"AN ACT TO AMEND SECTIONS 5, 6 AND 8 OF ARTICLE
I; SECTION I, OF ARTICLE III; SECTIONS 1, 2, ~
AND § OF ARTICLE IV; AND SECTION I OF ARTICLE
V OF THE CHARTER OF THE TOWN OF BOYNTON
W~EREAS, the Charter of the Town of Boynton, in Palm
Beach County, Florida, embraced in Chapter 8918, of the
laws of Florida, Special Acts of 1921, in the opinion of
the Town Commission of said Town has become inadequate
for the needs of said municipality; and,
WHEREAS, in the opinion of the Town Com$ission of said
Town it is deemed necessary, expedient and advisable and
to the best interests of the Town of Boynton, its inhabit-
ants, citizens and taxpayers, that certain sections of the
said Charter of the Town of Boynton be an ended to provide
for a Town Commission of five members, instead of three
as now provided for, prescribing the term of office of the
members of the Town Commission, their Jurisdiction, powers
and the manner in which they shall be nominated and elected;
to provide for the election of two Commissioners; to
prescribe the time for the holding of general elections
on said municipality; to presscribe tb~ qualifications of
voters at such general elections; to provide further and
additional powers for said municipality; to provide for a
Municipal Court fer said Town, presided over by a Munici-
pal Judge to bee appointed by the Town Commission, instead
of the Mayor's Court presided over by the Mayor as now
provided for; to provide for an election for the ratificat[ on
or rejection ~ such amendments by the qualified voters
who are freeholders in said Town$ and to repeal all other
laws or parts of laws relating to or affecting said Town
in conflict with such amend~ants;
NOW THERFi~0RE BE IT RESOLVED BY THE TOWN COMMISSION OF
~HE 'T01~ OF BOYNTON, IN PALM BEACH COUNTY, FLORIDA:
That a special act to be entitled:
"AN ACT TO AMEND SECTIONS 6, 6 AND 8 OF ARTICLE I;
SECTION 1, of ARTICLE III; SECTIONS 1, 2, ~ and $
· ]~C~RTICLE IV; AND SECTION i OF ARTICLE V OF THE
CHARTER OF THE TOWN OF BOYNTON~ IN PALM BEACH
COUNTY, FLORIDA~ EMBRACED IN CHAPTER 8918~ OF THE
LAWS OF FLORIDA, SPECIAL ACTS OF 1921~ THE SAME
BEING AN ACT ENTITEE D "AN ACT TO ABOLISH THE
PRESENT MUNICIPAL GOVERNMENT OF THE TOWN OF BOYNTON,
IN PALM BEACH COUNTY~ FLORII~; TO CREATE AND
ESTABLISH A NEW MUNICIPALITY TO BE KNOWN AS THE
TOWN OF BOYNTON~ IN PALM ~EACH COUNTY, FLORIDA;
TO LEGALIZE AI~) VALIDATE THE ORDINANCES OF SAID
TOWN OF BOYNTON, AND OFFICIAL ACTS THEREUNDER;
AND FIX AND PROVIDE ITS TERRITORIAL LIMITS,
JURISDICTION AND POWERS~ AND THE JURISDICTION
AND POWERS 0F ITS OFFICERS;" TO PROVIDE FOR A
TOWN COMMISSION OF FIVE MEMBERS, THEIR TERM OF
OFFICE, JURISDICTION~ PBWERS AND THE MANNER IN
WHICH THEY SHALL BE NOMINATED AND ELECTED;
PROVIDING FOR THE ELECTION OF TWO COMMISSIONERS;
PRESCRIBING THE TIME FOR THE HOLDING OF GENERAL
ELECTIONS IN SAID MUNICIPALITY; PRESCRIBING THE
QUALIFICATIONS OF VOTERS AT SUCH GENERAL ELECTIONS;
TO PROVIDE FURTHER AND ADDITIONAL POWERS FOR SAID
MUNICIPALITY; TO PROVIDE FOR A MUNICIPAL COURT,
PRESCRIBING ITS JURISDICTION AND POWERS; PROVIDING
FOR THE RATIFICATION OR REJECTION OF SUCH ANENDMENTS
BT THE QUALIFIED VOTERS ~t0 ARE FREE~0LDERS IN SAID
MUNICIPALITY; AND TO REPEAL ALL OTHER LAWS OR PARTS
0F. LAWS RELATING TO OR AFFECTING SAID TOWN IN CONFLICT
WITH THIS ACT"
be prepared and submitted to the Legislature of the Stmte
of Florida at its 193V session for passage
2 That notice of intention to apply to the Legislature
of the State of Florida at its'lg~V session for the passage
of the special act as set forth in Section 1, hereof, be
publis~d in the Palm Beach Times, of West Palm Beach,
Florida~ one time as provided by the Constitution and Laws
of the State of Florida, notwithstanding the fact that there
sl~ll be a referendum attached to said special act
That a copy of this Resolution shall be sent with
said special act to the Representatives from Palm Beach
County, Florida, as well as th~ State Senatc~ represent-
ing Palm Beach County, Florida,urging them to pass said
apecial act
4 That ~a P Somerville, a resident, citizen and tax-
payers of the Town of Boynton, Florida, be and he hereby
is appointed a Deputy Town Clerk ~f the Town of Boynton,
Fl~rida, for the purpose of typewriting said special act
ami taking same when completed to Tallahassee, Florida,
ar~ presenting same to the Representative8 and State
Senator representing Palm Beach County, Florida, to intro-
duce for passage by the ~egislature of Florida at its
lgS~ session; and that ~n P Somerville be paid a reason-
able compensation for such services as well as hi8 expenses
