We received $4,943.21 in interest from the Money Market Account this month.
There were three payrolls with the month of July. $2,250.00 was sent to Lord Abbet to
setup the 457 Retirement Plan accounts, administration and vesting schedule.
Due to checks being process on July 1 and July 29 the following expense categories
include payments for July and August; Health Insurance, Rent Expense, Telephone,
Electric and Copier Rental.
High Ridge Properties was paid for the completion of their Facade Grant request
approved by the CRA Board on July 8, 2003.
Staff received two refunds totaling $ 495.56 for BD Cole Insurance for insurance
policies that were cancelled upon the CRA obtaining insurance as an agency.
Staff will be bringing the Budget Transfer Request to the CRA Board for approval in
September for the following categories.

Staff is recommending the following changes, identified in italic and bold, to the
Procurement Manual. These changes will accommodate the purchase of food
and drink during CRA business luncheons, business meetings and business
entertainment activities to improve the proficiently in processing Iow dollar value
purchases.
CRA PURCHASING POLICY MANUAL
PURCHASING CREDIT CARD
PURPOSE:
The CRA Purchasing Credit Card Program is designed to improve efficiency in
processing Iow dollar value purchases from any vendor that accepts the Visa /
MasterCard or American Express credit card.
This program will allow the cardholder to purchase approved commodities and
services as well as use for CRA business luncheons, business meetings
and business entertainment activities directly from vendors. Each purchasing
credit card is issued to a named individual and the CRA's name is clearly shown
on the card as well. The tax-exempt number will be given to each cardholder.
The CRA Director will monitor the performance of the program. The purpose of
these policies and procedures is to accomplish the following:
To provide an efficient method of purchasing and paying for goods and
services as well as use for CRA business luncheons, business
meetings and business entertainment not exceeding $500 per
purchase (total invoice).
2. To replace manual hardcopy requisitions and purchase orders for Iow
dollar value purchases.

3. To ensure purchasing credit card purchases are in accordance with the
CRA's policies and procedures.
4. To ensure that the CRA bears no legal liability from the inappropriate use
of the purchasing credit cards.
5. To provide for disciplinary action if the purchasing credit cards are
misused.
The policies and procedures provided herein are minimum standards for use.

SUBJECT: Proposed Language Changes to Human Resources Manual

The following language changes, identified in italic and bold lettering, are
proposed to the Human Resources Manual. These changes are in response to
the CRA Board's decision to incorporate Long Term Disability and Life Insurance
into the Employee Benefits Program.
Staff has expanded the "Leave Without Pay" benefit to One Hundred Six (106)
days to cover an employee until Long Term Disability coverage begins. Upon
review of the documents received from Principal Edge, the coverage provider, all
invoices must be paid until the employee is placed on Long Term Disability.
Principal Edge has confirmed that there is no gap in coverage from Short Term to
Long Term. Also, once an employee is on disability the CRA's responsibility to
pay premium coverage ends. As a result the employee can be discharged for
their position once Long Term Disability begins.
6-7 DISABILITY
Regular full time Exempt and Non-exempt employees may experience illness or
disability requiring that an employee is not able to work for a duration of time that
may or may not be defined at the onset of the illness or disability. Employees
under a physician's care that require an extended duration of time away .from
work due to such illness or disability will have their positions (or a position of
equal compensation and comparative duties/responsibilities) held for a maximum
of...,...,~"*" mm~..../One Hundred Six (106) working days, constituting a total of 480 848

Employees exercising provisions of this section may continue their regular
compensation through use of the employee's accrued sick, annual, and/or any
otherwise authorized accumulated/credited leave time that has been
earned/accrued by the employee and recorded by the CRA. Employees that do
not return to work at or prior to the expiration of the allowable 480 848 hours will
be deemed to have abandoned their position with the CRA.
The CRA does provide Short Term and Long Term Disability policies to all
regular full time Exempt and Non-exempt employee.
6-8 LIFE INSURANCE
Afl regular furl time exempt and not-exempt employees will be eligible for
$100,000.00 of Term Life Insurance.
6-9 LEAVE WITHOUT PAY
A regular full time exempt or regular non-exempt employee may be granted leave
of absence without pay for a period not to exceed o~-'*,, mm One Hundred Six
(106) working days (48~ 848 hours) for illness, disability or other reasons. Such
reasons, other than physician attended illness or disability, must be outlined in
writing and submitted to the CRA Executive Director for review and approval or
denial.
Employees may not be employed elsewhere during an authorized Leave without
Pay period of time. Such leave shall require the prior approval of the CRA

6-10 MEDICAL AND DENTAL INSURANCE
The CRA will offer regular full time employees medical and dental insurance
coverage comparable to those programs offered by the City of Boynton Beach.
The CRA Executive Director will perform a review of the medical and dental
insurance coverage every year and provide the CRA Board with the information

to make an informed decision on the selection of medical and dental insurance
coverage for the CRA staff. The CRA will cover the cost for exempt and non-
exempt full time employee medical and dental insurances. The CRA employee
will cover any additional cost for any additional coverage selected for spouse
and/or children of the employee. Employees on approved leaves of absence
must pay the non-subsidized rate for all insurances in effect during their leaves of
absence.
6-11 RETIREMENT
All regular full time exempt and non-exempt employees will be eligible to
participate in the CRA' 's 457-retirement benefits plan after one (1) year of
continuous employment. The CRA will match the employee's contribution up to
5% of the employee's gross salary on an annual basis. The employee will receive
a 20% vesting schedule each year and be considered 100% vested after five (5)
years.

The site is currently an undeveloped cleared, 1.44-acre lot. It is
predominately vegetated with a variety of overgrown grasses. There is no
other vegetation of any significance. The subject property is surrounded by
other industrial uses, and zoned M-1. The north property line of the subject
property is screened by a chain link and wood fence.
BACKGROUND
The applicant, Thomas Potter is seeking approval to construct a 2,800 square foot
building measuring fourteen feet (14'-0'') in height, and a 1,250 square foot
warehouse building with a height of twenty-one feet (21"-0"). This proposal includes
a future 1,440 square foot warehouse building. Further, a "paved equipment storage
area" is proposed at the rear (east) of the property. The buildings, with related
parking will be for a paving contractor business (See Exhibit "B" - Proposed Site
Plan).
ANALYSIS
A traffic statement for this project was submitted and was sent to the Palm
Beach County Traffic Division for their review and approval. The Palm Beach
County Traffic Division determined the project is in compliance with the Traffic
Performance Standards of Palm Beach County.
Conceptual drainage information was provided for the city's review. The city's
concurrency ordinance requires drainage certification at time of site plan
approval. The Engineering Division is recommending that the review of
specific drainage solutions be deferred to time of permit review (see Exhibit
"C" - Conditions of Approval).
The project proposes one (1) main point of ingress / egress along West
Industrial Avenue. The entrance would be comprised of a 32-foot wide ingress
/ egress driveway. The proposed on-site traffic circulation system consists of
one (1), two-way drive aisle 27-feet in width, extending through the interior
of the site. Since the project is within the Community Redevelopment Agency
boundaries, the required backup distance for parking lot drive aisles is
reduced from 27 feet to 24 feet in width.
The parking spaces required for the proposed project have been tabulated based on
the ratio of one (1) space per 500 square feet of gross floor area, which is required
for manufacturing and industrial uses. Based on the total square footage proposed,
11 parking spaces are required. However, the applicant is providing a total of 15
parking spaces including two (2) handicap spaces. All spaces except the handicap
spaces will be dimensioned nine and one half feet by eighteen and one-half feet (9
1/2'x 18 1/2') and will include wheel stops. 3268

Landscaping=
The proposed landscape material would fully meet the code requirements when staff
comments are incorporated. The proposed pervious or "green" area is 11,473 square
feet or 19% of the total site. A 50-foot wide drainage easement is currently located
along the western (front) property line. A seven (7) foot wide landscape buffer is
proposed east of the aforementioned easement area. This landscape buffer would
contain Royal Poinciana and Yellow Elder trees with ]:xora Nora Grant and Blue
Plumbago shrubs to be planted at the base of the trees. A landscape buffer five (5)
feet in width would be provided along the north, south, and east property lines.
These perimeter buffers will have a row of Cabbage Palm, Live Oak, and Golden
Trumpet trees. The foundation plantings around the building are extensive, exceed
code requirements and further enhance the site. The development would be provided
with the required amount of perimeter and internal landscaping as required in the
Land Development Regulations, Chapter 7.5 Article :[]:.
Building and Site.'
Building and site regulations would fully meet code when staff comments are
incorporated into the permit drawings. The maximum height allowed by the M-1
zoning district is 45 feet. All proposed buildings would comply with this maximum
height requirement.
Design:
The proposed building facade, as viewed from the south elevation (see Exhibit "B'~,
is standard of the typical one (::[)-story industrial struCtures constructed in this M-1
zoning district. The proposed building front fa~;ade would have a single door entry
covered with a yellow awning facing south. The proposed rectangular-shaped
building would be constructed of stucco painted white (Behr W-F-620). Banding with
multiple score lines is proposed at the higher portion of the building and to be
painted yellow (Behr S-G-350) and black (Behr DC4C-20-4) on a stucco finish. The
window and single door entry will be white while accent band trims will be black in
color.
Signage:
The project is proposing one (1) wall sign. The wall sign measures 14.5 square feet
and would be located on the proposed yellow awning covering the entry on the east
facade depicting the company's name. One (1) double-faced freestanding monument
sign is proposed depicting "The Paving Lady, Inc". lettering measuring 36 square feet
in area. This site sign is to be placed in the "drainage ditch" and would extend
approximately 6 feet above the sidewalk grade. The proposed wall signs and the
freestanding sign comply with sign standards including maximum sign area and
height as set forth in the Land Development Regulations, Chapter 21.
RECOMMENDATZON:
The Technical Review Committee (TRC) has reviewed this request for new site plan approval. The Planning
~nd Zoning Division recommends that this request for site plan be approved, subject to the comments
duded in Exhibit "C" - Conditions of Approval. Staff also recommends that the deficiencies identified in
:his Exhibit "C" be corrected on the set of plans submitted for building permit. Any additional conditions
recommended by the Board or City Commission shall be documented accordingly in the Conditions of
Approval.

BACKGROUND
Mr. Carl A. Cascio, agent for the First Baptist Church of Boynton Beach is requesting a one (:[)-year time
extension, for the major site plan modification approval (HSPM 0:[-02:[) originally granted on May 2:[,
2002. :[ts accompanying request for a height exception (HTEX 02-00:[) was simultaneously approved with
the site plan.
The subject property currently contains dual zoning districts, namely Neighborhood Commercial (C-2) and
Single-family Residential (R-lA). The northern one-half of the property is zoned R-:[A and the southern
one-half is zoned C-2. It is also comprised of.several lots assembled as one (:[) parcel under one
ownership for a total of 3.84 acres.
At one time, Northwest 3rd Court traversed through the interior of the subject parcel. The original
abandonment process of this right-of-way began in :[994 when a 374-foot segment of Northwest 3rd Court
was abandoned per Resolution 94-53 and closed to Seacrest Boulevard. The 1999 request to abandon the
remaining portion of the right-of-way for the anticipated church expansion is now complete.
The subject site is developed with an existing 23,040 square foot church. Built in :[948, the church is
located at the northwest corner of Boynton Beach Boulevard and Seacrest Boulevard. The property owner
(First Baptist Church of Boynton Beach) proposes to construct a two- (2) stow 31,192 square-foot
expansion to the existing church facility for a total of 54,230 square feet. The applicant has already
demolished a commercial building on the lot in order to accommodate the church expansion. If this
request for site plan extension is approved, the new expiration date of this site 'plan would be May 21,
2004.
ANALYSZS
On May 21, 2002, the City Commission approved this major site plan modification subject to 28 conditions
of approval. All project conditions of approval pertaining to the site plan would still apply. The
accompanying height exception (HTEX 02-00::[) application contained no conditions of approval.
According to Chapter 4, Section 5 of the Land Development Regulations, "the applicant shall have one (:[)
year to secure a building permit from the Development Department". Tt states further that the City
Commission may extend the approval for one (:[) year provided that the applicant has filed a request for
a time extension prior to the expiration of the original approval. Tn this case, the applicant has met the
requirement. The Planning & Zoning Division received the application for a site plan time extension on
February :[6, 2003, prior to the expiration date.
On -~anuaw 27, 2003, the appliCant submitted drawings for building permits for the new church building.
Building Division staff reviewed the permit application and prepared comments to the applicant. A time
extension for the building permit application, which is set to expire on October 2:[, 2003, has been filed
with the Building Division. Therefore, the applicant is acting in "good faith" to start construction of the
church expansion,. These reasons are justification and need for the formal request for major site plan
modification extension. However, the applicant may be required to submit an updated traffic study with a
build-out year past 2003 in order confirm continued compliane with the Traffic Performance Standards of
Palm Beach County (see Exhibit "B"- Conditions of Approval).

RECOMMENDA'Y~ON
Staff recommends approval of this request for a one (1)-year time extension of the major site plan
modification approval (MSPM 01-021)) and its corresponding height exception (HTEX 01-003). This
recommendation is based on the "good faith" effort shown to build the project, the fact that traffic
concurrency has been maintained, and no changes have been made to the Land Development
Regulations that would impact this project since it was approved in 2002. Approval of this request for
site plan extension would extend the project's expiration date to May 2:L, 2004.
All conditions of approval included in the initial development order must still be satisfactorily addressed
during the building permit process. No new conditions of approval are recommended in conjunction with
this site plan extension except for perpetual maintenance of the approved traffic concurrency. In any
case, any .new conditions of approval recommended by the Board or required by the City Commission
would be placed in Exhibit "B" - Conditions of Approval. Staff would not support a second extension, if
so requested, due to the upcoming rewrite of the Land Development Regulations. The site plan would be
required to meet all new regulations at that time.

Pursuant to the City Manager's request, I have consulted with Permitting staff and the City
Attorney's office to discuss revising Chapter 2, Section 4.J. 15 of the Land Development
Regulation to limit encroachment by docks into City waterways. Currently Section 4..[. 15 allows
docks to project into a waterway up to one-third of the navigable width of the waterway. To
remain consistent with the Army Corp. of Engineers, the Department of Environmental
Protection, South Florida Water Management District, and the Lake Worth Drainage Disthct, we
are proposing to change the encroachments of the current ordin_ance from one-third of the
waterway to one-fourth of the width of the waterway.
The philosophy behind the proposed change is to remain consistent with the other regulatory
bodies. The second reason for the change.is to ensure that two neighbors on opposite sides of the
waterway would each encroach only twenty-five percent of the waterway, leaving fit'cy percent
of the total waterway open for navigable purposes.
We have analyzed the affect that the proposed change to this ordinance will have on the citizens
of Boynton Beach and offer the following:
Legal Non-Conforming Doeks/IVlarine Facilities - These will be docks/marine
facilities that were previously permitted to be up to a max/mum of th/try-three percent
of the canal width. These docks/mar/ne facilities would be able to remain and be
maintained as legally permitted. Legal Non-Conforming docks/marine facilities
would not be able to be increased in size that would add to the non-conformity. The
existing docks/marine facilities could be added to only in compliance with the new
ordinance requirement of twenty-five percent max/mum encroachment into the width
of the canal. Approval from any other regulatory authority would be necessary pr/or
to application for permit to the City Of Boynton Beach. These new docks/marine
facilities would have to meet all applicable building codes.

New Permitted Docks/Marine Facilities - Upon approval of the changes to the
proposed ordinance, these docks/mar/ne facilities would not be allowed to encroach
more than twenty-five percent maximum into the ca,ual as per the proposed ordinance.
These new docks/marine facilities would have to receive approval from any other
regulatory authori .t-7 prior to application for permit to the City Of Boynton Beach and
must meet all applicable building codes.
Unpermitted Docks/Marine Facilities - These are docks/marine facilities that have
been installed without benefit of permits and would be in violation of Section 104.1.1
of the Boynton Beach Amendments to the 2001 Florida Building Code. These
docks/marine facilities would have to meet all current permitting requirements for
docks/marine facilities. These docks/mar/ne facilities would be required to meet the
maximum encroachment of twenty-five percent of the waterway. If the docks/marine
facilities' encroachment exceeds the maximum twenty-five percent of the canal
width, it would be necessary to remove any portion that encroaches over the
maximum twenty-five percent limit. Approval of any other regulatory authority prior
to application for permit City Of Boynton Beach would be necessary and the
unpermitted dock/marine facility would have to meet all applicable building code
requirements.
The Permitting staff also conducted a random sampling of the ten most recent docks/mar/ne
facilities permits that we have issued. It was determined that all ten of these docks meet the
twenty-five percent max/mum encroachment of the waterway.

You have asked us to supply any suggested changes to Section 4.J. 15 - OTHER STRUCTURES,
of the above referenced ordinance. I would like to propose that the following wording be added
in order to remain consistent with Section 104.1.1. of the Boynton Beach Amendments to the
2001 Florida Building Code - Marine Facilities:

Open terraCes, including walkways, unenclosed decks and slabs, natural plant
landscaping and docks, with or without canopy. Docks projecting into
waterway owned by a different property owner than the owner of the dock
shall require prior approval at time of permitting from the owner of the

~NTRODUCTION
The Florida Department of Community Affairs (DCA) has reviewed the Comprehensive Plan text
and future land use map amendments, adopted by the City on 3une 17, 2003, and has agreed
to find them "in compliance", if the City will adopt remedial amendments to add ranges of
allowable percentages of land uses within the Hixe~J Use (MX) and Mixed Use-Core (MX-C) land
use categories as defined in Future Land .Use Element Policy :t.:L6.1. DCA has cited the
requirements of Rule 93-5.006, FAC, which reads:
"(c) Mixed use categories of land use are encouraged. ];f used, policies for the
implementation of such mixed uses shall be included in the comprehensive plan,
including the types of land uses allowed, the percentage distribution among the
mix of uses, or other objective measurement, and the density or intensity of
each use." (underline added)
PROCEDURE
Upon review and approval by the CRA Board and the City Commission and First Reading of the
adopting ordinance, the proposed amendments will be transmitted to DCA for their review.
Since the amendments are "remedial," they will be counted as part of the current large-scale
amendment cycle. Staff expects an expedited review process by DCA.

The Department of Community Affairs (Department) has completed its review of the adopted
Comprehensive Plan Amendment, Ordinance Numbers 03-026, 03-027, 03-025, 03-030, 03-031
and 03-033 (DCA No. 03-1), for the City of Boynton Beach, as adopted on June 17, 2003, and
determined that it meets the requirements of Chapter 163, Part II, Flor/da Statutes (F.S.), for
compliance, as defined in Subsection 163.31 $4(1)(b), F.S. The Department is issuing a Notice of
Intent to find the plan amendment In Compliance· The Notice of Intent has been sent to the Palm
Beach Post for publication on August 11, 2003.
The Department initially raised objections regarding the proposed increase in density
pertaining to the Mixed Use Core land use designation that is located within the Coastal High
Hazard Area (CHHA) east of Federal Highway. City staff provided additional information
confirming that the City had acquired other lands within the CI-FrtA, just north of this property
within planning Area III, thereby substantially offsetting the proposed increase in density.
However, in order to meet the intent of the policy language, the acquired properties must also be
locnted x~ itl'~in the Mixed Use Core land use category. Based on our discussions with your staff,
it is our understanding that the City will proceed with an amendment to designate the acquired
lands as Mixed Use Core or add policy language that documents the transfer of development
fights from the acquired lands to the Mixed Use Core properties.
It is also our understanding that the~roceed with an amendment to establish mixed
use controls to define how much land may be devoted to commercial, residential and other land
uses within the Mixed Use Core and Mi~-ed Use Low Intensitz land use categories as required ._by
Chap[er 163, F.S. and Rule 9J-5, Flor/da Administrative Code. These standards are necessary ~n

The Department's notice of intent to find a plan amendment in compliance shall be
deemed to be a final order if no timely petition challenging the amendment is filed. Any affected
person may file a petition with the agency within 21 days after the publication of the notice oi:

Pathways system has conducted a walk through of the area. Staff

Direct Incentive Program and loan for the Arches. - Legal Staff
is generating the draft document. The second review

Ocean District Redevelopment Plan Update - City Planning
Department is drafting the plan study. Plan was accepted in the
May 13th Board meeting and a workshop was set to review the
update. The CRA Staff is working with City Staff and CRA Board
on the revisions. The meeting with City Staff to work on thc
revisions is completed. The draft proposed will be completed
and sent to the CRA Board in September 2003
MLK Property Acquisition Phase I - Staff has begun meetings
with the area property owners about redevelopment. Developers
and owners are being assembled for creation of development
strategies to begin projects. Target Au_oust for public
announcements.
CBD Parking Acquisitions - Negotiations have been underway to
acquire future public parking spaces. Project scope includes
several existing owners in the targeted Block. Comprehensive
Redevelopment Master Plan for the Block is being completed by
the private sector. Tar_~Tet August for "letter of understandinq"
between the various parties.
Contract for Real Estate Services - Individual Work Tasks are
being defined by Staff and TUG. Focus will be on the first priority
properties, three key properties for acquisition and/or condemnation
as identified by the City Planning Department. Staff is
coordinating with Developer and the City
RFQ for Boynton Beach Blvd District Redevelopment Plan Up-
date- Initial meeting upon approval in July. Schedule set for
work program. Copies distributed to the Board
Financial Investment Strategies - Staff developed a RFQ for
investment strategies, which has been reviewed by legal. Staff is
presenting the RFQ to the CRA Board on Consent Agenda.
Staff will be recommending a CSC Committee to review an~J

Human Resources - Staff is in the process of hiring a
Secretary. Approximately One hundred resumes were
submitted. Sixteen candidates were selected for the first round
of interviews. Finalist will be ranked and the second round of
interview will be conducted after third party testing of
grammar, tv=ing and proof reading skills have been

Museum Feasibility Study- Savage Creatures of Ancient Seas
Museum staff feasibility study has been completed. Three RFQ's
responses have been received. Review committee member
suggestions are bein_cl presented to the CRA Board August
2003. Selection of the Feasibility Team will be presented for
the September 2003 Meeting.
· CRA Budgets -The revised 2003-2004 bud.qets will be
delivered to the CRA Board for review prior to the September
9, 2003 Board Meeting. The 2003-2004 bud.qet will be placed on
the September 2003 CRA Board meeting for approval.
CRA Brochure and Web Site Development - A letter of interest
for seeking graphic designer and web services has been advertised
and 8 candidates have responded. Staff is currently reviewing the
submitted materials. If the project costs exceed $10,000, the CRA
will have to go through the traditional public bid process. Tar.qet
information back to the Board in August.
Events - The overall event strategy is being formally formatted for
each event with goals, projections and time schedules. Alliances,
Resources and sponsors are been developed Initial contact has
been made with the identified partners and the first draft of the
plan has been completed. Tar.qeted for September.
Group B
· High School Adaptive Re-Use Task Force - The Taskforce is
scheduled to submit a contract for structural and
environmental status review. Contract should be approved by
September 2003.
Land Development Regulation (LDR) - LDR re-write by the City
of Boynton Beach over the next several months. CRA asked to
submit concerns, ideas, etc. Staff is interfacing on re-write
language and reviewing the Second draft concept.

Affordable Spaces Incentive - Program to reward projects for
inclusion of below market Retail, Commercial and Residential
spaces. Developing incentives and possible criteria guidelines for
program. The CRA Board has received a complete Draft.

of Boynton District in order to ensure a competitive environment
once proposed redevelopment for those areas are actualize. Data

GISMO Mapping System - Bringing in-house the mapping system

Infrastructure Size and Availability - Working with the City of
Boynton Beach on project planning to assess the growth impact on

BACKGROUND INFORMATION
The CRA serves an area of approximately 6 square miles. The CRA was created
under Florida Statutes 163.356 in 1982 and has operated as a unit of a local
government within the boundaries of the CRA in Boynton Beach. On October 1,
2002 the CRA was given independent status by the City and is controlled by a
CRA Board. The CRA consists of the following: Executive Director, Controller
and Secretary.

PART IV - QUALIFICATION REQUIREMENTS
4-1 SUBMISSION OF QUALIFICATION
The PROPOSER must submit the following to be considered for this RFQ:

asked to consult with the bond-working group to select the Investment
Banker Services associated with the Tax Increment Bond Financing.
Bond Phase II- The PROPOSER shall:
a. prepare the CRA thoroughly for any necessary rating and assist in
obtaining the most favorable rating possible.
b. provide assistance and recommendations with the selection of
ancillary service providers such as registrar, trustee, bond counsel and
printer.
c. advise on the appropriate timing of the bond sale, terms and
conditions of the sale including maturity schedule, underwriter
discounts, advising on redemption provisions, provide interest rate
bidding requirements and basis for award.
d. advise staff as to the advantages and disadvantages of a negotiated
versus a public sale of bonds.
e. provide CRA Bond Counsel with information and details necessary for
the drafting of the authorizing bond resolution or ordinance and
validation documents.
f. act as a liaison with CRA Bond Counsel and coordinate other
professionals providing information in connection With the proposed
financing.
g. assist the staff in preparation of the comprehensive official statement
of the bonds in conformance with full disclosure guidelines and
arranging for its printing.
h. provide the following work products for each competitive and
negotiated debt offering; Presale Analysis, Offering Statement, Notice
of Sale and Bid Forms, Postsale Analysis, Rating Agency Presentation
outlines and other such analysis, cash flow projections and materials
necessary for financial planning and bond sale purposes.
i. direct bond-closing details including coordination with bond counsel in
order to ensure delivery in the shortest possible time frame.
j. furnish prompt, complete reinvestment analysis so that maximum
earnings will result for investing bond proceeds, in addition to assisting
staff with establishing a schedule for drawdown of funds, if any.
k. direct, coordinate and supervise preparation of the transcript and
provide the CRA with bond and interest records showing required
semiannual payments and other information relevant to the completed
financing.

PART I - INTRODUCTION
1-1 WORK OBJECTIVE
Boynton Beach Community Redevelopment Agency, hereinafter know as the
"CRA" is seeking qualifications from a Firm interested in providing Financial
Advisory Services, hereinafter known as '"THE PROPOSER". The PROPOSER
will provide comprehensive financial planning services to aid in the development
of a five (5) year financial strategy to accomplish the CRA's budget goals.
PART II - SCOPE OF SERVICES
2-1 SCOPE OF WORK TO BE PERFORMED
THE PROPOSER shall perform the following services for the CRA when authorized.
Planning and Development Phase 1- THE PROPOSER shall:
a. attend meetings as requested by the CRA for the purpose of
developing a long term plan to address all proposed programs and
capital needs and how these needs should be funded.
b. perform a comprehensive analysis on the budget's financial needs.
c. carefully analyze financing methods to determine the best methods for
the CRA consistent with current economic and capital market
conditions and increasingly stringent rating agency criteria. The
PROPOSER shall provide advice as to the advantages and
disadvantages on long term financing and credit enhancements. The
PROPOSER will make recommendations as to the use of municipal
bonds, surety bonds, letters of credit or other credit enhancement
devices.
d. prepare a comprehensive plan for the .offering of bonds, taking into
consideration federal arbitrage regulations and other legal parameters,
presenting financing alternatives, evaluating debt capacity, evaluate
future flexibility and vulnerability to market conditions, estimating
financing cost and setting forth various structuring alternatives.
~ e. consult with Moody's, Standard & Poor's or Fitch with regard to the
proposed financing, attend meetings and participate in those meetings.
f. prepare a time schedule coordinating the actions of the CRA and other
members of the bond working group, estimating the date of the sale of
bonds and availability of the proceeds. The PROPOSER may be

TECHNICAL QUALIFICATIONS
General Requirements- The purpose of the-Technical Qualifications is to
demonstrate the qualifications, competence and capacity of The PROPOSER
seeking to undertake the financial advisory needs of the CRA. The Technical
Qualifications shall state The PROPOSER and the staff to be assigned to this
engagement.
The RFQ should provide a straightforward concise description of The
PROPOSER's capabilities to satisfy the requirements of the RFQ and Scope of
Work. While additional data may be presented, the following subjects listed
below must be included and they represent the criteria against which each RFQ
will be evaluated.
Independence- The PROPOSER should provide an affirmative statement that it
is independent of the CRA and the CRA Board.
The PROPOSER shall also describe any professional relationships with any
CRA Staff or CRA Board Members for the past five (5) years, together with a
statement explaining why such relationships do not constitute a conflict of
interest relative to performing the Financial Advisory Services.
In addition, The PROPOSER shall give the CRA written notice of any such
professional relationships entered into during the period of this agreement.

License to Practice in Florida- An affirmative statement should be included
that The PROPOSER and all assigned key professional staff are properly
licensed to practice in Florida.
Firm Qualifications and Experience- The PROPOSER shall state the size of
the firm, the location of the office from which the work on this engagement is to
be performed and the number and nature of the professional staff to be
employed in this engagement.
The PROPOSER shall provide information on the circumstances and status of
any disciplinary action taken or pending against The PROPOSER or its staff
during the past three (3) years with state regulatory bodies or professional
organizations.
The PROPOSER shall also describe any litigation or proceeding whereby, during
the past two years, a court or any administrative agency has ruled against The
PROPOSER and or any staff member in any manner related to its professional
activities. Similar information shall be provided for any current pending litigation.
Additional Information to be provided
The PROPOSER shall identify the principal staff that would be assigned to this
engagement. The PROPOSER shall provide information on the financial
backgrounds and resumes of each person, including information on relevant
continuing professional education for the past three (3) years and membership in
professional organizations relevant to the performance of this Financial Advisory
Service.
The PROPOSER shall indicate how the quality of staff over the term of the
agreement will be assured.
The PROPOSER shall indicate the in-house capabilities to provide technical
support and consulting, computer modeling, financial analysis and econometrics
projections.
The PROPOSER shall indicate its' experience in dealing with credit rating
services and the ability to help establish and maintain a good credit rating.
The PROPOSER shall demonstrate an understanding of Tax Increment
Financing, Bond Issues, and other types of financing to fund projects and
programs of the CRA.
The ~PROPOSER shall proved a list of at least five (5) Public Sector Professional
references (name, address and telephone number) that the CRA may contract in
relation to The PROPOSER qualifications and experiences in similar type work
or similar past jobs.

Financial Information - The PROPOSER shall provide full disclosure of its
financial position which will include (a) the most recent annual report; (b) 10-k
and 10-Q if filed or the most recent audited financial statements for the past
three fiscal years; (c) copies of the last quarterly financial report; (d) a statement
regarding any material change in the mode of conducting business, bankruptcy
proceeding and mergers or acquisitions for the past three years.

V - EVALUATION OF RFC~
EVALUATION METHOD AND CRITERIA
Qualifications will be evaluated in accordance with the weighted criteria listed
below:

Qualifications and experience of the firm in Public Financing in Florida.
This will be evaluated based on breadth and depth of the firm's
experience as a whole in the performance of comparable financial
advisory assignments in Florida. 15 points.
Understanding of and approach to the work to be performed on the CRA
Financial needs using Tax Increment Financing. 10 points.
Qualifications and experience of the specified individuals who will perform
and oversee the work. Names, titles and experience shall be detailed in
the RFQ. 10 points.
The PROPOSER in-house capability to provide technical support,
computer modeling, financial analysis and econometrics projections.
15 points
The PROPOSER will explain their experience in dealing with credit rating
agencies and providing services on acquiring a high credit rating. The
PROPOSER will indicate how they will help the CRA maintain a rating if
established. 5 points
The accessibility and availability to the CRA for consultation and support.

Ability to effectively communicate complex financial concepts to technical
and non-technical audiences as indicated by written and possibly oral

PROCUREMENTSCHEDULE
After submission of the RFQs, the Evaluation Selection Committee shall review
each RFQ and rank them based on the Evaluation Method and Criteria noted
within the Procurement Manual of the CRA. Some RFQs may be selected for
oral presentation in front of the Evaluation Selection Committee prior to a
recommendation being presented to the CRA Board. The Evaluation Selection
Committee shall rank the three top RFQs to be presented to the CRA Board for
final ranking and selection, which may include an oral presentation or interview.
If three RFQs are not accepted then less than three may be considered.
FINIAL SELECTION
Based on the Evaluation Selection Committee's review and possible oral
presentation to the Evaluation Selection Committee, the CRA Board or both, the
CRA Board will rank the RFQ's and authorize negotiations with The PROPOSER
ranked the highest. The CRA Board will select The PROPOSER that meets the
best interests of the CRA. The CRA Board shall be the sole judge of its own
best interests, the RFQs, and the resulting negotiated agreement. The CRA
Board decisions will be final.
The PROPOSER will be selected in a timely manner. Following notification of
the firm selected, the CRA will expect a contract to be executed bY the parties
within thirty (30) days.
VI - GENERAL CONDITIONS FOR FIRM~
FAMILIARITY WITH LAWS
The PROPOSER is assumed to be familiar with all Federal, State and Local
laws, Ordinances, Rules and Regulations that in any manner affect financial
services. The PROPOSER will in no way be relieved from responsibility dUe to
ignorance of any or all Federal, State and Local laws, Ordinances, Rules and
Regulations.
EXECUTION OF RFQ
RFQs must contain a manual signature of an authorized representative of the
PROPOSER.
RFQ OPENING
RFQs shall be opened in public on the date as specified in the RFQ. It is The
PROPOSER responsibility to assure that the RFQ is delivered at the proper time
and place. The CRA will in no way be responsible for delays caused by the
United States Mail or any other delivery service or by any other occurrence.

RFQs, which for any reason are not so delivered, will not be considered. RFQs
by telegram or telephone will not be accepted.
6-4 RIGHT TO REJECT RFQ
The CRA reserves the right to reject any or all RFQs and to waive technical
errors, or to accept any RFQs that are in part deemed as the best responsible
PROPOSER and the most advantageous to the CRA.
6-5EVALUATION FACTORS
The CRA expressly reserves the right to:
·, Waive any defect, irregularity or informality in any RFQ or RFQ procedure;
· Reject or cancel any or all RFQs;
· Reissue the RFQ Invitation;
· Extend the RFQ opening time and date;
· Procure any item by other means;
· Increase or decrease the quantity specified in the RFQ Invitation unless The
PROPOSER specifies otherwise.
6-7 STANDARDS
Factors to be considered in determining whether The PROPOSER is
responsible:
· Availability of appropriate resources and expertise as indicated by The
PROPOSERS to meet all contractual requirements;
· A satisfactory record of performance;
· A satisfactory record of integrity;
· Qualified legally to Contract within the State of Florida and with the CRA;
· Supplied all necessary information in connection with the inquiry concerning
responsibility.

INFORMATION AND DESCRIPTIVE LITERATURE
The PROPOSER must furnish all information requested in the RFQ. Further, as
may be specified elsewhere, each PROPOSER must submit for evaluation
descriptive literature and technical specifications covering the services offered.
INTERPRETATIONS
Any questions concerning conditions or specifications should be directed in
writing to the CRA Office no later than five (5) days prior to the RFQ opening.

CONFLICTS OF INTEREST
The award hereunder is subject to any and all conflicts of interest that exist or
may arise with the CRA Board, its employees or agents.
ADDENDA (S)
From time to time, the CRA may issue an addendum to change the intent or to
clarify the meaning of the RFQ. Since all addenda(s) are available to The
PROPOSER at the CRA, Office, it is the PROPOSER's responsibility to check
with the CRA office and immediately secure all addenda(s) before submitting a
RFQ.
ESCALATOR CLAUSE
Any RFQ, which is submitted subject to an escalator clause, will be rejected.
EXCEPTIONS
Exceptions to any portion of this RFQ shall be concisely noted in the RFQ on a
separate sheet marked "EXCEPTIONS TO RFQ" and this sheet shall be
attached to the RFQ.
DISPUTES
In case of any doubt or difference of opinion as to the items to be furnished
hereunder, the decision of the CRA Board shall be final and binding on both
parties.
GOVERNMENTAL RESTRICTIONS
In the event any governmental restrictions may be imposed which would
necessitate alteration of performance of the service offered on this RFQ, it shall
be the responsibility of the successful PROPOSER to notify the CRA, at once,

indicating in a letter the specific regulation which required an alteration. The CRA
reserves the right to accept any such alterations, including any price adjustments
occasioned thereby, or to cancel the contract at no expense to the CRA.
6-16 LEGAL REQUIREMENTS
Federal, State, County, and Local Laws, Ordinances, Rules, and Regulations
that in any manner affect the items covered herein apply. Lack of knowledge by
The PROPOSER will in no way be a cause for relief from responsibility.
6-17 ON PUBLIC ENTITY CRIMES
All RFQ Invitations as defined by Section 287.012(11), Florida Statutes, requests
for RFQs as defined by Section 287.012(16), Florida Statutes, and any contract
document described by Section 287.058, Florida Statutes, shall contain a
statement informing persons of the provisions of paragraph (2)(a) of Section
287.133, Florida Statutes, which reads as follows:
"A person or affiliate who has been placed on the convicted
vendor list following a conviction for public entity crime may not
submit a RFQ on a contract or provide any goods or services to
a public entity, may not submit a RFQ on a contract with a public
entity for the construction or repair of a public building or public
work, may not submit RFQs on leases of real property to a
public entity, may not be awarded or perform work as a
contractor, supplier, subcontractor, or consultant under a
contract with any public entity, and may not transact business
with any public entity in excess of the threshold amount provided
in Section 287.017, for CATEGORY TWO for a period of 36
months from the date of being placed on the convicted vendor
list".
6-18 ADVERTISING
In submitting a RFQ, The PROPOSER agrees not to use the results therefrom
as a part of any commercial advertising. Violation of this stipulation may be
subject to action covered under "NONCONFORMANCE TO CONTRACT
CONDITIONS".
6-19 ASSIGNMENT
Any Purchase Order issued pursuant to this RFQ invitation and the monies,
which may be come due hereunder, are not assignable except with the prior
written approval of the CRA.

The PROPOSER shall hold and save the CRA, its Board, its agents, its
volunteers and its employees harmless from liability of any kind in the
performance of any resulting contract.

occurrence, for Bodily Injury and Property Damage Liability. Coverage must be
afforded on a form no more restrictive than the latest edition of the
Comprehensive General Liability Policy, without restrictive endorsements, as
follows and shall include:
Premises or Operation;
Independent Contractors;
Broad Form Property Damage;
Broad Form Contractual Coverage applicable to this specific Agreement,
including any hold harmless or indemnification agreement; and
Personal Injury Coverage with Employee and Contractual Exclusions
removed with minimum limits of coverage equal 'to those required for
Bodily Injury liability and Property Damage Liability.
The CRA is to be included as "Additional Insured" with respect to liability arising
out of services performed for THE PROPOSER by or on behalf of the CRA or
acts or omissions of THE PROPOSER in connection with such services.
Professional Liability
THE PROPOSER agrees to provide professional liability insurance for the
benefit of the CRA with combined single limits of $1,000,000 per claim and which
insures against errors and omissions by THE PROPOSER, its sub contractors
and other professionals.
Worker's Compensation
THE PROPOSER agrees to provide Worker's Compensation and Employer's
Liability Insurance for the benefit of the firm's employees, if required by law.
Indemnification
In performing its services hereunder, THE PROPOSER will use that degree of
care and skill ordinarily exercised, under similar circumstances, by reputable
members of its profession practicing in the same or similar locality at the time the
services are provided. It is agreed that THE PROPOSER is not a fiduciary of the
CRA. THE PROPOSER and its officers, directors, employees, agents,
consultants and sub contractors shall indemnify and hold harmless the CRA or
anyone claiming by, through or under the CRA or third parties, for any and all
claims, losses, costs or damages whatsoever arising out of, resulting from or in
any way related to the services under this agreement from any cause or causes,

including but not limited to, the negligence, professional errors or omissions,
strict liability or breach of contract or any warranty, express or implied.
Automobile Liability
THE PROPOSER agrees to provide Business Automobile Liability coverage to
include bodily injury and property damage arising out of ownership, maintenance
or use of any auto, including owned, nonowned and hired automobiles and
employee nonownership use.

Before commencing performance of this contract, THE PROPOSER shall furnish
the CRA with a duplicate Certificate of Insurance for the required insurance as

any subcontractors will be the sole responsibility of THE PROPOSER.

On April 10, 2003 we requested an update from Anderson & Carr on the Boynton Beach
Congregational United Church of Christ, Inc., which was a sole source contract, due to
the fact that they provided the first appraisal.
On June 3, 2003 we received the updated appraisals and an invoice for $ 4,500.00 for
the update of the appraisals. The CRA Director and I contracted Anderson & Carr's
office several times for an explanation of the high cost of the update. We received no
response to the request.
On July 3, 2003 I spoke to Wayne Lewis, who informed me that the reason for the high
cost was due to the fact that an update was not possible. There were changes in zoning
and other factors, so a completely new appraisal was done. The appraisers went
forward without approval for the re-appraisal on the property. Wayne Lewis informed me
that he would provide detail as to billing hours and the reasons for the new appraisal in
writing. The CRA had not authorized a new appraisal. If the CRA had authorized a new
appraisal, which would not be a soul source item, then we would have had to seek three
bids as per the purchasing policy.
On July 15i 2003 we wrote a second letter to Anderson & Carr because we had not
received the information requested. In the letter we review the past events along with
the purchasing policies of the CRA. I have attached the letter for your review.

On Apdl 10, 2003 we requested that you only update the following appraisals of the
Boynton Beach Congregational United Church of Christ, Inc. File No 210679 and File No
210378, of which I have attach for your review.
On June 3, 2003 we received an invoice for $4,500.00 for the update of the appraisals. Your
office was contacted several times as to an explanation of the high cost of an update on the
appraisals. Your office did not respond to the requests.
On July 3, 2003 the Controller spoke to Wayne Lewis, who informed her that the reason for
the high cost was due to a completely new appraisal not an update. Wayne Lewis informed
her that he would provide detail as to billing hours and the reasons for the new appraisal. 'As
of this date, that information has not been received.
Also, the original letter approved an update not a new appraisal. According the purchasing
policies of the Community Redevelopment Agency if the cost of a service or item is over
$500.00 it requires, three verbal bids and if the cost is over $2,000.00 it requires three
written quotes. If the cost is a single source contract, it will require verification by the
Community Redevelopment Staff. Anderson and Carr were given the update due to
providing the original appraisal. Staff considered Anderson and Carr as a sole source in
anticipation of a Iow cost to complete the update. Anderson and Carr did not contact the
Community Redevelopment Agency for permission to complete a new appraisal at the
substantial cost of $4,500.00.
To date the Community Redevelopment Agency is holding the invoice due to waiting on the
explanation as to the cost and the need for a new appraisal. The invoice and all of the
information for payment will now have to be approved by the Community Redevelopment
Agency Board before payment can be considered.

M your request we would like to provide further documentation regarding our appraisal bill for the above
-eferenced property. As you are aware, we had previously appraised the church property on December 18, 2001.
./ince the date of that appraisal, a change in zoning so substantially changed the overall' neighborhood's
development potential that a complete reappraisal was necessary in order to provide a credible indication of the
subject property's market value.
In our earlier appraisal, the highest and best use of the property was for a continuation of the existing church
operation. Due to the zoning change, the highest and best use changed to redevelopment of the property with a
high density mixed use residential & commercial complex. Since the zoning change was so recent, market evidence
had not yet surfaced through traditional closed sales. This forced us to pursue very confidential information
regarding pending contracts for each of the several competing properties. Due to the confidential nature of this
information, we were forced to delve through zoning files, and speak to the property owners of each of the major
parcels in this immediate market in order to gather enough information to provide a credible appraisal. The
resulting report provides, we believe, the most up to date and through analysis of the market value of the subject
site that could be produced.
In order to gather the information required for this appraisal, the appraisers spent a full five days gathering,
verifying and reporting the information. Our presentation alone required three days to type and gather pertinent
site plans so that the land sale information could be as through and professionally presented as possible. The staff
appraiser logged 38 hours in inspections, research, visits to the zoning office to review files and document
preparation. At $125 per hour the staff appraiser's time ran into the range of $4,750. On top of that amount the
Senior appraiser was required to inspect the'property, have discussions with Mr. Hutchinson and the staff appraiser
as well as review the final document. His four hours of time at $200 Per hour added an additional $800: to the
-rerall fee for a total of $5,550. DUe to our understanding that the fee had exceeded the expectations of the client
ce chose to provide a Professional courtesy and reduce our bill to $4,500 prior to submission to the client.

PART I - INTRODUCTION
1-1 WORK OBJECTIVE
Boynton Beach Community Redevelopment Agency hereinafter referred to as
"CRA" invites firms, individuals and / or solo practitioners hereinafter referred to
as "FIRM" to submit qualifications for the position of General Counsel. This RFQ
is for general legal assistance, including but not limited to the areas of legislative
local government issues, land use and zoning, code enforcement, contract law,
labor relations as well as monitoring the activities of outside counsel.
PART II - SCOPE OF SERVICES
2-1 SCOPE OF WORK TO BE PERFORMED
The FIRM will prOvide general legal assistance, including but not limited to the
areas of legislative local government issues, land use and zoning, code
enforcement, contract law, labor relations as well as monitoring the activities of
outside counsel.
PART III - DESCRIPTION OF THE COMMUNITY REDEVELOPMENT AGENCY
3-1 NAME AND TELEPHONE NUMBER OF CONTACT PERSONS
The FIRM's principal contact with the CRA will be the Executive Director (561)
737-3256. There will be no independent communications between the FIRM and
individual members of the CRA.
3-2 BACKGROUND INFORMATION
The CRA serves an area of approximately 6 square miles. The CRA was created
under Florida Statutes 163.356 in 1982 and has operated as a unit of a local
government within the boundaries of the CRA in BoyntOn Beach. On October 1,
2002 the CRA was given independent status by the City and is controlled by a
CRA Board. The CRA consists of the following: Executive Director, Executive
Director, Administrative Assistant and Secretary.

PART IV - RFQ REQUIREMENTS
4-1 SUBMISSION OF QUALIFICATIONS
The FIRM must submit the following to be considered for this RFQ.
An original (so marked) and five copies of the RFQ are to be included.
Title Page
Title page showing the RFQ's subject, the firm's name, addresses and telephone
number, the contact's name and phone number and the date of the RFQ.
Table of Contents
The table of contents of the RFQ should include a clear and complete
identification of the materials submitted by section and page number.
Transmittal Letter
A signed letter of transmittal briefly stating that the FIRM has an understanding
of the work to be done, the commitment to perform the work within the time
period outlined in the contract, a statement why the FIRM believes itself to be
best qualified to perform the engagement and a statement that the RFQ is a firm
and irrevocable offer for ninety (90) days.
Detailed Qualifications
The detailed qualifications should follow the order set forth in Section 4-2 of this
RFQ.
RFQ must be submitted in a sealed envelope clearly marked with the name of
the FIRM and CRA RFQ No. 2003-3 Leqal Advisor Services.
4-2 TECHNICAL QUALIFICATIONS
General Requirements
The purpose of 4-2 Technical Qualifications is to demonstrate the qualifications,
competence and capacity of the FIRM seeking to undertake the legal needs of
the CRA. Technical Qualifications Section 4-2 shall state the FIRM's name,
address and phone numbers as well as the staff to be assigned to this
engagement.
The RFQ should provide a concise description of the FIRM's capabilities to
satisfy the requirements of the RFQ. While additional data may be presented,

the following subjects listed below must be included and they represent the
criteria against which each RFQ will be evaluated.
Independence
The FIRM shall provide an affirmative statement that it is independent of the
CRA Staff and the CRA Board.
The FIRM shall also describe any professional relationships with CRA Staff and /
or CRA Board Members for the past five (5) years, together with a statement
explaining why such relationships do not constitute a conflict of interest relative
to performing the Legal Services.
In addition, The FIRM shall give the CRA written notice of any such professional
relationship entered into during the period of this agreement.
License to Practice in Florida
An affirmative statement shall be included that the FIRM and all assigned key
professional staff are properly licensed to practice in Florida.
Firm Qualifications and Experience
The FIRM shall demonstrate their abilities, knowledge and expertise in legislative
local government law, ability to provide general legal advice, knowledge of
appellate representation and the ability to oversee outside counsel the CRA may
choose to contract with. Firms shall demonstrate their ability to devote sufficient
amounts of time, personnel and resources to meet the demands of the CRA.
All members assigned to the general counsel work must be members in good
standing of the Florida Bar for at least five (5) years, have (5) years experience
in public sector law, and have a superior professional reputation.
The FIRM shall also describe any litigation or proceeding whereby, during the
past two years, a court or any administrative agency has ruled against the FIRM
or any staff member in any manner related to its professional activities. Similar
information shall be provided for any current pending litigation.
Additional Information to be provided
The FIRM shall provide resumes for all attorneys who will be representing the
CRA and their specialty practice areas. A response to this section should also
include information as to the length of time that each attorney has provided such
services in the public sector.

The FIRM shall provide a description of the general capabilities of the firm,
including information relating to total size and staffing, resources, library and
research capabilities, support equipment, professional staff and clerical support.
The FIRM shall provide a fee proposal based which shall include an hourly rate
for litigation and administrative proceedings as well as general legal advice,
including rates for partners, associates and paralegals, if applicable.
The FIRM shall provide a list of at least five (5) Public Sector Professional
references (include name, address and telephone numbers) that the CRA may
contact in relation to the FIRM qualifications and experience in similar types of
work or similar past jobs.
The FIRM shall provide a list of relevant cases of the firm's wins and losses
within the past five (5) years.
The FIRM shall provide a list of significant Public Sector issues that the firm has
dealt within the past five (5) years, including how the issues were resolved.
The FIRM shall provide a description of activities conducted within the public
sector relating to the provision of legal services associated with code
enforcement, land use and zoning law practiced within at least the last five (5)
years.
The FIRM shall provide a description of activities conducted within the Public
Sector relating to the provision of legal services associated with contract and
construction law practiced within at least the last five (5) years.
The FIRM shall provide a description of activities conducted within the Public
Sector relating to the provision of legal services associated with Florida Statutes
163, Community Redevelopment Agency Law.
Financial Information - The FIRM shall provide full disclosure of its financial
position which will include (a) the most recent annual report; (b) 10-k and 10-Q if
filed or the most recent audited financial statements for the past three fiscal
years; (c) copies of the last quarterly financial report; (d) a statement regarding
any material change in the mode of conducting business, bankruptcy proceeding
and mergers or acquisitions for the past three years.

PROCUREMENT SCHEDULE

After submission of the RFQs, the Evaluation Selection Committee shall review
each RFQ and rank them based on the Evaluation Method and Criteria noted
within the Procurement Manual of the CRA. Some RFQs may be selected for
oral presentation in front of the Evaluation Selection Committee prior to a
recommendation being presented to the CRA Board. The Evaluation Committee
shall rank the three top RFQs to be presented to the CRA Board for final ranking
and selection, which may include an oral presentation or interview. If three RFQs
are not accepted then less than three may be considered.
FINIAL SELECTION
Based on the Evaluation Selection Committee's evaluation and possible oral
presentation to the Evaluation Selection Committee, the CRA Board, or both, the
CRA Board will rank the RFQ's and authorize negotiations with the FIRM ranked
the highest. The CRA Board will select the FIRM that meets the best interests of
the CRA. The CRA Board shall be the sole judge of its own best interests and
the RFQs. The CRA Board decisions will be final.
The FIRM will be selected in a timely manner. Following notification of the firm
selected, the CRA will expect a contract to be executed by the parties within
thirty- (30) days.
PART VI - GENERAL CONDITIONS FOR FIRM~
6-1 FAMILIARITY WITH LAWS
The FIRM is assumed to be familiar with all Federal, State and Local laws,
Ordinances, Rules and Regulations that in any manner affect Legal Services.
The FIRM will in no way be relieved from responsibility due to ignorance of any
or all Federal, State and Local laws, Ordinances, Rules and Regulations.

The RFQ must contain a manual signature of an authorized representative of the
Firm.

RFQ OPENING
The RFQ shall be opened in public on the date as specified in the RFQ. It is the
FIRM's responsibility to assure that the RFQ is delivered at the proper time and
place. The CRA will in no way be responsible for delays caused by the United
States Mail or any other delivery service or by any other occurrence. RFQs that
for any reason are not so delivered will not be considered. RFQs by telegram or
telephone will not be accepted.
RIGHT TO REJECT RFQ
The CRA reserves the right to reject any or all RFQs and to waive technical
errors, or to accept any RFQs that is deemed as the best responsible FIRM and
the most advantageous to the CRA.
EVALUATION FACTORS
The CRA expressly reserves the right to:
Waive any defect, irregularity or informality in any RFQ or RFQ procedure;
Reject or cancel any or all RFQs;
Reissue the RFQ Invitation;
Extend the RFQ opening time and date;
Procure any item by other means;
Increase or decrease the quantity specified in the RFQ Invitation unless the
FIRM specifies otherwise.

· Supplied all necessary information in connection with the inquiry concerning

INFORMATION AND DESCRIPTIVE LITERATURE
The FIRM must furnish all information requested in the RFQ. Further, as may be
- specified elsewhere, each FIRM must submit for evaluation descriptive literature
and technical specifications covering the Services offered.
INTERPRETATIONS
Any questions concerning conditions and or specifications should be directed in
writing to the CRA Office no later than five (5) days prior to the RFQ opening.
CONFLICTS OF INTEREST
The award hereunder is subject to any and all conflicts of interest that exist or
may arise with the CRA Board, its Employees or Agents.
ADDENDA (S)
,From time to time, the CRA may issue an addendum to change the intent or to
clarify the meaning of the RFQ. Since all addenda(s) are available to the FIRM
at the CRA Office, it is the FIRM responsibility to check with the CRA office and
immediately secure all addenda(s) before submitting a RFQ.
ESCALATOR CLAUSE
Any RFQ, which is submitted subject to an escalator clause, will be rejected.
EXCEPTIONS
Exceptions to any portion of this RFQ shall be concisely noted in the RFQ on a
separate sheet marked "EXCEPTIONS TO RFQ" and this sheet shall be
attached to the RFQ.

DISPUTES
In case of any doubt or difference of opinion as to the items to be furnished
hereunder, the decision of the CRA Board shall be final and binding on both
parties.
GOVERNMENTAL RESTRICTIONS
In the event any governmental restrictions may be imposed which would
necessitate alteration of performance of the service offered on this RFQ, it shall
be the responsibility of the successful FIRM to notify the CRA at once, indicating
in a letter the specific regulation which required an alteration. The CRA reserves
the right to accept any such alterations, including any price adjustments
occasioned thereby, or to cancel the contract at no expense to the CRA.
LEGAL REQUIREMENTS
Federal, State, County, and local laws, ordinances, rules, and regulations that in
any manner affect the items covered herein apply. Lack of knowledge by the
FIRM will in no way be a cause for relief from responsibility.
ON PUBLIC ENTITY CRIMES
All Request for Qualification Invitations as defined by Section 287.012(11),
Florida Statutes, requests for RFQs as defined by Section 287.012(16), Florida
Statutes, and any contract document described by Section 287.058, Florida
Statutes, shall contain a statement informing persons of the provisions of

ADVERTISING
In submitting a RFQ, the FIRM agrees not to use the results therefrom as a part
of any commercial advertising. Violation of this stipulation may be subject to
action covered under "NONCONFORMANCE TO CONTRACT CONDITIONS".
ASSIGNMENT
Any Purchase Order issued pursuant to this RFQ invitation and the monies,
which may be come due hereunder, are not assignable except with the prior
written approval of the CRA.

General Liability
THE FIRM agrees to provide comprehensive General Liability Insurance for the
benefit of the CRA with combined single limits of $1,000,000 per occurrence, for
Bodily Injury and Property Damage Liability. Coverage must be afforded on a
form no more restrictive than the latest edition of the Comprehensive General
Liability Policy, without restrictive endorsements, as follows and shall include:
Premises or Operation;
Independent Contractors;
Broad Form Property Damage;
Broad Form Contractual Coverage applicable to this specific Agreement,
including any hold harmless or indemnification agreement; and
Personal Injury Coverage with Employee and Contractual Exclusions
removed with minimum limits of coverage equal to those required for
Bodily Injury liability and Property Damage Liability.
The CRA and the City of Boynton Beach are to be included as "Additional
Insured" with respect to liability arising out of services performed for THE FIRM
by or on behalf of the CRA or acts or omissions of THE FIRM in connection with
such services.
Professional Liability
THE FIRM agrees to provide professional liability insurance for the benefit of the
CRA with combined single limits of $1,000,000 per claim and which insures
against errors and omissions by THE FIRM, its sub contractors and other
professionals.
Worker's Compensation
THE FIRM agrees to provide Worker's Compensation and Employer's Liability
Insurance for the benefit of the firm's employees, if required by law.
Indemnification
In performing its services hereunder, THE FIRM will use that degree of care and
skill ordinarily exercised, under similar circumstances, by reputable members of
its profession practicing in the same or similar locality at the time the services are
provided. It is agreed that THE FIRM is not a fiduciary of the CRA. THE FIRM
and its officers, directors, employees, agents, consultants and sub contractors
shall indemnify and hold harmless the CRA or anyone claiming by, through or
under the CRA or third parties, for any and all claims, losses, costs or damages

Florida Marine (Riviera Beach) Design and permitting for the rehabilitation of an existing 2-acre + boatyard. Work included
site design, concrete pavement design for wheel loads of up to 36 tons, drainage, water, and sewer plans.
Southeast Freight (Riviera Beach) Design and permitting for an 11-acre + freight truck terminal. Work included site design,
site plan approval, pavement design, drainage, water, and sewer plans, and permitting.
CongresslNorthlake Commercial Development (Palm Beach Gardens) Design and permitlJng for a 3-acre commercial
development. Work included coordination of traffic approvals, land use change, coordination with MacArthur Land Foundation
and Palm Beach County Engineering for right-of-way issues for the proposed six-lane median divided thoroughfare Congress
Avenue, preliminary design for water management, drainage, paving, water and sewer plans.
TRI-GAS Industrial Gases, Inc. (Palm Beach County) Design and permitting for a five acre expansion of an air separation
plant. Work included site plan design, water management, paving, drainage, water and sewer plans, and permitting. We also
provided local contact services for two out of state engineering firms and assisted owner with general construction permitting
issues for this $20 million project.
Landfall Associates (Ponder County, North Carolina) Design involving a recreation of a 200-acre hardwood wetland from a
farm.
