Mayor Broening called the meeting to order at 5:00 p.m.
Introduction
Dick Hudson, Senior Planner, explained that staff has been working with The
RMPK Group to rewrite the Land Development Regulations (LDR). A previous
workshop was held to afford the Commission an opportunity to provide their
suggestions. The purpose of today's workshop is to garner the opinion of the
Commission on the rewrite of the Table of Contents for the Code. Mr. Hudson
requested that Ms. Rivers present the item.
Jody Rivers, of The RMPK Group, gave a brief background of the process; the
analysis phase, the organizational format of the Code; and the draft rewrite of the
Code. They are at the second phase and are here today to present the
organizational format, a copy of which is on file in the City Clerk's Office. Ms.
Rivers explained that there are three Tables of Contents.

· Section 2- Proposed Changes
· Section 3- Proposed Code Format
Model Land Development Code
Ms. Rivers introduced John McPherson, an Attorney from Gainesville, Florida,
who is an expert on the Model Land Development Code. Attorney McPherson
stated that it was his firm that wrote the Model Land Development Code in 1989.

At that time a copy was provided to every municipality in the State. The basic law
has not changed, but there have been some procedural requirement changes.
Attorney McPherson explained that The RMPK Group forwards their suggested
changes to him. He reviews them and then makes suggestions to ensure that the
suggestions would fit into the format and that they are written to be user-friendly.
He pointed out that the Model Land Development Code should be a true
integration of the City's LDR. Further, the Model Land Development Code
should have a logical organization, which is being presented to the Commission
today, and which Mr. McPherson reviewed, Article-by-Article:

Attorney McPherson continued to explain that when the material is being
reviewed certain points need to be taken into consideration, such as:
the "essentials of legislative drafting,"
the language needs to be concise, clear and unambiguous as possible,
the regulatory language should be where a person would expect to find it,
internally consistent, and
the number system should be easy to use ("citation friendly")
With regard to the numbering system, Attorney McPherson said it is important
that it be discernible so that people can easily locate the section that they are
looking for. The Code must be legally defensible and consistent with the
Comprehensive Plan. There is a State requirement in Chapter 163 that the LDR
has to be consistent with the Comprehensive Plan. Also, the LDR must be
consistent with case law. There have been a lot of changes in the quasi-judicial
procedures and there are still many questions unanswered. Therefore, it is
important that the procedures in the Code are consistent with what the courts are
saying in that area.

Lastly, Attorney McPherson pointed out that the Code must be consistent with
the U.S. Constitution. Normally, this is not a big constraint, except when there
are issues dealing with signs, freedom of speech, churches and due process,
i.e., adequate notice and hearings.
Ms. Rivers went on to address Section 2 in the book and the Commission was
referred to the language in "red" that are articles RMPK is suggesting be added
to the proposed Code. The language in "blue" is whether to use Model Land
Development Code or Boynton Beach Code Language or in some cases, new
language.
Section 3 is the new Table of Contents for the new Land Development
Regulations for Boynton Beach. This is not final until the Code is rewritten. They
have met with the neighborhoods, planners and developers, and the Chamber of
Commerce. They will also be meeting with the Planning and Development Board
and the CRA Board. Ms. Rivers pointed out that this would be a major revision of
the Code in order to make it better. As soon as the Commission and the other
two Boards approve the format presented tonight, they will begin to rewrite the
Code. Once the rewrite begins, the format presented tonight could not be
changed.
A brief question and answer period followed. Ms. Rivers pointed out that they
would be mainly addressing the organizational issues.
Mr. Bressner asked how the new format would assist him in finding answers to
citizens' questions when it comes to various code and building related issues.
Ms. Rivers said that Mr. Bressner would be furnished with a matrix that will tell
him what was allowable in all the zoning districts in the City. Also, a lot of the
current problem issues will be addressed and rewritten.
Commissioner McCray inquired if this would be available on the Internet and Ms.
Rivers stated that once the Code is codified it would be available on the website.
Ms. Rivers pointed out that they were seeking the Commission's approval tonight
to move ahead with this format and move onto the draft Code rewrite.
Commissioner McCray asked for staff's comments. Mike Rumpf, Planning and
Zoning Director, responded that they are working closely with the consultant.
Ms. Rivers explained that the developers are also pleased with the new format.
With regard to the numbering system, Attorney Cherof noted that the Table of
Contents contained the "rolling numerical sequence separated by decimal
points," which Attorney McPherson had said they wanted to avoid. Attorney
McPherson said that this type of numbering was due to the large amount of

sections in the LDR. Attorney McPherson noted that at some point, the number
sequence changes to letters.
Attorney Cherof inquired if the "definition" section would be broken down into
categories of definitions, or would all the definitions be listed alphabetically in one
place. Ms. Rivers responded that the definitions would be broken down into
categories and some may overlap. She also stated that this still needs fine-
turning to determine whether they want to do a straight alphabetical system.
Attorney Cherof said that he would prefer an alphabetical listing. Attorney
McPherson said that he would continue to work on this. Mr. Rumpf noted that
there is consolidation, but many of the definitions are scattered throughout the
Regulations.
Ms. Rivers pointed out that definitions are a big issue with the Code since there
are definitions spread throughout the entire Code and there is regulatory
language that is required to be used. She stated that all this needs to be cleared
up.
Mayor Broening thanked Ms. Rivers and Attorney McPherson for their
presentation.

INTRODUCTION
This booklet is design to assist the user in understanding how the proposed code format
was developed. Section 1 is the Table of Contents of the Model Land Development
Code. This is a generic code used to guide the development of a new code or the
rewriting of an existing code. Il is comprehensive and may contain information that is
not relevant to a specific municipality. Additionally, it may not contain all the
information needed by a specific municipality; therefore, a number of modifications to
the Model Code were necessary.
Section 2 is the Table of Contents for Boynton Beach's existing Land Development
Regulations. Each Article/Section is followed by information in red and blue
parentheses. The information in red indicates where in the Proposed Land Development
Regulation the article/section is located or if the article/section was deleted. The blue
indicates if the text of the proposed article will be from the existing Boynton Beach Code
(BBC), from the Model land Development Code (MLDC) or new language.
Section 3 is the Proposed Table of Contents for the rewritten Land Developmem
Regulations. The format follows that of the Model Land Development Code using the
regulations required by Boynton Beach.
