City Manager Bressner began the agenda review at 4:01 p.m.
Commission meeting would be held on Wednesday, November 5t~,
He announced that the
V.Z. Accept the award of the block grant for $89,467 from the U.S. Department of
3ustice Office
l~t was the consensus of the Commission that the agenda specify that the grant would be used
for training, equipment and computers and that the local match is 10%.
V.3. Authorization to re-direct a portion of Community ]nvestment Funds to the R.
M. Lee Community Development Center, Znc.
City Manager Bressner distributed a revised agenda item. He explained that he received letters
from some schools requesting some of the money. Staff is recommending that $2,000 go to
the R.M. Lee Center. There was $11,000 allocated and $5,525 has been requested from
schools.
V:[.A. Approve/ratify settlement in the amount of $80,000 in the matter of Coral
Tech vs. City of Boynton Beach
City Manager Bressner explained that this was a claim by the contractor who remodeled the
Senior Center. The claim has been mediated. The words "Completion of the Senior Center" will
be added to the item on the agenda.
[X.A. Discussion of Marina Development Agreement (Tabledon $/20/03,)
City Manager Bressner reported that there will be a meeting of the parties on Tuesday. He
believed that matters have been resolved but things could change.

Dale Sugerman, Assistant City Manager, suggested that the item remain on the table and that
the Commission take no action since it must go to the CRA first for a $:[ million decision as it
relates to the settlement. Assuming the document is ready, it will go to the CRA on November
20th and should be ready for the Commission's review at the first meeting in December.
City Manager Bressner agreed that Commission action on the agreement should wait until after
the CRA meeting. However, for purposes of public information, he felt that the terms of the
agreement should be summarized at the Commission meeting.
X.C. Proposed modification to the Land Development Regulations regarding rear
yard setbacks
City Manager Bressner explained that in some existing areas there have been problems with
people wanting to build porches or enclosures that currently encroach in the rear yard setback.
These have caused a perceived hardship. This future agenda item is a matter of reviewing
some of the zoning classifications and determining whether to modify the code that may allow
for certain types of permitted encroachments in the rear yard setbacks.
X.D. Follow-up Meeting with CRA on Development Issues (November 2003)
Commissioner McCray requested that the meeting not be scheduled on a Saturday.
X.E. Workshop regarding City Hall/Public Safety Space Needs Report (November
18 or December 2, 2003)
City Manager Bressner felt that December 2nd was the earliest this item could be heard. The
November 18th date will be deleted from the agenda.
X.G. Continued discussion of possible legal challenge to County mandated
fire/rescue level of service (recommended if Palm Beach County Commission
authorizes Fire-Rescue Level of Service Referendum
City Manager Bressner explained that the County Commission did not approve the fire rescue
standards. Therefore, this item can be removed from the agenda.
X.H. Workshop Regarding Cemetery Options and Proposal by Cemetery Beard to
Expand Cemetery West into Little League Park (December 2003)
The date for this item was changed to January 2004.
X.I. Proposed Lease Agreement with Boynton Woman's Club (TBA)
City Manager Bressner reported that they are attempting to get the architectural study done.
They are piggybacking on the High School architect and may have an answer by the end of the
year.

X.3. Proposed Resolution regarding approval of Community Development Block
Grant (CDBG) Sub-Grantee Agreement with Juvenile Transition Center, Inc. of
Boynton Beach in the amount of $7,500
Ms. Lamanna reported that this item was very close to being resolved.
XII.A. 1. Proposed Ordinance No. 03-057 Re: Amending Chapter 14
Motor Vehicles and Traffic, Sec. 14-5 to include "Storage," creating new subsections
(4) and (5), and providing for the prohibition of parking or storage of vehicles in the
public right-of-way or within five feet of the public right-of-way
City Manager Bressner explained that there has been a suggested minor change to this
ordinance. The ordinance, as drafted, said "on the right-of-way or within five feet of the right-
of-way." There were concerns that this might create a hardship for someone who might have a
vehicle with a tarp parked on private property near the right-of-way. :If the ordinance says "no
part of the vehicle can be in the right-of-way," that would cover concerns regarding being on
the street, parked on the swales or blocking the end of a driveway. The revised text will be
faxed to the Commission tomorrow.
XII.A. 2. Proposed Ordinance No. 03-058
Early Retirement Tncentive Program
Re: Establishing a limited
City Manager Bressner reported that the State has signed off on the program so it is ready to
go with the Commission's approval.
Other
City Manager Bressner relayed information regarding a construction accident at The Harbors on
Sunday. Apparently, the walls were not properly shored up and, because of the winds over the
weekend, part of the walls collapsed and fell into the Intracoastal Park. Don Johnson, Building
Official, is working with the developer and Risk Manager Chuck Magazine is involved since there
was damage to City property.
Commissioner McCray said that since this happened in his district, he would have liked to have
been apprised of it. City Manager Bressner said he did not find out about the accident until this
morning and asked that in the future, he be kept abreast of things of this nature.
Commissioner McCray wanted the Commission to understand that they are still responsible for
the CRA loan that they signed for. The citizens are holding the Commission accountable for
some things that are happening. At the CRA meeting the other night, some people approached
him regarding the Genesis program contract. Once the new Commission is elected, he felt that
they need to readdress the whole issue of the CRA.
