RESOLUTION 06- {q :3
A RESOLUTION OF THE CITY OF BOYNTON BEACH,
FLORIDA, AMENDING THE FINAL BUDGET FOR THE
FISCAL YEAR BEGINNING OCTOBER 1, 2006, AND
ENDING SEPTEMBER 30, 2007 BY INCREASING THE
GENERAL FUND APPROPRIATION TO $74,840,414.00
AND TRANSFERRING $2,500,000.00 TO THE CIP FUND
FOR THE BOUNDLESS PLAYGROUND PROJECT;
PROVIDING FOR SEVERABILITY, CONFLICTS, AND
AN EFFECTIVE DATE.

WHEREAS, a final budget was approved by the City Commission on September 19,
2006, for the 2006/07 fiscal year; and
WHEREAS, as a follow-up to the CIP discussions that were part of the Public Budget
Hearing the recommendation was to transfer $2,500,000.00 from the General Fund to help
start the development of the Boundless Playground.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA:

Section 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as being

true and correct and are hereby made a specific part of this Resolution upon adoption hereof.

Section 2. That the final budget of the City of Boynton Beach, Florida, for the
fiscal year beginning October 1,2006, and ending September 30, 2007, is hereby amended
and increased by $2,500,000.00, providing for a transfer of $2,500,000.00 in 2006/07 from
the General Fund to the Capital Improvement Fund for the Congress A venue Boundless
Playground project.

Section 3.
All delinquent taxes collected during the ensumg fiscal year as
28 proceeds from levies of operation millages of prior years are hereby specifically appropriated
29 for the use of the General Fund.
Section 4.
If any clause, section or other part of this Resolution shall be held by
31 any court of competent jurisdiction to be unconstitutional or invalid, such unconstitutional
32 or invalid part shall be considered as eliminated and shall in no way affect the validity of the
33 remaining portions ofthis Resolution.

Section 5.
If any clause, section or other part of this Resolution shall be held by
2 any court of competent jurisdiction to be unconstitutional or invalid, such unconstitutional
3 or invalid part shall be considered as eliminated and shall in no way affect the validity of the
4 remaining portions of this Resolution.

Section 6.
6 repealed to the extent of such conflict.
All Resolution or parts of Resolution in conflict herewith are hereby
PASSED AND ADOPTED this 0 day of November, 2006.
