O86-54AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING THE COMPREHENSIVE PLAN OF THE CITY BY ADOPTING AN EVALUATION AND APPRAISAL REPORT REGARDING SAID PLAN; PROVIDING THAT A COPY OF THE EVALUATION AND APPRAISAL REPORT WHICH IS ATTACHED HERETO BE INCORPORATED HEREIN BY REFERENCE; PROVIDING A CONFLICTS CLAUSE, A SEVERABILITY CLAUSE, AND AND EFFECTIVE DATE; AND FOR OTHER PURPOSES. WHEREAS, pursuant to Section 163.3161 et seq, Florida Statutes, the City Council of the City of Boynton Beach, Florida has adopted a Comprehensive Plan for said City; and WHEREAS, pursuant to Section 163.3191,Florida Statutes :he City Council is required by law to periodically assess and evaluate, the success or failure of the Comprehensive Plan or any element or portion thereof; and WHEREAS, the City Council of the City of Boynton Beach Florida, has complied with the provisions of Section 163. 3191, Florida Statutes, and WHEREAS, the City Council has also complied with the procedures for the adoption of an amendment to an approved Compre- hensive Plan as set forth in Section 163.3184 and Section 163.3187 Florida Statutes; and WHEREAS, the City Council of the City of Boynton Beach Florida hereby intends to adopt the attached Evaluation and Appraisal Report, as amended,.thereby constituting an amendment to the Comprehensive Plan as provided by Section 163.3191, Florida Statutes. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: Section 1: The City Council of the City of Boynton Beach, Florida hereby adopts the attached Evaluation .and Appraisal Report ~f its Comprehensive Plan and incorporates the same herein by reference as if set forth in full herein, said Evaluation and Appraisal Report thereby constituting an amendment to the Compre- hensive Plan of the City. Section 2: The Planning Department is hereby author- ized and directed to transmit the Evaluation and Appraisal Report, i'as adopted, to the Florida Department of Community Affairs. Section 3: Ail ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 4: Should any section or provision of this Ordinance or any portion thereof be declared by a court of compet- ent jurisdiction to be invalid, such decision shall not affect the remainder of this Ordinance. The ~pparent lace of 'ability of the Lake W~rth Drainage- District to recharge, the canal system west of the Lawrence Road structures on the Boynton Canal indicates that the surficial aquifer probably will not be a totally dependable source of. water in the long range, particularly during the dry season. When~the surficial supply is'restricted~, the Floridian Aquifer will n'eed to be' used. as a raw water source. Since conventional lime or alum treatment cannot be used for Floridian Aquifer water., some type of membrane treatment such as Ultra Filtration., Membrane Softening, or Reverse Osmosis will be required to produ~e potable water. It must be recognized than Boynton Beach is not unique in being in this position of water availability. The City's Utility Department is recognizing the long range water supply problems that most cities in southeast Florida will face sooner or later. Fortunately, the various reverse osmosis plants on the west coast of Florida have faced the lack of surficial water for several years~ and have developed techniques for using deeper aquifers. In the near ~uture~ Boynton Beach~must drill a well into the Upper Floridian Aquifer to determine the water quality in this area and develope estimates ~or the co~t of treatment. (65) Average Daily and Peak Sewage Flows at Build-Out (sec. 3.6.4.1.2.1.31 on pp. 191-192 and sec. 5.6.4.5.~.~ 2.~2.2. on p. 201) The figures for average daily sewage flows and peak flows should be changed from 13.18 mgd and 19.77 mgd to. 14.25 and 21.38 mgd.
