Chair DeLiso called the meeting to order at 7:00 p.m.
Approval of Minutes of April 16, 2003
Motion
Ms. Zibelli moved to accept the April 16, 2003 minutes as presented.

At this point, Hr. Foot arrived and stated that it was not yet 7:00 p.m. He asked, and
the Chair consented, to reconsider the minutes.
In the April 16, 2003 minutes, Mr. Foot wished to change the word "dissent" in the
motion on page 36 to reflect that he had been in favor of Ms. Costantino for
Chairperson and did not "dissent" to Mr. DeLiso's election. The same would apply to
the election for Vice Chair in which Mr. Foot wished to show that there had been 2
votes for Ms. Hammer and 4 votes for Ms. Costantino.

Mr. Foot moved to accept the minutes of the April 16, 2003 minutes as amended.
Costantino seconded the motion that carried unanimously.

Mr. Foot pointed out that the Board had not yet considered the Lien Reduction minutes
of March 27, 2003. He stated that in the motion where he passed the gavel, he had

passed the gavel to Mr. Miriana and made the motion as opposed to Mr. Rossi making
the motion.

Mr. Foot also asked that the Board consider the minutes from the April 24, 2003 Lien

Mr. Roy introduced and welcomed the new Board member, Ms. Kathy Cook, Alternate.
He also introduced and welcomed Ms. Diane Bellino, the new Administrative Secretary
in the Code Compliance Division.

Inspector Cain stated that this property had been cited because the building permit had
expired. He read from a letter that Mr. Don 3ohnson, the Building Official, had sent to
him explaining that Mr. Katz had to either secure a new permit for the proposed
renovation work or properly board up and secure the rear of the structure. Mr. 3ohnson
was present at the meeting and said that the City hoped that Mr. Katz would apply for a
new permit but failing that, the rear portion of the building had to be boarded up. Tt
was now open to the elements and to the general public, which presented a safety
hazard. Tnspector Cain stated that service had been accomplished by certified mail.
Robert Katz, 306 S.E. Ist Avenue, Boynton Beach, stated that the whole area was
under a Master Development Agreement and that he was waiting to see what happened
with Mr. Bill Morris' project.
Don .lohnson, Building Official, asked Mr. Katz to apply 4' x 8' pieces of plywood all
around the perimeter of the structure in the back. Mr. Katz believed that he could take
care of this in 15 working days.
Motion
Based on the testimony and evidence presented in Case No. 03-310, Mr. Foot moved
that this Board find that Robert Katz is in violation of the Florida Building Code, 2001
Edition, Section 104.5, and moved to order that the Respondent correct the violation on
or before .lune 11, 2003. The Board has considered the gravity of the violation, the
actions taken by the Respondent, and any previous violations by Respondent, and
hereby orders that if the Respondent does not comply with this Order, a fine in the
amount of $25.00 per day plus administrative costs shall be imposed for each day the

Inspector Cain reported that the violations were due to occupying a structure without a
Certificate of Occupancy and related issues. The property was originally cited on April
11 and service was obtained by hand carry. Inspector Cain verified that this was the
Two Georges property.
Mr. Don Johnson stated that a Temporary Certificate of Occupancy was issued per
Section 106.13 for 30 days. The Two Georges has used the two allowable extensions,
which ran out on .lune 9, 2002. It has been almost a year. They have had numerous
disputes with the contractor and architect and have applied for permits to close out. He
hoped that in the next couple of days, the City would be able to issue a permanent
Certificate of Occupancy.
Steve Skaggs, 728 Casa Loma Boulevard, Boynton Beach, pled no contest and
asked for 60 days. Mr. 3ohnson recommended 30 days instead.
Motion
Based on the testimony and evidence presented in Case No. 03-1160, Mr. Foot moved
that this Board find that DSS Properties is in violation of the Boynton Beach
Amendments to the Standard Building Code 106.1.1 and 106.1.2 and the Standard
Building Code 1997 Edition, Sections 105.4 and 106.1.3, and moved to order that the
Respondent correct the violations on or before .lune 20, 2003. The Board has
considered the gravity of the violations, the actions taken by the Respondent, and any
previous violations by Respondent, and hereby orders that if the Respondent does not

3esse 3ones, 334 N.E. 23rd Avenue, Boynton Beach, spoke on behalf of his wife,
Patricia A. 3ones. Mr. Tolces asked Mr..]ones if Ms..]ones had given him permission to
speak on her behalf and he said that she had. Mr..]ones pled no contest and asked for
30 days to bring the property into compliance.

Based on the testimony and evidence presented in Case No. 03-691, Mr. Foot moved
that this Board find that Patricia A..]ones is in violation of Chapter 15, Article IX-15-120
(D) .IA of the City of Boynton Beach Code of Ordinances, and moved to order that the

Inspector Roy reported that this property had been cited on January 28, 2003 as a
result of a routine inspection. Service was obtained by certified mail. The City
recommended a compliance date of June 5, 2003. This is an apartment complex on
Knuth Road.
Ms. Suzanne Pavlik, Operations Manager for the owner, I Belmont Place,
Boynton Beach, pled guilty and stated that she had come before the Board to see if
there were anything that they could do to continue using the banners such as using
fewer banners or better banners. Ms. Pavlik explained that they have no drive-by
exposure. She requested 60 days to come into compliance so that they could benefit
from the start of summer business.
Chair DeLiso suggested that Ms. Pavlik or the owner set up an appointment to discuss
this with the City Manager, Kurt Bressner. He explained that this Board could only
enforce the Code. Mr. Tolces explained that the Code provided for an application for a
sign permit and if the application were to be denied, the City Commission could
consider a variance.

Based on the testimony and evidence presented in Case No. 03-189, Ms. Costantino
moved that this Board find that Belmont at Boynton Beach, :[nc. is in violation of Part 3,
of the Land Development Regulations, Chapter 21-I:[, Section 3.D. of the City of
Boynton Beach Code of Ordinances, and moved to order that the Respondent correct
the violations on or before June 20, 2003. The Board has considered the gravity of the
violations, the actions taken by the Respondent, and any previous violations by
Respondent, and hereby orders that if the Respondent does not comply with this Order,
a fine in the amount of $25.00 per day plus administrative costs shall be imposed for

Inspector Lewis reported that this property had been cited on March 11, 2003. Many of
the items have been fixed, but there is still debris on the side and a house number must
be affixed to the house.
Elaine Hyman, 126 S.E. 28th Court, Boynton Beach, explained that she had affixed
a house number to the house on the day of this meeting. She further explained that
years ago, her husband had petitioned to change their house number to 26 instead of
126 since there were two 126 S.E. 28th Courts in the City. Mr. Tolces remarked that the
Code Board used the County Tax Rolls and that this record shows a numerical address
of 126 for this property. She was counseled to put the correct house number up so
that emergency vehicles would be able to locate her home.

moved that this Board find that 3erry and Elaine Hyman are in violation of Chapter 15,

Inspector Pierre reported that this property had been cited on March 10, 2003. It was
discovered through a routine inspection. Mr. Johnson has come before the Board
before.
George Johnson, 219 N.W. 4th Avenue, Boynton Beach, pled no contest and
asked for 45 days to bring the property into compliance.
Inspector Pierre shared pictures of the property with the Board and stated that there
was a lot of material to be removed. Mr. Foot thought that this was a prime example of
hurricane hazards and that 30 days would be liberal.

Based on the testimony and evidence presented in Case No. 03-739, Ms. Zibelli moved
that this Board find that George Johnson is in violation of Chapter 15, Article IX-15-120
(D) Inc., Part 3, Land Development Regulations, Chapter 2, Section 5.D.1 of the City of
Boynton Beach Code of Ordinances, and moved to order that the Respondent correct
the violations on or before June 20, 2003. The Board has considered the gravity of the
violations, the actions taken by the Respondent, and any previous violations by
Respondent, and hereby orders that if the Respondent does not comply with this Order,
a fine in the amount of $50.00 per day plus administrative costs shall be imposed for

Inspector Pierre stated that this property had been cited on March 21, 2003 for a
carport enclosure that was completed without the required inspections. Mr. Blasie
explained that the persons from whom Mr. Thomas purchased the home had a permit
for the enclosure but that it had expired in 1997. The owner was not aware that the
house had two liens on it and did not have a title search done when he purchased the
home. There was some thought that bringing the structure up to current Code would be
very costly and that the only other alternative would be to bring the property back to its
original condition by removing the addition. Mr. Blasie recommended 90 days for
compliance and asked Inspector Pierre to help the owner arrange a meeting with Mr.
Don Johnson and Mr. Tim Large to determine what it would take to obtain the permit
and inspections.

B. Lien Penalty Certification
Case #03-405
Lancaster Investments LLC 501 N.W. 13th Avenue
Inspector Pierre reported that this property had been cited on February 10, 2003 for
violations of the Community Appearance Code. A hearing was held on March 19, 2003
and no one appeared. The Board set a compliance date of April 18, 2003 and proposed
a fine of $25.00 per day. The violation still exists.
Kevin Rogers, 343 N.W. 36th Avenue, Deerfield Beach, explained that the trash
was coming from the people who ride their motorcycles and all terrain vehicles up to
the canal through their property. If they were to put grass down, it would be torn up in
a matter of days. They wished to put a fence around the house area and leave the
other side of the lot empty because they could sod it and control it. The Board
discussed the case at length.
Motion
Mr. Foot moved to table Case #03-405 until the Code Compliance Board meeting on
.lune 18, 2003. Ms. Costantino seconded the motion that carried unanimously.
Mr. Tolces commented that if the owner could only commit to part of the requirements,
i.e. within the proposed fenced in area, that this Board did not have the ability to waive
any portion of the Code. Therefore, he recommended that Mr. Rogers speak to
Inspector Pierre to make sure that whatever he did complied with the Code.

Inspector Lewis reported that this property had received a citation on February 3, 2003
for an Occupational License requirement. Mr. Andrew Lucci appeared at the Board
meeting on February 19, 2003. The Board set a compliance date of April 16, 2003 and
proposed a fine of $25.00. The violation still exists.
Andrew Lucci, 5577 Descartes Circle, Boynton Beach, stated that Inspector Roy
had stopped by and seen that they have a "For Rent" sign on the property. They had
started moving people and items today and would have the rest of the people out by
the next Friday.
Chair DeLiso asked :Inspector Roy if he knew whether they were moving

Inspector Lewis reported that this property had been cited on April 29, 2003 for
violations of the Florida Building Code and the Housing Code. The City recommended a

Jean St. Fort, 176 S.E. 28m Court, Boynton Beach, pled guilty and asked for 30
days.
Inspector Lewis stated that people were living in a screen enclosure turned into a living
room. He had discovered these violations when he went to the property for an
inspection for a rental license.
Chair DeLiso asked Mr. St. Fort where he lived now and he responded :[75 S.E. 28th
Avenue on the other side of the subject property. In response to Chair DeLiso, Mr. St.
Fort agreed that the wiring was not safe and he had arranged for someone to come in
and take care of it. Inspector Lewis stated that the building would have to come down
because it could not possibly meet Code. Chair DeLiso asked if it were occupied and Mr.
St. Fort stated that there were tenants.

that this Board find that 3ean L. & Kethlie St. Fort are in violation of Part 3 of the Land

Respondents do not comply with this Order, a fine in the amount of $100.00 per day
plus administrative costs shall be imposed for each day the violations continue past May
31, 2003. The Respondents are further ordered to contact the City of Boynton Beach
Code Compliance Division in order to arrange for reinspection of the property to verify

C. Lien Reductions
Case #00-2554
3ohn Burns

Mr. Blasie stated that this property had originally been cited on October 3, 2000 for lack
of an occupational license in a rental property. :It came before the Board on December
20, 2000 and no one appeared. The Board set a compliance date of February 19, 2001
and proposed a fine of $25.00 per day. The property came into compliance on
September 20, 2002. The total fine is $14,425 plus $730.15 in administrative costs.
The property is now empty. Mr. Burns' health has declined since the property was cited
and he wants to settle the lien and stop being a landlord.
3ohn Burns, P.O. Box 596, Boynton Beach, stated that he did not have an
occupational license because the previous owner had a license from the County. Chair
DeLiso asked Mr. Blasie if Mr. Burns had this property prior to the City Commission
enactment of the occupational license requirement. Mr. Blasie stated that Mr. Burns had
owned this property since about 1981. Mr. Blasie thought the occupational license
ordinance had gone into effect prior to 1997. Mr. Blasie said a code had been in place
in the late eighties when Mr. Moore was mayor but it was abolished at one point and
resurrected by a later Commission. Mr. Burns explained that in 2002 when he had
gotten the notice, he tried to get a license. When he came to the City to apply for it, he
was told that a lien had already been placed on the property and the individual he

property did not come into compliance by that time. The compliance date was

Chair DeLiso asked if this property had been a rental property since she purchased it
and she stated that she had purchased it as an investment and had never lived in it.
Chair DeLiso ascertained that Mrs. Garcia would sell the property when the liens were
settled. Mr. Blasie stated that it had come to the attention of Code Compliance because
it was overcrowded. On November 19, 1998, there were 23 men sleeping on the floor.
Mrs. Garcia explained that when they discovered this through a visit from the Police,
they went over to the property the next day, removed all of the people, and began to
refurbish the property. She asked for a reduction of liens to "zero" or the minimum
possible fine. Mr. Blasie indicated that the property looked good at this time. Mr. Tolces
stated that the liens totaled $24K plus administrative costs.

VII. Items for Discussion
A. Code Compliance Calendar
Mr. Blasie discussed the Code Compliance Board meeting calendar for meetings through
2004, as requested by the Board. He referred to a letter that Ms. Bellino had written to
the Board members. There are two months this year that have a conflict and two
months in 2004. Mr. Blasie proposed resolving the conflict on three of them by moving
lien reductions to the regular hearing. For example, on Thanksgiving, they would have
the lien reduction at the regular hearing on the prior Wednesday. The September 17,
2004 meeting conflicts with Rosh Hashanah, which begins at midnight on September
16. Mr. Tolces stated that there was also concern that people were being cited during a
holiday. Mr. Blasie will check with the City Clerk's office and present the options to the
Board at the next meeting. Mr. Foot suggested moving the September meeting to
September 8, 2004.

Greetings and Peace unto you.
This letter is to request a fitting extension to come into compliance regarding our home at 165
SE 26th Avenue. We experienced and are still experiencing some financial difficulties that
prevent us from applying our scarce monies to address our properties deficiencies.
The specific deficiencies include water damaged fascia board on the flat roof outside
patio facing 1 st Street and lack ora green yard. The carpentry work is something that had
resulted from water settling and permeating the seams in the flat root: The grass issue spawned
from damage that our irrigation system sustained as a result of hasty work by the contractor in
charge of the swale improvements done in our neighborhood.
The contractor did eventually get the system up and running and installed grass on the
swale however the yard has never fully recovered and is now under attack of weeds and dying
grass. Despite our situation we have received estimates for both the fascia board repairs and for
new sod and currently pursuing loans from family members.
We appreciate any and all of your assistance, patience, and grace with us through our
time of need.
