AN ORDINANCE OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
AMENDING CHAPTER 2, ARTICLE V. SECTION
2-75 OF THE CODE OF ORDINANCES TO
P~OVIDE CODE ENFORCEMENT BOARD
JURISDICTION FOR CHAPTER 13. LICENSES;
AMENDING CHAPTER 13, ARTICLE I SECTION
13-19 TO PROVIDE THAT ENFORCEMENT OF
OCCUPATIONAL LICENSE INFRACTIONS CAN BE
PURSUED THROUGH THE CITY'S CODE
ENFORCEMENT BOARD; PROVIDING THAT EACH
AND EVERY OTHER PROVISION OF CHAPTER 2'.
ARTICLE V. AND CHAPTER 13 ARTICLE I. NOT
SPECIFICALLY AMENDED HEREIN SHALL REMAIN
IN FULL FORCE AND EFFECT AS PREVIOUSLY
ENACTED; PROVIDING A CONFLICTS CLAUSE;
PROVIDING A SEVERABILITY CLAUSE;
PROVIDING AUTHORITY TO CODIFY; PROVIDING
FOR AN EFFECTIVE DATE; AND FOR OTHER
PURPOSES.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
~THE CITY OF BOYNTON BEACH, FLORIDA:
Section 1. That Chapter 2, Article V. Section 2-75
Ls hereby amended by adding the words and figures in
underlined type and by deleting the words and figures in
struck-through type as follows:
Sec. 2-75. Provisions under jurisdiction of boards.
The code enforcement boards shall enforce and have
jurisdiction of the following codes:
Building codes, Chapter 5; occupational license codes,
Chapter 13; fire codes, Chapter 9; Licenses, Chapter
~3; zoning codes, Chapter 19 and Append-ix~s~Aand B of
the Code of Ordinances; sign codes, Chapter 21; and
related technical codes in force in the city.
Section 2. That Chapter 13. Article 1. Section
13-19 is hereby amended by adding the words and figures in
underlined tYPe and by deleting the words and figures in
struck-through type as follows:
Section 13-19. Method of enforcement; injunction.
(a) Any person subject to and who fails to pay a
license privilege tax required by this or any other
ordinance of the city or law of the State of Florida,
shall upon petition by the city be enjoined by the
circuit court from engaging in the business for which
he has failed to pay said license, until such time as
he shall pay the same with all costs of such action.
(b) The specific penalties and enforcement mechanisms
contained within this Article are not exclusive
remedies and shall not be construed as prohibiting the
City from seeking penalties, sanctions and other

remedies provided within Chapter 2, Article V of the
Code of Ordinances.
Section 3. Each and every other provision of
Chapter 2, Article V. and Chapter 13, Article I. not
specifically amended herein shall remain in full force and
~ffect as previously enacted.
Section 4: That all ordinances or parts of ordinances
in conflict herewith be and the same are hereby repealed.
Section 5: Should any section or provision of this
ordinance or portion hereof, any paragraph, sentence, or
word be declared by a court of competent jurisdiction to be
invalid, such decision shall not affect the remainder of
this ordinance.
Section 6: Authority is hereby granted to codify said
ordinance.
Section 7: This ordinance shall become effective
immediately upon passage.
