City Manager Bressner began the agenda preview at 4:00 p.m. He announced that the public
hearing concerning the budget would be held on Tuesday at 6:00 p.m. The proposed
ordinance regarding the budget would be adopted at the conclusion of the public hearing.
Mayor Broening requested that an item be added to the agenda to discuss the CRA
chairperson's term. The term is now open-ended. It was the consensus of the Commission to
place this item under New Business. City Manager Bressner said that he would provide a copy
of the ordinance dealing with the CRA to the Commission.
V.C.1. Proposed Resolution No. R03-143 Re: Raising fees for annual permits,
daily fees and light fees at the Tennis Center, effective October 1~ 2003 (7'ablegY
8/19/05- Request table to
Vice Mayor Ferguson commented that he would pull this item for discussion at the Commission
meeting.
V.3. Approve the list of top ranking qualifiers identified by the Evaluation
Committee from the responses received to the Request for Qualifications (RF(~)
#065-2821-03/C3D, "Two-Year Contract for General Consulting and Engineering
Services for the City of Boynton Beach"; and authorize the Utilities Department to
conduct negotiations for compensation of services with the recommended qualifiers
according to Florida State Statute #287.055, Consultants' Competitive Negotiations
Act
Commissioner McKoy said that he would pull this item for discussion at the Commission
meeting.

City Manager Bressner distributed a copy of a letter from Shalloway Engineering. A copy of the
letter is on file in the Office of the City Clerk. He explained that a representative from
Shalloway would be at the Commission meeting to make a presentation. She has been advised
to fill out a card to speak at the meeting. City Manager Bressner met with the principal of the
firm and explained that they have an opportunity to have the Commission accept, reject or
modify the staff's recommendations. The staff's recommendation did not include this firm on
one of the tasks area. They were selected for task D but wanted to be considered for task C
also.
Dale Sugerman, Assistant City Manager, explained that a short list is being presented to the
Commission. If the short list is approved, then negotiations with the firms would be held.
Subsequently a contract would be awarded.
City Attorney Cherof will provide an overview of the statutory process at the Commission
meeting.
V.M. Authorize the use of $1,000 of Community Investment Funds for the Boynton
Community Forum Families and Friends Network, Inc. by Commissioner Carl McKoy
Commissioner McCray will pull this item from the consent agenda at the Commission meeting.
He wanted to announce that the payments would be on a reimbursement basis.
~X.A. Discussion of Marina Development Agreement (Tabled on $/20/03)
City Manager Bressner explained that City Attorney Cherof met last Tuesday with the attorney
for the Related Group. City Attorney Cherof said that they have all the City's suggested
changes to the modified settlement agreement and are reviewing them with their principals.
There will be additional feedback from the Two Georges. He hoped that this was nearing the
end of the process.
IX.B. City Hall/Public Safety Space Needs Report
City Manager Bressner distributed some E-mail he received from individuals who are interested
in keeping the City Hall function in its current complex. Copies of the E-mails are on file in the
Office of the City Clerk.
X.A. Follow-up Meeting with CRA on Development Tssues (September 2003)
City Manager Bressner said they were not successful in arranging this meeting for September.
It was the consensus of the Commission to change the date to November 2003 when the new
members of the Commission are on board.
X.C. Resolution of Necessity for 8 parcels of land associated with the Railroad
Avenue Stormwater Improvement Project (October 7, 2003)
Dale Sugerman, Assistant City Manager, explained that of the nine parcels needed for the
project, the City has been successful in getting one under contract. The asking prices for the

remaining eight parcels are either much too high or the owners are not willing to negotiate.
These parcels are needed for drainage, not only for Railroad Avenue but also for the Heart of
Boynton project.
X.E. Workshop Regarding Cemetery Options and Proposal by Cemetery Board to
Expand Cemetery West into Little League Park (October 2003)
Tt was the consensus of the Commission to defer this item until after the election in November.
XZ.A. Discussion regarding proposed off-premise sign at Texaco Station (Tab/ed on
8/$/03 - Request table to 9/16/03)
Mike Rumpf, Planning & Zoning Director, said that he assumed that the applicants were going
to work this out with the City at the time they process their major site plan modification.
City Manager Bressner requested that the Commission move this item to Future Agenda Ttems.
This could be done at the Commission meeting.
XII.A. 1. Proposed Ordinance No. 03-049 Re: Amending Chapter [[!
Compensation of the Personnel Policy Manual by creating a new subsection 09
entitled "Travel Reimbursement"
City Attorney Cherof explained that the 29 cents per mile was changed to the current TRS rate.
This should be noted before the ordinance is adopted.
XTZ.B.1. Proposed Ordinance No. 03 -048 Re: Amending Land
Development Regulations, Chapter 2, Zoning, Section 4.3 limiting the distance a
dock can extend into the canal to one-third (1/3) of the canal width, to reduce the
percentage to one-quarter (1/4) to coincide with regulations of other agencies
(Tab/ed on 9/2/03,)
City Manager Bressner distributed an additional report dated September 11t~. This is on file in
the Office of the City Clerk. He said that the existing docks would be o.k. and would be dealt
with on a case-by-case basis. Anything that has been issued within the past four to five years
fell under the proposed guidelines because the Army Corps of Engineers and the South Florida
Water Management District's standards are preeminent to the City's standards.
Quintus Greene, Director of Development, explained that even if the docks encroach beyond
what the City is proposing, they will be legally non-conforming. As long as nobody does
anything to them, they can remain.
Tt was explained to the Commission that there is no accurate information on the number of
non-conforming docks. Mr. Greene said that it would be very staff intensive to perform a count
since there would need to be two-person teams, one in a boat and one on the street because
the street address is not identified on the dock. G.T.S. could be used; however, the resolution
is not high enough on the aerial photographs outside of the CRA.

Commissioner McCray asked who would enforce this resolution. It was noted that the City
Commission would.

There was discussion regarding the Andre St..~uste Code Compliance case. City Attorney
Cherof said that there could be a motion to reconsider. Mayor Broening felt that this would be
an individual City Commissioner's option and he did not want to see it written on the agenda.
The consensus of the Commission was not to add it to the agenda.

community meetings, individual homeoWner meetings, etc. This schedule of public
participation will be spelled out in our contract documents with the City'of Boynton
Beach and be established as part of our-Standard Operating Procedure (see
attached).

After project construction is complete and first walk through with residents, a get
together (party) will be organized that will recognize assistance of community and
City staff.
The plan for design services with the City of Boynton Beach will be a collaboration
(partnership) between City Officials/staff, City residents and SFRN. The intent of
partnership is to bring the community into project eady to get "buy in" and offer contacts
to resolve issues. This will allow for a smoother construction project and reduce resident
complaints.

I am a concerned citizen who believes that relocating our Boynton Beach City Hall will
adversely impact the economy of the entire downtown area.
Our downtown economy can not only be moved and energized by private investors, and
property owners, Public buildings are a key part of this composition.
City Hall should and must continue in downtown. Our Public offices should continue
developing projects that help the revitalization of the downtown area, to become attractive
to business and the public, the same way other cities have done it. We have examples on
how revitalization affect neighborhoods; nearby is downtown Delrey Beach, further south
downtown Fort Lauderdale (Las Olas), and so many other nearby cities.

What is happening to downtown Boynton Beach??? Are we
getting rid of it entirely, one building at a time?
PLEASE consider the implications of moving City Hall
for those of us who have hung in there, struggling to
get businesses going in an uncertain area. This would
impact too many people, negating the efforts we have
made to become established as a part of "downtown".
I think allegiance works both ways. Those of us who
have stuck in out on Ocean Avenue -- through digging
up the street, building the new bridge, etc., etc.
--have held onto a belief that it would all pay off in
smooth sailing down the road. Now you are going to
"abandon ship"? Please reconsider.

A. Boat Docks and Seawall
On October 3rd the City Commission requested staff revisit the issue of unpermitted docks
and seawails. Staff has reviewed the previous discussion by the City Commission, as well
as concerns brought forward by residents and would like !o recommend the following:
EXISTING DOCKS AND/OR SEAWALLS
o
The two outstanding issues with docks were how the interpretation of the City code would
apply to the structure and construction of existing dOCks and if canopies or boathouse roofs
were to be allowed. Regarding the permitting of the dock itself staff would recommend the
procedure listed below:
All property owners having docks that are not currentJy permitted would need to apply
for a permit. The City would administratively suspend Code Enforcement for
unpermitted docks, and suspend the code requirement for sealed engineering
drawings as a condition of original permit submission for existing docks for a pedod
of three years.
A property owner would apply for a permit and the City inspectors would inspect the
dock to insure it is safe and in a state of good repair. The City is arranging with Lake
Worth Drainage Distdct and South Florida Water Management Distdct for their
agency staff to do the physical inspection of docks if the dock is in their jurisdictional
waters to assist with the workload.
After inspection, if the dock is deteimined safe and in good repair, a certificate of
completion will be issued by the Department of Development. If the dock is
determined not to be safe or in good repair, the City will request sealed engineering
drawings to either certify the dock as sound or set forth a construction plan to repair
the dock. After the work is completed and the applicant's engineer certifies that the
dock is safe and in good repair, a certificate of completion will be issued.
If the dock is located on City property, the current City lease would also need to be
signed and proof of insurance obtained by the property owner.
A hold harmless agreement for docks would also be signed by the property owner.
The same procedures outlined in paragraphs 1 thru 5 apply to seawalls.
Any existing, unpermitted dock which has not come in to the City and received a
certificate of completion by September 30, 1997, will be cited for code violation and
must be immediately removed or reconstructed to current code standards.
Any seawall which has not received a certificate of completion by September 30,
1997 will be cited for code violations and must be repaired/replaced within the time
established by the Code Enforcement Board. If not completed, code enforcement
fines/liens would accrue.
The City Commission also at its previous meeting suggested that for six (6) months
building permit fees for this process be waived. I am a§suming the City Commission
wishes to continue that policy.
NEW DOCKS AND/OR SEAWALLS
A new dock or seawall, not constructed, will have to submit engineering drawings and
meet current code standards.
CANOPIES/BOATHOUSES
The issue of the roofs on docks is a separate issue. Currently, roofs are not allowed and
would need to be removed if a property owner requested a permit. Staff needs further
direction from the City Commission if roofs are to be allowed. This item was discussed at
the March 15, 1994 City Commission meeting and unanimously denied (minutes and
ordinance attached), however, if the Commission wishes to revise this policy, an
ordinance would be placed for first reading on November 1, 1994.
