AN ORDINANCE OF THE CITY COMMISSION OF
THE CiTY OF BOYNTON BEACH, FLORIDA,
AMENDING CHAPTER 18, ARTICLE III, OF
THE CODE OF ORDINANCES OF THE CITY OF
BOYNTON BEACH, FLORIDA, CREATING A NEW
SECTION 18-173, ENTITLED "REEMPLOYMENT";
PROVIDING SPECIFIC CRITERIA FOR POLICE
OFFICERS TO REENTER THE PENSION PLAN UPON
REHIRE; PROVIDING FOR CONFLICTS,
SEVERABILITY, CODIFICATION AND AN
EFFECTIVE DATE.
WHEREAS, the City Commission has determined that it is in
the best interests of the City to amend Chapter 18, Article
III by creating a new Section 18-173 to allow police officers
who been rehired to come back into the same pension plan, with
specific criteria as set out hereinbelow.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA~ THAT:
Section 1.
That Chapter 18, Section 18-173 is hereby
created as follows:
Sec$i0n 18-173. Reemployment.
When any former uolice officer of the
City is reemDloved, he will become a
member of the plan uPOn reemployment as a
full-time permanent police officer. When
a former police officer of the City is
reemDloved and said uolice officer had
withdrawn contributions previously made
to the nlan. he may have forfeited
credited service reinstated upon
satisfaction of each of the followin~
conditions:
(1) The break in city emDiovment is not
more than sixty (60) months: and
(2) the plan is paid the total amount
previously withdrawn (consistin~ of
accumulated member contributions Plus any
interest previously paid by the plan on
those contributions). Thi~ total amount

total number of months from the date of
withdrawal to the d~e of repa_vment.

Section 2. Each and every other provmsion of Chapter
18 not herein specifically amended shall remain in full force
and effect as previously enacted.
Section 3. Ail ordinances or parts of ordinances in
conflict herewith be and the same are hereby repealed.
Section 4. Should any section or provision of this
ordinance or portion hereof, any paragraph, sentence or word
be declared by a courn of competent jurisdiction to be
invalid, such decision shall not affect the remainder of this
ordinance.
Section 5. Authority is hereby granted to codify said
ordinance.
Section 6. This ordinance shall become effective
immediately upon passage.
