AN ORDINANCE OF THE CITY CO~{MISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA, AMENDING
CHAPTER 18, SECTION 18-82 OF THE CODE OF
ORDINANCES OF THE CITY OF BOYNTON BEACH,
FLORIDA, PROVIDING CRITERIA FOR EMPLOYEES TO
REENTER THE PENSION PLAN UPON REHIRE;
PROVIDING FOR CONFLICTS, SEVERABILITY,
CODIFICATION AND AN EFFECTIVE DATE.
WHEREAS, the City Commission has determined that it is in
the best interests of the City to amend Chapter 18, Section 18-
82 to allow employees who have been rehired to come back into
the same pension plan, with specific criteria as set out
hereinbelow.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
~ That Chapter 18, Section 18-82 is hereby
amended by adding the words and figures in underlined .type and
by deleting the words and figures in struck-through type, as
follows:
Section 18-82. Reemployment.
When any former employee of the City is
reemployed, he will become a member of the
plan upon reemployment as a full-time
permanent general city employee. If

the City is reemDloyed and said employee had
withdrawn contributions oreviouslv made to
the plan, he may have forfeited credited
service reinstated upon satisfaction of each
of the followin~ conditions:
(1) The break in city emDlo_vment is not
more than sixty (60) months: and
(2) $h$ plan is paid the total amount
previously withdrawn (consistin~ of
accumulated member contributions Plus any
interest previously paid by the plan on
those contributions). This total amount is
brought:forward with interest for the total
number of months from the date of withdrawal
~O the da~e of repayment, calculated to the
ne~re~i month. This calculated amount
equals the amount to be repaid to the plan
in a lumD sum. The interest to brina
forward the total ~mount will be at the
~quival~t comDo~nd monthly rate derived
from the ear, ina rate assumed bv the actuary
in the most recent actuarial valuation
submitted to the Division of Retirement
Dursu~t to Dart VII of Chapter 112. Florida
Statutes. Repayment must be completed
within one year of reemployment.
$~ction 2. Each and every other provismon of Chapter 18
not herein specifically amended shall remain in full force and
effect as previously enacted.
Section 3. Ail ordinances or parts of ordinances in
conflict herewith be and the same are hereby repealed.
Section 4. Should any section or provision of this
ordinance or portion hereof, any paragraph, sentence or word be
declared by a court of competent jurisdiction to be invalid,
such decision shall not affect the remainder of this ordinance.
Section 5. Authority is hereby granted to codify said
ordinance.
