Minutes 05-17-06 NCFO, White Collar and City of Boynton Beach Union Negotiations May 17, 2006 Meeting Minutes Meeting held in City Hall, Conference Room Bat 10:00 A.M. Present: For the City of Boynton Beach For NCF&O Sharyn Goebelt, Director of HR Bobby Jenkins, Assistant Director of Finance Sharon Munley, Trustee, Local 1227 NCF&O Skip Lewis, Chief Steward, Code Monique Lewis, Communications (arrived 10:19 a.m.) Ron Eichorst, Police Meeting called to order at 10:16 p.m. and self-introductions were made. At the prior meeting, the City of Boynton Beach presented their proposal for changes to the contract and there were six articles proposed for change. The purpose of the meeting was to review the changes. Article 14. Ms. Munley indicated the union believed there would be issues when employees need to work during weeks that holidays fall in and it is at straight time. Ms. Munley proposed leaving just the holidays in the language. Article 15. Ms. Goebelt explained she spoke with the department heads and there are issues with the tracking of comp time because of the rolling calendar. She proposed putting a cap on comp time. She polled the departments and anywhere from 40 to 120 hours could be accumulated. Ms. Goebelt suggested capping the comp time at 80 and not have to convert the hours. Ms. Goebelt explained there would be no way to use the 80 hours in 60 days. After 80 hours, the time would need to be used or cashed in. Ms. Goebelt explained the proposal is 80 hours and then could be tracked on the pay stubs. The issue is the departments are not properly tracking the comp time. Ms. Goebelt explained the City recognized Fire and Police Services are different and she was referring to the White Collar Employees. The City would bring language to effect that change at the next meeting. It was noted the hours roll over to a new salary rate. Article 16. Ms. Munley indicated when a governing body ratifies a contract, they ratify what is in the contract, they don't go back to amend portions. Ms. Munley countered the options are ratifying the contract in one full swoop or the union can reopen for wages. She indicated she would also like to see the contract a little fatter for next year because circumstances will not be any better then than they are now. Ms. Goebelt explained there are three grievances pending pertaining to people on probationary status who were promoted in March. The employees feel they should receive a merit review in April and the City's policy is they need to wait six months. She is hoping to work out these grievances, or they need to make an adjustment to their proposal to exclude those individuals and put specific language in. One issue noted, was that performance evaluation pertains to prior performance. Article 23. Ms. Munley explained they agree with changing the one-half hour to one hour, but didn't want a separate set of rules for employees who work in communication. Ms. Munley explained the union was amenable to the changes about the two days and one week portion. In section 26.4 indicated the language put back in has been a problem in the past. Ms. Munley indicated she would like to see an "Ask and Answer time period". She thought 30 days was a lot and was okay with two or more weeks. The time period was noted as the employee receiving an answer within two weeks from the date the employee makes the request. This pertained to requests for vacation of two or more weeks. Ms. Munley emphasized she wanted a time frame for a response to the vacation request given within two weeks of the request. Ms. Goebelt expressed concern with late vacation requests and that management would not be given enough time to look at training and scheduling. The City will come back with proposed language. Article 40. Ms. Goebelt will bring back a proposal pertaining to the uniform issue. Article 50. Ms. Munley explained there are Police Department employees, in Records Management, that do not have access to the shared drive to view the contract. Ms. Goebelt explained they are working with ITS on the matter to obtain kiosks. Ms. Munley explained the police employees do not have access to the contract. Mr. Eichorst explained they cannot access the shared drive. It was noted internet access allows access to the City's website and the contract is available under public records/City Clerk. Mr. Eichorst will verify this. Article 12. Ms. Munley presented two corrections relating to the issue of insubordination. She suggested either moving "insubordination" to a lesser offense or put the real defintion of insubordination in the article. She indicated there is a definition from Black's Law Dictionary. Ms. Munley suggested training could also be held on this. Ms. Goebelt explained the verbiage was taken right from the Personnel Policy. Article 52. Duration was discussed. Ms. Goebelt requested clarification that if wages cannot be agreed upon, they will have a re-opener for wages. Ms. Goebelt will discuss it with the City Manager. The next meeting will be held May 31 at 10:00 a.m. in Conference Room B. A June 9th, 2:00 p.m. meeting and a June 23rd at 1 :30 p.m. meeting was also scheduled. There was a brief discussion between Mr. Eichorst, Ms. Munley and Ms. Goebelt regarding how the approved pay plan for employees was paid out.
