Foot asked the Board to consider corrections to the subiect minutes and to minutes formerly approved as follows: Tn the December 23, 2004 minutes, page 3, the motion on Case #01-746 shows passing unanimously when it actually passed 5-1, with Mr. Foot dissenting. In the December 15, 2004 minutes, Vice Chair Costantino was shown as presiding as Chair when, in fact, Chair DeLiso was present. In the same minutes, the minutes that were approved were shown to be September 23, 2004 when they were actually the minutes of November 17, 2004. In the minutes of November 17, 2004, the minutes were shown to be for September 23, 2004 when they were actually the minutes of October 20, 2004. in the November 17, 2004 minutes, on page 26, the motion on Case #03~2926 was made by Mr. Foot and not Ms. Carroll. All these cases had a shared violation, a community dock. Mr. Blasie asked that the case be heard as one, regardless of how the motions were handled. Also, Mr. Blasie requested that the next item be a lien reduction, Page 76, Case #00- 2240. The attorney representing the owner was present and was not available for the normal lien reduction hearing scheduled for the following week. Lien Reduction Case #00-2240 David W. Nicholls 3130 Orange Street Mr. Blasie presented the case. The notice of violation was initially issued on September 7, 2000 for violations of the Community Appearance Code. A Board hearing was held on December 20, 2000 and no one appeared. The Board set a compliance date of .lanuary 15, 2001 and proposed a fine of $25.00. The property came into compliance on November 2, 2004. Mr. Blasie commented that this was one of several violations during this time period and that IVlr. Nicholls had since passed away. The Board had heard about Mr. Nicholls' poor health and circumstances from Attorney Jeff Tomberg on many occasions. The Board had previously reduced the liens against Mr. Nicholls to administrative costs and staff recommended that it do so again. Mr. Tomberg was trying to clear the estate. The property now looks very good. The administrative costs are $922.21. Mr. Foot was in agreement with the proposal of staff, but asked Mr. Tomberg if he had anything to add to the matter. Mr. Tomberg stated that the case was tragic and that when administrative fines had been levied in the past, they had always been paid. Motion Based on the testimony and evidence presented in Case #00-2240, and having been advised that the Respondent has complied with all lien reduction procedures set forth in Section 2-84 through 2-89 of the City of Boynton Beach Code of Ordinances, Vice Chair Costantino moved that this Board reduce the fines instituted in Case #00-2240, by virtue of this Board's Order of December 20, 2000, to an amount of $922.21. Ns. Hammer seconded the motion that passed unanimously. A. See Red Tag from Building Department. Scott Blasie, Code Administrator, introduced the City's case. The community in question is known as Lakeside Harbor, one that was developed many years ago. There is a private easement that runs from Federal Highway down to the Intracoastal. In early October of 2004, the City got a report that the dock had been damaged. Upon investigation, Don Johnson, the City's Building Official, issued a Red Tag deeming the dock unsafe. Mr. Blasie's observation was also that the concrete-filled PVC pilings had been damaged. The Red Tag was forwarded to the Code Compliance office on November 18, 2004. Mr. Blasie consulted the Legal Department due to the unusual situation of so many people with a shared or vested interest in this dock. The Legal Department advised that all the people using the dock should be cited and most of those individuals were present at this meeting. Some did not send the green cards back. Senior Code Officer Webb issued the citations. A compliance date was given of December 31, 2004 and compliance had not been achieved. The condition of the dock is the same as it was in October. Two documents were mentioned as being pertinent to the case: 1) a letter from Michael S. Noell, an architect for Gulf Design Group to Don Johnson, stating that the dock was not in immediate danger of collapse; 2) a court docket for a case to be heard on March 18, 2005 pertaining to the dock. Don 3ohnson, Building Official, came forward to present his testimony in this case. He presented photographs of the dock to the Board. Mr. Johnson advised that he had received a phone call from a resident of the neighborhood, Mr. Donald Tracey, complaining that the dock had become unsafe due to hurricane damage. Mr. Johnson observed the dock on October 8, 2004 and found that the PVC pipe was damaged at the water level. The rebar is holding the pipe up. The concrete that was poured down the sleeve that supports the piling was damaged. He deemed that the dock was unsafe and a Red Tag was written. A resident in the vicinity at this time, Mr. Todd Barossa, was given the Red Tag and stated that he would forward it to the appropriate residents on the street. Mr. Johnson mentioned a different letter from Mr. Michael Noell, who concurred that the dock was unsafe and outlined what would have to be done in order to preserve it. The contractor for the homeowners would have to go through the Department of Environmental Protection and the Army Corps of Engineers to get approvals or an exemption letter, since those agencies have jurisdiction over the Intracoastal Waterway, prior to the City giving a permit for this work. Mr..lohnson referred to the litigation about the dock that was scheduled to go forward, but he did not know the details. 7 Meeting Minutes Code Compliance Board Boynton Beach, Florida _~anuary 19, 2005 Chair DeLiso asked Hr. Johnson what the homeowners were contending. Hr. ,lohnson stated that the homeowners' design professional had stated that the dock was not unsafe to the point that it was in danger of imminent collapse, but unless something was done, it would continue to deteriorate. In response to questions from the Board, Mr. _lohnson stated that it was his opinion and that of the design professional mentioned that the dock was safe enough at this time. He would have no problem with tabling the case until the court settlement had taken place. Hr. Blasie commented that that were at least two persons who were opposed to saving the dock. Chair DeLiso asked for a spokesman from the group, and Tom Warnke appeared. Tom Warnke, 526 Lakeside Harbor, Boynton Beach, did not believe that the damage was hurricane-related, citing three separate instances of vandalism coincident with a request that the dock be condemned. The homeowners were ready to sign off on getting the repairs to the dock accomplished, but the City required that there be 100% participation and agreement from everyone on the street before issuing a permit. Michael Singer, 695 Lakeside Harbor, Boynton Beach, stated that the dock was on his property. He stated that he did not mind the residents using his property, but that he had asked them to treat it with respect (which did not always happen.) Various accusations and comments were traded among the participants, but they are not noted, as they were not germane to the Code compliance issue at hand. Assistant City Attorney Tolces reminded the parties that the ownership of the dock was not of concern to the Board and the only item before the Board was whether or not the dock was in compliance and whether or not to table the case. A discussion ensued among the Board members, who ultimately decided it would be appropriate to wait for the court case to settle before proceeding with the Code issue. Motion Hr. Foot moved to table Case Nos. 04-2664, 04-2665, 04-2667, 04-2668, 04-2669, 04- 2670, 04-2671, and 04-2672 until the .]une 15, 2005 Code Compliance Board meeting. Ms. Hammer seconded the motion that passed unanimously. Mr. Hark Haher, Case # 04-2674, came forward and said that he had not returned his green card, but believed that his case should be included in the motion. 8 Meeting Minutes Code Compliance Board Boynton Beach, Florida January 19, 2005 Motion Mr. Foot moved to reconsider the previous motion. Ms. Cook seconded the motion that passed unanimously. Motion Mr. Foot moved to expand the original motion to include Case # 04-2674. Costantino seconded the motion that passed unanimously. Vice Chair Case #04-2811 Property Address: Violation(s): Scott A. & Jill Ann Smith 1114 S.W. 24th Avenue FBC '01 ED BBA 104.1.1 Permits required for sheds, fence, and awnings. Code Officer Courtney Cain presented the case for the City. The origin of the violation was a citizen's complaint. The property was inspected originally on December 13, 2004, at which time a written notice was sent to the property owner giving them 10 days to comply. A notice of hearing was sent certified mail on December 29, 2004. Confirmation of receipt of that notice was received in the City on January 6, 2005. Scott Smith, 1114 S.W. 24th Avenue, Boynton Beach, pled no contest. He was busy trying to clean up the property and obtain the necessary permits. He asked for 90 days to finish the task. Motion Based on the testimony and evidence presented in Case #04-2811, Mr. Foot moved that this Board find that Scott A. & _]ill Ann Smith are in violation of City of Boynton Beach Code Sections as cited, and moved to order that the Respondents correct the violations on or before May 19, 2005. The Board has considered the gravity of the violations, the actions taken by the Respondents, and any previous violations by Respondents, and hereby orders that if the Respondents do not comply with this Order, a fine in the amount of $25 per day plus administrative costs shall be imposed for each day the violations continue past May 19, 2005. The Respondents are further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re- inspection of the property to verify compliance with this Order. Vice Chair Costantino seconded the motion that passed unanimously. Case #04-2812 Property Address: Violation(s): Sharon & ]eft Brueggemann 1124 S.W. 24th Avenue FBC '01 ED BBA 104.1.1 Permit required for windows and shutters. 9 Meeting Minutes Code Compliance Board Boynton Beach, Florida January 19, 2005 Code Officer Cain presented the case for the City. The origin of the violation was a citizen's complaint. The initial inspection was on December 13, 2004, at which time a written notice was sent to the property owners giving them 10 days in which to comply. A notice of hearing was sent by certified mail to the property owners on December 29, 2004. An unsigned card was returned as proof of service. 3eft Brueggemann, :~:L24 S.W. 24th Avenue, Boynton Beach, pled no contest and asked for 90 days to comply. He commented that the inspection date did not match the date he had on his violation notice and asked which officer had issued the violation. Code Officer Cain responded that he had issued the notice of violation. Mr. Brueggemann stated that he had spoken to three inspectors for the same issue. The previous property owner had pulled a permit at the City today and if the City could make the final inspection, it could be completed tomorrow. There were other issues on his property involving the Lake Worth Water Drainage District that could take a little longer to resolve. Motion Based on the testimony and evidence presented in Case #04-2812, Vice Chair Costantino moved that this Board find that Sharon & _left Brueggemann are in violation of City of Boynton Beach Code Sections as cited, and moved to order that the Respondents correct the violations on or before April 19, 2005. The Board has considered the gravity of the violations, the actions taken by the Respondents, and any previous violations by Respondents, and hereby orders that if the Respondents do not comply with this Order, a fine in the amount of $25 per day plus administrative costs shall be imposed for each day the violations continue past April 19, 2005. The Respondents are further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re-inspection of the property to verify compliance with this Order. Ms. Cook seconded the motion that passed unanimously. Case #04-2848 Property Address: Violation(s): Cathy E. & Richard Barnes 230 & 226 S.W. 6th Street FBC '0~. ED BBA 104.1.:L Permit required to install window. Code Officer Cain presented the case for the City. He stated that this case involved a multi-family dwelling that included 230 and 226 S.W. 6th Street. The origin of the case was a citizen's complaint. The initial inspection was December 16, 2004. The initial notice was verbal and also a written notice with 10 days to comply. The notice of hearing was sent by certified mail on January 3, 2005. A green card signifying receipt was returned on 3anuary 10, 2005. 10 Meeting Minutes Code Compliance Board Boynton Beach, Florida _~anuary 19, 2005 Richard Barnes, 5534 Alban Drive, Greenacres, Florida, 33463, pled no contest. When he installed the windows, he did not know he needed a permit for it. His wife tried to obtain the permit but they had encountered some problems regarding the type of window they should have had. He requested 90 days. Code Officer Cain said Mr. Barnes had been trying to obtain a permit. Since it was a rental unit, he had to get a licensed contractor to put in the windows. Plotion Based on the testimony and evidence presented in Case #04-2848, Ms. Hammer moved that this Board find that Richard and Cathy Barnes are in violation of City of Boynton Beach Code Sections as cited, and moved to order that the Respondents correct the violations on or before April :19, 2005. The Board has considered the gravity of the violations, the actions taken by the Respondents, and any previous violations by Respondents, and hereby orders that if the Respondents do not comply with this Order, a fine in the amount of $25 per day plus administrative costs shall be imposed for each day the violations continue past April :19, 2005. The Respondents are further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re- inspection of the property to verify compliance with this Order. Mr. Foot seconded the motion that passed unanimously. Case #04-2841 Property Address: Violation(s): Jesse R. & Janice L. Webb 2130 N.W. 1st Street CH 15-ART.IX-15-120(B).1,(D)l INC, 10-52 BBC of Ord. Remove inoperable vehicles, trash, and debris. Re-sod trash hole in the swale area. Clean up carport of stored items. Sr. Code Officer Skip Lewis presented the case for the City. The violation was discovered as a result of a routine neighborhood inspection on December 15, 2004. Jesse Webb, 2130 N.W. 1st Street, Boynton Beach, pled no contest and asked for 90 days. Mr. Webb listed the items that were in his carport (a motorcycle, a Barbie jeep, a tricycle, and a bicycle.) He stated that the City had dug the hole in the swale and he thought the City should fix it. Chair DeLiso referred him to .]eft Livergood in the Public Works Department on this point. Sr. Code Officer Lewis showed some pictures of the property to the Board and to Mr. Webb. Mr. Webb denied that the trash was on his property. Mr. Webb wanted to keep the pickup truck that had belonged to his father as he wanted to restore it. His father's regular vehicle will be moved when his daughter gets her driver's license She will also license and insure that vehicle. 11 Meeting Minutes Code Compliance Board Boynton Beach, Florida ]anua~ ~9,2005 Through conversation back and forth between the respondent and the Board, it was determined that at any one time, this property has four vehicles on it. The Board advised Mr. Webb to get the vehicles registered and licensed and move some of them since there were too many to be parked on one property. I~lotion Based on the testimony and evidence presented in Case #04-2841, Ms. Hammer moved that this Board find that _~esse R. & .lanice L. Webb are in violation of City of Boynton Beach Code Sections as cited, and moved to order that the Respondents correct the violations on or before March 5, 2005. The Board has considered the gravity of the violations, the actions taken by the Respondents, and any previous violations by Respondents, and hereby orders that if the Respondents do not comply with this Order, a fine in the amount of $50 per day plus administrative costs shall be imposed for each day the violations continue past March 5, 2005. The Respondents are further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re- inspection of the property to verify compliance with this Order. Mr. Foot seconded the motion that passed unanimously. Case #04-2364 Property Address: Violation(s): Oswaldo & Susan Ona 1154 S.W. 24th Avenue FBC '01 ED BBA 104.1.1 Obtain permit for 2 docks, the jet skis, and the gazebo. Sr. Code Officer Melillo presented the case for the City. This case originated from a citizen's complaint and the Building Department. The initial inspection was on October 20, 2004, at which time written notice was sent giving the homeowners 30 days to comply. A notice of hearing was sent certified mail on December 5, 2004 and the City received the acknowledgment on December 9, 2004. Oswaldo and Susan Ona, 1154 S.W. 24th Avenue, Boynton Beach came to the podium. He thanked the City for the patience of Mike Melillo and Scott Blasie in helping move this case along. One neighbor in the neighborhood has caused just about everyone in the neighborhood to be cited, so it had been quite challenging. They also had to deal with the Lake Worth Drainage District. Mr. Ona submitted photographs of his property to the Board. The Onas have removed all structures and encroachments on the property that had been cited. There was a dock and a deck and everything is gone. The only thing left on the property is the original dock that was permitted by the Lake Worth Drainage District 20 years ago and was transferred to the Onas. Lake Worth Drainage District recently approved the dock, but asked the Onas to remove all other structures and they had done so in the last week. The Jacuzzi was still an open issue, but the electrician had gotten a permit that would be presented to them the day after this meeting. Hammer moved that this Board find that Oswaldo and Susan Ona are in violation of City of Boynton Beach Code Sections as cited, and moved to order that the Respondents correct the violations on or before February 18, 2005. The Board has considered the gravity of the violations, the actions taken by the Respondents, and any previous violations by Respondents, and hereby orders that if the Respondents do not comply with this Order, a fine in the amount of $25 per day plus administrative costs shall be imposed for each day the violations continue past February 18, 2005. The Respondents are further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re-inspection of the property to verify compliance with this Order. Case #04-2630 Property Address: Violation(s): Maria Prows 619 N.E. 7th Avenue Fmc '01 ED mBA 104.1.1, Fmc '01 ED 3401.6, CH15- ART.TX-15-120 (D) INC. Remove ail unpermitted electric and shed in backyard. Repair all broken windows and screens. Disconnect extension cords from one unit to another and restore power properly to units. Sr. Code Officer Melillo presented the case for the City. He explained that this was a multi-family unit. The violation came to light as a result of a citizen's complaint. The initial inspection was done on November 19, 2004, followed by a written notice to the homeowner giving 15 days to comply. A notice of hearing was sent by certified mail on December 10, 2004 and the acknowledgment card was received in the City on December 15, 2004. Sr. Code Officer Melillo commented that compliance could be met by removing the extension wiring between the living units, removing the wiring and plumbing from the shed, and fixing the broken windows. Maria Prows, 619 N.E. 7th Avenue, Boynton Beach, came to the podium and pled no contest. She asked four months to fix the building. Chair DeLiso asked if she lived in the property and she said that she did not. 13 Meeting Minutes Code Compliance Board Boynton Beach, Florida January 19, 2005 Sr. Code Officer Melillo remarked that Ms. Prows wanted to renovate the entire property and that would probably take four months, but one month would probably be sufficient in order to bring about compliance. 3ames Vanhangenhove, 15046 Hamlin Boulevard, Loxahatchee, Florida joined Ms. Prows at the podium. Mr. Vanhangenhove explained that it was an elevated duplex on one side and a two-story house divided into three units on the other. He and Ms. Prows were reluctant to remove the extension wires between the living units since the occupant(s) were drunk and disorderly. They had enlisted the aid of the Sheriff and hoped to have them evicted soon. The tenants had not paid rent in nearly a year. The Board discussed the pros and cons of tabling the case and setting a fine and compliance date. Motion Based on the testimony and evidence presented in Case #04-2630, Vice Chair Costantino moved that this Board find that Maria Prows is in violation of City of Boynton Beach Code Sections as cited, and moved to order that the Respondent correct the violations on or before February 18, 2005. The initial inspection was August 26, 2004 and a written notice was sent to the property owners, with 10 days to comply. A notice of hearing went out by certified mail on December 7, 2004 and came back unclaimed. The property was posted on .lanuary 8, 2005. The Planning & Zoning Division discovered that the height of this fence had been overlooked during permitting many years ago and it was necessary to cite it. The fence was six feet high on the arch portion of the gate. The Code limit is four feet. 3elf Heller, 5846 LaGrace Circle, Lake Worth, 33463, pled not guilty. He explained that he was appearing on behalf of his father, who was unable to attend. He believed that the property had recently been purchased and that it was actually in his mother's name, Ellen Heller. Ellen Heller, 829 Ocean Inlet Drive, accompanied her son at the podium. It was explained that the Code Compliance Division could only act on what was in the current property records (.left & Louis M. Heller) and he was directed to pursue this issue with the Property Appraiser's office. It could be that the Property Appraiser's records had not been brought up to date. Mr. Heller showed documentation where he believed the fence had been permitted. On examination, Ms. Cook declared that the fence that had been permitted was the one in the rear of the property and the violation was for the fence in the front of the property. Mr. Blasie explained that the violation surfaced as a result of a request from a neighboring property owner to put up a similar fence. When their request was denied, they mentioned that their neighbors had this fence. Chair DeLiso suggested that Hr. Heller might want to apply for a variance for the fence. The variance request would be heard by either the CRA or the Planning & Development Boards and then decided upon by the City Commission. He also suggested meeting with the Building Official to see what could be resolved. A Code Compliance Board hearing was held on October 20, 2004 and a representative of AAM Industries, Tnc. appeared. The Board set a compliance date of December 19, 2004 and proposed a fine of $25 per day. The violation still exists. Staff asked that the Board table the case for another 60 days because they were moving as fast as they could. They had a lot to go through with the Fire Department and Engineering. Mark Moretto, AAH ~ndustries, ]nc, 225 S.E. 5th Avenue, Boynton Beach, explained the history of the property and the permitting efforts. There were gas tanks in the ground when they purchased the property and they went through the City and got the necessary permits. They got two permits, one for the building and one for the parking lot. They were notified by the City that they could put a gas tank in the last bay of the building and they got what they thought was a permit for that. It turns out that the approval was for propane tanks in the last bay, but the gas tanks had been there since they took over the property. Inspectors had signed off on it, including the Fire Marshal. They were told to submit a minor Site Plan Modification to Ed Breese in the Planning & Zoning Division and they did so. Mr. Breese then advised them that the setback was 15 feet and AAH Industries, Inc. did not have 15 feet available. The building had been in place for 40 years. He explained his efforts to come into compliance and his various contacts with the Fire Department. When Mr. Griffiths spoke to Pointe Management about who was going to represent Pointe at this meeting, Pointe stated that, "Courtney Cain never got us plans for the buffer itself."
