AN ORDINANCE OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
AMENDING APPENDIX A SECTION ll-H.4, TO
PROVIDE FOR DRIVEWAYS SATISFYING PARKING
SPACE REQUIREMENTS AT MULTI-FAMILY
DWELLING UNITS CONTAINING GARAGES;
AMENDING ARTICLE X. PARKING LOTS,
SECTION 5-139, BY CREATING A NEW
SUBSECTION (e) EXEMPTING MULTI-FAMILY
RESIDENTIAL PROJECTS WHICH CONTAIN
GARAGES; AMENDING ARTICLE X. SECTION
5-141(i), TO PROVIDE AN EXCEPTION FOR
MULTI-FAMILY UNITS CONTAINING GARAGES
WITH A MAXIMUM OF FOUR PARKING STALLS;
PROVIDING A CONFLICTS CLAUSE; PROVIDING
A SEVERABILITY CLAUSE; PROVIDING
AUTHORITY TO CODIFY; PROVIDING AN
EFFECTIVE DATE; AND FOR OTHER PURPOSES.
NOW T~F. REFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA THAT:
Section 1.
Section ll-H.4 of Appendix A. Zoning is
hereby amended by adding the words in underlined type and by
deleting the words and figures shown in struck-through type
to read as follows:
Driveways shall satisfy the parking
space requirements for single-family
detached dwellings a~ units, duplexes,
and multi-family dwelling units
containing garages, provided such
driveways are of sufficient size to meet
the parking space requirements of this
subsection.
Section 2.
That Section 5-139 of Article X is
amended by creating a new subsection (e) as follows:
(e) When a multi-family~
project is proposed and is designed in
such a manner so as to include units
containing garages served by driveways,
then these units shall be exempt from
the requirements of this article. This
exemption shall not be construed to
apply to multi-family units that do not
contain garages.
Section 3.
That Section 5-141(i) of Article X,
Parking Lots is hereby amended by adding the words in
underlined type and by deleting the words and figures in
struck-through type to read as follows:
(i) Parking Lot: Any outdoor,
partially enclosed or enclosed space,
plot, yard or any portion thereof upon
which two (2) or more parking stalls are
constructed. Parking facilities designed
for detached single-family homesT--e~
duplex units , or multi-family units
containing garages with a maximum of
four (4) parking stalls are exempted
from this definition. ~h~s exemption
Shall not be construed to ap~ly to
multi-family units that do not contain
garages.
Section 4: That all ordinances or parts of Ordinances
in conflict herewith be and the same are hereby repealed.
Section 5: Should any section or provision of this
ordinance or portion hereof, any paragraph, sentence, or
word be declared by a court of competent jurisdiction to be
invalid, such decision shall not affect the remainder of
this ordinance.
