Foreclosure suit-Chancery 12341RESOLUTION
( A RESOLUTION GOVERNING PROCEDURE IN FORECLOSURE SUIT BEING KNOWN
AS CHANCERY NO. 12,~41. )
WHEREAS, the Town Commission of the Town of
Boynton, Florida, has heretofore foreclosed against certain
lands located within the Town of Boynton, Florida, such
foreclosure suit being known as Chancery No. 12,341; And,
WHEREAS, the Town of Boynton is indebted to the
Lake Worth Herald Publishing Company inthe sum of Two Hundred
and no/100 ($200.00) DollarS, said sum being the balance due
the Lake Worth Herald Publishing Company for the publishing of
the Notice of Foreclosure and the Notice of Sale in the above
styled suit; And,
WHEREAS, the said Lake Worth Herald Publishing
Company is willing to take a promissory note in payment
thereof, provided that ample provision is made for there-
demption of said note on or before Decembers. S, A. D. 1938.
THEREFORE BE IT RESOLVED, That the Mayor of said
Town, M. A. Weaver and the Clerk of Said Town, A. V. Peterson
be and they are each hereby authorized, ordered and directed, for
and on behalf of said Town, to ~ake, execute and deliver to
said Lake W~rth Herald Publishing Company, a promissory note
in the principal sum of Two Hundred and no/lO0 ($200,00)
Dollars; said note to be dated July 5, A. D. 1938 and to be
due and payable on or before December 8, A. D. 1938, together
with interest at the rate of 6 (6%) percentum per annum.
BE IT FURTHER RESOLVED that a sufficient amount
of money which may be realized from the sale of lands which
were included in the above named suit be set aside for the
payment of said note.
BE IT FURTHER RESOLVED that in the event sales of
such lands are not sufficient to redeem said note, then, in
that event, there is hereby appropriated a sufficient sum of
monies from the General Fund to meet said obligation when due,
or the balance thereof remaining unpaid.
