Minutes 08-31-05 MINUTES OF THE CODE COMPLIANCE BOARD LIEN REDUCTION MEETING HELD IN THE LIBRARY PROGRAM ROOM, BOYNTON BEACH, FLORIDA, ON WEDNESDAY, AUGUST 31,2005 AT 3:00 P.M. Present Michele Costantino, Chairperson Kathy Cook, Vice Chair Chris DeLiso Bob Foot Kathleen Carroll (arrived at 3:08 p.rn.) Richard Yerzy David Tolces, Assistant City Attorney Scott Blasie, Code Administrator Absent Lisa Simshauser I. Call to Order Chairperson Costantino called the meeting to order at 3:01 p.m. II. Approval of Minutes - August 17,2004 Mr. Foot noted he had just received the minutes and requested that approval of the minutes be addressed at the next regularly scheduled meeting Motion Mr. Foot moved that the minutes be approved at the next regularly scheduled Board meeting. Motion seconded by Ms. Cook and unanimously carried. III. Approval of Agenda Ms. Blasie announced there were no additions or deletion to the agenda. Motion Mr. DeLiso moved to approve the agenda. Motion seconded by Mr. Yerzy and unanimously carried. IV. Swearing in of Witnesses and Introduction Attorney Tolces administered the oath to all persons that would be testifying. Meeting Minutes Code Compliance Lien Reduction Meeting Boynton Beach, Florida August 31, 2005 v. Old Business A. Reconsideration of Fine Case #05-364 Joseph C. & Suzanna Y. Bean 131 NE 17th Avenue Mr. Blasie reported that Mr. Bean came to the Code Compliance Board Office last week. Mr. Blasie noted the Board has heard Mr. Bean's case twice and the fine was certified on August 1ih. However, at the previous meeting, Mr. Bean was under the impression that he had 30 days to comply, but felt he only actually received 27 days for compliance. He did appear at the July certification hearing and the case was tabled. At that meeting, Mr. Bean was under the impression he had 30 days to comply. Code Officer Lewis re-inspected the property on August 25th and there was still no grass in the front yard. The respondent informed Mr. Blasie that grass was placed in the yard on that day, but it was later in the day, on the same day. Mr. Blasie requested that Mr. Bean furnish him with a receipt for the grass, which he did. The receipt was from the "Sodfather" and was dated August 17, 2005. There was no delivery date on the receipt. Mr. Bean is asserting that his property was in compliance the night his fine was certified. Mr. Blasie brought the case back to the Board for re-consideration since staff informed the Board on August 17, 2005 the property was not in compliance, when in fact it was. Chairman DeLiso asked Mr. Blasie if it has been verified that the Code Officer told the respondent he had an additional 30 days. Mr. Blasie responded that it has not been verified because he is not certain what the Code Officer had said. Mr. Bean responded he was under the impression at the last meeting that the case was tabled for 30 days by the Board to allow him to come up with the money to pay for the grass. At that time he was having financial problems. Once he had the funds, he had difficulty getting the grass planted on a timely basis. Mr. Bean did not realize that the case was not tabled for 30 days previously, which was why he was not at the fine certification meeting. Mr. Foot inquired if the grass has been put in and Mr. Blasie stated he has verified that the grass was put in and looks good. Motion Mr. DeLiso moved to zero out the fine in Case No. 05-364. Motion seconded by Ms. Carroll. Mr. Foot asked if the City has expended any money on this case. Mr. Blasie noted no filing costs were incurred. 2 Meeting Minutes Code Compliance Lien Reduction Meeting Boynton Beach, Florida August 31, 2005 Mr. Blasie pointed out that staff did send the respondent a letter on July 21st that the case was tabled until August 1 ih. Vote Motion unanimously carried. VI. New Business A. Lien Reduction Case #03-2160 Richard D. Zolnay 168 SE 31st Avenue Mr. Blasie reported that a representative on behalf of the respondent in Case #03-2160 was supposed to be present at the hearing. At 3:11 p.m. no one was present to represent the respondent. Attorney Tolces and Mr. Blasie attempted to contact the respondent and his representative. It was decided to wait until 3:30 p.m. for the respondent or his representative to arrive at the meeting. The meeting recessed at 3:11 p.m. The meeting reconvened at 3:31 p.m. When the applicant or his representative did not appear by 3:31 p.m., the meeting was adjourned. VI. Discussion None VII.
