AN ORDINANCE OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
REGARDING THE APPLICATION OF BOYNTON
BEACH COM~JNITY DEVELOPMENT DISTRICT
(CDC); AMENDING ORDINANCE 91-70 OF SAID
CITY BY REZONING A CERTAIN TRACT OF LAND
MORE PARTICULARLY DESCRIBED HEREIN, FROM
R-1 (SINGLE FAMILY RESIDENTIAL) to C-1
(OFFICE/PROFESSIONAL); AMENDING THE
REVISED ZONING MAP ACCORDINGLY; PROVIDING
FOR CONFLICTS, SEVERABILITY AND AN
EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Boynton
Beach, Florida has adopted Ordinance No. 91-70, in which a
Revised Zoning Map was adopted for said City; and
WHEREAS, The law office of Allen Wm. Martincavage, Sr.,
agent for the Boynton Beach Community Development Corporation,
owner of the property more particularly described hereinafter,
has heretofore filed a Petition, pursuant to Part III of the
Land Development Regulations, Chapter 2, Zoning of the City of
Boynton Beach, Florida, for the purpose of rezoning a certain
tract of land, said land being more particularly described
hereinafter, from R-1 (Single Family Residential) to C-1
(Office/Professional); and
WHEREAS, the City Commission deems it in the best
interests of the inhabitants of said City to amend the
aforesaid Revised Zoning Map as hereinafter set forth.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1: The following described land, located in the
City of Boynton Beach, Florida, as set follows:
Lots 1,2 and 3 of Block 27, Rolling Green
Ridge First Addition Subdivision. Plat
Book 24, Page 233 of the Public Records
of Palm Beach County, Florida.
Containing approximately 0.34 acres, more
or less
be and the same is hereby rezoned R-1 (Single Family
Residential) to C-1 (office/Professional). A location map is
attached hereto as Exhibit "A" and made a part of this
Ordinance by reference. Attached hereto as Exhibit "B" is a
copy of the conditions/requirements for this rezoning, which
are incorporated herein.
Section 2:
That the aforesaid Revised Zoning Map of the
City shall be amended accordingly.
Section 3: Ail ordinances or parts of ordinances in
conflict herewith are hereby repealed.
Section 4: Should any section or provision of this
Ordinance or any portion thereof be declared by a court of
competent jurisdiction to be invalid, such decision shall not
affect the remainder of this Ordinance.
Section 5: This ordinance shall become effective thirty-
one (31) days following adoption of the Ordinance, pursuant to
Florida Statutes.

1. Limiting building height to the
height restrictions of the existing R-1
zoning; and
2. Reverting the C-1 zoning to the R-1
zoning if the use of the property and
building by CDC discontinues.
