AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA, REPEALING
APPENDIX A - ZONING, SECTION 4. GENERAL
PROVISIONS, SUBSECTION M. SATELLITE DISH
ANTENNAE IN ITS ENTIRETY; ADOPTING A NEW
SUBSECTION M. SATELLITE DISH ANTENNAE BY
PROVIDING FOR PERMITS; PROVIDING FOR SEALED
ENGINEERING DRAWING REQUIREMENTS; PROVIDING
PLACEMENT REQUIREMENTS; PROVIDING FOR
SCREENING AND LANDSCAPE REQUIREMENTS;
PROVIDING MOUNTING SPECIFICATIONS; PROVIDING
APPROVAL IN CERTAIN SITUATIONS UNDER SITE
PLAN REVIEW; PROVIDING THAT EACH AND EVERY
OTHER PROVISION OF APPENDIX A - ZONING SHALL
REMAIN IN FULL FORCE AND EFFECT AS
PREVIOUSLY ENACTED; PROVIDING A CONFLICTS
CLAUSE; PROVIDING A SEVERABILITY CLAUSE;
PROVIDING AUTHORITY TO CODIFY; PROVIDING AN
EFFECTIVE DATE; AND FOR OTHER PURPOSES.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1. Appendix A - Zoning, Subsection 4.
General Provisions, Subsection M. Satellite Dish Antennae of
the Code of Ordinances, City of Boynton Beach, Florida, is
hereby repealed in its entirety.
Section 2. New Subsection M. Satellite Dish
Antennae of Appendix A - Zoning, Section 4. General
Provisions is hereby adopted as follows:
M. SATELLITE DISH ANTENNAE
1. General Provisions
(a)
No satellite dish antennae shall be
installed, removed, or
substantially modified without
first obtaining a permit from the
Building Official- for structural
and electrical purposes.
(b)
Ail requests for the installation
of a satellite dish antennae shall
be accompanied by sealed
engineering drawings in a form
acceptable to the Building
Official.
(c)
(d)
No satellite dish antennae shall be
installed forward of the front of
any building and the installation
shall not encroach into any
required side or rear yards.
Ail satellite dish antennae shall
be screened on three (3) sides with
landscape materials or walls with
landscaping which are of a height
equivalent to the total height of
the mountedsatellite dish.
(e) No satellite dish antennae shall be
installed which requires mounting
to a mast or other structure
attached to the front, Side or rear
of a building.
2. Special Provisions
(a)
Satellite dish antennae installed
to serve single-family or duplex
homes on platted lots which meet
required district lot area
regulations.
(1) Ground mounting is required.
(b)
Satellite dish antennae installed
to serve other than single-family
or duplex homes on platted lots
which meet required district lot
area regulations.
(1) Approval is required subject
to Chapter 19, Article II. SITE
PLAN REVIEW AND APPROVAL.
Section 3.
Each and every other provisions of
Appendix A - Zoning. of the Code of Ordinances of the City
of Boynton Beach, Florida, shall remain in full force and
effect as previously enacted.
Section 4. That all ordinances or parts of ordinances
in conflict herewith be and the same are hereby repealed.
Section 5. Should any section or provision of this
ordinance or portion hereof, any paragraph, sentence, or
word be declared by a court of competent jurisdiction to be
invalid, such decision shall not affect the remainder of
this ordinance.
Section 6. Authority is hereby granted to codify said
ordinance.
Section 7. This ordinance shall become effective
immediately upon passage.
