AN ORDINANCE OF THE CITY OF BOYNTON BEACH,
FLORIDA, CREATING A NEW SUBSECTION 2-123,
WITHIN CHAPTER 2, "ADMINISTRATION," OF THE
CODE OF ORDINANCES; PROVIDING FOR THE
CONSOLIDATION OF THE CHILDREN AND YOUTH
ADVISORY BOARD AND THE EDUCATION ADVISORY
BOARD; AMENDING CHAPTER 2, ARTICLE VIII
CHANGING ALL BOARD REFERENCES FROM
"EDUCATION ADVISORY BOARD" TO "EDUCATION
AND YOUTH ADVISORY BOARD"; PROVIDING FOR
CONFLICTS, SEVERABILITY, CODIFICATION AND AN
EFFECTIVE DATE.
WHEREAS, the Children and Youth Advisory Board and the Education Advisory

Board both appointed by the City Commission and empowered with fact-finding and advisory

functions; and

WHEREAS, the consolidation of the Children and Youth Advisory Board with the
20
Education Advisory Board would facilitate the advisory function of those Boards; and

WHEREAS, the Education Advisory Board meets so infrequently that the transition
f its responsibilities to the Children and Youth Advisory Board would not constitute

dditional burden on the Children and Youth Advisory Board; and

WHEREAS, the current number of active members of Education Advisory Board
25
oes not constitute a quorum for meetings the City Commission has experienced difficulty
26
mding qualified individuals to serve on that Board as evidenced by the fact that there are
27
urrently no incoming applications for appointment to the Board;

WHEREAS, considerable administrative effort and cost IS associated with
29 aintaining and operating City boards, and the Commission finds that consolidation of the
30 hildren and Youth Advisory and the Education Advisory Boards would lessen the

Board and Education Advisorv Board; survival of actions
All powers. duties. and responsibilities of the
Education Advisorv Board shall survive and be deemed
men!ed and consolidated with the powers. duties and
responsibilities of the Children and Youth Advisorv Board.
All previous actions of the Education Advisorv Board shall
survive this consolidation unless specifically revoked bv the
Children and Youth Advisorv Board. The consolidated
hoard shan be lmown as The Education and Youth
Advisorv Board. All current members of the Children and
Youth Advisorv Board are appointed to the Education and
Youth Advisorv Board as votine: members for the balance of
their terms of appointment.
Section 3.
That Chapter 2, Article VII, "Children and Youth Advisory Board" is

The ('hildrcn Education and Youth Advisory .aBoard shall act
as a fact finding and advisory board on the following issues
and on such other issues as are, from time to time, designated
by the City Commission by resolution:
(1) Development of programs that promote ongoing
relationships with caring adults;
(2) Formulation of long and short range programming to
benefit the children and youth of the community by involving
parents, the business community, civic and neighborhood
organizations. includine: volunteer recruitine: for before and

(3) Development of incentives and enhancements ~

(a) The edueation ad~/isory hoard shall eomprise
seyen (7) permanent memhers and two (2) alternate
members, all to be appointed hy the City Commission. Of
the members so appointed, four (4) shall be for a term of
three (3) years and three (3) shall he for a term of two (2)
years. Their sueeessors shall be appointed for a term of two
(2) years. :\lternate memhers shall he appointed for a
period of one (1) year. There shall also he appointed two (2)
high sehool seniors, who must reside within the eity limits of
the City of Boynton Beaeh and who must attend a publie
sehool in Palm Beaeh County to sen'e for a term of one (1)
year, to be seleeted by the City Commission. .tAll terms shall
expire in the month of ''''April. Student members of the
Edueation ,......dyisoFy Board shall enjo)' the right to vote, the
same right that is eurrently enjoyed by regular ~/oting
memhers of the Children and Youth Advisory Board.

Section 5.
Each and every other provision of the Code of Ordinances not herein

pecifically amended, shall remain in full force and effect as originally adopted.

Section 6.
All laws and ordinances applying to the City of Boynton Beach In
10 onflict with any provisions of this ordinance are hereby repealed.

Section 7.
Should any section or provision of this Ordinance or any portion
12 ereof be declared by a court of competent jurisdiction to be invalid, such decision shall not
13 ffect the remainder of this Ordinance.

Section 8.
