3 AN ORDINANCE OF THE CITY OF BOYNTON BEACH,
4 FLORIDA AMENDING LAND DEVELOPMENT
5 REGULATIONS, CHAPTER 2.5 "PLANNED UNIT
6 DEVELOPMENT" , SECTION 9.D COMMERCIAL
7 STANDARDS TO ALLOW COMMERCIAL USES TO
8 FRONT ON EXTERIOR OR PERIMETER STREETS
9 WHEN SUCH LOCATIONS ARE CONSISTENT WITH
10 ADOPTED REDEVELOPMENT PLANS; PROVIDING
11 FOR CONFLICTS, SEVERABILITY, CODIFICATION
12 AND AN EFFECTIVE DATE.

14 WHEREAS, the City Commission, upon recommendation of the Community
15 Redevelopment Agency, does deem it appropriate and in the best interests of the citizens and
16 residents of the City of Boynton Beach, to amend the Land Development Regulations of the
17 City of Boynton Beach to allow commercial uses to front on exterior or perimeter streets when
18 such locations are consistent with adopted redevelopment plans.
19 NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
20 THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
2] Section L The foregoing whereas clause is true and correct and is now ratified and
22 con finned by the City Commission.
23 Section 2. Chapter 2.5 "Planned Unit Development", Section 9D of the Land
24 Development Regulations of the City of Boynton Beach Code of Ordinances is hereby
25 amended as follows:

29 D. COMMERCIAL STANDARDS. Commercial uses located in a PUD
30 are intended to serve the needs of the PUD and not the general needs of a
31 surrounding area. The maximum area within a PUD and not the general needs
32 of a surrounding area. The maximum area within a PUD which may be
33 devoted to neighborhood commercial uses, including required off-street
34 parking requirements, is governed by Table 1, Section 4 and Section 9C. Areas
35 designated for commercial activities shall not generally front on exterior or
36 perimeter streets, and shall be preferably centrally located within the project
37 unless these criteria would be inconsistent with, or contrary to, adopted I
38 redevelopment plans. In instances where a PUD in the Community

1 Redevelopment Area includes commercial uses, it shall be developed
2 consistent with adopted design guidelines or requirements contained in
3 redevelopment plans.

6 Section 3. Each and every other provision of the Land Development Regulations
7 not herein specifically amended, shall remain in full force and effect as originally adopted.
8 Section 4. All laws and ordinances applying to the City of Boynton Beach in
9 conflict with any provisions of this ordinance are hereby repealed.
10 Section 5. Should any section or provision of this Ordinance or any portion
11 thereof be declared by a court of competent jurisdiction to be invalid, such decision shall not
12 affect the remainder of this Ordinance.
13 Section 6. Authority is hereby given to codify this Ordinance.
14 Section 7. This Ordinance shall become effective immediately.
