Vice Chair Costantino called the meeting to order at 7:00 p.m.
II. Approval of Minutes of September 23, 2004
Motion
Mr. Foot discussed the following changes that should be made to the minutes of
the September 23rd Lien Reduction Meeting: page 9, 2nd paragraph should be
changed to "Chairman "DeLiso" recommended assessing (from Chairman
"Blasie") , and on page 10, 2nd paragraph should have sentence added at the
end that the "Motion was seconded Vice Chair Costantino and was unanimously
carried."
Mr. Foot moved to accept the subject minutes with the two corrections made as
previously stated. Ms. Hammer seconded the motion that passed unanimously.
III. Approval of Agenda
Sr. Code Compliance Officer Mike Melillo stated the following case numbers
complied: Case No. 04-1350, Case No. 04-1589, Case No. 04-910, Case No. 04-
1630, Case No. 04-1893, Case No. 04-1834. Case No. 04-1836, Case No. 04-
1844, and Case No. 04-2024.

Motion
Ms. Cook moved to accept the agenda as amended. Mr. Foot seconded the
motion that passed unanimously.
IV. Swearing in of Witnesses and Introduction
Sr. Code Officer Melillo called the roll and asked that those persons present
identify themselves.
Attorney Tolces administered the oath as required to all persons who would be
testifying at the meeting.
Vice Chair Costantino explained the plea system.

Sr. Code Compliance Officer Mike Melillo reported that this was a single-family
home that is homesteaded. The original inspection was October 24, 2003,
service was accomplished by hand carry.
Jeffrey Smith, owner{s) of property at 2525 SW 14th Street pled no
contest. Mr. Smith explained he had contracted to have the screened-in
enclosure added to the back of the house; however, the contractor implemented
the improvements prior to receiving approvals from the City. At that time, Mr.
Smith was unaware the enclosure encroaches on the 25 foot setback for a
paneled roof.
Mr. Smith learned on October 19, 2004 that the consultant the City contracted to
review the Land Development Regulations (LDR) is no longer under contract and
the item is now the responsibility of the Zoning Department to resolve.
Mr. Blasie confirmed that the LDRs had not been revised that it could take 1 year
or more before a resolution is reached. Mr. Blasie reminded the Board that the
regulations state a property owner be given a "reasonable amount of time" to
resolve any violations.
Mr. Blasie clarified for Ms. Hammer that this case is not a Fine Certification and
can be tabled again since the LDR issue could be an ongoing open item for quite
some time.
Ms. Cook asked for the amount of encroachment for this enclosure and was
informed the overage is approximately 10 feet.
Motion
Based on the testimony and evidence presented in Case No. 03-2938, Mr. Foot
moved that this Board find that Jeffrey A. and Cindy J. Smith are in violation of

the Florida Building Code 2001 Edition 104.1.1 and 104.7.5 Boynton Beach
Amendments and moved to order that the Respondents correct the violation on
or before April 15, 2005. The Board has considered the gravity of the violation,
the actions taken by the Respondents, and any previous violations by the
Respondents, and hereby orders that if the Respondents do not comply with this
Order, a fine in the amount of $25 per day, plus administrative costs, shall be
imposed for each day the violation continues past April 15, 2005. The
Respondents are further ordered to contact the City of Boynton Beach Code
Compliance Division in order to arrange for reinspection of the property to verify
compliance with this Order. Ms. Hammer seconded the motion that was passed
unanimously.
Mr. Smith asked for clarification of the Board's decision. Mr. Smith was advised
he is to have the structure violations completed by April 15, 2004 or he will incur
further fines. Mr. Smith was reminded to stay in contact with Mr. Melillo
regarding the progress of resolving the violations.

Code Officer Cain reported that this case was a citizen complaint. The initial
notice was a written notice giving 10 days to comply and sent certified mail
September 27, 2004. The green card was signed and returned on September
28, 2004.
Rachel L. Buckley, 315 SW 2nd Avenue, Boynton Beach, FL pled not guilty.
Ms. Buckley purchased the property in December of 2004. At that time, she
wasnt aware the home had been illegally converted. She purchased the
property from the family who resided in the residence. She later learned the
previous owners had converted the screen porch into an apartment and had it
rented, all without permits.
Ms. Buckley stated she has removed the locks that separated the three units and
the tenants are moving. She is unsure of what else needs to happen to comply.

Mr. Cain clarified the only violation is renting the house as a triplex, not the
improvements to the porch. Mr. Foot clarified that zone R-1-A is a single family
residence only.
Attorney Tolces clarified the plea system for Ms. Buckley. Ms. Buckley changed
her plea to no contest and reiterated she has already complied by removing the
locks within each unit and removing the tenants.
Ms. Buckley was reminded that she must have a licensed contractor pull the
permits for any improvements and was directed to speak with the Building
Department about how to proceed.

Based on the testimony and evidence presented in Case No. 04-427, Ms. Cook
moved that this Board find that Rachel L. Buckley is in violation of the Florida
Building Code 2001 Edition 104.1.1 Boynton Beach Amendments and moved to
order that the Respondent correct the violation on or before December 19, 2004.
The Board has considered the gravity of the violation, the actions taken by the
Respondent, and any previous violations by the Respondent, and hereby orders
that if the Respondent does not comply with this Order, a fine in the amount of
$25 per day, plus administrative costs, shall be imposed for each day the
violation continues past December 19, 2004. The Respondent is further ordered
to contact the City of Boynton Beach Code Compliance Division in order to
arrange for reinspection of the property to verify compliance with this Order. Mr.

property. The initial routine inspection was June 23, 2004. Written notice was
issued giving 30 days to comply and sent certified mail August 30, 2004 and no
green card has been returned. The property was posted on September 29,
2004.
Derek Roper, 1515 NE 4th Street pled no contest. He stated the entire
driveway needs to be replaced but he cannot afford to do so at this time. The
lowest estimate he has obtained is $800.00. Mr. Webb distributed pictures of
the driveway to the Board.

Hammer moved that this Board find that Derek & Michelle Roper are in violation

moved to order that the Respondents correct the violation on or before
December 19, 2004. The Board has considered the gravity of the violation, the
actions taken by the Respondents, and any previous violations by the

Sr. Code Officer Webb reported that this property is a single-family homesteaded
property. This case was initiated by a citizen's complaint. The initial inspection
was July 28, 2004. Written notice was issued giving 10 days to comply and sent
certified mail August 19, 2004. The green card was returned September 28,
2004.
Ismael Perdomo, representative for Real Estate Depot, Inc., 1300
North Federal Highway, Boca Raton, FL pled no contest. Mr. Perdomo
stated he was recently tasked with bringing this property into compliance. Mr.

Perdomo was onsite approximately two weeks ago but was instructed by a
Boynton Beach Police Officer to vacate the premises. The officer explained that
no one was supposed to be inside the property because it belonged to the State.
Mr. Perdomo asked for a few days to complete the repair of the pool fencing and
install house numbers.
A discussion ensued as to the ownership of this property. Mr. Webb verified
ownership is Real Estate Depot, Inc. according to the City records. It was
determined that the Police Department's involvement on the premises was in
error.
Motion
Based on the testimony and evidence presented in Case No. 04-1746, Ms. Cook
moved that this Board find that Real Estate Depot, Inc. is in violation of Chapter
15, Article IX-15-120(D).1 Inclusive of the Boynton Beach Code of Ordinances,
PT3-LDR. CH20-VIII.SEC1.G, and Florida Building Code 2000 Edition
424.2.17.1.8 and moved to order that the Respondents correct the violation on
or before October 30, 2004. The Board has considered the gravity of the
violation, the actions taken by the Respondents, and any previous violations by
the Respondents, and hereby orders that if the Respondents do not comply with
this Order, a fine in the amount of $100 per day, plus administrative costs, shall
be imposed for each day the violation continues past October 30, 2004. The
Respondents are further ordered to contact the City of Boynton Beach Code
Compliance Division in order to arrange for reinspection of the property to verify

Virginia Hernandez, 2125 NE 3rd Court pled no contest. Ms. Hernandez
requested 30 days to resolve. Mr. Webb clarified the only infraction is a 4 inch
house number.

moved that this Board find that Virginia Hernandez is in violation of Chapter 15,
Article IX-1S-120(D).1A and Chapter 20, Section 8 E-16, of the Boynton Beach
Code of Ordinances, and moved to order that the Respondent correct the
violation on or before October 30, 2004. The Board has considered the gravity
of the violation, the actions taken by the Respondent, and any previous
violations by the Respondent, and hereby orders that if the Respondent does not
comply with this Order, a fine in the amount of $25 per day, plus administrative

Code Compliance Officer Cain stated that this was a commercial, non-
homesteaded dwelling. The property owner of record is AAM Industries, Inc.,
P.O. Box 3662, Boynton Beach, FL. Original inspection was completed on August
9, 2004. The initial notice was written and the owner was given 14 days to
comply.
Mark Moretto, representative for AAM Industries, Inc., 225 SE 5th
Avenue pled no contest. Mr. Moretto stated the company was under the
impression they were in compliance with the gas tanks after having received a
letter from the Building Department stating such.

Ms. Cook inquired how this case came to the Board's attention, what type of gas
tanks are involved, and what is the type of violation. Mr. Cain verified violation
was brought to the Department's attention through the Fire Department and the
concern is the tanks are not permitted. Mr. Moretto clarified the gas tanks are
above ground automobile fuel tanks.

Based on the testimony and evidence presented in Case No. 04-1890, Ms. Cook
moved that this Board find that AAM Industries, Inc. is in violation of the Florida
Building Code 2001 Edition 104.1.1 Boynton Beach Amendments and moved to
order that the respondents correct the violation on or before December 19,
2004. The Board has considered the gravity of the violation, the actions taken
by the Respondents, and any previous violations by the Respondents, and
hereby orders that if the Respondents do not comply with this Order, a fine in
the amount of $25 per day, plus administrative costs, shall be imposed for each
day the violation continues past December 19, 2004. The Respondents are

organized and he is planning to pull a permit so he may redo the driveway. The
sand has been removed. He will be obtaining a permit to complete the
construction and asked for 30 days to comply.

moved that this Board find that Gustavo Mejia & Yenny Cuervo are in violation of
the Florida Building Code Edition 2001 104.1.1 Boynton Beach Amendments,
Chapter 15, Article IX-1S-120(D) 1 Inclusive, and 10-2 of the Boynton Beach
Code of Ordinances and moved to order that the Respondents correct the
violation on or before December 19, 2004. The Board has considered the gravity
of the violation, the actions taken by the Respondents, and any previous
violations by the Respondents, and hereby orders that if the Respondents do not
comply with this Order, a fine in the amount of $25 per day, plus administrative

was returned on October 18, 2004.
Arthur J. Tubesing, 2203 NW 22nd Way, pled not guilty. Mr. Tubesing stated
that the improvements were made after he sold the property to Patrick Retzler.
Patrick Retzler, 106 Stirrup Lane, Royal Palm Beach, FL stated he
purchased the property from Arthur J. Tubesing and the improvements were
made after the sale of the property.

Attorney Tolces suggested tabling this case to allow the code inspector to cite
the current owner. This would only be done upon proof of the sale and
ownership change.
Mr. Retzler was advised he will need to obtain an occupational license and permit
if he rents this property to his in-laws. He was directed to speak with Mr.
Guillaume for directions on how to proceed.
Motion
Mr. Foot moved that Case No. 04-2171 be tabled until the Code Compliance
Board meeting to be held on November 17, 2004. Ms. Hammer seconded the
motion that was passed unanimously.

2004 and the initial notice was written with 30 days to comply. The notice was
sent certified mail on September 29, 2004 and the signed green card was
returned on October 18, 2004.
Sanjuanita Carranza on behalf of Alicia H. Ramos, 1890 NE 2nd Lane
pled no contest. Ms. Ramos requested 120 days to comply stating she has
sustained roof damage from the hurricane. The construction in front of the
house caused damage to the fence and mailbox post. These items have been
discarded by the construction crew and need to be replaced as well.
Mr. Webb confirmed the sidewalks and street are torn up in front of the house
and the City will replace anything that has been damaged. He confirmed the
sodding is the only remaining violation. Pictures of the property were
distributed.

Simshauser moved that this Board find that Alicia H. and Rolando Ramos are in

Inclusive, and moved to order that the Respondents correct the violation on or
before January 18, 2005. The Board has considered the gravity of the violation,
the actions taken by the Respondents, and any previous violations by the
Respondents, and hereby orders that if the Respondents do not comply with this
Order, a fine in the amount of $25 per day, plus administrative costs, shall be
imposed for each day the violation continues past January 19, 2005. The
Respondents are further ordered to contact the City of Boynton Beach Code
Compliance Division in order to arrange for reinspection of the property to verify
compliance with this Order. Mr. Foot seconded the motion that was passed
unanimously.
Ms. Carranza was advised to make sure that Ms. Ramos understands the
compliance deadline and costs of outstanding violations that remain beyond the
compliance date.

Code Officer Pierre stated the original notice of violation was on March 23, 2003.
Thomas Vilius appeared at the Code Compliance Board hearing on May 21, 2003
and a compliance date was issued of August 20, 2003 or $25 per day. The
number of days in non-compliance is 426.
Marie R. Thomas, 12S NW 4th Avenue pled no contest. Ms. Thomas stated
she understands her property is still in violation but does not understand why.
Ms. Cook clarified this is a permit violation that has been outstanding since 1997.
Ms. Thomas did not know about the permit issue when she purchased the
property in 2001.
Code Compliance Administrator Blasie clarified that a room was enclosed without
a permit. Mr. Pierre confirmed the room was a patio. These violations were
active with the previous owners and were assumed with the purchase of the
property. Mr. Blasie state a permit will not be required to demolish the room
because it was never permitted to begin with.
Motion
Mr. Foot moved that Case No. 03-824 be tabled until the Code Compliance Board
meeting to be held on January 19, 2005. Ms. Hammer seconded the motion that
passed unanimously.

Vice Chair Costantino strongly admonished Mr. Estrella for leaving the doors on
the refrigerator and instructed him to remove them immediately for the safety
and welfare of the children in the neighborhood.
Motion
Based on the testimony and evidence presented in Case No. 04-2186, Mr. Foot
moved that this Board find that Guy Estella & Iglad Naurelus are in violation of
the PT3-LDR.CH2. SEC.6.B.2 of the Boynton Beach Code of Ordinances and
moved to order that the Respondents correct the violation on or before October
21, 2004. The Board has considered the gravity of the violation, the actions
taken by the Respondents, and any previous violations by the Respondents, and
hereby orders that if the Respondents do not comply with this Order, a fine in
the amount of $500.00 per day, plus administrative costs, shall be imposed for
each day the violation continues past October 21, 2004. The Respondents are
further ordered to contact the City of Boynton Beach Code Compliance Division in
order to arrange for reinspection of the property to verify compliance with this
Order. Ms. Hammer seconded the motion that was passed unanimously.

VII. Discussion
Code Compliance Administrator Blasie informed the Board of the change in the
attendance notification procedures. Board members must contact the Code
Compliance Department to confirm or cancel attendance at each Code Board
meeting by calling 742-6833 (Diane Springer.) The City Clerk's office is
redrafting the membership letter with the new instruction.
Attorney Tolces reminded the Board that Florida Statutes provide if a Board
member fails to attend two or three successive meetings without cause and prior
approval of the Chairman, his/her membership will be revoked.
A discussion ensued regarding whether the Lien Reduction meeting scheduled for
November 24, 2004 will be absorbed into the regular Code Compliance meeting
scheduled on November 17, 2004. No definitive answer was provided.
