Minutes 08-17-05 MINUTES OF THE CODE COMPLIANCE BOARD REGULAR MEETING HELD IN COMMISSION CHAMBERS, CITY HALL, BOYNTON BEACH, FLORIDA, ON WEDNESDAY, AUGUST 17, 2005 AT 7:00 P.M. Call to Order Chairperson Costantino called the meeting to order at 7:00 p.m. II. Approval of Minutes - July 20, 2005 and July 28, 2005 Mr. Foot requested that the minutes of July 28, 2005 reflect that Mr. DeLiso was not present when the minutes were approved. Motion Mr. Foot. moved to approve the minutes of July 28, 2005, as amended. Motion seconded by Vice Chair Cook and unanimously carried. Motion Ms. Simshauser moved to approve the minutes of July 20, 2005, as read. Motion seconded by Mr. Yerzy and carried 5-1 (Mr. Foot voting nay since he was not present at the meeting). Chairperson Costantino welcomed two new Code Compliance employees, Ms. Samantha Sid lower and Vania Raphael. III. Approval of Agenda Officer Lewis announced there were no changes to the agenda. Meeting Minutes Code Compliance Board Boynton Beach, Florida August 17, 2005 Motion Mr. Foot moved to approve the agenda. Motion seconded by Vice Chair Cook and unanimously carried. IV. Swearing in of Witnesses and Introduction Attorney Tolces explained the plea procedures and stated cases would be heard in the order of their listing on the docket. People who were present would have their cases heard first. All persons present were requested to sign in. The Code Board is authorized by law to ensure compliance with the City's Code of Ordinances. All testimony is under oath and evidence may be presented to the Board. After presenting testimony and evidence, an order would be entered. Pursuant to Florida Statutes, Chapter 162, all orders of the Code Compliance Board may be appealed to the Circuit Court of Palm Beach County Florida. Transcripts of the hearings are available. Attorney Tolces administered the oath to all persons who would be testifying. Officer Lewis called the roll and all persons present were requested to state "here" when their name was called. V. New Business A. Cases to be Heard (New) Case No. 05-423: Property Address: Violations: Bernard Santini, Carina Santini & Maria Montejo 116 W. Ocean Drive FBC '01 Edition BBA 104.1.1. You must obtain a permit for your carport enclosure, doors and remodeling Code Officer Courtney Cain presented the case and reported he was previously sworn in. The property is a single-family, homestead dwelling. The property was cited on February 18, 2005, as the result of a citizen's complaint. The property was cited by written notice, certified mail, and the respondent was given 15 days to comply. Bernard Santini, 116 W. Ocean Drive, Boynton Beach, pled guilty. Chairperson Costantino inquired how much time the respondent needed to comply. He noted that he has to remove the doors he installed and install doors that are approved by the State. Mr. Santini said he could comply within 30 days. Motion Based on testimony and evidence presented in Case #05-423, Mr. Foot moved that this Board find that Bernard Santini, Carina Santini and Maria Montejo are in violation of City of Boynton Beach Code Sections as cited, and moved to order that the Respondents correct the violation on or before September 16, 2005. The Board has considered the gravity of the violation, the actions taken by the Respondents, and any previous violations by the Respondents, and hereby orders that if the Respondents do not comply with this Order, a fine in the amount of $25.00 per day for each day the violation continues past September 16, 2005, plus Administrative Costs, shall be imposed. The Respondents are further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re-inspection of the property to verify compliance with this Order. Motion seconded by Ms. Simshauser and unanimously carried. Case No. 05-1346: Property Address: Violations: Boynton Shipwreck, Inc. 811 SE 3rd Street Section 10-3 B.B.C. of Ord.; Chapter 15, Article IX-15-120 (D) 1, Inc.; and Chapter 20, Section 8 E-16. Please remove abandoned and unlicensed vehicle from your property. Install 4" street numbers on house that are visible from the adjacent street. Pick up all loose items that can cause a hurricane hazard. Officer Laverdure presented the case and stated he was previously sworn in. The property is a single family, homestead dwelling. The property was cited as the result of 3 Meeting Minutes Code Compliance Board Boynton Beach, Florida August17,2005 a routine inspection on June 20, 2005. Notice was in writing and the respondent was given 15 days for compliance. The notice was sent on July 8,2005 by certified mail. The owner has asked for time to correct the violations that were the result of the tenant on the property. The street numbers have been placed on the house. The remaining violations are removal of some trash and the vehicle in the yard. Bob Katz, 306 SE 1st Avenue, Boynton Beach, pled guilty and said he notified the tenant to vacate the premises and the tenant said he would be vacating the premises by the end of the month. Mr. Katz requested 45 days for compliance. Motion Based on testimony and evidence presented in Case #05-1346, Ms. Simshauser moved that this Board find that Boynton Shipwreck, Inc. is in violation of City of Boynton Beach Code Sections as cited, and moved to order that the Respondent correct the violations on or before October 1, 2005. The Board has considered the gravity of the violations, the actions taken by the Respondent, and any previous violations by the Respondent, and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $25.00 per day for each day the violation continues past October 1, 2005, plus Administrative Costs, shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re- inspection of the property to verify compliance with this Order. Motion seconded by Mr. Foot and unanimously carried. Mr. Foot inquired if the respondent needed to obtain an occupational license and Officer Laverdure responded that one was needed. Mr. Katz is aware of this and will be applying for one. Case No. 05-1367: Property Address: Violations: Michael Fitzpatrick and Lisa Hanley 175 SW 2nd Street Chapter 15, Article IX-15-120 (D) 1, Inc. and Section 10-3 B.B.C. of Ord. Please trim all overgrowth and pick up all loose items that would cause a hurricane hazard. Officer Laverdure presented the case and reported the property is a single-family, homestead house and was cited through routine inspection on June 22, 2005. The notice of the violation was in writing and the respondents were given 20 days for compliance. The notice was sent on July 14, 2005 by certified mail. Officer Laverdure met with Mr. Fitzpatrick on July 18th and walked the property to explain what needed to be done to comply. The hurricane hazards have been taken care of. Officer Laverdure presented photographs of the property to the respondents and then to the Board. 4 Meeting Minutes Code Compliance Board Boynton Beach, Florida August 17,2005 Michael Fitzpatrick and Lisa Hanley, 175 SW 2nd Street, pled not guilty. Mr. Fitzpatrick addressed the complaints in sections: (1) pick up loose items that would cause a hurricane hazard, (2) trim all overgrowth, (3) the back corner of the lot, and (4) harassment and/or selective enforcement. With regard to the first complaint, Mr. Fitzpatrick noted Officer Laverdure stated there were no hurricane hazards. Mr. Fitzpatrick presented photographs, as well, to the Board. With regard to trim all overgrowth, he noted Officer Laverdure came to the property and Mr. Fitzpatrick thought they had come to an understanding that if the property was trimmed 50' back from the sidewalk, the property would comply, which he has done. Mr. Fitzpatrick reported that Mr. Blasie and Officer Laverdure were at his property yesterday and took the pictures presented to the Board. Mr. Fitzpatrick noted that they have taken out all the grass in the swale area. Mr. Fitzpatrick further felt they have complied by trimming back the grass 50' from both roads, since the property is on a corner lot. When the Code Officers came to his property yesterday, some grass has since grown out into the 50' area and if this is a violation, he felt they should be cited again because the property had complied. Mr. Fitzpatrick acknowledged that the back corner lot is overgrown with natives and they would like to keep it in this condition because it acts as a bird and wildlife habitat. Their yard is a State of Florida certified yard and they use no pesticides or fertilizer and very little water. Mr. Fitzpatrick would like to install a privacy fence approximately 25' to 50' back from the road in order to maintain this part of the yard in its current condition. Ms. Hanley had a letter from their neighbor across the street complimenting the Fitzpatrick's yard. Ms. Hanley weeds the yard on a daily basis. Further, Ms. Hanley pointed out that the plantings they were cited for are the same as those at the Children's Museum. They are mitigating the globally imperiled Florida Coastal Scrub on a 29' pile of sand. She stated there is a certain kind of grass that keeps growing back and the birds feed on this. She had repeatedly cut back the "unknown grass," but she does not want to totally rid the property of it because the birds feed on it. Ms. Hanley also noted that State Representative Anne Gannon liked their yard and requested Ms. Hanley help her with her yard. Ms. Hanley opined that people like the feel of the old Florida look that their yard presents. Vice Chair Cook said that the yard must comply with the Code and not what people would like to have their yard look like. She asked what the issue was regarding the appearance of the Fitzpatrick property. Officer Laverdure noted xeriscape yards must be weed free and mulched. With regard to the 50' setback, this applied to commercial property, not residential. Officer Laverdure agreed that Mr. Fitzpatrick has cut back 50' from the front of his house, but the back lot 5 Meeting Minutes Code Compliance Board Boynton Beach, Florida August 17,2005 has not been cut back. Vice Chair Cook inquired if the respondents were allowed to erect a fence, would this correct the violation. Scott Blasie, Code Compliance Administrator, explained there are two separate Code sections that address this issue. One was cited and one was not. The more restrictive Code was cited. A copy of the Code was furnished to Mr. Fitzpatrick. The Code section dealing with the 50' setback is in Section 10-2 of Chapter 10 and deals with "acreage." Mr. Fitzpatrick's property is not "acreage." Officer Laverdure cited the property for the Community Appearance Code that is more specific. Grass cannot be more than 12" high and the property is in violation of many Codes. Mr. Blasie stated the fence would not resolve the issue, and the Board has no authority to grant a variance for the fence. Mr. Blasie felt the pictures were quite evident that a violation of the Code exists. Further, Mr. Blasie did not think that this hearing was the place for the selective enforcement issue and he informed Mr. Fitzpatrick yesterday what selective enforcement is. Mr. Blasie pointed out even if the respondents contend their property is xeriscaped, it still needs to be maintained. The Code does not allow people to grow things willy-nilly or to neglect pruning the landscaping. He added that staff feels the violations are clear-cut and did not warrant further debate. Ms. Simshauser asked about the Florida Certified Yard and Mr. Blasie explained that even though a yard may have that status, it still needed to be maintained according to the Code. Mr. DeLiso inquired if Mr. Fitzpatrick applied for a variance for the fence, would it shield the yard from the street. Mr. Blasie explained there are no variance options for the Community Appearance Code. The only variances available are limited to the zoning Code. Mr. Blasie noted that a 6' fence would not hide the yard from the street. Motion Based on testimony and evidence presented in Case #05-1367, Mr. Foot moved that this Board find that Michael Fitzpatrick and Lisa Hanley are in violation of City of Boynton Beach Code Sections as cited, and moved to order that the Respondents correct the violation on or before October 16, 2005. The Board has considered the gravity of the violations, the actions taken by the Respondents, and all previous violations by the Respondents, and hereby orders that if the Respondents do not comply with this Order, a fine in the amount of $25.00 per day, for each day the violations continues past October 16, 2005, plus Administrative Costs, shall be imposed. The Respondents are further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re-inspection of the property to verify compliance with this Order. Motion seconded by Ms. Simshauser. 6 Meeting Minutes Code Compliance Board Boynton Beach, Florida August 17,2005 Vice Chair Cook thought the fine should be higher and recommended a fine of $50 per day. Mr. Foot amended his motion to $50.00 per day. Vice Chair Cook seconded the amended motion. The Recording Secretary called the roll and the motion carried 4-2 (Mr. DeLiso and Ms. Simshauser dissenting). Ms. Hanley said if they had been told in June that the tall grass was actually the problem, they would have taken care of it. She reported they were never originally informed that this was the violation. Attorney Tolces informed the respondents that they should speak with the Code Compliance staff to determine what they must do to come into compliance. Case No. 05-738: Property Address: Violations: Thomas Hatch 1620 NE 3rd Court FBC '01 Edition BBA 104.1.1 and Section 13-16 B.B.C. of Ord. A building permit is required as stated in memo from Building Official. Rental property requires an occupational license. Officer Lewis presented the case. The property is a single-family, non-homestead home and was initially inspected on April 4, 2005. Thomas Hatch, 1620 NE 3rd Court, Boynton Beach, pled no contest and asked for 60 days. The respondent reported that they will be tearing down non-permitted structure and turning it back into a carport. No hurricane hazards are prevalent. Motion Based on testimony and evidence presented in Case #05-738, Vice Chair Cook moved that this Board find that Thomas Hatch is in violation of City of Boynton Beach Code Sections as cited, and moved to order that the Respondent correct the violations on or before October 16, 2005. The Board has considered the gravity of the violations, the actions taken by the Respondent, and any previous violations by the Respondent, and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $25.00 per day for each day the violation continues past October 16, 2005, plus Administrative Costs, shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re- inspection of the property to verify compliance with this Order. Motion seconded by Ms. Simshauser and unanimously carried. Case No. 05-1436: Property Address: Marie C. Nicolas 1401 NW 1st Court 7 Meeting Minutes Code Compliance Board Boynton Beach, Florida August 17, 2005 Violations: Chapter 10, Article 1110-24, Inc.; Chapter 10, Article II, Section 10-26 (E); Chapter 15, Article IX-15-120 (0), Inc.; and Chapter 15, Article IX-15-120 (B) 1. Please remove all construction debris from the swale and property area. Mow and trim overgrown yard and hedges. Officer Lewis presented the case. The property is a single family, non-homestead home. The property was cited on June 28, 2005, as the result of a citizen's complaint. Service was obtained on August 15, 2005 and there are health and safety issues at the site. Jean Baptiste, 11446 54th Street North, Royal Palm Beach, Florida, assumed the podium and stated he was the husband of the respondent and pled guilty. Officer Lewis explained that the violation resulted from an addition being built onto the property and the last time he inspected the property was in February. The job had been halted. All the construction material has been left at the site and there is material on the roof. The debris in the swale has been there since June 28, 2005, when the property was cited. Officer Lewis pointed out the debris has nails sticking out and was left in the area between the sidewalk and the swale. Officer Lewis thought someone was living at the property and it may be rented. He will be checking into this. Since the property was cited, the Building Division red tagged the property and this is another case. Officer Lewis presented photographs to the respondent and then to the Board. Mr. Foot inquired why the construction was not completed. Mr. Baptiste responded that he paid someone to bring a dumpster to the site, but he never showed up. With regard to the permit that expired, he said he paid $17,000 to a contractor that never completed the job and left the site. He asked if he could have 90 days to complete the job. Mr. Baptiste said he would have the yard cleaned up in a week. Officer Lewis was going to recommend 10 days for the current violations to get the property cleaned up. The permit issue needed to be addressed with the Building Division. Officer Lewis informed the respondent he could rent a dumpster from Public Works. Mr. Baptiste was under the impression if he left the debris on the swale, the City would pick it up. Officer Lewis noted the City does not pick up construction debris that has nails and Mr. Baptiste would have to call for a special pick up. Motion Based on testimony and evidence presented in Case #05-1436, Vice Chair Cook moved that this Board find that Marie C. Nicolas is in violation of City of Boynton Beach Code Sections as cited, and moved to order that the Respondent correct the violations on or before August 27, 2005. The Board has considered the gravity of the violations, the actions taken by the Respondent, and any previous violations by the Respondent, and 8 Meeting Minutes Code Compliance Board Boynton Beach, Florida August 17,2005 hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $100.00 per day for each day the violation continues past August 27,2005, plus Administrative Costs, shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re- inspection of the property to verify compliance with this Order. Motion seconded by Mr. Yerzy and unanimously carried. Case No. 05-1479: Property Address: Violations: Michael Rogers 111 NE 3rd Avenue Chapter 15, Article IX-15-120 (B). Inc. Please remove all unregistered and inoperable motor vehicles and all outside storage. Officer Melillo presented the case. The property is a single-family homestead house and was cited through routine inspection on July 5, 2005. The respondent was notified in writing by certified mail of the violation and given 10 days to comply. The letter came back from the Post Office and Officer Melillo hand delivered it to the respondent yesterday. Chairperson Costantino asked if this property was before the Board last month. Officer Melillo stated it was, but it was for a different violation. Michael R. Rogers, 111 NE 3rd Avenue, Boynton Beach, pled guilty. Mr. Rogers said he would have the property in compliance by the end of the month. He has hired someone to pick up the debris and is selling the motor vehicle. He presented a copy of the ad for the sale of the motor vehicle to Mr. DeLiso. Mr. Rogers also thanked Mr. DeLiso for his assistance and presented him with a letter of commendation. Motion Based on testimony and evidence presented in Case #05-1479, Mr. DeLiso moved that this Board find that Michael R. Rogers is in violation of City of Boynton Beach Code Sections as cited, and moved to order that the Respondent correct the violations on or before September 1, 2005. The Board has considered the gravity of the violations, the actions taken by the Respondent, and any previous violations by the Respondent, and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $50.00 per day for each day the violation continues past September 1, 2005, plus Administrative Costs, shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re- inspection of the property to verify compliance with this Order. Motion seconded by Vice Chair Cook and unanimously carried. Case No. 05-1641: Property Address: Violations: Sharon G. Frazier 2280 NW 1 st Street Chapter 15, Article IX-15-120 (0) 1, Inc. Please remove all unlicensed and 9 Meeting Minutes Code Compliance Board Boynton Beach, Florida August 17,2005 inoperable vehicles from the property (backyard) and trim all overgrowth and mow tall grass. Officer Webb presented the case and noted he had been previously sworn in. The property is a single-family, homestead property. The property was cited on July 20, 2005 through routine neighborhood inspection. The respondent was notified of the violation by certified mail on August 8, 2005 and was informed she had 10 days to comply. Officer Webb reported no hurricane hazards existed and he had two photographs of the property. Sharon Frazier, 2280 NW 1st Street, Boynton Beach, pled guilty. Chairperson Costantino asked how much time the respondent needed for compliance. Ms. Frazier requested 10 days. Officer Webb pointed out that the respondent has started to work on the yard. Motion Based on testimony and evidence presented in Case #05-1641, Vice Chair Cook moved that this Board find that Sharon Frazier is in violation of City of Boynton Beach Code Sections as cited, and moved to order that the Respondent correct the violations on or before September 16, 2005. The Board has considered the gravity of the violations, the actions taken by the Respondent, and any previous violations by the Respondent, and hereby orders that if the Respondent does not comply with this Order, a fine in the amount of $25.00 per day for each day the violation continues past September 16, 2005, plus Administrative Costs, shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division in order to arrange for re-inspection of the property to verify compliance with this Order. Motion seconded by Ms. Simshauser and unanimously carried. VI. Old Business A. Lien Penalty Certifications (Tabled) Case #04-2319 Gulf Stream Lumber Co. 1415 S. Federal Highway Dennis Vlassis Registered Agent Margot Vlassis Officer/Director Officer Cain presented the case. The notice of violation was October 12, 2004 for violation of the Florida Building Code and the Community Appearance Code. No one appeared at the June 15, 2005 Code Compliance Board Hearing. A compliance date of June 25, 2005 was set or be fined $1,000 per day. The property complied on August 16, 2005 for 51 days of non-compliance. 10 Meeting Minutes Code Compliance Board Boynton Beach, Florida August 17,2005 Dennis Vlassis, 1415 South Federal Highway, assumed the podium. Mr. Foot inquired if there were any other outstanding issues related to this property and Officer Cain stated there were no other violations. Chairman DeLiso inquired if the property was sold and Mr. Vlassis stated that it was. Vice Chair Cook felt that the respondent should be assessed for the administrative fees and the Board was in agreement with this. She acknowledged the respondent had difficulty with the sale of the property. Mr. Vlassis reported that he had allowed the City to use the property for fire training purposes and 10 days before the closing, it was postponed. At that point he had to find a firm to demolish the buildings that added to the time for compliance. The respondent reported it cost $30,000 to raze the buildings. Mr. Blasie noted the respondent had been given 10 days to raze the buildings, but before he could proceed, he was required to obtain an asbestos survey that took about two weeks. After that, there was an additional 10-day period when the Health Department reviewed their findings. Mr. Blasie noted during this time, no work could be done. Motion Based on the testimony and evidence presented in Case No. 04-2319, Mr. DeLiso moved that this Board find that the Respondents, Gulf Stream Lumber Company, Dennis Vlassis, Registered Agent, and Margo Vlassis Officer/Director, were in violation of the City of Boynton Beach Code Sections as cited, subsequent to the date of compliance specified in this Board's Order of June 15, 2005, and in consideration of the gravity of the violations, the actions taken by the Respondents to remedy the violations, and previous violations of the respondents, that this Board impose and certify a fine in the amount of $768.24, including Administrative Costs. Motion seconded by Vice Chair Cook and unanimously carried. Case #03-2938 Jeffrey A. & Cindy J. Smith 2525 SW 14th Street Officer Melillo presented the case. Notice of violation was October 24, 2003 for violation of the Florida Building Code. The respondent did appear at the October 20, 2004 Code Compliance Board Hearing. A compliance date of April 15, 2005 was set or be fined $25 per day. The property complied on August 11, 2005 for 117 days of non-compliance. Jeffrey Smith, 2525 SW 14th Street assumed the podium. Mr. Smith reported that the City approved his application for a variance and he has now received his permit and final inspection. 11 Meeting Minutes Code Compliance Board Boynton Beach, Florida August 17,2005 Motion Mr. DeLiso moved to dismiss Case No. 03-2938. Motion seconded by Ms. Simshauser and unanimously carried. Case #05-572 Joseph Sabine 152 SE 29th Avenue Officer Pierre requested that the case be tabled for 90 days. Motion Ms. Simshauser moved that Case No. 05-572 be tabled until the Code Compliance Board Meeting to be held on November 16, 2005. Motion seconded by Vice Chair Cook and unanimously carried. VII. Lien Reduction Case No. 04-2338 Matthew J. & Dianne Williams 125 SW 1st Avenue Scott Blasie, Code Compliance Administrator, presented the case. The property was originally cited on October 15, 2004 for violations of the Florida Building Code. The case first came before the Board on December 15, 2004 and no one appeared. A compliance date of January 14, 2005 was set or be fined $25 per day. The demolition permit was final on April 4, 2005, for 79 days of non-compliance. Mr. Blasie explained that the building was severely damaged during the hurricanes. The building was demolished and is now a vacant lot. Attorney Tolces administered the oath to Mr. Williams. Matthew Williams assumed the podium and explained that the property was destroyed by a hurricane at the end of September. Mr. Williams noted the structure was non- conforming and only half of the building was destroyed by the hurricane, but because it shared a common roof, he had to tear down the entire building. He also had a problem getting paid by his insurance company because he had to re-file his claim for the entire building because the case had already been settled for half of the building. As a result, it took longer to get the building demolished. With regard to not appearing at the meeting, he thought it was a miscommunication because he did not think he had to appear since he was addressing the problem. When the certified letter went out in January, he was not in town when it was delivered to his house, so he never received it. Also, he did not realize hewas being fined $25 per day. Chairperson Costantino asked what Mr. Williams' intentions were with the lot and he said he would be selling it, along with two adjoining lots. Chairperson Costantino inquired if the Code staff was acquainted with the protective netting displayed by the respondent. Mr. Hilton also said he has contracted with a company to install a fence around the pool as well. The netting was only temporary until the fence could be erected. Members were not certain if the protective netting would, in fact, meet Code. Mr. Blasie inquired if the respondent obtained a permit to install the netting and the respondent stated a permit was not required. Mr. Blasie explained the City would require a permit, because a barrier would have to be approved by the City. Mr. Blasie was unfamiliar with the protective netting that Mr. Hilton purchased. He recommended that the respondent submit the "product approval" to the Building Division.
