Present: Lee Wische, Chairman William Cwynar, Vice Chair Sergio Casaine Woodrow Hay .lames McMahon Steve Myott Mike Friedland Anne Centi, Alternate Mike Fitzpatrick, Alternate Mike Rumpf, Planning & Zoning Director David Tolces, Assistant City Attorney Maxime Ducost6-Am~d6e, Planner Pledge of Allegiance Chair Wische called the meeting to order at 6:30 p.m. and Mr. Myott led the members in the Pledge of Allegiance to the Flag. II. Introduction of Board Chair Wische introduced the Board members. III. Agenda Approval Motion Vice Chair Cwynar moved to approve the agenda. carried unanimously. Mr. Hay seconded the motion that I*V. Approval of Minutes Motion Vice Chair Cwynar unanimously. moved for approval. Mr. Hay seconded the motion that carried V. Communications and Announcements A. Planning and Zoning Report Mr. Rumpf reported on the disposition of the following items that were reviewed by the Planning & Development Board and acted upon by the City Commission at the April 7, 2004 Commission meeting. Meeting Minutes Planning & Development Board Boynton Beach, Florida April 27, 2004 1. Boynton Commerce Center Use Approval for Catering and Food Services was approved. 2. Renaissance Commons Phase ! Height Exception of 5' 4" for Mechanical Rooms and Stair Towers was approved. 3. Conditional Use for Chick-FiI-A Restaurant was approved. 4. The Suburban Mixed Use Ordinance was approved. 5. The DRT-A Ordinance for the Renaissance Commons project was tabled at the request of the applicant to allow it to be reviewed in con,junction with the returning corresponding Land Use Amendments. This will be picked up at the Ordinance process when they return from DCA. 6. Bermuda Bay Annexation, LUAR, and Zoning Ordinances were approved. 7. Anderson PUD Rezoning and Land Use Plan Amendment on Lawrence Road was approved. At the April 20 City Commission Meeting: 1. The second readings of the Ordinances for Anderson PUD and Bermuda Bay were approved. The Board asked that copies of the Commission meeting minutes be placed in their agenda packets in the future. They used to get them and find them to be helpful. Chair Wische opened the floor for anyone wishing to speak on any item not on the agenda. He closed it when no one wished to speak. Board Attorney Tolces administered the oath to all persons who planned to testify at this meeting. Old Business VI. None VII. New Business A. Zoninq Code Variance 1. Project: Agent: Owner: Location: Wantshouse Residence (ZNCV 04-002) Mark Wantshouse Mark Wantshouse 3416 South Lake Drive Meeting Minutes Planning & Development Board Boynton Beach, Florida April 27, 2004 Description: Request for relief for Chapter 2, Zoning Section 5.B.2.a, requiring a minimum rear yard setback of 25 feet for a single-family home within the R-i-AAB zoning district, to allow for a variance of 15 feet, and a rear yard setback of 10 feet. Mark Wantshouse, 3416 South Lake Drive, Boynton Beach, came to the podium to answer questions. Maxime Ducost~-Am~d~e, Planner, stated that the property was unique in its configuration and that the requested setback would not be detrimental to the neighborhood. Staff recommended approval of the request. Chair Wische noted that the staff report indicated that staff found that a hardship existed in this case, and Mr. Ducoste-Amedee agreed. Chair Wische opened the floor for the Public Hearing and closed it when no one wished to speak. Motion Mr. Friedland moved to grant the request for relief from Chapter 2, Zoning Section 5.B.2.a, requiring a minimum rear yard setback of 25 feet for a single-family home within the R-i-AAB zoning district, to allow for a variance of 15 feet, and a rear yard setback of 10 feet for Hark Wantshouse, consistent with the findings in the Land Development Regulations. Hr. Hay seconded the motion that carried unanimously. B. New Site Plan Project: Agent: Owner: Location: Description: Anderson PUD (NWSP 04-005) Chip Bryan, .Julian Bryan & Associates, Inc. H. Loy Anderson West side of Lawrence Road, 1/2 mile south of Hypoluxo Road Request for new site plan approval for 85 single- family homes on 18.32-acre parcel in a PUD zoning district 3ulian Bryan, 1700 Arcadia Way, Boca Raton, appeared representing D.R. Horton Homes. Eric Johnson, Planner, stated that staff recommended approval of this request. Chair Wische noted that there were 39 staff comments and asked the applicant whether they understood and agreed with them. I~lotion Mr. Casaine moved to approve the Anderson PUD request for new site plan approval for 85 single-family homes on an 18.32-acre parcel in a PUD zoning district, subject to the 39 conditions of approval. Mr. Hay seconded the motion that carried unanimously. C. Site Plan Time Extension Project: Agent: Owner: Location: Description: Arbolata (SPTE 04-001) William Wietsma ERMOE, LLC Southeast corner of South Congress Avenue and southwest of SW 35th Avenue Request for a one-year time extension of the subdivision master plan approval granted on February 4, 2003, from February 4, 2004 to February 4, 2005. William Wietsma, 578 Palm Way, Gulfstream, came to the podium. Chair Wische noted that if this request were to be approved, all of the conditions of approval granted in the first year would still apply. Eric Johnson, Planner, pointed out that the applicant had submitted a minor site plan modification to change the one-car garages to two car garages and reduce the number of units from 172 to 158. That was not in the report and would be handled as a minor site plan modification. Chair Wische opened the Public Hearing and closed it when no one wished to address this issue. Mr. Myott asked staff's opinion about whether the applicant had acted in good faith relative to the extension request. Mr. Johnson said that considering what the City requires and monitors, they acted in good faith. Mr. Myott asked if he foresaw any zoning changes or anything that would affect this approval in the coming year, and Mr. Johnson responded that he did not. Notion Vice Chair Cwynar moved to approve the request from Arbolata for a one-year time extension of the subdivision master plan approval granted on February 4, 2003, from February 4, 2004 to February 4, 2005. Mr. Hay seconded the motion that carried unanimously. VIII. Other Board Attorney Tolces suggested putting Board elections on the agenda for May.
