June 10, 2003. The violation was discovered through a neighbor's complaint and
service was accomplished by certified mail.

asked for 45 days.
Motion
Based on the testimony and evidence presented in Case No. 03-1753, Vice Chair
Costantino moved that this Board find that Alexandra Kad, Trustee, is in violation of the
City of Boynton Beach Code Sections Chapter 15, Article IX-15-120 (E)2A, and moved
to order that the Respondent correct the violations on or before October 4, 2003. The
Board has considered the gravity of the violations, the actions taken by the Respondent
and any previous violation by the Respondent, and hereby orders that if the Respondent
does not comply with this Order, a fine in the amount of $25.00 per day, plus
administrative costs, shall be imposed for each day the violation continues past October
4, 2003. The Respondent is further ordered to contact the City of Boynton Beach Code
Compliance Division in order to arrange for reinspection of the property to verify

Inspector Melillo presented the case and explained that the property was a vacant lot on
West Boynton Beach Boulevard west of NW 10th Court. The case was originally cited on
June 19, 2003 through a neighborhood complaint, as well as a complaint from the
Police Department. Service was accomplished by certified mail.
Vahram Danialian, representing the Armenian Cultural Association requested 45 days
for compliance. The respondent explained that they are in the process of building on
the property and have presented plans to the City and are waiting approval.
Motion
Based on the testimony and evidence presented in Case No. 03-1834, Vice Chair
Costantino moved that this Board find that the Armenian Cultural Association of
America is in violation of the City of Boynton Beach Code Sections 10-2, and moved to
order that the Respondent correct the violations on or before October 4, 2003. The
Board has considered the gravity of the violations, the actions taken by the Respondent
and any previous violations by the Respondent, and hereby orders that if the
Respondent does not comply with this Order, a fine in the amount of $25.00 per day,
plus administrative costs shall be imposed for each day the violation continues past

Mike Williamson, 9161 Northwest 11th Court, Plantation, Florida, area manager for
Boston Market, stated that it was Boston Market that was being cited. Mr. Williamson
pled no contest and asked for 30 days, to which the City agreed.
Motion
Based on the testimony and evidence presented in Case No. 03-387, Vice Chair
Costantino moved that this Board find that Catalina Shoppes FLA, LLC and Boston
Market are in violation of the Florida Building Code '01 Edition 105.6, and moved to
order that the Respondent correct the violations on or before September 19, 2003. The
Board has considered the gravity of the violations, the actions taken by the Respondent
and any previous violations by the Respondent, and hereby orders that if the
Respondent does not comply with this Order, a fine in the amount of $25.00 per day,
plus administrative costs shall be imposed for each day the violation continues past
September 19, 2003. The Respondent is further ordered to contact the City of Boynton

Kathy Stiles, 414 NW 4th Avenue, Boynton Beach, daughter of Ida M. White, pled no
contest. Ms. Stiles requested 45 days for compliance. Inspector Pierre stated that the
trash, automotive parts and debris should be removed as soon as possible and
suggested 10 days.
Motion
Based on the testimony and evidence presented in Case No. 03-1679, Mr. Foot moved
that this Board find that Estate of Ida White is in violation of the City of Boynton Beach
Code Sections Chapter 15, Article IX-15-120 (D) Inc., and moved to order that the
Respondent correct the violation as to debris, trash and automobile parts and engine on
or before August 30, 2003 and the remaining violations on or before October 4, 2003.
The Board has considered the gravity of the violation, the actions taken by the
Respondent and any previous violation by the Respondent, and hereby orders that if the
Respondent does not comply with this Order, a fine in the amount of $25.00 per day,
plus administrative costs shall be imposed for each day the violation continues past
August 30, 2003 and October 4, 2003. The Respondent is further ordered to contact
the City of Boynton Beach Code Compliance Division in order to arrange for

Inspector Pierre stated that the property was originally cited on July 23, 2003 and the
violation was discovered through a neighborhood complaint.
John Wright, 528 NW 13th Avenue, Boynton Beach, was present for his sister, Ella
Wilfork. Mr. Wdght stated that he removed all the vehicles today and requested that
Inspector Pierre return to the property to inspect it. Mr. Wdght further stated that he has
cleaned the property and removed the tires. He expects that the City will pick up the
leaves on Friday. Chairman DeLiso requested that the respondent be given ten days to
allow time for inspection.
Motion
Based on the testimony and evidence presented in Case No. 03-1856, Vice Chair
Costantino moved that this Board find that Ella Wilfork is in violation of the City of
Boynton Beach Code Sections Chapter 15, Article IX-15-120 (D), Inc., and moved to
order that the Respondent correct the violations on or before August 30, 2003. The

Inspector Webb stated that the property was originally cited on June 12, 2003. Service
was obtained by posting.
Shadd Vickery, 660 Las Palmas Park Drive, Boynton Beach, pled no contest and
asked for 90 days. Mr. Vickery stated that he is in the process of applying for a dock
and lift permit and has made application for a permit to the DEP and has discussed his
plans with the Building Department.
Motion
Based on the testimony and evidence presented in Case No. 03-1768, Vice Chair
Costantino moved that this Board find that Shadd Vickery is in violation of the City of
Boynton Beach Amendments to the Florida Building Code '01 Edition 104.1.1 and
104.7.5, and moved to order that the Respondent correct the violation on or before
November 18, 2003. The Board has considered the gravity of the violation, the actions
taken by the Respondent and any previous violation by the Respondent, and hereby
orders that if the Respondent does not comply with this Order, a fine in the amount of
$25.00 per day, plus administrative costs shall be imposed for each day the violation
continues past November 18, 2003. The Respondent is further ordered to contact the
City of Boynton Beach Code Compliance Division in order to arrange for reinspection of
the property to verify compliance with this Order. Motion seconded by Mr. Miriana and

Inspector Pierre stated that the property was cited on February 7, 2003 for having trash,
debris and unregistered and inoperable vehicles in the yard; and the yard needed sod.
No one appeared at the Code Compliance Board Hearing on March 19, 2003. A
compliance date of April 18, 2003 was set or be fined $50.00 per day. The property
complied on August 18, 2003 for 121 days of non-compliance.
Joseph Daffin, 315 NW 10th Avenue, Boynton Beach, appeared at the podium.
Chairman DeLiso asked Ms. Daffin why it took her an extra 121 days to bring the
property into compliance. She responded that she had difficulty buying sod and one of
her family members purchased it for her. When the car was removed, she was in a
rehab facility. Inspector Pierre presented photos taken today to the respondent and then
to the Board.
Chairman DeLiso asked the respondent if the tree had been cut down and she stated
that her cousin cut the tree down for her. Members acknowledged that the property
looked greatly improved.
Motion
Based on the testimony and evidence presented in Case No. 03-378, Mr. Rafkin moved
that this Board find that the Respondent, Josephine Daffin, was in violation of the City of
Boynton Beach Code Sections Chapter 15, Article IX-15-120 (D), Inc., subsequent to
the date of compliance specified in this Board's Order of March 19, 2003, and in
consideration of the gravity of the violation, the actions taken by the Respondent to
remedy the violations, and previous violations of the Respondent, that this Board
impose and certify a fine in the amount of $0. Motion seconded by Mr. Rossi.
Mr. Foot recommended that the motion be amended to fine the respondent $250.
Inspector Pierre stated that the respondent could not afford to pay this amount and that
she had to get assistance to bring the property into compliance.
Mr. Rafkin did not wish to amend his motion.

Recording Secretary administered the oath to Ms. Harrell. Ms. Harrell pled guilty and
requested 30 days to repair a small portion of the fence.
Motion
Based on the testimony and evidence presented in Case No. 03-1144, Mr. Foot moved
that this Board find that Annette Harrell is in violation of the City of Boynton Beach Code
Sections Chapter 15, Article IX-15-120 (D) .lA, and moved to order that the
Respondent correct the violation on or before August 30, 2003. The Board has
considered the gravity of the violation, the actions taken by the Respondent and any
previous violation by the Respondent, and hereby orders that if the Respondent does
not comply with this Order, a fine in the amount of $25.00 per day, plus administrative

Costantino moved that this Board find that the Respondent, Susan Y. Kee, has not
complied with this Board's Order dated May 21, 2003, and having considered the
gravity of the violations, the actions taken by the Respondent, and any and all previous
violations committed by the Respondent, that this Board impose and certify a fine in the
amount of $50 per day, plus administrative costs, which shall continue to accrue until

the Respondent comes into compliance or until a judgment is entered based upon this
certification of fine. Motion seconded by Mr. Rafkin and carried 6-1 (Ms. Cook
abstaining).

Based on the testimony and evidence presented in Case No. 01-3431, Vice Chair
Costantino moved that this Board find that the Respondent, Ralph Rosie, Inc., has not
complied with this Board's Order dated January 15, 2003, and having considered the
gravity of the violations, the actions taken by the Respondent, and any and all previous
violations committed by the Respondent, that this Board impose and certify a fine in the
amount of $25 per day, plus administrative costs, which shall continue to accrue until
the Respondent comes into compliance or until a judgment is entered based upon this
certification of fine. Motion seconded by Mr. Rafkin and unanimously carried.
