Mayor Cassandra called the meeting to order at 7:30 P. M.
The invocation was given by Reverend George Dettman, First
United Methodist Church, followed by the Pledge of Allegiance
to the Flag led by Attorney Rea.
Mayor Cassandra called attention to the yellow forms in the
back of the room and said anyone wishing to speak on an item
on the agenda, including the Consent Agenda, should fill out
a form. A form should also be filled out if they wished to
speak on an item not on the agenda, and they would be called
at the appropriate time.
AGENDA APPROVAL
Councilman Marchese wished to make an announcement under
"E. ANNOUNCEMENTS", which was added as item 3. Under "IV.
CONSENT AGENDA, B. Bids", City Manager Cheney deleted item
1. He drew attention to "C. Resolutions" under "VIII. LEGAL"
and said the proposed Resolution should be proposed Ordi-
nance No. 87-4 under "B. Ordinances - 1st Reading".
Councilman Hester moved, seconded by Councilwoman Zibelli,
to accept the Agenda as corrected. Motion carried 5-0.
ANNOUNCEMENTS
1. Proclamations
Mayor ~assandra read the following Proclamations:

Mayor Cassandra announced that this service will begin at
7:30 P. M., ~Sunday, February 1, 1987 at the Boynton Beach
Jewish Center, 501N. E. 26th Avenue.

Mayor Cassandra announced that a brotherhood service, open
to the public, will be at the Boynton Beach Jewish Center at
8:15 P. M., Friday, January 30, 1987.
Charles Coleman, Jr. Vice Commander, Jewish War Veterans
Post 440, thanked the Mayor for the two Proclamations and
invited everyone to the services. He said all veterans'
posts in Boynton Beach will be at the Brotherhood service.
Vice Commander Coleman said the big ceremony will be on
Sunday, February 1st. Mayor Cassandra promised to get the
Proclamations to Vice Commander Coleman.
Bob Borovy, 2521S. W. llth Street, Past commander of
American Legion Post 164, and presently Chairman of the
Boynton Veterans' Council, which is composed of VFW Post
5335 and VFW Post 10150 Leisureville, American Legion Posts
164 and 288, and Jewish War Veterans' Post 440, said the
Jewish War Veterans Post 440 was hosting the Four Chaplains
ceremony this year.
c) Black Awareness Day Celebration
d) B'nai B'rith Women's Day - January 28, 1987
Gertrude Lubin accepted the Proclamation for B'nai B'rith
and thanked the Council.
A.A.R.P. Tax Assistance - Boynton Beach City Hall -
2nd Floor - February 2nd through April 15th - Monday,
Wednesday and Friday - 9:00 A. M. to 4:30 P. M.
Mayor Cassandra made the announcement. City Manager Cheney
said this would be in the Council Chambers unless the room
is being used. In that case, it would be in the upstairs
hallway.
3. Police Department Commended - Councilman Marchese
Councilman Marchese thanked and congratulated Police Chief
Hillery and his department for the job they did over the
holidays. He referred to the idea of putting wrecks in
strategic locations, as he thought they had a good impact.
Mayor Cassandra showed a South County poster ("The Party's
Over"), which will be displayed throughout the South County.
It was Boynton Beach's Police Officer and Photographer.
There was applause.

Report on status of Tradewinds Court Cases -
Attorney Kirk Friedland
As Kirk Friedland, Special Counsel for the City in the
Tradewinds case, had entered the room, Mayor Cassandra
asked that this matter be moved up on the agenda.
Councilman Marchese moved, seconded by Vice Mayor Zimmerman,
to correct the agenda to move this item up before "CITY
MANAGER'S REPORT".
Attorney Friedland reported that the case has moved forward,
and they had the hearing before Judge Rudnick on the motion
to compel the City's compliance with the settlement agree-
ment in the Tradewinds matter. Attorney Rea and Vice Mayor
Zimmerman attended. Attorney Friedland had asked Carmen
Annunziato, Planning Director, to attend and give testimony
about the efforts of the City to request additional docu-
mentation and additional submittals from Tradewinds.
The hearing was held. It was adjourned, and they reconvened
in the afternoon to take additional testimony from the City's
side9 Vice Mayor Zimmerman also testified. Attorney
Friedland reported that the Judge obviously was having a
grea~ deal of difficulty with the complexities of the case,
~ut ne did request Tradewinds to draft an Order which, to
his knowledge, has not yet been entered. Attorney Friedland
received a copy of it and thought the Council received a
proposed Order. There was no reason to think the Judge was
not going to sign that Order.
If the Council read the Order, Attorney Friedland said they
would know the City is being ordered by the Judge to go
ahead with the first reading of the Tradewinds' Ordinance
to give them the zoning they need to go ahead with the
Planned Unit Development (PUD). It has to be done forthwith,
and the City Council is complying with the Order to go ahead
and schedule that.
Attorney Friedland said the Order, as it relates to the
Planned Commercial Development (PCD) is a little more
complex. Before the City can adopt the zoning necessary for
the BCD, they must first submit a request to amend the
Compmehensive Plan to the Department of Community Affairs

(DCA). The Order provides that the City shall do that
within thirty days of the Order being entered, so the Order
should probably be entered within the next few days. That
will start the thirty day clock running for the City to go
ahead and submit a request to the DCA to amend the
Comprehensive Plan.
Attorney Friedland said the Order is specific in that if DCA
finds the submittal is inadequate for any reason (perhaps
because of failure to conduct additional public hearings or
because submittals were not adequate), DCA could send it
back to the City. That would be the problem of the developer,
not the City.
Attorney Friedland since learned that the developer desires
to submit some additional documentation, and he thought the
City should let the developer give anything they would like to
the City to send to Tallahassee. Then the City will do its
job in complying with the Judge's Order, send it on out, and
let DCA either recommend adoption or recommend that the City
not adopt the amendment to the Comprehensive Plan.
Attorney Friedland continued that the Order goes on to order
the City to comply with all remaining terms of the settle-
ment agreement. As soon as that is entered, he will be
conveying the actual Order to the City Attorney, and they
will discuss the mechanics of going ahead and complying with
this.
Attorney Friedland said that was only half of the story.
The other half was that the City has been sued in what
amounted to a new lawsuit by Intervenors. The Intervenors
are Joseph Molina and the Lake Boynton Estates Homeowners'
Association, Inc. They were previously allowed to come into
the case as third parties or as Intervenors.
Attorney Friedland said the Intervenors did two things:
They first filed an appeal to the Fourth District Court
of Appeals, asking that higher Court to hold that the
whole settlement arrangement with Tradewinds was void
because it was illegal. That appeal is pending, and the
initial break in that case will be in several weeks.
The new case Attorney Friedland referred to was called
a Cross Complaint for Declaratory Relief and for
Injunctive Relief. That means the Intervenors are
asking the trial Court (Judge Rudnick, the same Judge

that just entered the Order compelling the City to comply
with the settlement agreement) to consider at the trial
level whether the settlement agreement is legal or not
legal.
Attorney Friedland said the City*is going in two differ-
ent directions toward the same end, which is to have the
Tradewinds settlement agreement declared void. They are
also asking for injunctive relief, which means they are
going to request the Court to enter an Order stopping
everything and enjoining the City from moving forward in
adopting Ordinances or issuing building permits.
Attorney Friedland stated that the answer to this
complaint is due at the end of the month, and he will be
answering, on behalf of the City, each of the allega-
tions raised in the complaint on a point by point basis.
Attorney Friedland did not know how Judge Rudnick might rule
on the request of the Intervenors, just as he did not know
how the Appellate Court will rule on the appeal.
If and when this proposed Order is signed by the Judge and
the Council would desire to appeal it at that time, Vice
Mayor Zimmerman asked if the entire Order would have to be
appealed or if either the PCD or PUD could be appealed. If
the City would file a Notice of Appeal, it would appeal the
entire Order, but the City would not have to direct argument
toward any part they agreed to. Therefore, Attorney
Friedland thought the answer to Vice Mayor Zimmerman's ques-
tion was that the City could attack one aspect or the other,
or both.
once~ithe Order is entered, Attorney Friedland advised that
the City would have a period of thirty days to file a Notice
of Appeal, should the Council choose to do that.
Mayo~ Cassandra's concern was for the City and the Council
persons, as far as their jeopardy was concerned. In the
second paragraph of the Order, he noticed it said the
Ordinances shall be scheduled for reading, as required by
the City Charter. Mayor Cassandra asked if that put it by
City!!Charter or by stipulation. Stipulation would be
overriding the City Charter, and he asked what the Council
mustldo.
Attorney Friedland replied that, at this point, they know the
Judge intended that the Ordinances be scheduled. The Judge

also made the implication that they be properly advertised,
but that there be no additional public hearings on applica-
tions, since the City's Charter requires opportunity for a
public hearing upon the reading of the Ordinances. Attorney
Friedland had referred to Attorney Rea on this point and
stated that he thought the City should go ahead and open the
proceeding for public hearing. However, Attorney Ffriedland
pointed out that they would have the dilemna that the
Council can only vote one way. They will not have the
liberty of freely voting on this matter because the Judge is
ordering the Council to vote to adopt the Ordinances, and
therein lies the basis for an appeal.
Mayor Cassandra read from the proposed Order that, "Pursuant
to the Settlement Agreement, to submit to new hearings and
new voting procedures approving the applications, which were
the subject of the Settlement Agreement, would render it
meaningless. To him, this meant there was no sense in
having a hearing, but he thought the Florida Statutes said
they should have a hearing. Mayor Cassandra questioned
whether the City Council persons were in jeopardY now of the
laws of the Florida Statutes. Attorney Friedland answered,
"No", and explained that, obviously, there was a collision
course between what the City agreed to do some months ago
and the Council's freedom to vote their consciences at the
time when it comes up for a vote.
In the stipulation, Mayor Cassandra asked if Tradewinds
agreed to submit all necessary paperwork, as far as the
City's Charter is concerned, and wondered if they still had
to do that. Attorney Friedland replied that was a matter
subject to interpretation. At the hearing, the City made a
strong interpretation to show the Judge that additional sub-
missions were needed in order for the City to say, "You
should build the permits." The Judge found the City really
did not need any additional submittals to get the thing up
to Tallahassee but that the other submittals would be
required before the City would actually issue building
permits.
If Tradewinds starts to develop their land, based upon
permits and approval, and the Appellate Court rules against
the developer, Mayor Cassandra questioned whether Tradewinds
would have to put the City back in the same shape they found
it. He asked how the City was protected. Attorney
Friedland answered there is certainly a risk. As a matter
of fact, the Judge made it clear that there was testimony at
the hearing that Tradewinds had invested some $7,000,000 to

date in preparing to go forward with the development. Since
there are matters on appeal and legal difficulties that they
have known about from the beginning, they would be at risk
as far as what would be required in terms of putting the City
back in the position it was in before Tradewinds started.
Attorney Friedland stated that he could not begin to comment
on that, and that it would be interesting and a tough knot
to unravel if it ever comes to that.
Vice Mayor Zimmerman wondered if it would be premature to
have a motion tonight concerning the Order that the Judge
may sign. Attorney Friedland thought it would be premature
because they did not have the Order before them, and he did
not think it was the right time to bring it further into the
discussion.
Vice Mayor Zimmerman asked if a Special Meeting would be
required. Mayor Cassandra interjected that thirty days
would still give them Council time.
CITY MANAGER'S REPORT
Me~ting of Downtown Review Board (DRB) -
Water's Edge Marina Project
City Manager Cheney announced that the DRB was having a
public hearing for the Water's Edge Marina Project tomorrow
night (Wednesday, January 21, 1987) at 7:30 P. M. at Boat
Ramp Park because there was no other place where they could
have a public hearing kind of facility. He commented that
the project is moving along step by step to get into
construction and have the first restaurant opened by the 1st
of NOvember.
Wa~er Testing Imposters and Quality of Water
City Manager Cheney reported that the City heard something
abou~ people going around the City under the guise of doing
water testing, and the Police Department made some arrests.
John Guidry, Director of Utilities, informed City Manager
Cheney that there have been a number of complaints from the
same area of the City about the quality of water, and City
Manager Cheney said the City can only surmise that there is
an influx of people selling bottled water or filtered water.
One way to sell it is to convince people the water they are
drinking is not good, and City Manager Cheney explained. He
was not saying any company was out there doing this, but the
coincidence was interesting.

City Manager Cheney told the audience that if they thought
something was wrong with their water, they should call the
City. Mr. Guidry tested the water today, and it was clear
and absolutely perfect.
Ordinances on Agenda - Codes Enforcement and
Towing of Vehicles
City Manager Cheney called the audience's attention to two
significant Ordinances on tonight's agenda. One is for
amendments to the Codes Enforcement process and picks up
what the Legislature allows the City to do. The other one
is to revamp the City's vehicle towing and get rid of the
abandoned car process. These Ordinances will make it easier
for the City and various Boards to address problems and up-
date the quality and aesthetics of the City.
Councilman Hester asked about the towing of vehicles.
Before the City tows a vehicle, City Manager Cheney said
they put a sticker on the window of the vehicle, warning
people that within ten days or 72 hours, depending on the
situation, the City will tow it.
The City Manager's report was accepted as presented.
PUBLIC AUDIENCE
Potential Danger on Ocean Drive
Vernon H. Allinson, 1100 S. W. 7th Avenue, recalled that
six months or more ago, someone brought before the Council a
property at 2001 Ocean Drive, better known as Glenhurst
Executive Plaza. On Sunday, he was walking there, and only
due to a young lady's agility was a serious accident
averted. The lady was riding a bicycle on the sidewalk with
a 3 year old child strapped on the seat, and somebody was
walking. The edge of the walk drops four to six inches down
on each side of the sidewalk. Then there is a steep slope.
The lady had to jump off and hold the bicycle. Otherwise,
the child would have gone down, and there would have been a
bad accident.
Mr. Allinson said this property has a well maintained
construction trailer that has been there for a long time,
but the area around it is disgraceful. There are piles of
scrap lumber, construction debris, Brazilian Peppers, and
leaves growing over the sidewalk.

Mr. Allinson felt the construction trailer should clean the
sidewalk so it is not a hazard and make the property present-
able as the surrounding area of Leisureville is. The
trailer has been there too long to be considered temporary.
Far back, hidden behind Australian Pine trees, Mr. Allinson
said there are two big automobile trailers. He stressed
that something has to be done.
City Manager Cheney said the City will look into it and will
see what they can do to resolve the construction site. Vice
Mayor Zimmerman recollected that the Council did permit the
trailers to be there and extended the amount of time. He
did not think the trailers were in violation but said the
overgrowth and trash were 50 feet from residential property,
and he felt that Ordinance was being violated and the
property should be cleaned up.
Purchase of City Lot
Wilda Searcy, 402 N. E. 13th Avenue, presented a letter to
the Council about a vacant lot on N. E. 13th Avenue, owned
by the City, which she and her relative want to buy.
NAACP Banquet
Mrs. Searcy asked the Council to attend the NAACP banquet
in Boca Raton on Saturday, February 28, 1987 at the Boca
Raton Country Club, 7601 Country Club.

William Sullivan, Purchasing Agent, showed in his memos of
December 19, 1986 and January 9, 1987 that Zuccala's
Wrecker Service, Boynton Beach, was the sole source for
this purchase in the amount of $1,500.

1. Consider request submitted by David E. Mackey for
site plan approval to construct a 32,775 square foot
mixed use industrial/warehouse building on 1.66
acres on the north side of S. W. 30th Avenue,

The Planning and Zoning Board unanimously recommended
approval of this request, subject to staff comments.
Consider request submitted by Charles Gilbert,
Agent for Summit Associates, Ltd. for site plan
approval to construct 86 duplex and multi-family
units plus recreation and landscaping at Tract I of
the Hunters Run Planned Unit Development on the west
side of South Congress Avenue, between the Lake

Consider request submitted by Paul Brown, Sign
Craft, Inc., for approval of an amended site plan to
allow for improvements in informational and
directional signage at Bethesda Memorial Hospital
located on the west side of South Seacrest Boulevard,
south of Golf Road
The Planning and Zoning Board unanimously recommended
approval of this request, subject to staff comments.
Mayor Cassandra recalled Mr. Wandelt of the Planning and
Zoning Board felt that the size of one sign at the new
entrance on 23rd Avenue would be obstructing the view. The
other Board Members voiced their concern. Mayor Cassandra
guessed the sign was going to be put on the right-of-way.
He did not recall whether approval was given to that sign.
With respect to the location, Mr. Annunziato felt confident
that the hospital would locate the sign, consistent with the
staff comments. That was that they would move it southward
so it would not form an obstruction. The size was a
different issue. Mr. Annunziato confirmed Mayor Cassandra's
statement that no motion was made by the P&Z Board not to
approve the sign.
Mr. Annunziato informed Mayor Cassandra that if the Council
approved this tonight, they would be approving the sign
which was submitted, only further south from its current
location. City Manager Cheney questioned whether the appli-
cant agreed to locate the sign further south~ Paul Brown of
Sign Craft, 1890 Church Street, West Palm Beach, stated
there would be no problem, and Jim Schiller, Director of
Engineering, Bethesda Hospital, said the hospital was
agreeable to moving the sign back.
City Manager Cheney asked if there was a problem with the
size of the sign. Mr. Annunziato said no problem was found,
and it was acceptable.
Consider request submitted by Briel, Rhame, Poynter
& Hauser, A/E, Inc., Agents for the Department of
Education, State of Florida, for site plan approval
to construct a 32,700 square foot public broadcast-
ing facility, including a broadcasting tower and a
satellite dish farm on 6.20 acres on the west side
of South Congress Avenue, south of Charter Drive
The Planning and Zoning Board unanimously recommended
approval of this request, subject to staff comments.

Consider request submitted by Ed Duggan, Agent for
Oakwood Square Associates, Ltd., for approval of an
amended site plan to allow for a change in site
layout and design in the vicinity of the southern-
most out parcel in connection with a lease agreement
for Ciccio's restaurant on North Congress Avenue at
Old Boynton Road, the southeast corner
The Planning and Zoning Board unanimously recommended
approval of this request, subject to staff comments.
City Manager Cheney informed the Council that these five
items had a problem relative to the Community Appearance
Board's (CAB) approval and the waiving of some of the
requirements that quite likely the CAB did not realize they
cannot waive because the Evaluation and Appraisal (E&A)
Report was filed. Mr. Annunziato was not in the room and
City Manager Cheney thought he was talking to one of the
developers about this issue.
Mr. Annunziato returned and drew attention to comments
generated by Kevin Hallahan, City Forester/Horticulturist,
which related to Comprehensive Plan requirements. The
requirements resulted from the adoption of the E&A Report as
to the interim Comprehensive Plan, and the comments were
given to the City by the Regional Planning Council.
Basically, they affect the City in certain ways. Mr.
Hallahan's comments referred to these items in the site plan
applications.
Mr. Annunziato explained that one set of criteria involves
utilization of native species in connection with landscaping.
Another pertained to waterfront properties where the Regional
Planning Council recommended that the Council adopt policies
related to planting of littoral zones and buffers. Basically,
this was vegetation from approximately three feet below
water to approximately 10 or 15 feet above the water and the
recreation of that habitat.
Another item relates to the removal of exotics from sites.
Mr. Annunziato said those are the Melaleuca and Florida
Holly. There is an additional requirement for the utiliza-
tion of non-potable water for irrigation, if possible.
Mr. Annunziato advised that all of these policies are in the
conservation element of the Comprehensive Report. He
reported this to the Council because the comments were
generated in the site plan process, and they were discussed
at the CAB meeting. There may have been some misunderstand-
ing of the comments with respect to the approval process.

Because the comments are in the Comprehensive Plan, Mr.
Annunziato said they cannot be waived.
Mayor Cassandra asked which particular development Mr.
Annunziato was referring to. Mr. Annunziato answered that
each application before the Council had a comment based on
those policies, some more than others. Some related just to
the types of materials. Others related to the removal of
exotics and the planting of littoral zoned vegetation.
Mr. Annunziato added that they will have continuing
discussions with this set of developers, because this was
the first time, to clarify the fine points of the Compre-
hensive Plan policies. The problem is that they have not
been codified in terms of development Ordinances, and that
leads to misunderstanding. Mr. Annunziato said the City will
be moving in that direction in the near future.
Mayor Cassandra asked if it would be advantageous for a
member of Mr. Annunziato's department to spend time explain-
ing this to the appropriate Boards that are involved in the
Comprehensive Plan. Mr. Annunziato answered, "Certainly."
City Manager Cheney clarified that the City needed the
record to show that as the Council approved the Consent
Agenda, those items were not waived and could not be waived
by the CAB in their process as they are not a part of the
Landscape Code that the CAB reviews.
City Manager Cheney said Mr. Annunziato had talked to every-
body involved. Everybody said they understood it would be
a requirement, and City Manager Cheney wanted the record to
showthat.
Mayor Cassandra asked if the CAB made a recommendation to
waive it. City Manager Cheney replied that they did, in
some cases. He agreed with Mayor Cassandra's statement that
when the Council approves these plans, they are subject to
staff comments. Mayor Cassandra questioned whether the
Council would then have to make a note that they do not
approve to waive the portion the CAB did. City Manager
Cheney thought this discussion was putting that on the
record. The people involved with the developments already
agreed that they understood it, and he said the City was
simply establishing the record that this was the case, and
that they understood it through conversations Mr. Annunziato
had with them.

With regard to the placing of native species in the develop-
ments, Vice Mayor zimmerman asked if there would be any
requirement for the CAB to have another hearing. Mr.
Annunziato thought there were perhaps only two instances
where it will be a matter of just exchanging one type of
material for another. In those instances, he thought the
answer was "No", but he believed several plans would have to
go back to the CAB for final review. Mr. Annunziato did not
think that should hold up the approval process.

Approve contract to upgrade Filter Project at
Water Treatment Plant
By memo dated December 31, 1986, William Sullivan,
Purchasing Agent, requested the contract be awarded to
Uddo-Mims International, Inc. for $30,000.
G. Approve Encumbering Documents - Requested by
~Finance Department
Grady Swann, Finance Director, attached the 16 documents to
his memo dated January 15, 1987 and requested that they be
approved.
Approve required addition to Audit Report
Ernst & Whinney, Certified Public Accountants, 310 Okeechobee
Boulevard, West Palm Beach, Florida 33401, in their letter
of January 14, requested the Council to approve a single
audit, in addition to their examination of the combined
financial statements of the City, in accordance with the
Standards issued by the U. S. General Accounting Office.
The fee for the additional services will be $2,500 for
Federal Revenue Sharing and $3,500 for the Community Develop-
ment Block Grant.
Approve Request for Proposal for professional survey
work to be performed at the old Municipal Waste Water
Treatment Plant
The proposal of O'Brien, Suiter & O'Brien, Delray Beach, was
selected by Tom Clark, City Engineer, as explained in his
memo of January 15, 1987.

BIDS
None.
PUBLIC HEARING
Consider request submitted by Douglas R. Root, AIA,
Agent for Eroyn Girtman, for a modification to a
previously approved Conditional Use to allow for a 600
square foot increase in the size of the building, and
an increase in the maximum child capacity to 100 and a
change in parking lot layout and design to the Girtman
Child Care Center. This facility will be located on
North Seacrest Boulevard at N. E. 5th and N. E. 6th
Avenues
Mr. Annunziato reminded the Council that this request was
approved by them in mid-summer. The applicant is coming
back for a modified building. The location of the Center
will be on the east side of North Seacrest Boulevard at
N. E. 5th and N. E. 6th Avenues. The site will not change
much from what the Council previously approved in terms of
location of the structure and the parking lots.
Mr. Annunziato said none of the intensities of land use
changed substantially. Therefore, most of the comments
prepared by the Planning Department last summer were still
appropriate.
Mayor Cassandra informed the audience that the full Council
was present at the P&Z Board meeting and were familiar with
what was said.
Mr. Annunziato told the Council N. E. 5th Avenue disects the
property in a north/south way. There is a parking lot south
of 5th Avenue, and the building is north of N. E. 5th Avenue
with a parking lot south of the building and a play area
east of the building.

The Technical Review Board (TRB) recommended that this be
approved, subject to staff domments. The only issue which
ended up being discussed at great length at the P&Z Board
meeting related to the form of buffer wall, which will be
located along the east property line of the children's play
area. The Planning Department recommended that this wall
be constructed of concrete block similar to other buffer
walls in Boynton Beach.
Mr. Annunziato said the applicant addressed the P&Z Board
to explain some of the hardships related to that wall, and
the P&Z Board unanimously recommended to the City Council
that the Conditional Use be approved, subject to staff
comments. However, the P&Z Board concurred with the appli-
cant that the concrete wall can be replaced by a wood wall.
Mayor Cassandra announced that anyone wishing to speak in
favor of or against the request could do so now. There was
no response, and THE PUBLIC HEARING WAS CLOSED.
Councilman Hester moved to approve the modifications of the
Conditional Use, subject to staff comments and the P&Z
Board's recommendations. Councilwoman Zibelli seconded the
motion, and the motion carried 5-0.

DEVELOPMENT PLANS
A. Consider request submitted by George W. Zimmerman, Agent
for Deutsch-Ireland Properties, for approval of the
master lighting plan for the public and private rights-
of-way within the Quantum Park Planned Industrial
Development, which is located on the west side of Inter-
state 95, between the Boynton Canal and Miner Road
extended. (Quantum Park) (Postponed at December 16, 1986
Meeting to'January 20, 1987 Meeting)
Mr. Annunziato said this item was postponed at the previous
Council meeting to allow staff and the applicant time to get
together and talk about the City's position with respect to
the care and maintenance of street lights in the public
righ~s-of-way at Quantum Park of Commerce.

thought there were two issues before the Council.

The first issue related to the liability of the City involving
the location of the street lights, and Attorney Moyle pro-
posed that the best way to handle that would be for the
developer (Quantum Associates) to pay for the City's liabil-
ity insurance in connection with those lights. They would,
of course, insure insofar as the lights located within the
park. These would be outside of the park.
Attorney Moyle pointed out that they probably would not have
an insurable interest, so they would have the City take out
the policy, and they would pay the premium. They discussed
that with Attorney Rea, City Manager Cheney, and Mr.
Annunziato, and that seemed to be a suitable way of handling
that issue.
The second issue involved the maintenance of the street
lights located on the City property. They were talking about
several different ideas ranging from the Property Owners'
Association promising to do it to the possibility of putting
up an escrow fund. Attorney Moyle thought they came up with
a suitable idea that would probably provide more protection
for the public and the City than either one of those. That
was that the Property Owners' Association has the ability,
if the property owner fails to pay a valid assessment, to
file a lien similar to a tax lien, to see who gets the
property of that property owner in order to pay for that
legitimate charge.
Attorney Moyle said what they would do would be to prepare
the legal documents (which David Pressly, Attorney at Law,
and Attorney Rea will get together to be sure are prepared
properly) to assign that lien right to the City in connection
with the rights located on City owned property, so that in
the event the City had to do maintenance, (the Property
Owners' Association could not do maintenance on the lights,
and the City had to do it), the City would be assigned the
right to file a lien and go against the property owners, so
the City would have security. The legal process would be
very similar to a tax lien.
Attorney Moyle thought they agreed that, subject to Attorneys
Pressly and Rea getting together to make sure the Property
Owners' Association documents properly reflect what he just
described, they would have a solution to that issue.
Mayor Cassandra questioned whether there was any jeopardy in
the City taking out the insurance and them paying the
premium. He pointed out that the City's name would be on it

and asked if the applicant's name would be on it the other
way. Attorney Rea thought Attorney Moyle was saying they
would have no insurable interest, since they are public
properties. Theoretically, the applicant cannot get
insurance for an interest they have no interest in. In that
respect, there was no problem with that technique.
Attorney Rea thought the City's only question with the whole
scenario was the potential for amending the Association
documents at a later date without the City having some type
of input or final approval, especially with regard to the
lighting requirements.
Attorney Moyle thought they had handled that and informed
Attorney Rea that the City Manager had prepared a letter,
which they will receive shortly that covers that. The docu-
ments will be amended so that the Property Owners documents
cannot be amended insofar as those items that are on City
property without the City's approval. Attorney Moyle
believed Mr. Deutsch had agreed to that.
Vice Mayor Zimmerman questioned whether this would spell out
that a suitable limit of insurance would be provided, not
just any amount. Attorney Rea advised that they will have
to have a liability figure that will be mutually agreed on.
If the City Council approved it, it would certainly be
contingent upon the parties getting together and agreeing on
a figure.
Mayor Cassandra asked if $10,000,000 still created a heart-
burn. George W. Zimmerman, Vice President of the Development
for Deutsch-Ireland Properties, Quantum Park, 2455 East
Sunrise Boulevard, Suite 1106, Fort Lauderdale, Florida
33304, replied that his heart does not burn at $10,000,000.
Attorney Rea mentioned that $10,000,000 would not necessarily
be the figure. Mr. Zimmerman said they are great believers
in having an abundance of insurance, and they will have much
greater than those limits on the park itself, so they will
not have a problem with that.
City Manager Cheney informed the Council that eventually,
the property owners' documents would come back again to them
for approval with comments. Pending the final acceptance of
the property owners' documents, he recommended that the
Council approve the master lighting plan for the public and
private rights-of-way within the park.
Councilman Hester moved to approve the request, subject to
staff comments, seconded by Councilwoman Zibelli. Vice

Mayor Zimmerman felt they should also add that the motion
was subject to the Council approving documents of the
Property Owners' Association. Councilman Hester and
Councilwoman Zibelli agreed with the suggestion. A vote was
taken on the motion, and the motion carried 5-0.
Consider request submitted by Richard C. Reilly, Agent
for S. P. Development, Inc., for site plan approval to
construct 135 townhouse units plus recreation and land-
scaping at the Quail Lake Planned Unit Development (PUD)
on South Congress Avenue at Golf Road, the northwest
corner
Mr. Annunziato said it was the recommendation of the P&Z
Board that this project be approved, subject to some addi-
tional clarifications on dumpster locations as they relate
to utility easements.
The project is currently called Sutton Place. Along the
entire frontage is Congress Avenue. Along the southerly
border is Golf Road. The entrance to the project is from
S. W. 19th Avenue, which is the entrance to the Woolbright
Professional Buildings. To the west of the project is the
lake, which was platted as part of Quail Lake West.
Mr. Annunziato said the property initially came into the
City as a part of an annexation and zoning of a PUD under
the name of the Kirsner Cove and PUD. The overall density
was 4.5 units per acre for the entire site, which netted out
with an allocation of 135 units for the plot. The potential
for 135 units allowed for up to three story garden apartments.
In order to continue the effectiveness of the zoning, a plat
was recorded under the name ~f Quail Lake. A site plan was
never approved under that name. Following that, a site plan
was approved under the name of Savannah Place, which expired.
After Savannah Place's plan expired, another plan was sub-
mitt~d bearing the same name. That application went to the
P&Z Board, and they were displeased with the request. It
went to the City Council with a recommendation to deny, and
the applicant withdrew that application.
The applicant was now requesting site plan approval for 135
two story townhouse apartments under the name of Sutton Place.
The TnB recommended approval, subject to staff comments.
Mr. Annunziato said the issues involving the Utilities
Director related to the location of dumpsters along and on

utility easements parallel to Congress Avenue. After
negotiations between the Utilities Director and the appli-
cant, they concluded that two dumpsters which are on top of
the utility easement on the southerly half of the project
can be removed from the easement and put on the property.
However, it would be inappropriate to relocate the two
dumpsters on the northerly half of the project because of
the relationship of the houses to the parking lot, etc.
Mr. Annunziato explained and said the Utilities Director
found this was consistent with the policies of this project.
The Utilities Director did recommend, however, that the
Council enforce a hold harmless agreement for any damages
those dumpsters might incur as a result of the City access-
ing its utility easements at the time of emergency. The
applicant would like to see that placed on the replat of his
property.
Another issue the P&Z Board discussed at some length
concerned striping of the parking lots. Some units have
garages and some do not. In each instance, there is-a drive-
way from a building that is similar to a person's private
driveway. Therefore, striping is inappropriate, and that
recommendation came unanimously to the Council from the P&Z
Board.
Mayor Cassandra had some questions about the concept drawing
the developer had at the P&Z Board meeting. He explained
that there was no break in the symmetry, and it looked like
one level.
Richard C. Reiliy, Architect, 2500 North Federal Highway,
Suite 303, Fort Lauderdale, Florida 33305, thought the
problem was that Mayor Cassandra was looking at a plat plan
of a footprint, and it did not indicate the undulations that
go ba.ck and forth in the elevations. He clarified that the
faces of the buildings move back and forth. Mayor Cassandra
argu~d that the eye would only see a two dimension and not
necessarily a depth from a distance. Half of the homes will
not ~,e facing Congress Avenue, and people will see the back
of t~e homes. Mayor Cassandra expressed that would be one
solid wall.
Mr. Reilly explained the plan and showed the movement back
and forth in the face of the building. He emphasized that
it did not hold a straight barracks line. Mayor Cassandra
replied that the depth is true when you are close but dis-
appears when you are at a distance. Mr. Reilly disagreed,

saying the depth appears in shadow. He indicated the only
place where people would be looking at the rear of a
building. Mr. Reilly said they took that into consideration,
~as they had been "shot down" very severely.
There were further comments and Mayor Cassandra referred to
the location. He was concerned that this project would set
a precedent for that whole corner to be developed this way.
Mr. Reilly emphasized that they took deep consideration in
the fact that they were not going to present a barracks to
the Council. It would not even be marketable. Mr. Reilly
further explained the movement back and forth.
Mayor Cassandra asked how far the project is from the right-
of-way of Congress Avenue. Mr. Reilly answered that they
are about 65 feet, and he indicated the closest point, which
was 40 feet. In the site plan, they used the blocked out
area of the setback and worked within that movement back and
f~orth.
Vice!iMayor Zimmerman asked Mr. Reilly to explain the
materials used, Mr. Reilly replied that they are CBS build-
ingsi!with stucco. The roofs will be asphalt shingled in
grayi!tOnes. Mr. Reilly thought the Council would find
the tones very attractive. There will be bay windows with
grayilplatinum glass and expensive landscaping. Mr. Reilly
eixpl~ined the landscaping, which will vertically undulate
Up a~d down and break the lines along with the tremendous
amount of trees they will put in.
Mr. Reilly said they had no problems with any staff comments
or recommendations and were satisfied with them.
Mayor Cassandra had a very bad feeling and compared the
project to homes in Brooklyn.
CounCilman Marchese moved to approve the request, subject to
staff comments, plus the comments of the Planning and Zoning
Board and additional comments as a result of the meeting
withlithe Director' of Utilities. Councilman Hester seconded
the motion.
Mr. Reilly was in agreement with the motion. A vote was
taken on the motion, and the motion carried 4-1. Mayor
Cassandra voted against the motion.

Vice Mayor Zimmerman understood there would be no cost
attached to this. Attorney Rea responded that there should
be an extremely minimal cost. This would be instituted by
an addendum form or an update that normally comes with the
Code. W~nen the update comes, it will probably cost one sheet
of paper to make that notation that the name is expected to
be changed.
In other words, City Manager Cheney said they are not going
to print the whole book. In the Ordinance, Attorney Rea

said they indicate that when such time comes that the Code
of Ordinances has to be redone (there is a general cleaning
out period every five or seven years), the City will then
introduce the changes throughout the Code and make it uniform
at that time. Presently, it would just be indicated as a
notation prior to the Code itself.

Kathleen Kirton, 2526 S. W. 13th Court, speaking as a tax-
payer, strongly urged clarification of the eligibility of
candidates seeking public office and believed it was impera-
tive that this issue be resolved expeditiously. Therefore,
she requested that the Council seek an opinion from the City
Attorney or State Division of Elections, if necessary.
Mrs. Kirton did not really think this should be necessary
because the City had a referendum recently and, on this same
issue, it clearly gave the people the choice. A large group
of people voted, and it seemed to her the majority vote was
crystal clear that after being elected for two terms, an
individual could not seek reelection without dropping out
for a term. Mrs. Kirton thought a moral issue might exist,

as well as a legal issue. Referendums cost taxpayers a lot
of money, so she thought the City should abide by the
majority vote on this.
Mrs. Kirton continued that other candidates are seeking the
office of Mayor, so she thought the City should get-on with
things so people can elect a Mayor. If this starts a chain
reaction, she questioned what would keep anyone else from
esigning, walking away from their responsibilities, and
anting to do the same thing again. Mrs. Kirton thought the
Council should get an opinion and get it now because the
election comes up March 10th. She thought it could affect
the election of other candidates and did not think it was
fair.
Mayor Cassandra called attention to the subject of this item
on the agenda, said he made the request, and said it was in
front of the Council.
Mrs. Kirton's very strong opinion was that more was involved
here than just tenure of office. The City has been at an
impasse of interpretation for over a year, and she explained.
Mrs. Kirton said there is a difference between the two
tenures and intent (one by Mr. Ferrell and one by Mayor
Cassandra). Each has his own interpretation of the Charter.
It was the City's responsibility to rephrase or lock in what
the citizens demanded in their referendum. Mrs. Kirton said
evidently, this was not done. She felt this had been
disruptive and had an effect on more pressing decisions to
be made by the Council.
Mrs. Kirton wanted the situation settled in Court so the
City does not repeat this scenario in the future. Mayor
Cassandra asked if she wanted the City to take it to Court.
Mrs. Kirton replied that it should be settled in Court, and
whoever takes it to Court should pay the expenses.
Councilman Hester thought it was unfortunate that this came
up between two people but, as Mrs. Kirton stated, it was
clear that the referendum stated that you are only to serve
two consecutive terms. To him, after you serve two terms,
you have to wait another year before you can seek office
again. Councilman Hester admitted he is not a lawyer, but
he pointed out that the Charter says all elected officials
of Boynton Beach. The Mayor has been elected, and the
Council was elected.
As far as Councilman Hester was concerned, the Charter is
clear because it says you can serve two consecutive terms.

It is clear, and in no way can it mean anything else.
Councilman Hester believed at the last election, they had
this, and they wanted three years. It was turned down.
As far as Councilman Hester was concerned if you serve two
years, you are out. You just wait and start over again.
Mayor Cassandra pointed out that the question now was whether
the Council wanted the City Attorney to give an opinion. He
thought the arguments would be very important if the Council
wanted the Attorney to give an opinion on the ability of the
two people to run for Mayor.
Vice Mayor Zimmerman asked if the next step would be for
the opinion to be voted on by the Council, if they asked the
City Attorney 'to give an opinion. Mayor Cassandra answered
that was right. Vice Mayor Zimmerman thought it would help
the Council if they knew what the next steps were. He
believed it was provided for in the Charter that the Council
has the right to make decisions about the qualifications of
candidates, and they could make a decision on the City
Attorney's opinion. Vice Mayor Zimmerman expressed that
they may have to have a Special Council Meeting to expedite
this.
After other comments, Attorney Rea thought he could have an
opinion by Friday, January 23, 1987.
Vice Mayor Zimmerman moved, seconded by Councilman Marchese,
to ask the City Attorney to render an opinion by Friday,
January 23, 1987.
Depending on the vote of the Council now, Mayor Cassandra
said he would call a Special Council Meeting on Friday,
January 23, 1987 at 5:30 P. M.
Councilman Hester stated he would accept the City Attorney's
opinion, but there are a lot of loopholes in the law. He
was just sorry it came up. Mayor Cassandra believed the
Attorney says, "until judiciously determined otherwise."
which basically says you go to Court. It is an opinion.
Mayor Cassandra asked if he could vote on the motion.
Councilman Hester knew the problem was brought up by Mayor
Cassandra and Robert Ferrell and thought it was too bad
they did not leave the names off, but it was too late now.
Because of the type of motion it was, Vice Mayor Zimmerman
did not believe there would be a conflict of interest. If
they were voting on whether Mayor Cassandra was eligible or
not, then there would definitely be a conflict of interest.

Attorney Rea did not think there was any specific conflict
Mayor Cassandra would have to worry about at the present
time.
A vote was taken on the motion, and the motion carried 5-0.
Mayor Cassandra announced the Special Council Meeting and
invited the public.
3. Twin Construction payment per arbitration award
City Manager Cheney informed the Council that the Arbitrator
said the City should pay. He was not happy (1) that the
Arbitrator did not have to give the City a reason for why he
arrived at his opinion, but that is the way the arbitration
system works. (2) City Manager Cheney said the City was
going to see if they can do something to recoup a portion of
it, but that is still being discussed with the attorneys.
He told Vice Mayor Zimmerman it was binding arbitration and
explained.
Councilman Hester moved to authorize the payment of the
arbitration award in the sum of $24,500, payable to Twin
Construction, Inc. The motion was seconded by Vice Mayor
Zimmerman and carried 5-0.
NEW BUSINESS
Consider Five Year Road Plan and City suggestion for
amendment
Mr. Annunziato referred to his memo of January 6, 1987 and
changed paragraph 4 to read: "4. The construction of Miner
Road from High Ridge Road (as opposed to the Melear PUD) to
Military Trail as a County arterial.'
Councilman Hester asked if realigning Old Boynton Road was
included. Mr. Annunziato answered affirmatively and
explained that every project in his memo is on the County
thoroughfare plan, but it does not appear in the list of
projects.
Mayor Cassandra noted there were items outside of the City
and wondered about roads in the City. He called attention
to paragraph 3 of the memo. Mr. Annunziato said N. W. 22nd
Avenue, from 1-95 to Congress Avenue, will be constructed
to Quantum Park.

City Manager Cheney wanted a motion supporting this, so
they can go to the public hearing and try and get these
added.
Councilman Hester moved to approve the proposed five year
County road plan and the addition of the projects outlined'
in Mr. Annunziato's memo of January 6, 1987, copy of which
is attached to the original copy of these minutes.
Vice Mayor Zimmerman asked if a date had been set for this
to come up before the County Commission. City Manager
Cheney replied that a date had not been set for the public
hearing. It was postponed and delayed as a result of
concerns and questions about additional traffic figures,
among other things, concerning the extension of Woolbright
Road. City Manager Cheney was still following the Council's
instructions to push for Woolbright Road.
A vote was taken on the motion, and the motion carried 5-0.
Approval of draft of "Request for Proposal" for
Consultants to conduct a site selection study for the
approved multi-purpose recreational facility
Mayor Cassandra complimented City Manager Cheney on the
draft. City Manager Cheney advised that it was a combination
of the work of Mr. Annunziato and Charles Frederick, Director
of Recreation and Parks. He informed Mayor Cassandra that
a limit had not been put on the dollars and cents for this,
and he did not think a limit should be put on it. As the
City is spending $250,000, he thought they should be sure
they do it right. City Manager Cheney thought the economic
analysis the City asked for was important.
Mayor Cassandra asked if the City should ask for their fee,
based on the City's proposal. City Manager Cheney answered
that he was not sure because it was a different kind of
study, and he explained. City Manager Cheney said the City
wants to get it going.
Councilwoman Zibelli asked whether the City had any idea
about the school property. City Manager Cheney. replied
that it is the City's understanding that when a substitute
school is constructed west of the City and the current
school is not used, that land will be transferred to the
City. That is the City's formal understanding with the
school's staff.

Councilwoman Zibelli inquired whether there is any projec-
tion. City Manager Cheney answered that there was a projec-
tion, but now that the school bond issue is being contested
in Court, projections of time are disappearing by a year or
so. Two or three years was a projection.
Councilwoman Zibelli moved, seconded by Councilman Marchese,
to approve the draft. Motion carried 5-0.

Consider request that Palm Beach County Board of County
Commissioners stop issuing building permits to Parkwalk/
Aberdeen until Golf Course access road is compatible by
constructing the extension
At one time, at the start of the zoning and master plan
approval of the Parkwalk development, City Manager Cheney
said Parkwalk or Urban Development Corporation (UDC) was
required to build the access road to the golf course to what
was then Jog Road. The cost of that and some other projects
were all included in a road contribution that developer had
of $1,300,000. It was understood at that time that Jog Road
would eventually be moved, and the access would have to be
extended to the new Jog Road.
Before Jog Road was relocated by UDC, all of the other
things they had to do were completed, and the remainder of
that $1,300,000 was turned over to the County. The County
has the money to continue the road. There has been a lot of
procrastination in planning.
City Manager Cheney said the extension has been designed by
Rossi and Malavasi for 1½ years. He did not know how many
conversations they had with a variety of people. The City
thought about two months ago the thing was set and went
before the Board of County Commissioners. The agreement was
approved by the County Commissioners.
City Manager Cheney did not know who was delaying (UDC or
the County), but it seemed to him if they could get someone
concerned about building permits, things would move faster.
Today, he was told by the Assistant County Administrator
that there will be an agreement on the Board of County
Commissioners' agenda either on the 27th of January or at
their first meeting in February,.which he thought would be
the l~0th. It will finally be signed by UDC and approved by
the County Commissioners. Construction will be required
within 110 days of that approval. City Manager Cheney hoped
that would happen.

Most projects with the County go on through but because of
private developers being involved with this one, City
Manager Cheney said it has not been an easy one to move
along. He recommended that if the contract between the
County and UDC is not approved by the middle of February,
the City request the Board of County Commissioners to refuse
any more building permits to UDC as, in his judgment, they
are now and will be then in violation of their zoning and
master plan approval.

to proceed with City Manager Cheney's recommendation.
Even if the motion passed, Vice Mayor Zimmerman thought the
Council should "keep on the ball" and figure out what they
will do next. They should not let this go to sleep.
A vote was taken on the motion, and the motion carried 5-0.
D. Seacrest Boulevard
City Manager Cheney asked that the agenda be amended ~to
include this item. Councilman Hester so moved, seconded by
Councilman Marchese. Motion carried 5-0.
City Manager Cheney wanted the Council's approval to request
the Board of County Commissioners to close Seacrest Boulevard
to through traffic during construction with the exception
that traffic will be allowed to cross Seacrest Boulevard at
14th Avenue, the 17th and 19th Avenues' area, and 22nd
Avenue.
When the Seacrest project was approved, City Manager Cheney
reported that through traffic would be prohibited, and he
thought everybody understood that, but the contract between
the County and the Contractor was not written that way. He
guessed it would be easier if the City went on record also
requesting it. The Police Department strongly urged the
City to make the request. There are no sidewalks on one
side of the street now, and there will not be any on two
sides.
City Manager Cheney said there is a lot of construction of
piping, ditches, storm drains, water, and sewer. There will

have to be some traffic through there, but the City would
like to have the ability to get all of the traffic out of
there that does not belong there. City Manager Cheney
further explained.
Vice Mayor Zimmerman asked if that would be the length of
Seacrest from the bridge to the north City limits. As
construction proceeds to a point where it is dangerous,
City Manager Cheney said the City would expect Seacrest to
be closed to through traffic in segments. The first segment
now is 22nd to the bridge. The City has to see how the
construction goes at that point.
Mayor Cassandra asked if the east/west road that City
Manager Cheney recommended were to give the people living
north and south a way to their homes. City Manager Cheney
answered affirmatively and added that the roads will be
messed up from time t0 time but will be open to get across
in half a lane.
Vice Mayor Zimmerman moved to grant the request, seconded
by Councilwoman Zibelli. Motion carried 5-0.
