A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF BOYNTON BEACH, FLORIDA, AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE PHASE 2 AND
PHASE 3 OPTIONS WITH H.T.E., INC., PROVIDING FOR
SOFTWARE, TRAINING, SUPPORT AND CONVERSION
SERVICES ON THE CONTRACT PREVIOUSLY APPROVED
BY RESOLUTON R97-152; AUTHORIZING AND
DIRECTING THE MAYOR AND CITY CLERK TO EXECUTE
A CUSTOMER INFORMATION SYSTEM PURCHASE
OPTION WITH H.T.E., INC., AND EXECUTION OF A
CONTRACT ADDENDUM FOR SAID PURCHASE; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Boynton Beach by Resolution
No. R97-:152 on September :16, :1997, provided for a Software License and Services
Agreement with H.T.E., Inc., which piggy-backed a contract between the City of
Palm Beach, Florida and H.T.E., Inc.; and
WHEREAS, sufficient funds have been encumbered from the :1997/98
budget for these purchases;
NOW, THEREFORE, BE I'T RESOLVED BY THE CITY COMM'rSSI'ON OF
THE CTTY OF BOYNTON BEACH, FLORI'DA, THAT:
Section 1. The City Commission of the City of Boynton Beach, Florida
hereby authorizes the Mayor and City Clerk to execute Phase 2 and Phase 3 Options
with H.T.E., INC., providing for software, training, support and conversion services
on the Contract previously approved by Resolution R97-152; authorizing and
directing the Mayor a'nd City Clerk to execute a Customer Information System
Purchase Option with H.T.E., INC., and execution of a Contract Addendum for said
purchase, all of which documents are attached hereto and made a part hereof.
Section 2. That this Resolution shall become effective immediately upon
passage.

Footnote
*No additional Project Management will be required for the Licensed Program included in this Agreement, provided it is
installed at the same time as the Phase I Licensed Programs, however HTE will require additional Project Management if the
installation is delayed until Phases II or III.
HTE Application Support Service
The irlitial term of HTE application support services shall commence one hundred twenty (120) days after delivery of the
Licensed Program(s) and extend for a twelve (12) month term. Support fees for the initial term of support are due prior to the
commencement of support. Subsequent terms of support will be for twelve (12) month periods, commencing at the end of the
initial support period and support fees will be due at that time at the then prevailing rate. Rates for subsequem years of support
service are subject to change.
Application Training
The number of training sessions and the number of days of training vary per applications. Listed above are the number of
hours for the Licensed Programs listed herein, and the standard fee per applications. Additional application training can be
provided upon request at the standard billing rate in effect at that time, which at the time of this Supplement is one thousand
dollars ($1,000) per day. The fee quoted above does not include travel and living expenses.
Travel and Living Expense
Actual and reasonable travel and living expenses are in addition to the prices quoted for the HTE Licensed Programs and
services and will be invoiced as incurred.

A description of Project Management is attached to this Supplement, if applicable, and will be invoiced as incurred, at the
standard billing rate in effect at that time, which at the time of this Supplement is One Thousand Dollars ($1,000) per day. A
mutually agreeable work plan will be created by the HTE Project Manager and the Customer, and will be made a part of this
Supplement. Additional days of Project Management, if requested by Customer, will be invoiced as incurred at the then current
HTE dady rate.

The C stomer acknowledges that HTE makes every effort to schedule training and project management sessions sufficiently in
advan :e to obtain favorable travel and living costs, which are payable by the Customer. Any training or on-site project
mana ement session canceled~ for the benefit of the Customer after being scheduled by HTE may be subject to a penalty
char . HTE's current penalty charge for any on-site sessions canceled by the Customer within seven (7) days of the date
schedt.led by HTE is fifty percent (50%) of the original cost of such service as provided above. Fees for on-site sessions
cancel cl within seventy two (72) hours of the scheduled date shall be fully due and payable by the Customer. The charges and

but nc t limited to non-refundable travel and living expenses, which shall also be due and payable by the Customer.

subsequent penalty to the Customer. ·

Warranty - Third Party
Unless[otherwise stated, Customer shall enter into separate purchase of maintenance agreements with each individual hardware
or thir{l party software supplier for the equipment or software as may be provided herein. Warranty and maintenance offerings
by HT E for its Licensed Program(s) do not apply to any hardware or third party software supplied under this Supplement.
HTE .oes not make any warranties for any non-HTE products unless otherwise provided herein.

SUBJECT: Customer Relations Software/Hardware Package
The Utilities Department is requesting that ITS proceed with the approval and purchase
of the Customer Relations system. As you are aware the existing system is deteriorating
rapidly and something needs to be done before a major failure occurs.
We are in possession of a copy of the pricing proposal from HTE, Inc. dated September
5, 1997 and Pete Mazzella of this office has been in contact with you regarding the
Customer Relations package. The 16 GB of Raid Disk is not needed as we understand
from you, please confm-n that this indeed is the case;
The total for the package without the Raid Disk and including additional licenses,
estimated travel and living, and GUI is $114,055.00. Funding is available in account
number 401-000-1-451.18. Please. prepare the package and present to Commission as
soon as possible. If you have any questions please contact Pete Mazzella ~at ext. 6404 of
this office.
