buildings are 15 stories, which normally would not be over 150 feet in height. However, so that the buildings remain esthetically attractive there are certain mechanical functions and design elements and that need to exceed the 150 foot height. These include the elevator machine rooms, and roof-top air conditioning equipment (which is screened from view through the use of perimeter mansard type roofing which exceeds the 150 foot height to the top of the mansard). Section 4 (F) (3) states several questions to be answered by an applicant for a height exception, as follows: (a) Whether the height exception will have an adverse effect on the existin8 and proposed land use Answer: The requested height exceptions will not have an adverse effect on the existing and proposed land uses since the proposed buildings are consistent with the Mixed Use (High Intensity) Zoning District, which allows for a height of 150 feet. (b) Whether the height exception is necessary. Answer: The height exception is necessary to hide rooftop air conditioning equipment and to provide for roof top elevator machine rooms. In addition, the roof treatment provides articulation to give the buildings a more desirable aesthetic appearance - not horizontal flat parapets. The closest part Marina Village to the Financial Tower is the parking garage and the seven story element of the site plan. Facilities At Boynton North Industrial Park Dear Mr. Rumpf: The nature of this landscape appeal is to eliminate the required hedge and tree buffer on the eastern property line of the proposed Vermeer warehouse facility at 1060 West Industrial Avenue currently under construction. The uses east of this property include: a new Tri-Rail track project currently under construction at an elevation 10' to 15' higher than the subject property grade and an existing CSX railroad track further up the embankment some 15' to 20' higher in elevation, and a berm with natural hedgerow of vegetation at additional elevation. These features virtually block the view from 1-95 corridor immediately to the east of the railroad. The existing berm includes a natural vegetation hedgerow barrier of native Scrub Oak, Live Oak, Silver Palmetto, Florida Myrtle and other plants block the entire site except the roofline of Vermeer facility some 600+ feet west of the Interstate. The requirement of a landscape buffer should not be considered an effective screen due to the major change in grade between the two uses and existing vegetative barrier currently in place. Special conditions existing on the subject site also support this appeal include: A 10' wide Utility Easement that was granted the City of Boynton Beach for the purpose of a 16" ductile iron sewer force main installed at approximately 5'-6' west of east line within the easement. In addition a 6" water main was installed 6'-7' west of the granted easement. As a result of the recently discovered 6" water line apparently installed outside the easement, on subject property, the Utilities Department is requesting an additional 14' easement further encumbering the east portion of the property.
