AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF BOYNTON BEACH, FLORIDA, AMENDING
SECTION 64.1 OF THE CITY CHARTER OF THE
CITY OF BOYNTON BEACH, FLORIDA, BY
PROVIDING A NEW EXCEPTION TO THE
REQUIREMENTS OF COMPETITIVE BIDDING ON
PURCHASES IN EXCESS OF ONE THOUSAND
($1,000.00) DOLLARS; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH;
PROVIDING A SAVINGS CLAUSE; AUTHORITY TO
CODIFY; AN EFFECTIVE DATE; AND FOR OTHER
PURPOSES.

Section 1. Section 64.1 of the City Charter of the City
of Boynton Beach, Florida, is hereby amended to read as
follows:
Section 64.1 Same--Exceptions.
(a) The purchase or sale of any real property by the
City from or to another governmental agency shall conform
to such regulations as the City Council may from time to
time prescribe, but such purchase or sale shall be
excepted and exempt from the remaining provisions of
Section 64 of Article IV of the Charter of the City.
(b) On any purchase of personal property involving
amounts in excess of $1,000.00 and less than $5,000.00
and in the event that three or more prospective vendors
have rejected invitations to bid, the City Manager is
authorized to negotiate informally with other prospective
vendors to secure as his judgment may direct, the most
advantageous and beneficial purchase for the City and to
execute a purchase order or contract to that vendor which
shall best serve the interests of the City in price,
quality or time of delivery.
(c) On the purchase of personal property if the City
Manager shall maintain that an emergency exists in regard
to the purchase of any commodity so that the delay
incident to giving opportunity for competitive bidding
would be detrimental to the interests of the City, then
the City Manager shall file with the City Clerk a
statement under oath certifying the conditions and
circumstances.
(d) Commodities available only from a single source may
be excepted from bid requirements upon the filing by the
purchasing agent of a certificate of conditions and
circumstances, said certificate is to be filed with the
City Council and the City Council shall review said
certificate and may authorize such purchase by motion.
(e) On any purchase of personal property where the funds
for the price of the entire purchase are being supplied
by another governmental agency and no funds of the City
are being used towards the purchase price, the City
Manager at his discretion may elect to follow the
competitive bidding requirements of the governmental
agency which is supplying the funds for the purchase.
Upon invoking this section, the City Manager shall file a
letter with the City Clerk indicating that he has done

(f) The Purchasing Agent may award a contract by
accessing purchasing items from the Federal General
Services Administration Contract~ the State of Florida
Purchasing contract~ or other purchasin8 contracts of any
departments or subdivision of the State of Florida
without the competitive bidding process required by this
ordinance~ provided that the item and associated price is
the same as specified in the accessed contract.
Section 2. That all ordinances or parts of ordinances in
conflict herewith be and the same are hereby repealed.
Section 3. Should any section or provision of this
ordinance or portion hereof, any paragraph, sentence, or word
be declared by a court of competent jurisdiction to be
invalid, such decision shall not affect the remainder of this
ordinance.
