Chair DeLJso called the meeting to order at 3:00 p.m.

III. Approval of Agenda
Mr. Blasie indicated that if Mr. Stocker did not appear, his case would be heard at the
next Board meeting. Mr. Blasie had been unable to notify Mr. Stocker of today's
meeting.

Vice Chair Costantino moved to approve the agenda as amended. Ms. Cook seconded
the motion that passed unanimously.

Mr. Blasie presented the case. This property was originally cited on January 21, 2000 for
violations of the Community Appearance Code. There was trash, debris, broken windows, a
fence in disrepair, and unregistered vehicles. The Code Compliance Board met to hear the case
on April 19, 2000 and no one appeared. The Board set a compliance date of May 15, 2000 and
proposed a fine of $25.00 per day. Compliance was documented as of May 7, 2004. Service
was received on the notices by posting. Certified mail came back unclaimed. Mr. Blasie shared
some photographs with the Board that had been taken on June 16 and .lune 21, 2000 and on
May 27, 2004. He first showed the photographs to the respondents to verify that they were
indeed pictures of this property. Mr. Blasie viewed the property and it had not changed from
the pictures he took on May 27, 2004. He commented that he had not taken pictures in the
back yard but could attest that the back looked like the front. The sod was established and
irrigated and looked good. There was no trash or debris and no unregistered vehicles.
Guillermo Martinez, 2633 N.E. 4th Street, Boynton Beach, came to the podium and was
accompanied by his cousin, Blanca Manual of 531 A Street, Lake Worth. Mr. Roberto
Martinez had gone to Guatemala ten days prior to the meeting. Mr. Guillermo Martinez was Mr.
Roberto Martinez' brother. Ms. Blanca interpreted for Mr. Martinez.
Chair DeLiso asked Mr. Martinez why this had not been taken care of a long time ago.
Mr. Martinez, through Ms. Manual, stated that relatives were living in the house and did not tell
him what was going on or that there was any problem. He only found out about it when he
went to get a loan to put a new roof on, at which time he discovered there was a lien on the
property. Ms. Nanual stated that Mr. Martinez would be responsible to keep the house in
compliance and that she would be moving in shortly as well. They were sorry that the situation
had gone on as long as it did, but they were uninformed about it.
Mr. Foot suggested a fine of $:[500 plus administrative charges. He thought that the
neighborhood had to suffer for four years and that such a fine was in order.
Ms. Cook also felt there should be a fine, but suggested $750 including administrative costs.
She stated that the property looked fine now, and it might have been in compliance
considerably before May of this year. There were no other complaints or problems. Although
people had to abide by the Code laws, she felt that the circumstances were unusual and had to
be taken into consideration.
Motion
Based on the testimony and evidence presented in Case #00-128, and having been advised that
the Respondent has complied with all lien reduction procedures set forth in Sections 2-84
through 2-89 of the City of Boynton Beach Code of Ordinances, Ms. Cook moved that this Board
reduce the fines instituted in Case #00-:~28, by virtue of this Board's Order of April 19, 2000, to
an amount of $750, including administrative costs. Motion seconded by Vice Chair Costantino
and passed unanimously.

Since Mr. Stocker did not appear, both of these cases will be put on the agenda for the July 21,
2004.
VI. Discussion
Due to vacations in the Code Office, Mr. Blasie sought approval for hearing the lien reductions
at the regular Board meeting on July 21, 2004. The Board stated that this would be acceptable
and looked to Mr. Blasie to keep the agenda to a reasonable length.
Mr. Foot asked for the status of the "prompt lien payment" ordinance. Mr. Blasie stated that it
would be heard on second reading at the next City Commission meeting and should be in place
before the next lien reduction meeting.
Mr. Blasie stated that he was making copies of everything Vice Chair Costantino received at the
training conference recently given by the Florida Association of Code Enforcement. He would
get that information to each Board member as soon as it was available.
