Chair DeLiso called the meeting to order at 7:00 p.m.
Approval of Minutes of 3une 18, 2003
Mr. Miriana was concerned that some dates were set for two days after the next Code
meeting and wanted to be sure that the Clerk's office checked the dates. :It was his
understanding that when giving 30 days, the date was to be set for two days prior to
the next meeting and that was not done at the meeting on June 18. Mr. Tolces
explained that when cases are granted 30 days to come into compliance, that date is
shown as 30 days from the date of that Code meeting, regardless of whether or not
that coincides with the next Code Board meeting. When cases are tabled, however,
they are always tabled to the exact date of the next Code Board meeting. (Note: The
C/erk's office determined that a// the tab/ed cases were tab/ed to the correct date, Ju/y
16, 2003. The cases that were given 30 days were not on the date of the next meeting
but for $0 days from the date of the/ast meeting and this was as stated by the Board
members at that meeting.)
Motion
Vice Chair Costantino moved to accept the minutes of .lune 18, 2003, with the notation

Inspector Webb presented the case. The property was originally cited on .lune 2, 2003
as a result of a complaint from a neighbor. Service was accomplished by certified mail.
:Inspector Webb showed the Board a picture with one car covered and one up on jacks,
with a car motor in the driveway behind one of the cars.
.luan Nieves, 403 N.E. 15th Avenue, Boynton Beach, pled not guilty. He stated
that the covered vehicle is not registered and is not operable. The other vehicles are
registered and operable.
Mr. Blasie, Code Administrator, stated for the record that the City Code requires that
vehicles be currently registered and operable. Staff interprets operable as being able to
drive down the road at any given time. Mr. Nieves maintained that he kept the vehicle
up on jacks so that the tires would not go fiat. He has five cars in total, two of which he
uses. He also drives a 1979 Toyota that was vandalized.
Chair DeLiso explained that a person would not be able to take an engine apart in a
driveway but could change a tire, for example. Chair DeLiso suggested that Mr. Nieves
obtain a copy of the Code and advised him that the next step would be a Cease &
Desist Order, which would carry a fine and potentially, a lien against his property.
Motion
Based on the testimony and evidence presented in Case No. 03-1680, Ms. Hammer
moved that this Board find that Juan F. & Maria C. Nieves are in violation of the City of
Boynton Beach Code Section Chapter 15, Article :[X-15-120 (D) 1 Inclusive, and Part 3
of the Land Development Regulations, Chapter 2, Section 5.D.1, and moved to order
that the Respondents correct the violations on or before August 15, 2003. The Board
has considered the gravity of the violations, the actions taken by the Respondents and
any previous violations by the Respondents and hereby orders that if the Respondents
do not comply with this Order, a fine in the amount of $75 per day, plus administrative
costs, shall be imposed for each day the violation continues past August 15, 2003. The
Respondents are further ordered to contact the City of Boynton Beach Code Compliance

Based on the testimony and evidence presented in Case No. 03-373, Ms. Hammer
moved that this Board find that Montalan 3. Thermitus is in violation of the Standard
Building Code 1997 Edition, Section 105.6, and moved to order that the Respondent
correct the violations on or before September 14, 2003. The Board has considered the
gravity of the violations, the actions taken by the Respondent and any previous
violations by the Respondent and hereby orders that if the Respondent does not comply
with this Order, a fine in the amount of $25 per day, plus administrative costs, shall be
imposed for each day the violation continues past September 14, 2003. The
Respondent is further ordered to contact the City of Boynton Beach Code Compliance

Case #03-386
Montalan .1. Thermitus

Inspector Webb reported that this case had originally been cited on February 7, 2003.
No one appeared at the Code Compliance Board hearing of March 19, 2003. The Board
set a compliance date of March 29, 2003 and a fine of $25 per day plus administrative
costs. The violation still exists. Mr. Thermitus needs to have the work done at his
house inspected.
Montalan Thermitus, 1441 N.W. 3rd Street, Boynton Beach, stated that he had a
permit, i[nspector Webb stated that the inspection had been set up but was cancelled.
:Inspector Pierre translated and explained the inspection requirements to Mr. Thermitus

and it appears that Mr. Thermitus believes that he already had the inspection and
passed it.
Chair DeLiso asked Tnspector Pierre to make certain that Mr. Thermitus realized that the
fine was running on his case and that his case would be on the agenda for the August
20, 2003 Code Board meeting.

Ms. Hammer moved to table Case No. 03-386 to the next Code Compliance Board
meeting on August 20, 2003. Vice Chair Costantino seconded the motion that passed
unanimously.
Case #02-3093
David Z. Eunice
607 N. Seacrest Boulevard
Inspector Pierre reported that this property had originally been cited on December 9,
2002 for violations of the Community Appearance Code. No one appeared at the Code
Compliance Board hearing on February 19, 2003. The Board set a compliance date of
March 21, 2003 and a fine of $25 per day. The violations still exist. Inspector Pierre
explained that this case involves an accident where a third party ran into his house in a
vehicle.
David Z. Eunice, 1421 Dandelion Street, West Palm Beach, explained that it had
taken several months to get a Police report on his case. He had also spent a lot of time
with the insurance companies, who fought over who would pay. He was required to
have an independent contractor do the work. He stated that the length of time it took
to complete the work was dependent upon the City's permit approval process and how
quickly the contractor was able to do it. Mr. Eunice stated that he had cooperated fully
with the Code inspectors and Tnspector Pierre agreed that this was the case. Today was
the first time he was aware that the City had heard his case and that there was a fine
involved.
The Board decided to table this case. Chair DeLiso explained that the fine would
continue to accrue, but that when the violation was satisfied, the Board would take all
of the problems and difficulties into consideration.

Mr. Miriana moved to table Case No. 02-3093 until the Code Compliance Board meeting
on October 15, 2003. Ms. Hammer seconded the motion that carried unanimously.
Case #03-1160 DSS Properties 728 Casa Loma Boulevard
]nspector Cain reported that this property had received a notice of violation on April :L1,
2003 for violations of the Standard Building Code. ]nspector Cain stated that this case
pertained to the Two Georges Restaurant, which received a temporary Certificate of

Occupancy in June of 2002. The Board questioned why they were able to continue to
operate in the face of all that remained to be done. Mr. Tolces indicated that in general,
the City was trying to work with the property owner to see that the proper
improvements are made and ensure that the business remains viable. A Code
Compliance Board hearing was held on May 21, 2003 and the applicant appeared. The
Board set a compliance date of June 20, 2003 and a fine of $25 per day. The violations
still exist. Applications have to be filed; permits must be secured; and all remaining
inspections must be done.
Steve Skaggs, owner of the Two Georges, stated that they had been working with
everyone at the City in an effort to obtain the proper permits and resolve the open
issues. He introduced the architect for the project, .]ames Hoffman, who spoke at
length of the various difficulties that they had encountered in trying to bring closure to
this project.
]ames Hoffman, 1494 Roan Court, Boynton Beach, stated that a condition of the
Temporary Certificate of Occupancy (CO) was that all life safety and ADA issues had to
be in compliance before they could open their doors. He referred to the Mediation
Agreement between the former developer and the City, saying that this Agreement
allowed the parking lot to be approved in accordance with temporary standards but
there is no such thing, in fact and so that issue was stuck in the Building Division. The
City has said it would not issue a permit for the south side dock until the parking lot is
complete. He also mentioned that Ms. Byrne, Assistant Development Director, had
come to them with a requirement for lighting that had to be done before getting a CO
and stated that this lighting was not a part of the original requirements. They were
also waiting for the City's Engineering Department to sign off on the bulkheads.
After discussion, the Board felt that it would be wise to table the case and have the
applicant bring back a progress report.

meeting of September 17, 2003. Vice Chair Costantino seconded the motion that
passed unanimously.
Case #03-566
Daniel Morgan
1417 S. Seacrest Blvd.
Inspector Cain reported that this applicant received a notice of violation dated February
4, 2003 for violations of the Land Development Regulations. The applicant appeared at
the Code Board hearing on April 16, 2003. The Board set a compliance date of May 1,
2003 for the hedge issue (trimming required) and a fine of $25 per day. The Board set
a compliance date of .]une 15, 2003 and a fine of $25 per day for all other violations.
The hedges were trimmed and the City recommended "no fine".

Chapter 2, Sections 4.E and 5.F.1, and Chapter 15, Article :[X-15-120 (D) :[nc.
subsequent to the date of compliance specified in this Board's Orders of April 16, 2003,
and in consideration of the gravity of the violations, the actions taken by the
Respondent to remedy the violations, and previous violations of the Respondent, that
this Board impose and certify a fine in the amount of $0.00. Vice Chair Costantino

Case #03-715
Kathleen A. Romeo

:[nspector Cain reported that a notice of violation was issued for this property on March
5, 2003 for violations of the Florida Building Code. No one appeared at the Board
hearing of May 21, 2003. The Board set a compliance date of June 20, 2003 and a fine
of $25.00 per day. The violation still exists.
3udith Arning, 1232 North Ist Street, Lake Worth, stated that she was
representing Ms. Romeo, who had to return to Massachusetts to work. Ms. Arning
related a few details about the case. Attorney Tolces asked Ms. Romeo if she had a
power of attorney for Ms. Romeo and she replied that she did not and did not know she
needed one. The Board determined that there was no one living in the property and
asked Ms. Arning to get a power of attorney from Ms. Romeo and present it at the
August meeting.

Ms. Hammer moved to table Case No. 03-715 to the August 20, 2003 Code Compliance
Board meeting. Vice Chair Costantino seconded the motion that passed unanimously.
Case #02-2852 Victor L. Cook 6S4 W. Ocean Avenue
Tnspector Laverdure reported that the notice of violation in this case had been issued
on November 7, 2002 for violations of the Standard Building Code. No one appeared at
the April 16, 2003 Board hearing. The Board set a compliance date of _~une 15, 2003
and a fine of $25 per day. The violation still exists.
Victor Cook, 654 W. Ocean Avenue, Boynton Beach, stated that he had
resubmitted a permit and was waiting for it to be approved. He stated that he had been
at the April 16, 2003 meeting and had spoken to :[nspector Melillo, who gave him a 60-
day reprieve. He met with Don 3ohnson, who said they would have to find his file and
redo the permit. Then ten days later, the Building Division told him that he would have
to submit new blueprints, which he had done. He was waiting now for an electrical
inspection. The original permit was issued in 1992.

Case #03-685
Nathaniel Alexander

Inspector Laverdure reported that this violation had been issued on March 4, 2003 for
violations of the Community Appearance Code. No one appeared at the May 21, 2003
Code Board hearing. The Board set a compliance date of 3une 20, 2003 and a fine of
$100 per day. The violation still exists. He stated that the fascia needs to be painted, a
permit has to be obtained for the doors, and about a half a pallet of sod needs to be
put down in the yard.
Angel Alexander, 826 S.W. 12th Avenue, Delray Beach, stated that her ex-
husband had died and left the property to her daughter. Tt is a rental property and one
side is rented and the other is not. She had put sod down twice and could not afford to
do it again since she lost her job in February.
Attorney Tolces advised Ms. Alexander about the desirability of obtaining a recorded
deed showing that the property was transferred into her daughter's name.

Inspector Webb reported that the notice of violation was issued on March 14, 2003 for
Community Appearance Code violations. No one appeared at the May 21, 2003 Code
Board hearing. The Board set a compliance date of .]une 20, 2003 and a fine of $75 per
day. The violation still exists.
Anthony Dolphin, 1512 N.E. 2nd Court, Boynton Beach, explained that he had
moved the vehicle two weeks after he first received notification. He had put sod down
more than once. He provided the Board with pictures showing the improvement in the
property. Tnspector Webb agreed that there had been a lot of improvement, but stated
that he still needed more sod. Mr. Dolphin stated that the homeowners in his vicinity
were using a particular spot on his property as a collection point for trash and garbage
pickup and that he was unable to get the grass to grow there. He was advised to get a
"No Dumping" sign. The Board confirmed that May was the last time an inspector had
viewed the property.

fine of $100.00 per day. The property came into compliance on July 3, 2003. The City
recommended No Fine.
Kim O'Grady, listing agent for property under contract, explained the various
steps that had been taken to bring the property into compliance.

Occupational license required
Inspector Laverdure reported that a notice of violation was issued on April 23, 2003 for
requirements for an occupational license to do business and an environmental review
permit. This case was referred to the Code Compliance Division from the Building
Division. Service was accomplished by certified mail.
f4arcellus J. Francois, 408 N.E. 7m Avenue, Boynton Beach, stated that he had
purchased this property two years ago and had tried to fix it up. He pled not guilty. He
could not get his occupational license renewed in his upholstery business, that he had
operated at this location for 15 years, because he needed an environmental review in
order to approve the automotive portion of his business.
Scott Blasie referred to a letter dated April 16, 2003 to Mr. Francois from Mr..lose
Alfaro in the Building Division. He advised Mr. Francois that, "As of today, the process
of your environmental review permit application for M]F Automotive Services submitted
on April 25, 2002 has not been completed." Mr. Blasie paraphrased the rest of the
letter, in which Mr. Alfaro indicated that the City was tired of waiting for Mr. Francois to
do something about this and was turning the matter over to the Code Division. The Fire
Department has been to the property and found the oil change business in full
operation. The environmental review was never completed; therefore, a license was
not issued.
Omar Omuri, real estate broker, helping Mr. Francois to bring closure to this issue,
spoke to Mr. Alfaro about this. ]:n trying to help Mr. Francois, he put the property on
the market. There are three permits that are required and they were in the process of
taking care of all of them. There are two serious buyers who are looking at the
property. All the vehicles mentioned in the original complaint have been removed. The
gentleman who is doing the repair has been told that he has to vacate the premises
and he is almost out of there. They had not put the permits in place to take care of the
violations from the previous owner yet because they were negotiating with the new
