11 RECORDED WITH THIS ORDINANCE IN THE
12 PUBLIC RECORDS OF PALM BEACH COUNTY,
13 FLORIDA; AND PROVIDING AN EFFECTIVE DATE.

16 WHEREAS, Daniel Spotts, is requesting the abandonment of a portion of the twenty
17 (20) foot right-of-way alley lying west of Block I of Lake Addition to Boynton Beach as
18 recorded in Plat Book 11, Page 71 of the public records of Palm Beach County, Florida, subject
19 to staff comments; and

21 WHEREAS, comments have been solicited from the appropriate City Departments, and
22 public hearings have been held before the City's Community Redevelopment Agency, and the
23 City Commission on the proposed abandonment; and
24
25 WHEREAS, staff has determined that the subject right-of-way would no longer serve a
26 public purpose and with the establishment of an easement, the limited use of the alley for utility
27 purposes would be preserved.

29 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
30 THE CITY OF BOYNTON BEACH, FLORIDA THAT:

32 Section 1. The foregoing Whereas clauses are true and correct and incorporated
33 herein by this reference.

35 Section 2. The City Commission of the City of Boynton Beach, Florida, does hereby
36 abandon a portion of the twenty (20) foot alley lying west of 805 North Federal Highway and
37 abutting the Federal East Coast Railway west of Block I of Lake Addition to Boynton Beach as
38 recorded in Plat Book II, Page 71 of the public records of Palm Beach County, Florida, subject
39 to staff comments, and more particularly described in the attached Exhibit "B." A location map
40 is attached hereto as Exhibit "A."

42 Section 3. The City Manager is hereby authorized and directed to execute the
43 attached Disclaimer and cause the same to be filed, with this Ordinance, in the Public Records
44 of Palm Beach County, Florida.

Section 4.
This Ordinance shall take effect immediately upon passage.

WHEREAS, the second party desires an easement for water and sewer utilities
and/or other appropriate purposes incidental thereto, on, over and across said
