4 FLORIDA, AMENDING SECTION 2-16 OF THE COD OF
5 ORDINANCES TO ADD A NEW SUB-SECTION ) TO

8 CHAIR OF CITY BOARDS; PROVIDING FOR ONFLICTS,
9 SEVERABILITY, CODIFICATION AND A EFFECTIVE

12 WHEREAS, the City Commission has determin that it is advantageous to have a
] 3 niform procedure for nominating and voting for the air and vice chair of City Boards.

NOW, THEREFORE, BE IT 0 AINED BY THE CITY COMMISSION
15 F THE CITY OF BOYNTON BEACH,

Section 1.
The foregoing " ereas" clauses are hereby ratified and confirmed as
17
made a specific part of this Ordinance upon adoption

Section 2.
2-16 of Chapter 2, "City Boards and
20 amended to add a new Subsection (h) to read as
21 ollows:

2. Once all members of the Commission or Board have had the

3. The Commission, or Board in such cases that the Board

of nominees with each Commissioner

4. If a nominee receives a majority of vo s on the first ballot, that

nominee shall be appointed to the osition.

6. If no nominee re ives a majority vote on the second ballot, a

appoi ment; the nominees with highest preference ranked "1,"

th nominee with second highest preference ranked "2," and so

forth. The City Clerk shall tally the vote, and the nominee with

the lowest tally total will be appointed to the position.

7. In the event of a tie on the third ballot, a fourth ballot will be
19
conducted between the nominees with the two lowest tally
20
totals. The nominee that receives a majority of votes on the
fourth ballot shall be appointed to the position.
Section 3.
Each and every other provision of the Code of Ordinances not herein

Section 4. All laws and ordinances applying to the City of BOyntor in
2 onflict with any provisions of this ordinance are hereby repealed.

Should any section or provision of this

4 hereof be declared by a court of competent jurisdiction to be invali
5 ffect the remainder ofthis Ordinance.
