AN ORDINANCE OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
ESTABLISHING MINIMUM QUALIFICATIONS FOR
APPOINTMENT AND MEMBERSHIP TO THE CITY'S
BOARDS AND COMMITTEES; ESTABLISHING A
TRANSITION PERIOD FOR IMPLEMENTATION OF
THIS ORDINANCE; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; PROVIDIN(: AN
EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Boynton
5each, Florida, deems it in the best interests of the City
to establish consistency and qualifications for membership
to the various boards and committees of the City; and
WHEREAS, the City Commission believes it would be in
the best interest of the City to permit qualified
%dents of the City to serve on boards where their
or business experience would serve the needs of
Board and the citizens of the City;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY CO~ISSION
THE CITY OF BOYNTON BEACH, THAT:
Section 1. In order to qualify for appointment to
to serve as a member of any board or committee of the
of Boynton Beach, Florida, an individual must be an
of Palm Beach County, Florida.
Section 2. In selecting individuals to serve on
and committees of the City of Boynton Beach,
shall be given to individuals who are residents
of the City of Boynton Beach, provided however, that
non-residents who own and operate businesses located within
the City may also qualify for appointment provided they
possess qualifications or experience uniquely suited to deal
with the subject matter over which the board or committee
has subject matter review or power.
Section 3. No currently serving member of any board
or committee shall be disqualified for failing to meet the
minimum qualifications set forth in this Ordinance.
However, at the expiration of the term of each current board
or committee member, the vacancy created by that expiring
term shall be filled with an individual qualified in
accordance with the provisions of this Ordinance.
Section 4. That all ordinances or parts of
ordinances in conflict herewith be and the same are hereby
repealed. In the event of any conflict between the
~rovisions of this Ordinance and any State Statute which
lsets forth minimum qualifications for appointments to boards
'established by the City, provisions of State Statute shall
~ontrol.
Section 5. Should any section or provision of this
Drdinance or portion hereof, any paragraph, sentence, or
~ord be declared by a court of competent jurisdiction to be
invalid, such decision shall not affect the remainder of
~his ordinance.
Section 6. This ordinance shall become effective
immediately upon passage.
