Call to Order In the absence of the Chairman, Vice Chair Costantino presided and called the meeting to order at 7:01 p.m. I1. Approval of Minutes - May 21, 2003 Mr. Foot requested that the following changes be made to the minutes: v' On Page 15, Case #03-466, the amount of the fine cited at "$25.00 per day" is incorrect. The correct amount should be $50.00 per day. v' On Page 1, the minutes reflect that he and Mr. Rossi arrived after 7:00 p.m., where in fact they both arrived prior to 7:00 p.m. Mr. Blasie requested that on Page 22, Case #03-687, Nathaniel Robinson, the compliance date was incorrect. The order for compliance should be June 5, 2003 or be fined $100 per day and not as cited as July 20, 2003 at $50 per day. Motion Mr. Foot moved to approve the minutes, as amended. Inspector Melillo called the roll. V. New Business A. Cases to be Heard Case #03-961 Property Address: Violation(s): Orlando & Rosa Conde 3409 Diane Drive Chapter 15, Article IX-15-120 (D) 1, Inc. and 15-16 B.B.C. of Ord. Please de-weed and re-sod or mulch bare island area of the front yard. A visible street number is required. Inspector Lewis presented the case. The property was originally cited on March 28, 2003 for violations as stated above. Orlando Conde, 3409 Diane Drive, pled no contest and requested 90 days for compliance. Inspector Lewis stated that the respondent intends to xeriscape his property and add a fountain. Inspector Lewis presented photos to the respondent and the Board. The City agreed to 90 days. Mr. Rossi raised questions as to what constitutes proper xeriscaping and asked if a plan had to be approved prior to a person xeriscaping his property. Inspector Lewis said that he would be the one to approve the xeriscaping. 2 Meeting Minutes Code Compliance Board Boynton Beach, Florida June 18,2003 Motion Based on the testimony and evidence presented in Case No. 03-961, Ms. Hammer moved that this Board find that Orlando and Rosa Conde are in violation of the City of Boynton Beach Code Sections Chapter 15, Article IX-15- 120 (D) 1, Inc. and 15-16, and moved to order that the Respondents correct the violations on or before September 16, 2003. The Board has considered the gravity of the violations, the actions taken by the Respondents and any previous violations by the Respondents and hereby orders that if the Respondents do not comply with this Order, a fine in the amount of $25 per day, plus administrative costs, shall be imposed for each day the violation continues past September 16, 2003. The Respondents are further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for reinspection of the property to verify compliance with this Order. Motion seconded by Mr. Foot and unanimously carried. Case #03-001 Property Address: Violation(s) Louise Denson 229 NW 3rd Avenue Chapter 15, Article IX-15-120 (D) Inc. and PT3-LDR, Chapter 20-VIII, Section 2A. (1) Sod front and back yard. Also, fence needs to be repaired. (2) Repair all interior doors, walls, ceiling and exterior door window screens. (3) All electrical outlets and fixtures must be repaired and unsafe wires. (4) Repair all rotted wood. (5) Unsafe and unsanitary washing machine and dryer must be connected properly. Inspector Pierre presented the case. The property was originally cited on January 3, 2003 from a complaint from the Police Department. Service was made by certified mail and the respondent's daughter is present. Sharon Glover asked for an extension of time. She explained that they are trying to make the necessary repairs but needed more time due to the amount of money necessary to bring the property up to code. Ms. Glover pled no contest. Ms. Hammer asked what work has been done to date, and Ms. Glover responded that they have repaired the screens, doom, some electrical, the washer and dryer, and they did place some sod down. The rotten wood has also been repaired. Inspector Pierre presented photographs to the respondent and the Board. Ms. Glover requested 45 days for compliance, but was not certain if this was enough time. 3 Meeting Minutes Code Compliance Board Boynton Beach, Florida June 18, 2003 Mr. Foot raised concern about the unsafe wiring. Ms. Glover said that they have an electrician who will be fixing the wiring, but they have to wait until the rain stops. The electrician informed them that he cannot do the work until it stops raining. Mr. Foot suggested that there be two motions; 15 days for the electrical work and more time for the remainder of the work. Motion Based on the testimony and evidence presented in Case No. 03-001, Ms. Hammer moved that this Board find that Louise Denson is in violation of the City of Boynton Beach Code Sections Chapter 15, Article IX-15-120 (D) Inc. and PT3- LDR, Chapter 20-VIII, Section 2.A., and moved to order that the Respondent correct the violations on or before September 16, 2003. The Board has considered the gravity of the violations, the actions taken by the Respondent and any previous violations by the Respondent and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $25 per day, plus administrative costs, shall be imposed for each day the violation continues past September 16, 2003. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for reinspection of the property to verify compliance with this Order. Motion seconded by Mr. Rafkin. Mr. Foot requested that the motion be split to require that the electrical work and the washer and dryer be completed by July 18, 2003 and the remainder of the work be completed by September 16, 2003. Ms. Hammer agreed to amend her motion as Mr. Foot suggested. Mr. Rafkin amended his second of the motion that unanimously carried. Case #03-1308 Property Address: Violation(s): Michael E. and Sherel Francis 1481 NW 2nd Street Chapter 15, Article IX-15-120 (D) 1, Inc. Please sod all bare areas in yard. Inspector Webb presented the case and stated that the property was originally cited on April 25, 2003 through routine neighborhood inspection. Mr. Foot inquired if staff would apprise the Board if any of the respondents tonight were repeat violators and Mr. Blasie said that there were none tonight. Sherel Lee Francis, 1481 NW 2nd Street, pled no contest. Ms. Francis pointed out that in the section of the yard for which she was being cited, she intended to have concrete laid to extend the driveway. Ms. Francis also has applied for assistance from the City and will be submitting an application. 4 Meeting Minutes Code Compliance Board Boynton Beach, Florida June 18,2003 Mr. Blasie suggested that the case be tabled until the next meeting. Motion Ms. Hammer moved that Case No. 03-1308 be tabled until the Code Compliance Board meeting to be held on July 16, 2003. Motion seconded by Mr. Rafkin and unanimously carried. Case #03-1315 Property Address: Violation(s): Willie J. & Olivia V. Smiley 170 NW 14th Avenue Chapter 15, Article IX-15-120 (D) Inc. Please sod all bare areas in yard and remove all loose trash. Inspector Webb presented the case and stated the property was cited through routine neighborhood inspection. Service was obtained by certified mail. Olivia V. Smiley, 170 NW 14th Avenue, stated that Willie J. Smiley no longer lives at the property and they have divorced. Ms. Smiley requested 90 days for compliance. Inspector Webb pointed out that the trash has been removed and the respondent will be installing an irrigation system. Inspector Webb presented photographs to the respondent and then to the Board. Motion Based on the testimony and evidence presented in Case No. 03-1315, Ms. Hammer moved that this Board find that Olivia V. Smiley is in violation of the City of Boynton Beach Code Sections Chapter 15, Article IX-15-120 (D) 1, Inc., and moved to order that the Respondent correct the violations on or before September 16, 2003. The Board has considered the gravity of the violations, the actions taken by the Respondent and any previous violations by the Respondent and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $25 per day, plus administrative costs, shall be imposed for each day the violation continues past September 16, 2003. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for reinspection of the property to verify compliance with this Order. Motion seconded by Mr. Rafkin. Attorney Tolces stated that the order would have to be against both respondents. Ms. Hammer amended her motion to include Willie J. Smiley and Olivia V. Smiley. Mr. Rafkin seconded the amended motion. The motion unanimously carried. 5 Meeting Minutes Code Compliance Board Boynton Beach, Florida June 18, 2003 VI. OLD BUSINESS A. LIEN PENALTY CERTIFICATIONS Case #03-546 Audrey Williams 2051 NW 2nd Street Inspector Webb reported that the property was cited on February 21, 2003 for violation of the Community Appearance Code. No one appeared at the April 16, 2003 Code Compliance Board Hearing. A compliance date of May 16, 2003 was set or be fined $25 per day. The property is not yet in compliance. Attorney Tolces explained to the respondent that the Board has already found her guilty of a violation and a compliance date and fine were set. To date she has not complied and a fine continues to accrue. The Board could certify the fine and impose a lien on her property and is therefore looking for an explanation why the property is not yet in compliance. Audrey Williams, 2051 NW 2nd Street, said that the oversized vehicle has been moved. Ms. Williams said that she placed gravel along the side of the driveway because grass will not grow in this area. With regard to the swale, she needs to install a sprinkler system in order for the grass to grow. Inspector Webb presented photos to the respondent and then to the Board. Mr. Foot inquired if the gravel along the driveway was allowed and Inspector Webb stated that it was not. Ms. Williams had been apprised by Inspector Webb to put mulch and plants in where the gravel is located, which would be permissible. She said that she could bring the property into compliance within 90 days. Motion Ms. Hammer moved that Case No. 03-546 be tabled until the Code Compliance Board Meeting to be held on September 17, 2003. Motion seconded by Mr. Foot and unanimously carried. Inspector Melillo noted that Guy Estella (Case #02-3221) arrived late. The Recording Secretary administered the oath to all persons who came in late. Case #02-3221 Property Address: Violation(s): Guy Estella 212 SW 10th Avenue SBC '97 Edition 105.6; Inspection required; see copy of Red Tag dated October 21, 2001. Inspector Cain distributed a letter from Mr. Estella's Attorney, a copy of which is on file in the City Clerk's Office. Inspector Cain stated that in light of the circumstances concerning the property, he requested that the case be tabled 6 Meeting Minutes Code Compliance Board Boynton Beach, Florida June 18,2003 until the respondent can gain possession of the property to make the necessary corrections. Vice Chair Costantino inquired why there was a red tag, and Inspector Cain stated it was for inspections for an addition that was built onto the back of the house. The property does not pose any immediate danger, but merely needs to be inspected. Guy Estella, 126 Atlantic Drive West, said that his Attorney needs more time to work out his problems and currently he is not allowed by the court to go near the property. Once his finance, who currently occupies the property, moves out, he intends to move onto the property and have the necessary inspections made. Inspector Cain recommended tabling the case for 90 days, as long as the respondent keeps in touch with him and continues to furnish proof from his Attorney that he is trying to get the property back. Motion Ms. Hammer moved that Case No. 02-3221 be tabled until September 17, 2003. Motion seconded by Mr. Rafkin and unanimously carried. Case #03-1274 Property Address: Violation(s) Kathleen A. Romeo 303 SW ?th Street Chapter 15, Article IX-15-120 (D) Inc. Mow grass, weeds and trim your yard and swale. Remove all trash and tarp hanging on fence. Inspector Melillo stated that the case was originally cited on April 24, 2003 for violation of the Community Appearances Code. He reported that the tarp has been removed. Kathleen Romeo, 32 Bedford Terrace #12, Northampton, Massachusetts, pled not guilty. She reported that the tenants were supposed to take care of the yard and in exchange their rent was reduced. She did not know about these problems until the tenant moved out. She flew down from Massachusetts on Monday and began to work on the yard and only learned of the violation a week ago from her neighbor. Inspector Melillo said that he spoke with the leasing agent of the property three weeks ago, who assured him that the work would be done in a week. Inspector Melillo presented photos to the respondent and the Board. Ms. Romeo said that the property is now 85% cleaned up. Mr. Foot explained the plea system and Ms. Romeo changed her plea to no contest. 7 Meeting Minutes Code Compliance Board Boynton Beach, Florida June 18,2003 Inspector Melillo noted that if the property is rental property, an occupational license is required. Ms. Romeo said that she has an occupational license. Inspector Melillo noted that the County records show that the respondent lives at this address. Ms. Romeo said that she changed the records over two years ago and has not lived there for over two years. Attorney Tolces recommended that the respondent contact the County to have her address changed to the correct address. Motion Based on the testimony and evidence presented in Case No. 03-1274, Mr. Foot moved that this Board find that Kathleen A. Romeo is in violation of the City of Boynton Beach Code Sections Chapter 15, Article IX-15-120 (D) Inc., and moved to order that the Respondent correct the violations on or before July 3, 2003. The Board has considered the gravity of the violations, the actions taken by the Respondent and any previous violations by the Respondent and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $25 per day, plus administrative costs, shall be imposed for each day the violation continues past July 3, 2003. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for reinspection of the property to verify compliance with this Order. Motion seconded by Mr. Rafkin and unanimously carried. Case #03-1008 Property Address: Violation(s) Bradley Stocker 148 SW 14th Avenue Chapter 15, Article IX-15-120 (D) Inc. and 13-16 B.B.C. of Ord. An occupational license is required to rent house. De-weed yard and install sod wherever dead or bare spots Occur. Inspector Cain stated that the case was originally cited on April 1, 2003 through routine inspection of the neighborhood. Service was accomplished by certified mail. Bradley Stocker, 312 SW 9th Avenue, pled no contest and asked for 90 days for compliance. The City agreed to 90 days. Motion Based on the testimony and evidence presented in Case No. 03-1008, Ms. Hammer moved that this Board find that Bradley Stocker is in violation of the City of Boynton Beach Code Sections Chapter 15, Article IX-15-120 (D) 1, Inc. and 13-16 B.B.C. of Ordinances, and moved to order that the Respondent correct the violations on or before September 16, 2003. The Board has considered the 8 Meeting Minutes Code Compliance Board Boynton Beach, Florida June 18,2003 gravity of the violations, the actions taken by the Respondent and any previous violations by the Respondent and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $25 per day, plus administrative costs, shall be imposed for each day the violation continues past September 16, 2003. Motion seconded by Mr. Rafkin and unanimously carried. Case #03-1137 Property Address: Violation(s) Bradley Stocker 312 SW 9th Avenue Chapter 15, Article IX-15-120 (B) 1 and 120 (D) Inc. Sod swale or re-rock it. Remove woodchips from swale. Also, sod west side of driveway. Inspector Cain stated that the property was originally cited on April 10, 2003 through routine neighborhood inspection. Service was accomplished by certified mail. Bradley Stocker, 312 SW 9th Avenue pled no contest. Mr. Stocker said that he is working on the swale and has obtained a permit for the driveway and is waiting for the concrete to be poured. Mr. Stocker requested 90 days. Motion Based on the testimony and evidence presented in Case No. 03-1137, Ms. Hammer moved that this Board find that Bradley Stocker is in violation of the City of Boynton Beach Code Sections Chapter 15, Article IX-15-120 (B) 1 and 120 (D) Inc. and moved to order that the Respondent correct the violations on or before August 17, 2003. The Board has considered the gravity of the violations, the actions taken by the Respondent and any previous violations by the Respondent and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $25 per day, plus administrative costs, shall be imposed for each day the violation continues past August 17, 2003. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for reinspection of the property to verify compliance with this Order. Motion seconded by Mr. Rafkin and unanimously carried. Case #03-916 Property Address: Violation(s) Henry L. Watson 508 NW 9th Avenue Chapter 15, Article IX-15-120 (D) Inc. Please sod yard and swale area. Remove all trash and debris and inoperable vehicle. 9 Meeting Minutes Code Compliance Board Boynton Beach, Florida June 18,2003 Inspector Pierre presented the case and stated that the property was originally cited on March 26, 2003 for violation of the Community Appearance Code. The violation was discovered through routine inspection and service was accomplished by certified mail. Edwin Watson, 508 NW 9th Avenue, is the son of the respondent. Mr. Watson pled no contest and requested 90 days for compliance. Inspector Pierre suggested 60 days. Motion Based on the testimony and evidence presented in Case No. 03-916, Ms. Hammer moved that this Board find that Henry L. Watson is in violation of the City of Boynton Beach Code Sections Chapter 15, Article IX-15-120 (D) Inc. and moved to order that the Respondent correct the violations on or before August 17, 2003. The Board has considered the gravity of the violations, the actions taken by the Respondent and any previous violations by the Respondent and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $25 per day, plus administrative costs, shall be imposed for each day the violation continues past August 17, 2003. Inspector Laverdure presented the case. The property was originally on April 21, 2003 through routine inspection. Service was accomplished by certified mail and the City recommends compliance by July 18, 2003. Motion Based on the testimony and evidence presented in Case No. 03-1225, Mr. Foot moved that this Board find that Dale Beapot is in violation of the City of Boynton Beach Code Sections 13-16 and moved to order that the Respondent correct the violations on or before July 18, 2003. The case was originally cited on May 1, 2003 and service was accomplished by certified mail. The City recommends compliance by July 8, 2003. Motion Based on the testimony and evidence presented in Case No. 03-1387, Mr. Foot moved that this Board find that Paul Benito is in violation of the Florida Building Code '01 Edition 104.1.6 and moved to order that the Respondent correct the violations on or before July 8, 2003. The Board has considered the gravity of the violations, the actions taken by the Respondent and any previous violations by the Respondent and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $25 per day, plus administrative costs, shall be imposed for each day the violation continues past July 8, 2003. Hedge needs to be trimmed to 25' 30" each way of intersection. Trim your trees. Fix or remove your fence post. Install grass in all bare spots. Inspector Laverdure presented the case. The property was originally cited on December 17, 2002. All the violations have complied except for the grass. The City recommends July 18, 2003 as the compliance date. Motion 11 Meeting Minutes Code Compliance Board Boynton Beach, Florida June 18,2003 Based on the testimony and evidence presented in Case No. 02-3199, Mr. Foot moved that this Board find that Sam Peterson is in violation of the City of Boynton Beach Code Sections Chapter 15, Article IX-15-120 (D) 1, Inc. and moved to order that the Respondent correct the violations on or before July 18, 2003. The Board has considered the gravity of the violations, the actions taken by the Respondent and any previous violations by the Respondent and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $25 per day, plus administrative costs, shall be imposed for each day the violation continues past July 18, 2003. An occupational license is required for rental. Car repair is not allowed in residential area. Remove engine blocks off property. Sod yard, including swale. Re-seal driveway. Sod south side of driveway or extend driveway (permit required). Inspector Melillo presented the case. The case was originally cited on April 15, 2003 through a neighborhood complaint. The City recommends July 18, 2003 as the compliance date. Motion Based on the testimony and evidence presented in Case No. 03-1174, Mr. Foot moved that this Board find that Eduardo and Hermelinda Santiago are in violation of the City of Boynton Beach Code Sections 13-16 B.B.C. of Ord., Chapter 15, Article IX-15-120 (D)Inc. and PT-3-LDR, Chapter 2, Section 5.D.1 and moved to order that the Respondents correct the violations on or before July 18, 2003. The Board has considered the gravity of the violations, the actions taken by the Respondents and any previous violations by the Respondents and hereby orders that if the Respondents do not comply with this Order, a fine in the amount of $25 per day, plus administrative costs, shall be imposed for each day the violation continues past July 18, 2003. Inspector Guillaume presented the case. The case was cited on January 30, 2003 for violation of the Community Appearance Code. The City recommends a compliance date of July 18, 2003. Motion Based on the testimony and evidence presented in Case No. 03-255, Mr. Foot moved that this Board find that Fred S. Ross is in violation of the City of Boynton Beach Code Sections Chapter 15, Article IX-15-120 (D) 1, Inc. and 120 (E) 2A and moved to order that the Respondent correct the violations on or before July 18, 2003. The Board has considered the gravity of the violations, the actions taken by the Respondent and any previous violations by the Respondent and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $25 per day, plus administrative costs, shall be imposed for each day the violation continues past July 18, 2003.
