Swearing in of Witnesses and Introduction Inspector Melillo called the roll. The Recording Secretary administered the oath to all persons who would be testifying. Chairman DeLiso explained the plea system. V. New Business A. Cases to be Heard Case #04-997 Property Address: Violations: Robin Oyer 702 S. Seacrest Boulevard Chapter 15, Article IX-15-120 (D), Inc. Please remove all outside storage on side yard - table, buckets, glass, junk, etc. Meeting Minutes Code Compliance Board Boynton Beach, Florida July 21, 2004 Inspector Cain presented the case. The property was originally cited on May 5, 2004 through routine neighborhood inspection and is a single-family homestead. Robin Oyer, 702 S. Seacrest Boulevard, Boynton Beach, pled no contest. Ms. Oyer stated that they have a license to run their pressure cleaning business from their house and as a result were allowed to keep their truck parked at the premises. Mr. Oyer, who was also present at the podium, stated that they had been previously cited for the same issue and when they appeared before the Board, the case was dismissed. Inspector Cain presented photographs to the respondents and then to the Board. Inspector Cain explained that even though the respondents have an occupational license to conduct a business from their home, they are not allowed to keep any kind of material or vehicles related to their business on the property. Inspector Cain noted that when the respondent applied for an occupational license they signed an affidavit that they would not keep any equipment, materials or supplies at the property that was related to the business. Inspector Cain also reported that there is a boat in the yard that needs to be placed on concrete. Mr. Oyer noted that all the other items that they were cited for have been cleaned up. Chairman DeLiso pointed out that from the photographs there was still debris that needed to be cleaned up. Chairman DeLiso asked the respondents how much time they needed to bring the property into compliance. After discussion, the Board determined to provide the respondents with two separate compliance dates; one for the debris, and one for the equipment. Motion Based on the testimony and evidence presented in Case No. 04-997, Vice Chair Costantino moved that this Board find that Robin Oyer is in violation of the City of Boynton Beach Code Sections Chapter 15, Article IX-15-120 (D), Inc. for trash and debris, and moved to order that the Respondent correct the violation on or before August 20, 2004. The Board has considered the gravity of the violation, the actions taken by the Respondent and any previous violations by the Respondent and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $25 per day, plus administrative costs, shall be imposed for each day the violation continues past August 20, 2004. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for reinspection of the property to verify compliance with the Order. Motion seconded by Ms. Cook and unanimously carried. Case #04-1046 Property Address: Violations: Sea Mist Marina, Inc./Casa Loma 700 Casa Loma Boulevard FBC '01 Edition, BBA 104.1.1. Permits are required - See copy of "red tag" dated April 9, 2004 Inspector Cain presented the case. The property was originally cited on May 11, 2004 and the respondents were given 10 days to bring the property into compliance. The property has not yet complied and Don Johnson, the City's Building Official, is present as well. Barkley Garnsey, 326 SW Ist Avenue, Boynton Beach, assumed the podium and stated that he was one of the owners of the Sea Mist Marina and pled no contest. Mr. Garnsey stated that the case arose as the result of the City not being able to determine that a wall on the premises that has been on the property for over 30 years was ever permitted. He explained that he has a meeting tomorrow with Quintus Greene, the City's Development Director, and a design professional that they have engaged to resolve the matter. Mr. Garnsey stated that they have complied with all other violations. He requested that the case be tabled until they have an opportunity to meet with the City representatives. Mr. Don Johnson stated that the City performed a due diligence and cannot locate any records pertaining to the wall ever being permitted. Although the issue has been pending since April, he had no objection to tabling the case for 30 days. Mr. Johnson did point out that they have a survey that indicates the wall is actually located on someone else's property. Motion Ms. Carroll moved that Case No. 04-1046 be tabled until the Code Compliance Board meeting to be held on August 18, 2004. Motion seconded by Vice Chair Costantino and unanimously carried. Case #04-1021 Property Address: Gregory and Rose Johnson 3290 N. Seacrest Boulevard 4 Meeting Minutes Code Compliance Board Boynton Beach, Florida July 21, 2004 Violations: Chapter 15, Article IX-15-120 (D) 1, Inc. Please remove all loose trash and debris. Install sod in yard and swale. The Recording Secretary administered the oath to Inspector Guillaume. Inspector Guillaume presented the case and stated that the property was originally cited on May 6, 2004 through routine neighborhood inspection. The property is a single-family homestead and the trash and loose debris has complied. Gregory Johnson, 3290 N. Seacrest Boulevard, assumed the podium and asked for additional time to comply. Mr. Johnson stated that he is not working and cannot afford to plant sod. He noted that he had received grass from the City about five years ago, but it did not last. Chairman DeLiso requested to view the photographs, which Inspector Guillaume first presented to the respondent and then to the Board. Vice Chair Costantino inquired if the respondents were repeat offenders and were informed that they were not. Chairman DeLiso inquired if the CDC would be able to assist the Johnsons in obtaining grass and Inspector Cain felt that they could help. The respondent was advised to speak with Inspector Cain and the Board decided to table the case. Motion Ms. Carroll moved that Case No. 04-1021 be tabled until the Code Compliance Board meeting to be held on August 18, 2004. Motion seconded by Ms. Cook and unanimously carried. Case #04-757 Property Address: Violations: Heather S. Conley 417 SE 20th Court FBC '01 Edition BBA 104.1.1, 105.6 and 104.5. Please obtain proper permits and inspections for the front door installation, rear structure addition and all remodeling work being done. Inspector Lewis presented the case and stated that the property was originally cited on April 7, 2004. Heather S. Conley, 417 SE 20th Court assumed the podium and pled no contest. Ms. Conley requested as much time as possible for compliance because she had to find another contractor and to secure additional funds to complete the remodeling. Meeting Minutes Code Compliance Board Boynton Beach, Florida July 21, 2004 Inspector Lewis presented photographs to the respondent and then to the Board. Ms. Conley stated she had been unaware that she needed permits to do the remodeling, but has since obtained some permits. Inspector Lewis stated that most of the work has been done and the respondent needs to obtain an electrical permit. Vice Chair Costantino inquired if there were any hurricane hazards on the property and Inspector Lewis responded that there were none. After discussion, it was determined to grant the respondent eight months to provide her enough time to obtain the proper permits, financing and to have the construction completed. Motion Based on the testimony and evidence presented in Case No. 04-757, Ms. Carroll moved that this Board find that Heather S. Conley is in violation of the City of Boynton Beach Code Sections FBC '01 ED BBA 104.1.1,105.6 and 104.6, and moved to order that the Respondent correct the violation on or before March 16, 2005. The Board has considered the gravity of the violation, the actions taken by the Respondent and any previous violations by the Respondent and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $25 per day, plus administrative costs, shall be imposed for each day the violation continues past Mamh 16, 2005. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for reinspection of the property to verify compliance with the Order. Motion seconded by Vice Chair Costantino and unanimously carried. Case #04-882 Property Address: Violations: Hector V. Rivera & Mayler Faneite 3709 Diane Drive Chapter 15, Article IX-15-120 (D), Inc. and FBC '01 Edition 104.1.1. Please re-sod gravel parking area or install a permitted parking area. Inspector Lewis presented the case. The property was originally cited on April 19, 2004. Mayler Faneite, 3709 Diane Drive, stated that he was co-owner of the property and pled not guilty. Ms. Cook requested to view the photographs. Inspector Lewis first presented the photographs to the respondent and then to the Board. Mr. Faneite stated that the property has been in the same condition since 1993 when he purchased it. He was cited two years ago and when he appeared before the Board at that time the case was dismissed and he was informed that his property was grandfathered. Chairman DeLiso questioned how this could happen. Vice Chair Costantino noted that the property had to be re-graveled in order to use it for parking. If the respondent did not use the area for parking, it would have to be resodded. Meeting Minutes Code Compliance Board Boynton Beach, Florida July 21, 2004 Chairman DeLiso inquired if the City had a record of the case two years ago and Inspector Lewis stated that he was not aware of one. The respondent was asked how much time he needed to bring the properly into compliance and he stated he did not have the funds to put in a new driveway. He was informed that in lieu of putting in a new driveway, he could plant grass. Mr. Faneite asked for 120 days to bring the property into compliance. The City agreed to this amount of time. Motion Based on the testimony and evidence presented in Case No. 04-882, Ms. Cook moved that this Board find that Hector V. Rivera and Mayler Faneite are in violation of the City of Boynton Beach Code Sections Chapter 15, Article IX-15-120 (D), Inc. and FBC '01 ED BBA 104.1.1, and moved to order that the Respondents correct the violation on or before November 18, 2004. The Board has considered the gravity of the violation, the actions taken by the Respondents and any previous violations by the Respondents and hereby orders that if the Respondents do not comply with this Order, a fine in the amount of $25 per day, plus administrative costs, shall be imposed for each day the violation continues past November 18, 2004. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for reinspection of the property to verify compliance with the Order. Motion seconded by Vice Chair Costantino and unanimously carried. VI. OLD BUSINESS A. Lien Penalty Certifications Case #04-500 Anna M. Santiago 2180 N. Seacrest Boulevard Inspector Webb presented the case. The property was originally cited on March 11, 2004 for violation of the Community Appearance Code and inoperable vehicles. No one appeared at the Code Compliance Board Hearing date on May 19, 2004. A compliance date of June 18, 2004 was set or be fined $25 per day. The property has yet to comply. Mr. Faneite interpreted for Ms. Santiago. Ms. Santiago assumed the podium and stated that she resided at 2180 N. Seacrest Boulevard, Boynton Beach. Chairman DeLiso asked the respondent why the property has not been brought into compliance. Ms. Santiago stated that she lives alone and is caring for three children and does not have much money. She felt that she could have the property into compliance within three weeks. Inspector Lewis remarked that the vehicles have been removed and the only items remaining are sod and a house number. Cases to be Heard Case #04-931 Property Address: Violations: Wanda Robinson 1203 NW 4th Street Chapter 15, Article IX-15-120 (D), Inc. Sod all bare spots and water yard to obtain a uniform green appearance. Inspector Pierre presented the case. The property was originally cited on April 27, 2004 through routine neighborhood inspection. Wanda Robinson, 1203 NW 4th Street, Boynton Beach, assumed the podium and requested more time for compliance. She stated that she is doing all the yard work herself and it is taking her a long time to get it done. Chairman DeLiso requested to look at the pictures. Inspector Pierre presented the photos to the respondent and then to the Board. Chairman DeLiso asked the respondent how much time she needed and she asked for five months. Ms. Simshauser inquired if any work had been done and Ms. Robinson stated that she has done a great deal of work. Chairman DeLiso inquired if the respondent would be eligible for assistance from the City and was informed that the property is a duplex and is not eligible for sod. Inspector Pierre noted that many people use her property as a shortcut. Motion Based on the testimony and evidence presented in Case No. 04-931, Vice Chair Costantino moved that this Board find that Wanda Robinson is in violation of the City of Boynton Beach Code Sections Chapter 15, Article IX-15-120 (D), Inc., and moved to order that the Respondent correct the violation on or before October 19, 2004. The Board has considered the gravity of the violation, the actions taken by the Respondent and any previous violations by the Respondent and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $25 per day, plus administrative costs, shall be imposed for each day the violation continues past October 19, 2004. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for reinspection of the property to verify compliance with the Order. Motion seconded by Ms. Cook and unanimously carried. Meeting Minutes Code Compliance Board Boynton Beach, Florida July 21, 2004 Lien Penalty Certifications Case #03-3171 Barbara A. Phillips 2051 NW 2"a Court Inspector Webb presented the case. The property was originally cited on December 2, 2003 for violation of the Community Appearance Code. James Phillips appeared at the February 18, 2004 Code Compliance Board Hearing. A compliance date of May 18, 2004 was set or be fined $50 per day. The property has yet to comply. James Phillips, 2051 NW 2nd Court, Boynton Beach, assumed the podium. Mr. Phillips reported that the CDC informed him that he would be getting sod next week. Vice Chair Costantino inquired if he had anything in writing to evidence this. Mr. Phillips stated that he signed the necessary papers today. Inspector Webb confirmed that he received a phone call regarding the sod. Vice Chair Costantino requested that in the future the CDC should inform the Code Compliance Office in writing whenever they are providing sod. Inspector Cain said that he would relay this request to the CDC Office. Motion Ms. Carroll moved that Case No. 03-3171 be tabled until the Code Compliance Board meeting to be held on August 18, 2004. Motion seconded by Vice Chair Costantino and unanimously carried. Case #03-3104 Virginia E. Lewis 149 SE 27th Way Inspector Lewis presented the case. The property was originally cited on November 21, 2003. The respondent did appear at the April 21,2004 Code Compliance Board hearing date. A compliance date of June 5, 2004 was set or be fined $50 per day. The property has not yet complied. Virginia E. Lewis, 149 SE 27th Way, Boynton Beach, assumed the podium. Chairman DeLiso asked the respondent why the property has not been brought into compliance and she responded that she felt it was a matter of interpretation of the Code. The respondent felt that her property was in compliance and that she kept the place neat, but according to the Code Compliance Department it did not meet Code. She said that she keeps the trees large because she needs the shade to cool her house, since she does not have air conditioning. Inspector Lewis presented photographs to the respondent and then to the Board. Ms. Lewis stated that she has a gmat deal of plants in pots that her neighbors object to because they feel they are hurricane hazards. She intends to do more pruning in order to make the property more presentable. Inspector Lewis reported that the yard is full of leaves and the door and the street number are not visible because of all the growth in the yard. Meeting Minutes Code Compliance Board Boynton Beach, Florida July 21, 2004 Mr. Blasie, Code Compliance Administrator, noted that he was very familiar with this property and the numerous complaints lodged by the neighbors. At one time someone volunteered to help Ms. Lewis clean up her yard, but he was not sure of the outcome of this. Ms. Lewis inquired if the plants in the pots were permissible under the Code. Attorney Tolces explained that the respondent has already been cited. The property has not complied and she is present tonight for a lien certification. It is not the Board's responsibility to interpret whether or not her property is in compliance. Ms. Lewis stated that the volunteer mentioned by Mr. Blasie did come to her property and helped her on a few occasions. She has since been in contact with a tree trimmer to come out to trim the trees, but she has not heard back from him. She will be following through with getting the trees trimmed. After discussion, members felt that it would be best to cedify the fine since the respondent has not proved that she would be bringing the property into compliance in the foreseeable future. Motion Based on the testimony and evidence presented in Case No. 03-3104, Vice Chair Costantino moved that this Board find that the Respondent has not complied with this Board's Order dated April 21, 2004, and having considered the gravity of the violations, the actions taken by the Respondent, and any and all previous violations committed by the Respondent, that this Board impose and certify a fine in the amount of $50 per day, plus administrative costs, which shall continue to accrue until the Respondent comes into compliance or until a judgment is entered based upon this certification of fine. Motion seconded by Ms. Cook and unanimously carried. VII. LIEN REDUCTIONS Case #03-2853 Jean P. Messeroux 2950 SE 2nd Street Mr. Blasie presented the case. The property was originally cited on October 21,2003 for failure to obtain an occupational license and passing inspection. Also, there was trash and debris and the landscaping needed to be brought up to Code. The case first came before the Board on December 17, 2003 and no one appeared. A compliance date of February 15, 2004 was set or be fined $25 per day. The property came into compliance on June 18, 2004 for 123 days of non-compliance resulting in a fine of $3,075, plus administrative costs. Mr. Blasie also noted that the applicant had two cases on the agenda for the property that he owned next to this property. Both properties were duplex houses that were rented out. Mr. Blasie presented photographs of both properties first to Mr. Messeroux ]0 Meeting Minutes Code Compliance Board Boynton Beach, Florida July 21, 2004 and then to the Board. Two photographs were taken today and others were taken on December 17, 2003 and May 18, 2004. Jean Messeroux, 5643 Lincoln Circle E, Lake Worth, stated that he had trouble bringing the property into compliance because of problems with the tenants. He was unaware that there was a lien on the property until a real estate broker informed him of this. Mr. Blasie stated that there are signed certified mail receipts in the file indicating that the respondent received notice. Mr. Messeroux acknowledged that one of the signatures was that of his wife and the other signature was his. Inspector Lewis testified that he had met with the respondent and he was aware that the property had been cited and he informed him what needed to be done in order to bring the property into compliance. Inspector Lewis stated that the property needed grass and a sprinkler system had to be installed. Also one of the apartments did not have working smoke detectors. Chairman DeLiso inquired if there were tenants living at the property and was informed that they were occupied. Vice Chair Costantino inquired if the respondent has received his occupational license and Inspector Lewis stated that he has received it since the property is now in compliance. This applies to both properties. Motion Based on the testimony and evidence presented in Case No. 03-2853, and having been advised that the Respondent has complied with all lien reduction procedures set forth in Sections 2-84 through 2-89 of the City of Boynton Beach Code of Ordinances, Vice Chair Costantino moved that this Board reduce the fines instituted in Case No. 03-2853, by virtue of this Board's Order of December 17, 2003, to an amount of $826.18, including administrative costs. Motion seconded by Ms. Cook and unanimously carried. Case #03-2854 Jean Pierre Messeroux 2970 SE 2nd Street Mr. Blasie presented the case and stated that the property was originally cited on October 21, 2003 for the same violations as in the previous case. No one appeared at the December 17, 2003 Code Compliance Board Hearing. A compliance date of February 15, 2004 was set or be fined $25 per day. The property complied on June 18, 2004 for 123 days of non-compliance resulting in a fine of $3,075, plus administrative costs. Mr. Blasie pointed out that this is the second property referred to in the previous case and the same issues apply to this property as well. Motion Based on the testimony and evidence presented in Case No. 03-2854, and having been advised that the Respondent has complied with all lien reduction procedures set forth in Meeting Minutes Code Compliance Board Boynton Beach, Florida July 21, 2004 Sections 2-84 through 2-89 of the City of Boynton Beach Code of Ordinances, Vice Chair Costantino moved that this Board reduce the fines instituted in Case No. 03-2854, by virtue of this Board's Order of December 17, 2003, to an amount of $826.18, including administrative costs. Motion seconded by Ms. Cook and unanimously carried. Mr. Blasie explained the appeal process that is available to the applicant and the City Commission. Case #03-2091 Mariners Way Homeowners Assoc. 800 Mariners Way Mr. Blasie presented the case. The property was originally cited on July 15, 2003 for violation of the Florida Building Code related to the construction of a tiki hut. The case first came before the Board on September 17, 2003 and no one appeared. A compliance date of November 16, 2003 was set or be fined $25 per day. The property complied on June 17, 2004 for 213 days of non-compliance resulting in a fine of $5,325, plus administrative costs. Mr. Blasie presented a narrative on the problems the Homeowners Association had in getting the tiki hut properly built. The Florida Statutes require that a Seminole Indian must build it and not a Cheyenne as was originally contracted to build the tiki hut. The Homeowners Association eventually found the proper Indian representative that completed the tiki hut and it is now in compliance with the Code. Mr. Kenneth Hislop, 744 Mariners Way and Vice President of the Homeowners Association distributed a history of the construction of the tiki hut to the members, a copy of which is on file in the City Clerk's Office. Mr. Hislop related the difficulties they encountered in getting the tiki hut approved that required them to appear before the CRA Board twice and the City Commission. Chairman DeLiso inquired what the definition of a tiki hut was and was informed that it consisted of using 550 palm fronds that covered a 12' x 16' area and is used like a pavilion to sit under for shade. Motion Based on the testimony and evidence presented in Case No. 03-2091, and having been advised that the Respondent has complied with all lien reduction procedures set forth in Sections 2-84 through 2-89 of the City of Boynton Beach Code of Ordinances, Vice Chair Costantino moved that this Board reduce the fines instituted in Case No. 03-2091, by virtue of this Board's Order of September 17, 2003, to $0, including administrative costs. Motion Based on the testimony and evidence presented in Case No. 02-3221, Vice Chair Costantino moved that this Board find that Guy Estella is in violation of the City of Boynton Beach Code Sections SBC '97 ED 105.6, and moved to order that the Respondent correct the violation on or before August 20, 2004. The Board has considered the gravity of the violation, the actions taken by the Respondent and any previous violations by the Respondent and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $75 per day, plus administrative costs, shall be imposed for each day the violation continues past August 20, 2004. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for reinspection of the property to verify compliance with this Order. Case #03-2163 Property Address: Violations: Lucile Shelton 424 NW 9th Avenue Chapter 15, Article IX-15-120 (D), Inc. and 13-16 B.B.C. of Ordinances. Repair driveway and remove unregistered and inoperable vehicle from your backyard. An occupational license is required for rental property. Inspector Pierre presented the case. The City recommended a compliance date of August 20, 2004. Motion Based on the testimony and evidence presented in Case No. 03-2163, Vice Chair Costantino moved that this Board find that Lucile Shelton is in violation of the City of Boynton Beach Code Sections Chapter 15, Article IX-15-120 (D), Inc. and 13-16 B.B.C. of Ordinances, and moved to order that the Respondent correct the violation on or before August 20, 2004. The Board has considered the gravity of the violation, the actions taken by the Respondent and any previous violations by the Respondent and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $25 per day, plus administrative costs, shall be imposed for each day the violation continues past August 20, 2004. DISCUSSION Mr. Blasie pointed out that that the September meeting falls on Rosh Hashanah and asked members if they wanted to change the September meeting date. It was decided to change the September meeting to September 22, 2004. However, when the Clerk's Office checked the availability of September 22nd, it was determined that another party had already reserved the Chambers. After discussing this with Mr. Blasie, it was decided to hold the September meeting on the fifth Wednesday of September, i.e., September 29, 2004 in Commission Chambers at 7:00 p.m. X.
