AN ORDINANCE OF THE CITY C/)UNCIL OF THE CITY OF BOYNTON BEACH,
FLORIDA, STATING THE ~EEGATE M/T.T.A3C~E RATE ~O BE LEVIED ~C~LINST
PROPERTY OWNERS WITHIN THE CITY FOR THE 1985-1986 FISCAL YEAR;
PROVIDING THAT THE CITY MANAC?~R SHAT.T. HAVE ~tE AUII~ORITY TO AD-
JUST THE ~{EGATE MILLAGE RATE UPON RECEIPT OF THE FINAL TAX
ROLL; PROVIDING FOR AN EFFECTIVE DATE AND FOR ~ PURPOSES.
WHEREAS, the City Charter of the City of Boynton Beach, Florida, and
~e Laws of Florida require an appropriation ordinance be passed by the City
Duncil of said municipality each year adopting the budget; and
WHEREAS, Florida Statutes 200.065(2)(d) requires that prior to the
mdoption of the final budget that an ordinance stating the aggregate millage
rate proposed by the municipality be passed; and
WHEREAS, said ordinance must also state the per cent of increase in
property taxes adopted by the governing body; and
WHEREAS, said aggregate millage rate must be adopted separately and
before the budget of the community; and
WHEREAS, the City of Boynton Beach, Florida, has followed the proce-
dures as outlined in Florida Statutes 200.065; and
WHEREAS, Florida Statutes 200.065(5) provides for a ministerial adjust-
ment of the aggregate millage rate after receipt of the final tax roll.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BOYNTON BEACH, FLORIDA:
Section 1. That the Proposed Tentative Aggregate ~lillage Rate for the
1985/86 Fiscal Year shall be 7~.~1'9~ (7.1306)for the General Fund and .0665 for
the Publicity Fund), plus .9145 for Voted Debt Service for a total Proposed
Tentative Millage Levy of 8.1116 for the 1985/86 Fiscal Year.
Section 2. That said Millage Rate exceeds the computed rolled back
rate by 16.46 per cent.
Section 3. Tb~t upon receipt of the final tax roll if said roll indi-
cates that the certified taxable value within the district bas decreased from
the original tax roll presented to the City by the Property Appraiser's Office,
that the City Manager shall within three (3) days make the ministerial adjust-
ment to the aggregate millage rate to assure that the same amount, of taxes shall
be collected by the City. Said adjustment shall be reported to the Property
Appraiser within three (3) days of receipt of the final tax roll.
Section 4. That this Ordinance shall become effective immediately upon
its second reading and final passage.
